dianeb is my fiance (I'm the petitioner) & here is the translation of her above post lol:

Hello everyone!
Me and my fiance got our Noa2 late May and are therefore waiting for our "packet 3 " and trying to gather all the necessary papers for the interview at the embassy. As a member of VJ, we are afraid to make mistakes or forget things so we need the valuable assistance of those who have already gone through it ...: help:
Here is my list of questions, I hope some will enlighten us:
- Should I sign and paste a photo on the DS-230 part I?
- Do I have to fill DS-157 and DS-158? I have read repeatedly that 157 was only for men and 158 for students, but I find
it strange ...
- My fiance has only paper for taxes the past two years, & a few months of the third, but the total is well above the
poverty level, for the few missing months will there be a problem?
- his employer does not provide a "letter of employment " and accepts to only send or fax it to an address, has anyone had the same problem? Can they send it directly to the embassy easily?
- Apart from the documents related to I-134, a birth certificate and a letter of intent, what does he provide? His birth certificate can be a copy? United States birth certificate is provided only once at birth.
I'm sorry for the length of my message, it looks more like a novel, but I do not write often ... I'll do better next time!

Basically just making sure if the embassy needs MY original birth certificate, as the petitioner, do I need to provide a police certificate, & how do we go about getting the embassy my Letter of Employment, if my employer is of the kind that will only fax or mail it to an address?

First of all, thank you very much for your response! Regardless of your personal progress thus far in the K-1 process, I was looking for any input, & you responded; merci!

Secondly...a few updates!

My employer ended up providing me a Letter of Employment, stating my position, my hire date, my base salary, etc. The HR person however did not specify full or part time; though I am full time & my earnings from previous years clearly show it, so I am not too worried about that. (also my previous years earnings are substantial enough & the W-2's/1040's show that)

In regards to the address being different on the G-325 & the I-134; I like your advice of just using the same corporate address, though the Letter of Employment I just acquired I'm afraid states my office's address...bittersweet, eh? :bonk:
Again, not too worried: the company letterhead on the Letter of Employment shows the corporate address I put on the G-325...I'll look more & decide which I put on the I-134 but I think they will be able to verify it is indeed just the one company I work for, hopefully with little confusion.

The updated Letter of Intent, yes I addressed to the Embassy; good call.

The birth certificate....yes...I was just about to send her my documents complete, with a copy of my original birth certificate (as the petitioner) but now you have me questioning... :blink:
I did discover that I have 2 original birth certificates, & that the embassy will return original documents to you as long as you provide a copy along with it. Now it's tempting to mail both the copy & one of the originals. It is just a piece of paper after all...

Hello!

Currently working on the I-134, as the petitioner obviously, for the K-1 Visa process.

I'm a bit unsure what exactly to put for Question 7: "I derive an annual income of:"

I work on commission, sales. So my total pay is never perfectly consistent. My last year's W-2 shows me making $40,000. I have a Letter of Employment, where HR stated:
"His base salary is $20,800.00 per year plus any earned commission on commissionable sales."

My commission averages at paying out roughly the same as what my base salary is. Does anyone have any suggestions for what I should put in this section? I had an idea to add an attachment, & on the attachment state that I make a base salary, plus commission, & that my pay stubs submitted as evidence show that I make commission, & the average amount. Along with my YTD earnings from recent pay stubs, etc.

So, got the letter from NVC last Thursday, going to call tomorrow to see if it's left yet, & figure out the method to check if the embassy in Paris has received it yet.

I'm currently compiling what I need (as the petitioner) to send her, for her preparation going forward. I am getting together tax documents & beginning the I-134.

Is there anything else, either of us could or should be doing, while we wait for packet 3? She's gotten the police report, & has filed for a birth certificate, as well as studied up on the forms contained in packet 3.

A few other questions...

I believe this is embassy specific, but can she go ahead with a medical?
Is having just the past 2 years of 1040's/W-2's sufficient? (I was unemployed for most of 2008)
I made well above the poverty level last year, & less than that in 2009 (but still above the poverty level)
My employer is of the kind that won't release a Letter of Employment unless it's faxed or mailed to someone/location. Any suggestions?

That's all I can think of for now. I have been searching the forums of course for more detail on all of this, & found good info, just looking for any current, quick tips.

