Both ....I just got off the phone with the Visa Specialist in DC and they told me they don't have a number yet!! Sooo What can I say just wait....at least I know NVC won't hold it up.....I just wish there was something more concrete!! :( :(

My K-1 petition was approved on September 18, and NVC still doesn't have me on file yet... Evidently USCIS hasn't sent it out yet. I don't understand what is going on. I wish they have sent the approval on to Manila.


WOW, we are in the same boat, approved and sent to NVC on 14 Sept. Called NVC and they saif call back in 2 weeks as it usually take a month. I'm asking this because I'm ignorant of the cultural norms in the Philipines, so please, don't get defensive. I'm asking for my education.

Is it normal in the philipines for still married couples awaiting annulment to be romantically involved with new partners? It just doesn't sound right to me that your still married SO is using your surname and wearing a symbolic wedding ring you gave her when she's still married to another person. But is this how it's done in the Philipines?


something has concerned me for a while and its probably nothing to worry about so i would like opinions and experiences of others on this.....
relyn and i consider ourselves married although we are not. we are waiting now for 8 months for her annulment. we pray everyday it will be as we expect in december and then we will be able to begin the k-1 process........

we wear wedding rings and in almost all of our correspondence she is my wife in surname as well. this is including snail mail cards. i feel good about it and have absolutely no regrets and if we have a hassle because of it i wont regret it for a minute

i think they will check of course for any evidence of a marriage between us since we will file k-1. can they deny or barrage us with "rfe" 's because they have a "feeling". or are approvals based on fact?

i wont get defensive at all......relyn has not seen or heard from him in almost 7 years. even though there is a son involved as well. he has never seen his son in that time. so as far as her being married to him its just not something she considers herself to be anymore. i am right there with her on the annulment. while catholic church (philippines predominent religion) does consider them strictly married relyn on the other hand has a desire for more than an invisible marriage. we have chatted non stop, talked on phone and i have made two trips to be with her in a years time. it will be two years since we met before we can even realistically get married.

Patrick, The NBI background clearance and the Annullment from the Census and FSO will be evidence enough tha tyou ar eno tlegally married not matter how you consider yourslef or what nick names you call each ohter in correspondence. The using of your family name to send correspondence to her while strange and probably illegal in the U.S., may cause an RFE unless you explain that in your proof of relationship letter.

For the question of people in the Philippines that are legally married getting involved with someone else, yes it is very common because there is no divorce int he Philippines, just he annullment process through the church which is very expensive (bribes) and lengthy. Filipino couples split all the time and most of the time it is the guy that ups and leaves, not to be heard of again. My fiancee's parents have been separated for 15+ years and both have live-in partners they both consider their spouse. I guess neither have the money to get the annullment.

Patrick, It might be a good idea to stop using ur surname for ur fiancee', however if the proof of relationship items you are going to provide for the K1 is going to include items with your fiancee' using ur surname, it might be a good idea to continue.... it is a hard call to make for us forum readers. Matt, All you need is a Statement of Service letter that u can get online (AF) or from your personnel office and attach it to youe LES. I actualy had mine notarized just in case. It will have your specific brach of service seal at the top (letter head) which is a requirement. Good luck, Payato

Do I send the I-134 Affidavit of Support Form on my I-129F Package?

I am following the gidelines provided here:

Is that it? The only official forms on the I-129F package are:

1) I-129F
2) G-325A (1 from me & another from my fiancee)


Is this correct?

Miguel, You are correct. The only USCIS forms are the 129f and 325A. Just follow the guidelines and beging the waiting game like everyone else. The 134 is after the approval of the NOA2 and is for your Fiancee' to send or bring tot the embassy. Good Luck, Payato

Hi

We have now submitted 2 applications to the VSC (first one got lost in the mail) and are having very bad luck! We know the second one was recieved 11 September but we have not yet had an noa1 and the check hasn't been cashed.
My fiance has been trying to call the national helpline every day this week but he is calling from work and once he's been on hold about 30 minutes he usually has to hang up.
I notice some really fast approvals at the moment so I am getting a bit stressed!!

