Yes Jenn, I think you're correct. But for safety sake, I will enclose a letter of why re-filing for just in case, maybe keep it from getting held up processing wise at VSC and to fend off any possible RFE letter.
Afterall its for the same beneficiary, and we cancelled petitins before they they were processed, so we ought to be okay.

No we did not meet thru a marriage broker. I thought if you filed before for a K visa, and refile, you have to submit a IMBRA Wavier letter. But after much reading, I think it pretains to K1 visas and multiple petitions filed by the U.S. citizen. I do not think I need one, but maybe enclose some sort of a letter of why we are re-filing , kind of like a F.Y. I. thing.
Any ideas???

Hello VJer's.
Last year I filed a I-130 and a I-129F for a K3 visa for my husband, and cancelled them several months later. We are ready to re-file , this time for a CR-1 Visa, my question, Do I need to enclose a IMBRA Wavier letter????? The petitions I filed last year are the only ones I ever filed with USCIS, and they were for my husband, whom I'm now ready to re-file for.

The statement in bold above is incorrect. You are not required to file two petitions. You may simply file the I-130 petition and follow the CR1 or IR1 path. K3 is an option, not a requirement. If your spouse would rather work soon after arrival instead of sitting around for months without authorization, K3 is not for you.


Got it!! Will have to go with best petition to file, and carefully analize the difference of the two Visas, pros and cons of each.

Im preparing to file a petition to bring my foreign national husband to U.S. to join me. Filing at VSC, and would like to know which petition is the fastest to file , a K3 or a CR-1 petition? Any thoughts. And of course, like all of you's , want the fastest petition to be filed.
We have been married over a year, and have all proof of a true marriage.

Y habibitk is correct. Go to Walgreens or better yet Wal-Mart, both stores have a nice selection of calling cards and are reasonalby priced.
He can get a card for as cheap as $10.00 and will last a while.

If you have joint bank accounts or assets together, life insurance, wills, ect. you can include that in your Avid of Support part of your petition. That is what I did or my lawyer did, plus highlighted that it was a joint account.

We also submitted the plane ticket, boarding passes to prove relationship, along with photos marriage, and otherwise, to include with family members, also the wedding invitation.

No phone bills or any letters. I have that for the interview.

In addition to that you can submit copis of you marriage photographs.

I know I need to submit, marriage cert, and any other evidence of a bonafide marriage, joint utility bills, joint banking, life insurance, and etc. along with my I-130 petition, but do I need to submit any of our chats, letters, cards we sent each other and phone bills, , photos together, and plane tickets, etc for the visits to him , or just save all that for the interview at embassy???

What you may also be referring to is a Customs form, mainly used to claim the items you bought overseas, its for U.S. Customs duty. Such as people on vacation who bought trinkets, and etc. They are allowed $800.00 of free duty items. Im sure this does not pertain to her. But she will have to fill one out and give to the Immigration offcier at time of entry along with her papers and passport.
I just filled one out the other day returning from France from visiting my husband. All passengers must fill one out. Its no big deal at all, and nothing to worry about. I've done this many, many times.

To answer your question for the question I asked: What I wanted to know is VSC transferring any new petitions filed? , besides the large back log that was created many months ago?, in order to catch up with still some of the '07 and early '08 petitions filed. Since CSC is much more productive then VSC.



i dont think they are transferring any at the moment. however, there is a very good possibility that they will do so by end of jan or feb. thats what i can predict as per my observation of VSC in the last few months of observation. this wait is very painful. you are in for a crazy ride...not trying to scare you but sit tight..your time will come....find a new hobby to keep yourself busy! good luck!

I've been there before with VSC, I filed in Jan. 2008 and cancelled June 2008th. My husband and myself have already shared in the pain of waiting and waiting and waiting for VSC to do something. I got plenty of sickness motion pills for the crazy ride.

I thought of something, for all of us alone at Christmas, my husband and myself, the past 2 New Years have celebrated our New Years Eve via the web camera, he is 7 hours ahead of me so, I made sure I was at hoome at his midnight, and he made sure he was awake when 12 came here in the USA, so maybe for Christmas all of us, especially the ones with kids can use web cameras. Having a dad see his kids open their gifts Christmas morning would be great, he or she may not be there physically, but can have some Christmas joy seeing their kids open their gifts and seeing them on Christmas day.
Its a thought to ponder on.

I have never spent a Christmas with my husband, I have only spent his birthday with him on Dec. 6th when I was in Paris, and in July 2007 I spent Bastille day with him, "Its the French 4th of July"
Anyways, next christmas will be splended for all of us, we can always start planning next Christmas now. Happy holidays, and rememeber, your never alone or far from your loved ones, they live in our heart everyday, every minute. Next year we will ALL be home for Christmas.

Nobody truly knows how long it is going to take to process. That is the hard part, not knowing when our lucky day will arrive.

Im so sorry to hear that.
Keep checking the USPS website especially at night, its when they update it. Im sure its delayed do to the holiday, cards, packages and etc.
USPS is good about delivering our monthly bills, they never get lost, or delayed, lol
Im sure it will show up soon.

I got approved....223 Days after NOA1...But I am not complaining.....Better late than never...Best part...No Transfer to CSC..... Was approved by THE VERMONT SERVICE CENTER

I think its a good idea, use index cards or post it stickie papers. Makes it easier for the officer when sorting thru your petition. But also do a complete cover sheet, look at the example forms in this website. Best of luck on your journey.

Well, its been a while since you were approved. Doubt it was sent to the NRC instead of NVC. I would call USCIS and see what is going on, and maybe even call NVC and inquire there?
Just for grins, why do you think your approved petition was sent to the NRC???
