I-130 can be submitted by the USC "stepfather" as long as the stepchild relation occured before the age of 18.

IR 2 is immediate relative (child) of a USC

The income requirement is still the 125% of poverty for the size of family

The income requirement is proven after petition approval

your husband can petition your children under IR2-child of USC. my cousin was petitioned by her step mother. no need for your husband to live with your children. but in the USEM when my cousin was inetrviewed they asked for the pictures of her together with step mom who had her vacation here. maybe as a proof that there is a communication between the two.



Thank you so much for ur enlightenment. One more question, what are the requirements or forms and where will i be able to get these forms, is there a website that i could read to download the forms? what are the papers that my husband needs to send along with the I-130? Is this process 100% guaranteed that they will not be denied if the papers are complete? sorry im just down and i got phobia in denials at USEM . I was denied twice too with my tourist visa before. how sure is this "stepsons" process compared to me filing for them, im the mom and a permanent resident but i know if i do it would take 4-5 years and my eldest so would be 22 but that time. so is this stepson process is really sure? thank u so much for sharing your knowledge about this coz i dont really know anything about this . The consulate has no discretion on the 1 year follow to join limit. It is set by statute and they cannot issue a visa based on your K1 after the 1 year. Your husband will have to petition them as immediate relatives (stepsons).

hello anybody could help please... i came on a k1 visa last december 7, 2007. my sons need to follow to join me within a year since i got my visa. Their interview date was Dec. 2,2008 but there was an allergy reaction on vaccination of my youngest so St. Lukes moved the interview date in Dec. 12 ,2008. We asked if it doesnt cause any problem since i will be 1 year already in Dec 7, St. Lukes said its just fine bec they r the ones who moved the schedule and that they are connected to the embassy. BUt when my sons went for an interview the Consulate denied them bec the date was exceeded 3 days already. we tried to explain that it was the St Lukes who moved the interview bec. of my sons medical situation. My question is can we make an appeal to the embassy or can we ask a certification from st lukes so that the embassy will give us consideration? I picked Dec, 2, for their interview and not dec. 12. they also took all the original documents what should we do now? pls help

yes we filed an appeal. we wrote to the genral inspector of the us embassy in Manila Philippines to review the case and also we wrote to the congressman here in Flrorida .. would this help? and how long would it take for them to reply our appeal? why does it takes time for them to get a visa when they are still minor age? please help so worried here now coz nobody could take care of my sons in Phil. right now ..what kind of petition should we do ?...ty

My USC husband petitioned my sons in PHILIPPINES, the NVC approved the petitin and we were asked to submit Affidavit of Support Documents , Immigrant forms for my sons etc. All documents we sent already to NVC, my question is How long would my sons get an appointment for an interview in Manila Embasy?

its not lost.mine took awile to get there to.i said to myself how can it take this long to mail something.dont worry just keep calling them every day like i did.finaly you will be suprised and they will give you the case number.hang in there.just some advice.when they do give you the case number they will give you another number you will call from then on.call it and keep calling they will give you her interview date before she gets it.i called themon nov 20 and her interview date was dec 6 if i wouldent have called we would not have had time to plan for her medical and things.good luck