Any advice on what we should do?

Do you think we may need to resubmit a 3rd application :(

I think we are cursed!


Patience, I got my NOA1, notification and then the check cleared and it took almost 4 weeks for mine. It all depends on the case load and when your arrived and the fairy dust. If you know they received the package give it another week before calling them. Good luck, Payato

I don't know your whole story, but bottom line, given all it took to get her here, and now she's not sure, (if I were you), I'd be VERY UNSURE myself! I wish there was a 'divorce' forum here you could go read. I've read some stories here that would curl your toes!

As hard as it may be to accecpt, I'd accept it, send her back, and count my lucky stars that you didn't get married - tears now are better than tears plus an absolute nightmare later, (after you're married).

I continually, (to the point of being annoying sometimes), ask Pao "are you SURE this is really what you want", and we discuss all the negatives as well as positives.

I am of the belief that 'love is not enough' to ensure a happy relationship. There should be common goals, common interests, common beliefs about life, religion and child rearing, etc.

Now is the time to be very careful and save yourself alot of grief down the road.

TucsonBill and ChristinaM have hit the nail on the head. The process is way long enough and she had many opportunities to let u know about her doubts. Let me tell u form the experience of a failed marriage, do not do it just because u r sure... if she is not sure, there is more she is not telling you and the marriage will end in a disaster. I am assuming at this point her letter of intent was just to get through the K1 process and to get to the states.
All that said, u supposed ly know this person better than anyone here but a lot of flags are going off for us and they should be for u. If u feel she just has cold feet and is worth the wait, do not let the 90 K1 drive ur decision, wait and deal with the 130 later or send her home. Just remember she and u both, now have the K1 visa on ur records and will fall into the IMBRA laws of multiple petitions.
I wish u the best of luck, and my best advice is cut ur losses while u r ahead. If the relationship is this hard prior to marriage it will only get worse after. JMHO Payato

Claire, I have read most of the replies and I think you have a good understanding that expedite needs a good reason and can be done. If I understand your timeline from this post, you are still inside the 60 days published by the USCIS. As we have seen in this site, if the USCIS has not responded or acted on RFEs and petitions within the published 60 days, you can subit an expedite request. Do a search for expedite and there is a thread with and example letter, that just got his expedite approved because USCIS had busted their 60 day response timeline. Good luck, Payato

What is your justification for the expedite? There has to be a legitimate medical, health issue that can only be taken care of in the U.S. or if in the military and deploying to a combat zone like Iraq or Afghanistan. If you think you have justification, it is worth a try. good luck Payato

It says on my NOA2 that I must wait 4 weeks from when I received it, and if I haven't heard from NVC, I am to call them. My petition was approved on September 18th, so I still have to wait a little longer!

My fiancee passed her interview at the US Embassy in Manila, received her visa and was approved to come to the USA on a K1 Fiancee visa. I purchased plane tickets for myself and my fiancee and I will be leaving in October to the Philippines where I will stay for 2 weeks to help my fiancee pack her belongings and to spend time with her family before we fly back to gether to the US. Am I allowed to escort my fiancee back into the US ? Or does she have to fly here alone? I am asking because someone from this site said they did not think that was allowed and that my fiancee would have to fly to the US alone. Is that true? Does anyone know the answer to that. I never heard of such a thing.

If I read the guidelines correctly, if the USCIS has went beyond the 60 days as stated on the NOA1, you have grounds for an Expedite request. Granted all that will do is get you form one waiting line to the next one at NVC. We are at 30 days since our NOA2 approval and NVC still claims CSC has not sent the NOA2 ot them. I think its 60 days past an RFE not 60 days pass the NOA1 for an expedited request to look at your file again. I might be wrong, but I understood new policy at USCIS was a 6 month window from NOA1 to NOA2. Can anyone else can add here to clarify?


Both my NOA1 and NOA2 say if you have not received the notice or heard from this office 60 days form this notification, contact the USCIS or NVC. Once outside the 60 dyas and they have not taken action, I'd be filing expedite request. They have to deny or approve the expedite request or at least respond to it. If you receive the standard polotical we are gettign to it answer, contact you congressman.