I was born & raised in Virginia. I met my fiance at a country club where she was doing a H2B Visa, from France. She finished up the 1 year work-visa, no problem, in September '09. She is now home in France. If we were thinking of getting married within the next year, what would be her options for work in the US? Is there an amount of time she has to wait before being able/eligible to work in the US again, after having finished a 1 year work-visa? How does a fiance visa work with just having finished a 1 year-work visa? Does it make a difference, or no? As an example, if we got married July '10, would she have to wait any certain period of time before working in the US again?

captal: Many thanks for sharing your story! It's SO great to see SO many people & couples have similar tales & similar thoughts & predicaments. You have basically been in our same situation, & it's encouraging to know you successfully struggled through it. In my situation, she has already gone & lived in Australia for 7 months. We had considered NZ/Australia, but because she had already been down there & lived & worked, we decided against it. The distance it is from France & US, the price of the plane tickets, etc. Especially with her already having been there, we just decided the K-1 at this point makes more sense, for us. It's a tough call but that's where we stand right now. Currently trying to do more research on what exactly legal marriage means in US, & all the steps for starting the K-1 process.

And once again, ANY feedback or advice, words of encouragement....always welcome!

It's comforting to know so many other people have felt the same way we do, with just trying to make a responsible decision, but realizing that it's different than a "normal" relationship, having to speed things up, more than we normally would have. Thanks for saying it doesn't seem like we'll have much trouble with this...I hope you're right! :) Well said, the best thing about the K-1 process is that it's eventually over, & keep our eyes on the prize! Great advice.

A slight update:

After much deliberation (& exhaustion of options), we've semi-decided to go forward with the K-1 process! (inside I'm jumping & yelling happily) :)

I'm (we're) looking now for any words of encouragement, or further advice, to help us push that "semi" off the semi-decided quoted above!

We've been together for 2 years almost, traveled to each other, talked every day; been through a lot. The perspective that with long-distance relationships, you have to move faster, or slower than you would normally do or wish, couldn't be more true. We both have acknowledged that given the circumstances, normally we would wait a few years after our exclusive relationship developed & living together, before deciding to get married; but feeling as sure as we do about each other & the possibility of being together permanently, we don't feel like we're being too risky, as a whole.

That being said, any little push of motivation from any angle would be gladly appreciated...staying positive!

Is it the entire end of the world of we cancel the K-1 or nullify things within a few years? Again, we wouldn't do it if we weren't sure about each other, but the comfort of a safety net that the world isn't going to end for each of us, if we for whatever reason go sour, can sometimes be a huge motivator in moving forward.

Any encouragement about the aftermath, the process & waiting (for the K-1), visiting while waiting for the K-1, or positive thoughts in general would be a huge boost. (our journey truly is unfolding on VJ) :P

Gingerpants: Yep, that's exactly what I've read about Ireland; Dublin included. It's unfortunate, certainly, that the one place we could both go fairly easily to live & work for 1 year just suffered a particularly hard economic blow. (Everywhere is hurting I suppose, but I also feel for the Irish). I'm not exactly sure how France's economy is doing, but I'm interested in the Partner's Visa. We've been together for almost 2 years exactly. I'll have to look into it more; thanks for mentioning it!

DaveyOntario: Currently my ties to the US are: employed at the same company for the last 2 years, very close with my family, & renting (help paying the mortgage) a house from my parents. Funny you mention the border living; this was my parent's suggestion as well! With them, & you, bringing this up as a possibility, you've now both got me researching just exactly how to pull this off. I could live & work in Buffalo, & her in a nearby Canadian city, just across the border. I will say it seems too good to be true; I feel like there's probably a small detail in daily border crossing that would hold us back, but I need to read more & see what I can find.

Kathryn41: I have no intention of working illegally in Canada, nor did I say that I would. The method which I described was finding a job while traveling in Canada, & with the chance of obtaining a positive LMO & job offer, taking it to the border to get a TWP, which is possible because US Citizens are TRV exempt. Please don't mistake me for doing anything illegal in Canada. Also, please don't think I assumed I could pick up & go anywhere I please; in fact I think I was quite clear in my posts that I am aware I can actually only easily work in Ireland, on a WHV, & that Canada would be difficult to find work because of the LMO process. I understand the sovereignty of individual nations.
Past that, I appreciate your advice. I'm happy that you filled me in on the specific details of the Affidavit of Support. You're right, & it seems like moving away would & could probably hurt our chances of actually fulfilling the K-1, in the long run. You're definitely right about international relationships, faster or slower; excellent way of putting it. Makes sense of course.

canadian_wife: Right, you're correct, I've done lots of research on the matter. Being a US citizen, I could "travel" there for 6 months solid. The idea was to go with her, who can enter Canada on a Working Holiday Visa, she finds an apartment, & I stay with her looking for jobs, until I find a job willing to do the LMO process (many people do it this way apparently, being that they're much more likely to find a willing employer in person). If I got a positive LMO, I could take it & the job offer to the border at Buffalo, NY, & get a Temporary Work Permit. This is possible because US Citizens luckily are TRV exempt. Still though, obviously it's risky because I may not find a job at all, willing to go through the LMO process.

