No worriess we had something similar. Call NVC it the petition is still there. But then when it gets to the USEM call them also. Finally when you do your interview call the point out to the CO. It there that we finally got it all corrected. The visa was correct. Also make sure your DS156 and DS157 has the correct name.

When she does her medical at St. Lukes they will determine what shots are needed and the shots are included in the fee. Since there is not time to complete the full serires they will annotate it on the medical form that they will also give to her that the first shot was done and the series is incomplete due to time to complete the full series. Assuming she passes the medical with no issues the lack of completing the series will not delay the visa. Then once in the US keep the series for those not completed going since you will need that for AOS when you see the cival surgeon.

If your married longer than 2 years what you will get is a 10 year GC. USCIS will assign you an interview date for the AOS. I have read enough posting that you do not want to change it, cancel it or miss it since it then tends to get all screwed up. Of course you might not ever get an interview since it might just go to CSC and be approved.

Leave the house number as is on G325A for the I-130. On the G325A for the I-129F attached a note explaing that it has changed. It is that simple. In our case my wife moved during the process. USCIS does not really care about the addresses. I called them and they did nothing about it. Once we got to NVC, NVC still had the incorrect addresses. I called the USEM once the case was sent to them and they changed it. The only one sending docs for a K3 to the beneficary will be the embassy so that is why it is important to get it correct with the USEM.

Use the correct name, the one your switching your passport to and then when asked for other names used (aliases) put in the one that is currently on your passport. This also means when you get your NBI later that you get it with a "also know as" (AKA) so it reflects both names. Then attach an explanation sheet that explains what happened, what your doing to correct it, and supporting docs.

ITIN is the way to go. We did that this past year and filed before Trisha was in the US and before she got a SSN. It was no problem. Just a few extra forms. Also you can be claimed as being a resident for the entire year but that also means your global income is taxable. Check out prior posts earlier in 2009 by searching for ITIN within VJ.

What is confusing to me is the two types of Visas that your comparing. The K1 means fiance thus your not married yet. The CR1 means your married. If your not married you have essentially one choice - K1. Married you have 2 choices K3 or CR1 and as pushbrk said the CR1 would probably be the best. Bet. We did K3 with no issues but given recent changes I would go with the CR1 route. But again if your married.

We attempted to do this back in September after our wedding since I knew I would need this. I can tell you that the US Embasssy will NOT do the notary. Instead they will send you to DFA. If you check out the instructions on the W7 documents like a passport must be certified by the originating authority. In this case DFA for the your passport.

At DFA you will want to bring a copy of your passport and 100peso. Then it takes them something like 1 week to create a document that "authenticates" your copy.

Call NVC and see if they got the case from USCIS. If they did then ask if they have assigned the MNL # to it. That is the new number you will use to track your case through NVC and the USEM. Congrats. Once NVC approves the petition your next call is the USEM and setting up the interview and getting the medical done. Get the forms started now for the USEM if you have not. Things can happen fast at this point.

Although not the same circumstance to stress my earlier point about family and culture. Trisha and I planned on getting the K1 visa. All was well until just a few days before filing the 129f in June this year. Yes it was all filled out and ready to go. Then she got the family pressure to instead get married in Phil. I had not planned on that I needed to return to the US. We discussed it before I left and I could tell she was torn. She wanted to be with me sooner than later but also needed to please the family. We decided to get married and knew that this meant a few months delay until my next trip in Sep this year. End the end it cost me nearly a 4 month delay but well worth it. It was a big burden for her that we lifted off her shoulders and end the end what is 4 months. Nothing - hopefully. But today we are glad we did it.

I can understand the frustration in having a family split apart. I have gone through that before in the 80's and am now apart from Trisha. This Christmas I am planning on spending it with her and her family as we await her visa approval which is still sometime off.

One thing you want to look at is the culture of a filipina. Understand that you married her and her family and her family is blood and much tighter than most families in the US. These are probably values that you respect that she has. She will not be open about issues that cause conflict since again it is culture and for her to show disappointment to you is not something that is typical. you need to learn how to read indirect communication which she probably is doing and your doing the American direct communication.

My suggestion is to spend sometime getting to know what you value from her and your relationship and then understand how that works in her life - its all connected. Also dig into the culture. Know it, breath it. It is who she is.

correc the VJ estimates tend to be correct. The issue with the USCIS timelines is that when they post it it is usually 1-2 months old already. For example the Nov update is not the data from Nov but rather if you look closely is really from September.

Our just took 7 business days to get to the Manila Embassy. It arrived on the 4th of Feb. The embassy packet you can download already from the USEM website but it is also sent to the SO in Phil from the embassy. I called the embassy last night and they said it would take about 4 days from receipt of the file from NVC until it was shipped to my wife. Then once your in the database at the embassy you can clal for the medical. The medical is first come first serve.

I have been watching interview dates lately and currently they have been handing out ones late Feb to early March.

Yes you have to submit the I-134 for the K1 and K3 visa at the USEM. It goes into more detail, specifically how much you make and is used to determine if you meet the 125% pvoerty level.

What really struck was your post about getting married in Phil and you already applied for a K1 visa. That is for a fiance and yet you will be married before you depart. Perhaps I am missing something but you should be planning on maybe a blessing or engagement party in Phil. the real wedding should be in the US.

No worries on sending the entire package back as long as everything else was there. They will send you an RFE "if" they want additional info to prove that you have seen her in the past 2 years. You may not need it but will depend upon what else you submitted. So you probably have a couple of months since you just got you NOA1. You will not need to repay everything.

I had a similar concern on my K3 app. I forgot to include items requested for bonafide relationship for the I-130. But I got my NOA2 in Jan and with no RFE.

I did a similar thing back in Oct. I called USCIS and they did what is called a service request. They are suppose to correct it and will give you a tracking number that they use for this request. It took them 2 months to make the corrections and I got letters back that they were corrected. Once I got the NOA2 the name was still wrong. I called NVC and they said no not worry they have both names in the system. When the case got the the USEM I called them since they also used the wrong name and they just advised us to make sure the CO knew the correct name during the interview. Trisha made sure and everything worked out in the end.

Sounds like you have a very good start on the docs for proof of relationship. Even if the photos are not dated you can still put dates on them. Just write the dates on the back of the photos. As far as the like or dislike of americans and the USEM with the Smith case. Media often sensationalizes things and can make things much bigger than it really is. Yes there is some tension but taken into context only by a few people. Most filipinos still like americans. So your putting so fears into things that really do not play into your visa journey.

Best to just get focused on the paperwork you need to get done. Just my 2 cents.

It actually will go the State Department's NVC office. You can contact them since they probably already have it. They will provide you the MNL case number. Once it leaves them which is usally 1-2 weeks it goes to the USEM and at that time you can start to call the USEM but it typically takes them 1-2 weeks to get the hard copy case and process it before you can setup your interview.

You can also do the medical at anytime now. Make sure you have all your forms ready for the USEM since the pace is moving fast