As far as the USCIS skipping petitions prior to the IMBRA law and new 129 forms, I think it stinks even though we are one of the Sept NOA2's. It might be as simple as the USCIS processing all the RFEs that had to be sent out for petitions filed before the new 129 form including the IMBRA RFEs. Either way it is unacceptable. Again, I say write you congressman and file an expedite request if you have been waiting since Mar/Apr. It has already worked for one member in VJ. Good luck, Payato

Pretty simple really! if you original question is about NOA, then search for NOA and looking in the NOA forum is pretty clear, not vague. I am fairy new but others here seem to think u keep changing ur details. As I said before your question is too vague, and time lines are only estimates. Alex, If you do a search on the timelines for the Philippines, you will see varying times on both 129 and 130 petitions. There does not seem to be an established procedure or pecking order for processing the Visa's. A rounded average for the 129s is 6-8 months. Once you look at the timelines, u will see some faster some a lot longer without explainations. The sooner you get the proces started the better, but patience is a must with this government process. Ok, we just got the email that our NOA2 is in the mail. I was reading about what I need to send to my fiance and I do not have a copies of the application or anything else we sent with it. It says to bring them with to the interview....so how big of a deal is this going to be?? I would think they would have the original with them at the time of the interview but I don't know.


It is OBE now, but every guideline and thread here tells you to makes copies of everything you send. Hopefully the consulate will receive the full package that you sent, but I would attempt to find copies of what you included int he package. Godd luck, Payato

I have a few questions about assembling the I-129F:

I was wondering how I should separate the sections when sending in the Initial Submission of the I-129F.

1- Should I insert a page stating “Proof of having met in person in the past two years” for the evidence part? Or should I just two hole punch and put them all together?

2- Also, what’s an ADCCO fastener? Is it a long clip looking item that goes through each of the two holes at the top of the pages to keep them together? If so, should I just use one fastener or several for each section?

3- The back of my Birth Certificate is blank. I made a copy of it anyway. How should I note that it's the back of my birth certificate? Should I put one of those removeable tabs on it and note it or should I use a pen and write on the copy itself? This also goes for the copy of my visa. I want to show the reviewer where the visa stamps are. What's the best way to do this? Write on the copy or use a removable Post-it tab?

Our_Love, There is no packet 3 for Manila, just a packet 4. Have your fiance call the embassy and give them the change of address and to check if they have received your case yet. He should receive a letter fromt he embassy stating they have received your case 2-3 weeks after tey get it. I know it can not be helped sometimes but it is not a good idea to be moving in the middle of the process, especially at this stage. Good luck, Ken (Payato)

Did you include the beneficiaries name and birthdate? This is required as well as the WAC#... I got more usless answer when calling than I did when I emailed them. Replies usually took anywhere between 3-6 days. Good luck, Ken (Payato)

I have met the most wonderful and loving girl. I will be going to Cebu 12/20/06 through 1/3/07 to be with her. I will get all docs done then. As I have learned what is needed through my past expirences. So this will be my first time in the Philippines for the xmas season and I will be with a girl that will honnor me while I am there.

Oh yes the last girl and family is suffering their fate for what they did to me, but I still wish them well and do not hold any anger to them.

I just heard of the case of a legally woman in the Philippines changing her legal name so she could get a K1 VISA. She didn't want to wait for an annulment which can take a year or two. By changing her name, she is shown as unmarried in records so she get a Certificate of Non-marriage and can get a K1 VISA. How can she get away with this? #######, isn't there a place on the USCIS forms for "other names used"? If her fiance knows about the previous name and lies on the forms can't he be in legal trouble well beyond the denial of the petition and VISA? If it was this easy, why don't all married women in the Phils do this rather than waiting for the annulment? #######, huh? :blink:


This sounds like another rumor or urban lagend in the Philippines. Like AFRigger stated, it is very easy to get fake documents and it happens all the time when people with a shady past gets a passport. I am sure this is not the first time the Embassy or NBI has heard of this and have procedures to check people with late registrations for BCs. If not, beginning a relationship on such false pretenses is not the best way to start out a marriage. Patato

