THRILLED to report that we finally received our case number tonight!! It only took 35 days! Promising news everyone! Maybe the CSC/NVC transfer is picking up the pace! Yay!!!! And as others have said, I called earlier today (3pm) and no case rec'd according to NVC. Literally JUST got off the phone & voila! Case # issued!

thanks for suggesting to call twice in one day!  I finally got my case number after 46 days!  Hang in there everyone.

We are using my fiance's assets of the i-134.  NOT his income.

 

He has non-retirement funds and retirement funds.  Which line in on Question. 7 of the i-134 http://www.visajourn.../Form-I-134.pdf do I put these assets/investements on?

 

Any advice would help!

The embassy just emailed to let me know that they mailed pkt 4 to my home and I was expecting a email. I'm on vacation with my fiance right now, and will not be home for another week.

Does anybody know if the Vancouver packet 4 instructions are the same for everyone? If so, could someone send me them?

I thought they usually emailed them?

I would love to book my interview ASAP.

email your montreal consulate.  They should reply in a day or 2.  Here is the email montreal-niv@state.gov .  Include you case #, your ds-160 confirmation #, and ask them about packet 4.

Just wanted to let the fellow Canadians know that theydid NOT need the DS-156's.  I emailed the consulate and they said it is replaced by ds-160.  They did not ask for it at my interview either.  I guess it is different for each country.

There was a cutoff date sometime last year for the old 156 and 156k.  The 160 superceded those.  You don't need the old ones if you are a recent approval and are filing the 160 now.

 

Do bring a printout of the completed 160 to the interview, even though they tell you that you don't need one.  It can come in handy.

US Embassy and Consulate Discussiondo I need DS-156 and DS-156k for interview??

I feel like I read somewhere the the DS- 156 and DS-156k forms have been replaced with the DS-160.  So, does this mean I do not have to bring the DS-156 and 156k to the interview?

 

On the consulate website when I booked my interview it was on the checklist of things to bring.  BUT it was NOT on the Packet 3 checklist.

 

I'm a little confused on this situation.  I emailed the vancouver consulate, but they have not emailed back yet.  My interview is in less than a week.

 

Please reply if you have any information.

Right now, the next available date is Dec 12, 2013.

 

You can check at usvisa-info.com and make an account, this is where you go to make the interview, you can do the stuff up until you actually schedule to see the next available date.

I can do this before the vancouver consulate contacts me?

We just got our NOA2 and I'm starting to gather the documents for the interview.
 
I'm concerned about the I-134 affidavit of support form.  We do not have anyone to be a co-sponsor.
 
For the past two years my fiance's income has been under the poverty level.  This year he has been unemployed, but caretaking his mother who has cancer.  She has been giving him monetary gifts throughout 2013 with value of $40,000.
 
He has ~$322,000 in retirement funds (10% penalty when taken out before 60yrs of age)
             ~ $ 213,000 in non-retirement  
             ~ $ 50, 000 in regular saving account
 
I'm wondering if this will be sufficient for the interview, as he is not currently employed and will not be employed at the time of the interview (december).
 
Also, not sure how to fill out the form with all of separate savings and the monetary gifts from his mom.
 
Any advice is greatly appreciated, as i'm wondering if we did the right thing in applying for a K1.

I'm just looking at the I-134 form.

 

Here is my situation.  My US fiance is currently unemployed because he has been caretaking for his mother.

 

His income for 2012 and 2013 is 0, but he has received monetary gifts from her.  For Question 7. on the http://www.uscis.gov.../form/i-134.pdf do I add the monetary gifts in 'deposits in savings banks in United states"  and should we get a letter from his mother starting that she gifts him money in lieu of caretaking?

 

 

Also, we are relying on his IRA assets that can be liquidated into cash.  Where do I put the amount of his Assets for Question 7. on the I-134 form?  

Can we print out the assets statements online (it will have his name and amount) or do we need LETTERS from the banks and investment company?

i went to 46 days.  The last few days before I got my case number I was losing hope and thought they lost it, but they didn't!

We have the same NOA2 date - have you called a USCIS Tier 2 officer to confirm it was sent out, and when? At least that way you'd know for sure whether it was sent or not - might take about 5-8 days from the date it was sent out for NVC to generate a case number.

I have not called USCIS.  Do I call and ask to be put to tier 2 and then ask them if it was sent out?  What is the # to USCIS?

I just picked up my birth certificate from my parents house and saw that my name is spelled differently from how I've spelled it my whole life, and how it is on my passport, SIN card (canada) and every other document.   When I get my interview (which will probably be a couple of months from now) I will need to bring my birth certificate.  What should I do????

It looks like my fiance and get his assets converted to cash in a few weeks.  He will lose a little money on his assets ( he's not sure how much) and he will have to pay taxes.  

 

From the I-864 instruction  "Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis for the owner's claim of its net cash value."    So, I'm not sure if his assets will be of use if he will lose a little money on them?  Does anyone have suggestions.  

We can't find a co-sponser, so we are a little stuck right now.  We did just receive our NOA2!

The net cash value of the assets is what will be used. Assets need to be able to be converted to cash within a year. I am not sure what you mean by only part of the value can be applied. They show proof of ownership of the assets and proof of value. That amount is used at 3 or 5 times depending on the consulate/CO to make up for the shortcoming in the USC petitioner's income, since they are only working part time. Even if the net cash value makes it a little lower, it is still a large amount. Using assets alone at 5 times is only $96,935.

 

The I-864 instructions give details on assets> "Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis for the owner's claim of its net cash value."

 

All that being said, I think it is a good idea to have a co-sponsor lined up anyway. Not because the assets are not enough, but because the work/income history is shaky and you never know how the CO will see it and what decision they will make on it.

From your reply, I'm feeling that we don't need to get a joint-sponsor.  The one concern is that he made very little money last year because he was caretaking his mother and she paid for everything.  He doesn't have any proof of this besides a letter from his mom.  Do you think this will throw up a red-flag?  Then the 3 years prior his income was under the poverty line.  So, we would be relying solely on his assets.

He does have over 300,000 dollars in assests.  He lives with his mother and owns a car.  I am wondering if he can still qualify as my sponser or do we need to get a co-sponser.   We both live really simply and together could live on $20,000 per year

I'm in the same situation.  Our NOA2 just came (to my fiance's place in the states).  Apparently they will send package 3 to my place in canada and to his in the states.  I'm hoping I can do as much as I can from the states.   Maybe you can always get somebody express mail documents from Ireland if you need them.  I think you'll be fine.

How does someone "mix up" having less than $2000 in assets to get Medicaid and having $60,000 when seeking an immigration benefit?

Most people can tell if they have $2,000 versus $60,000.

There was either fraud for Medicaid or fraud for the immigration benefit because no one mixes up having $2,000 versus $60,000



I got it all sorted.  No fraud involved.  It is a misunderstanding between my fiance and I.