: Thanks for your input! I agree with you completely; we just want to make sure the time is right for both of us to decide the big decision, 100%. Our reservations stem from just wanting to make a responsible choice. I'd personally choose Canada over Ireland, too: I can drive 10 hours to Toronto, Ireland's economy isn't great at all right now. But unfortunately of the two, only Ireland currently offers Working Holiday Visas to Americans.

newlyweds2010: Ireland & the US recently opened up the Working Holiday Visa for their citizens, & luckily I qualify to obtain an Irish Working Holiday Visa, being 28 years old. So, really, Dublin, Ireland makes the most sense for our scenario, because I could live & work (IF I find a job) there without a lot of rigmarole, for 1 year. To be honest...Toronto is probably out, because it's just that much harder for me, not her, to go there & live & work. And it's so close! Ha.

Still very open to any opinions or insight! I appreciate all the comments

canadian_wife: I was hoping to push more of my Sales experience, rather than Landscaping, for a job, to find an employer to start the LMO for me in Toronto. I've been posting on the canadavisa forums, asking how hard is it really, to move there & find a job/LMO within a few months, without being in specialized or professional work, as I don't think my experience quite qualifies for that. As it stands right now, it seems risky to move there without solidifying work, first. But I was willing to try...

JlovesA: We've done the short-terms trips; weeks there, months here, etc. It becomes expensive, & I suppose hard to gauge how well we "live" together when one of us is on "vacation." It's true we could start it now, & put it off for later, since there is the 6 month window to use the visa. But the way we're looking at it now, it's the Catch-22 scenario: we don't know quite yet if we should get married, without spending more time together, though the only reasonable way for us to spend time together is to get married.

aoifemc: I appreciate your info about Ireland. It's what I've been reading as well: it's hard to find work there, even in Dublin I hear? It makes the risk of not finding work that much more of a reality, especially since we'd only be temporary work, it's likely it wouldn't be quality pay I suppose. Again, we want to start the K-1, but still we both seem to agree the wisest would be to spend more time together first. Certainly a tough call...

Aztec&Taino: Yes, the ultimate goal IS to live in the US. And I agree, we are lucky because France is a VWP country. I agree with what you say, visiting each other during that time period, & continue to have solid income for that time. And yes, who is ever SURE anyway. An informed decision it would be. Still, we are slightly on the fence about it, with our reservations stemming from just wanting to make a responsible decision. It's quite a big change for her, especially.

I'll keep it short & to the point:

-I'm a born & raised US Citizen, my girlfriend is a French Citizen.
-Want to spend a little more time living together before starting the K-1 Visa process.
-Trying to find a country where we can do that!
-Deciding between Ireland & Canada..
-She can easily go to both. I can easily go to Ireland, but I read that Ireland's economy is fairly bad at the moment, possibly making it difficult for us to find jobs good enough to support us.

I know this will more than likely get moved to General Immigration, etc; perhaps not belonging at all on VJ...BUT

It's more of a personal question that's K-1 related, than a K-1 question that's slightly personal.

Any insight on whether or not just jumping into a K-1 is wise..
Or any insight into which path would make the most sense, Dublin or Toronto...
Perhaps starting the K-1 process halfway through the 1 year of living in one of these cities.

I'll have to ask her asap, if she applied, or if it was issued as a Tax ID number...? Either way, on her W-2, in the spot for SSN, there is a number listed. (mirroring a SSN in digits)

She told me she has a little blue card, & it's written on it "valid for work only with dhs authorization."

I'll provide more details regarding if she applied, asap.

Hello!

Just sent our I-129f package earlier this week, only to wake up this morning & realize we may have made a mistake.

My fiancee did a J-1 1-Year work visa in US, & was issued a SSN at this time. In our package we included copies of each of our W-2 tax forms, from this same place we were both employed (her as an international intern, me as a regular job). Her W-2 shows her SSN.

We messed up by not putting this SSN for her, that was issued, on her G-325a. We put "None." We unfortunately assumed she didn't have one, as she's a French citizen. (Didn't think the "temporary" one "counted") :unsure:

We realize, this is a mistake, after having read, where since she was given one, it's hers, for life.

My question is, how badly will this delay our process? Does anyone have any insight into whether this will inevitably result in a RFE, etc?

Just looking for a little peace of mind...

Yep, my thoughts exactly.

I'm fixing the lack of her SSN, & re-doing a I-129f form, latest version. Writing a new check. That's it.

Also, what about the dates, differing now, from the I-129f, & the Letter of Intent, etc.? Meaning, now that I've done redone the I-129f, I've dated it Jan. 15, 2011. Whereas my Letter of Intent is dated Dec. 30, 2010. Will this be an issue?

As for the check, I've decided to just trash it, & send a whole different one. Just to be sure.

I wasn't planning on doing a new G-325a; though I did a new I-129f, as it's the document that was the older, incorrect form.

Should I? Or, why do you advise also doing a new G-325a? Because of the SSN? After researching these forums, my logical conclusion was white-out.