Fel, Your timeline is similar to ours. You should have received a letter from the Embassy already stating they have received your case from the NVC. If not, I would call the embassy or have your fiance call 202-663-1225. Depending on the date the Embassy received your case and your case number, you are like us, looking at Feb or Mar for an interview. Good luck, Payato

I work with Manila Embassy and know quite a few people in the immigratins department. Your lawyer friend may be using people he knows (bribes) to get the case put ahead of people once it reaches Manila, but he has no controll over the USCIS or NVC process. I'd like to see the proof off this interview date and approval status. Thanks for the name though, I will check into it and see why certain cases can be pushed ahead of everyone else waiting and abiding by the rules of the process. There may be other attributing factors that had your friend's case pushed up early as well, but you did not give much information to decipher that.
My knowing people only gives me insight to the process but it does not give me favortism to get my case moved up. I would not ask the people I know to do that anyway, it is not fair to everyone else in the process nor to put my friends in that situation. They are busy as hell and really need to hire more people but the facility is already maxed out. JMHO Payato

Hey Everyone.

I know that when you live abroad you have to send the I-129F to the USCIS office where you last lived in the US. For me, that was with my parents in GA (where they still live), so I sent it to the TX office.

Of course, we want to put our return address for here in the UK where we live now.

Will they be confused as to why I sent my stuff to the TX office when they see our return address in the UK? Of course my form says that I used to live in GA so they should be able to see that...but I didn't know if anyone had had problems with this in the past! I could put my return address in GA as my parents still live there...but then they would just have to FW everything on to me here and that would take even more time and money!!!


If I am not mistaken, the USC is required to provide a U.S. address. You may want to use your parents address and have them forward the documents to you. Good Luck, Ken & Maria

Thuy, Go to the NVC forum and ask some of your Vietnam counter parts about time lines. As far as how you will know, check out the DHL tracking threads (search), you should get an email notification of the impending delivery from NVC to the consulate.... the rest is consulate specific. Frank & Fel, Like Gary stated, your case has left both USCIS and NVC so the only way to check your status now is by calling the embassy. I have seen an email for the Manila embassy but have not heard of many people using it. You should receive a letter from the embassy stating they have received your case....blah blah...blah. Ken

I was denied entry last Oct. 27, under sec212(a)(7)(A)(:)(I).What happened was I went there to spend my b-day with my fiance i was ssupposed to stay in my sisters house for 2 wks . When i was on myway already i commited a grave mistake of putting my fiance's add. instead of my sister's home add. coz i forgot to ask her, her new add. coz she just moved to a new house.so upon arrival i was lead to 2ndary inspection coz of my last visit wherein i stayed for 5 mos. coz they wanted to know if I i worked there on my last trip w/c never really happened. but during questioning i was asked abt. the add. i told them that it was my sister's add. coz I was scared that they wouldn't let me in if they found out that I have a fiance there, eventually they discovered the truth.They gave me an option of Withdrawal of Application for Admission which I took. my tourist visa got cancelled.My fiance intends to file K1 visa so we can finally be together my question is do we need to include the paperwork regarding my case to the attachmnts required for the K1 visa application or should i just bring it and mention it if ever i get interviewed.Thanks a lot everyone for your time!

When you guys filled in your timelines did you put the actual date of the NOA1/NOA2 or the date you recieved it in the mail? The actual date of my NOA1 is 11/24 but I got it in the mail on 11/30, so I put 11/30 in but I'm wondering if I should put the actual date in instead.


It realy does not matter as this is only a guage for VJers to figure out the averages for NOAs. I put the date on the NOA 1 & 2, not the actual receive date. JMO, Ken

So far i thought I had been very clear. JN&Ella hit the nail on the head. You want it straight, here it is. She or someone with her is lying to you and you are believing their BS. She has not had walking pnemonia for 90 days or it would have killed her by now.

The Doctor treating her is a real USA Texas Doctor just older than most (semi retired) and who lives next door to a close friend. She agreed to treat her for free,

First there is no Semi retired in the medical field. They are either licensed to practice or not. No one treats people legally for free and if the doctor is retired, who is writing the prescriptions? Have you seen the medications she is supposedly taking for a month now?

Of course I love Liuda and she loves me also, in fact we likely fell in love the day we first were introduced to each other in her home city of Kharkov on Sept 19 last Fall although we went out 14 more times, several times with her son along.

I do believe you think you Love her, but if she loved you as much as you think, this would not be an issue and you would not be here pouring your soul out to everyone.

She is not the same right now as she was in Kharkov, for the 11 months we waited, and for the first few weeks here when she was already tired and often dizzy but was well enough to seem herself. But for many weeks now she has not or can not be herself, and maybe she should be in the Hospital even if not at least a new Doctor treating her.

I would say it is about 2 months past the time she should have seen a real doctor with you present. If she has been this sick for 3 months, there are two possibilities... 1) she has some thing a lot worse than pnemonia... 2) This is all a farse and you are buying into it

For weeks now she has felt very weak and dizzy while she is normally a very stronge woman even if small.

You have admitted you only met her in person in Sept 05 for 14 or more dates... how much do you really know her? 14 dates is not enought time to judge if someone is being themselves.

Since sick she wants to see her Mom and is confused about why she still feels so bad, and seems to associtate being sick with coming to America. Yes I want to marry her and yet a week from Monday on Christmas Day comes our 90 day deadline. I am just looking at all ways to work around her sickness, confusion and the deadline without messing up anything with the USCIS. I wish she was feeling herself or would by Christmas, so while she rests I look for advice.

Didn't she get sick the minute she got off the plane here in the states? Your only experience with her in person is the 14 dates. Again, I think you are in love with her or at least you think you are, but you do not know her well enough and something is bad wrong wheter it is medical or personal.

Now is this to the point enough for you? You sound like one of my friends that ask for advise but never heeds any of it. Get her to a real doctor and run some real test and get her away form the "Free" doctor now!

Like any couple first living together we had a few bumps since we were living together but not same bedroom immediately, plus she was always tired and felt lousy most days while over there she had worked 70 hrs while we dated.

I do not get this one. If your are so in love and asked her to marry you then waited 11 months for the K1 process for her to get there, why the separate bedrooms and what does her working 70 hours a week before she got there have to do with anything?

We now know most of the problem since she arrived and even now were because she arrived with walking pneumonia, she has been on antibiotics for 3 weeks now but is not that much better.

You mention later that she went to a friends to see a doctor for free? Are you sure she is sick? Or is this possibly a scam... this and the separate beds are two red flags to me! You also stated "MOST" indicationg there are more issues???

They only give you 90 days and ours is up Christmas Day, but according to the Dr she could not medically even travel back now if she wanted to return and she has been and is too sick to date normally and think about the wedding let alone get married.

Everyone here gets the same 90 days and the K1 is in good fait approved because of your intention to marry, not date and wait and see 90 day trial period. Again, what doctor? I have had walking pneumonia and while I was tired, I was not bed-ridden and it did not keep me out of work more than the first 72 hours of taking meds.

But the lawyer even wanted me to "cut her loose" when she went to a friends to be near a "doctor friend" treating her for free, the lawyer is worried about tricks that could land me in trouble, but that stuff happens mostly in big cities and is not really our situation. We are both just going nuts about the deadline and she is pretty weak still

Who is this "doctor friend" have you met him/her? What doctor treats people for free in the U.S.? I agree with your lawyer, this is the 3rd Red Flag in this post that you have let us know about. 1) Separate bed after 11 months of waiting 2) A friends doctor for free treatment 3) Too weak to marry someone you are in love with....
If she was really going nuts, she would make this happen. I have made 5 trips to see my fiancee this year alone... I scraped every dollar and scammed every day off I can get to get there.... she is not putting enough effort and not displaying good faith in the relationship you think is going so well. I think you already know the answer and that is the reason you posted this here. JMHO Payato

Maybe Thailand is different, but in the PI, a 134 is required to show financial support as the sponsor for a Tourist Visa, so yes I filed 134s with both.
The complainst were not for the denials, it was for the rudness of the CO and their lack of explaination for the denial. They treated my fiancee like she was stupid and embarrassed me (I was present at both interviews). I got the official apology for the CO's rudeness.
Question 31 on the 156 ask if you have ever been denied a Visa to the US and we lisrted both Tourist Visa denials there. We wrote letters or memos of explaniation and have them ready but have not submitted them and will not unless asked. Our interview is 15 Feb, dau after Valentines. Good luck Ken & Maria

At any rate, I don't expect any complications from the denial of a tourist visa. I'm only concerned about the multiple filings of the I-134, and only because I saw one post from one guy who'd been denied one time, somewhere in the world, ostensibly for that reason. As I recall, he didn't say, but I'm guessing that he filed them on behalf of multiple beneficiaries.
One question: You say that both tourist applications & denials were included in "the package". What package is that? Do you mean that you included two copies of the DS-156 and I-134 forms along with the denial letters in your original 129F submission? Or do you mean that you intend to submit them with your other documents at the interview. Just curious.

We have our interview date and both Tourist Visa applications (with 134s) and denials were included in the package. I do not think tourist visa denials will affect the K1 process at all. We did not include any of the explaination letters but have them ready for the interview if asked. Ken & maria

There's really no danger of this issue resulting in an RFE (at least as I understand the term...), as this document will be presented at the foreign embassy at interview time. I only hope that I'm not sabotaging our application by acknowledging the earlier I-134, as unlikely as that seems.
I hadn't considered writing a letter of explanation and having my fiancee produce it only if requested. I sort of like that idea, except for the fact that (as I understand it...) ALL documents are collected at the Bangkok embassy for review an hour or two in advance of the actual interview. Also... the I-134 is a notarized document, and I'd expect that an attachment (as opposed to a supporting document, ie: statement from employer, or tax transcript) would have to be part of the package when notarized. Maybe not.
Anyway... thanks for your attention and advice!

1) You have to submit a new 134 as this is a totally differnt Visa process and application
2) You can include letters of explaniation but only provide them and have them available if you receive an RFE or asked the question at the interview. My Fiancee was denied two tourist visas and we did not receive any RFEs. Fill out a new document in it's entirity and answer all questions honestly. If you think a yes/no answer needs explaination, write the letter and have it available.
3) If I remember Question 9, it ask if privious Affidavits of Support have been submitted and for who? If that is right, answer yes because the consulate will pull up the B2 Tourist Visa on his system. Happend to us on our second attempt for tourist visa.

These are just my opinions, I am by far no expert or immigration attourney. Ken

So... my questions:
1) Am I correct in assuming that I cannot use the I-134 that was previously submitted? Does the document have a "shelf-life"?
2) When completing the NEW document, should I attach a letter explaining all of this, or simply fill in my fiancee's name, and date of submission?
3) Since I have my original I-134 in hand, is there any reason to risk answering "no" to question 9?

Looking forward to the day when questions like these won't keep me up at night!

Why couldnt you just say "it took us 3 weeks but you your time could vary" instead of that long winded speech about using the search function. You think i dont know there is a search function? I know there is a search function, its right there at the top of the screen. I am just lazy and would rather people answer my question than tell me to use the search function and i spend 20 or 30 minutes looking around. This way i can post my message and come back in an hour or so and see if it was answered. Much quicker for me. Imagine if every single user gave an answer like yours...there would be absolutely no information about anything. Just a website of people telling each other to use the search function or worse...telling each other to google the answer

Peil, use the search function and go tot he timelines and search for smilar timelines (Manila specifically) and you will get a better feel for the average time between the non-standards of the USCIS process. It differs per Service Center with CSC usually taking the longest and Vermont the fastest.
Also do the Foreign Embassy forum and look for the Manila Interview thread. It goes back for more than a year and loaded with all kinds of questions and answers. Good luck, Ken & Maria

It can take many many months for I-129F approval. Many waited for 5+. Hopefully your wait will not be that long, but certainly you should count on 3-4 months to be realistic.[/quote]
