Hi and welcome to Visa Journey! I'm sorry but in order to file for a Fiancee Visa (K1) or a Spousal visa (K3) you MUST first meet your fiancee or husband in person. You can file, but it will be denied and you will not get your money back.

If you have already filed a K1, I would suggest you plan a trip and go visit your fiancee face to face. Take many photo's and keep start compiling documentation.

Check first to see if you need a letter of invitation from your fiancee in order to file for a visa. Also check the CDC or your local health department to determine if you will need additional vaccinations to protect you while you are outside the country...and finally, if you do not have a passport, visit your local courthouse and go through the process of obtaining one.

When did I ever mention working 2-3 different jobs or what you're saying? I was working with the same employer since the beginning of last year, up until a couple months ago, but I lost my job there due to him having to be admitted to a Nursing Home and I couldn't care for him anymore in private home care. I'm not working at more than one job; I'm working at a nursing home, I've been there for a couple months only.



I'm not 100% sure of what you mean, but I made roughly 17,000 dollars last year, and I believe the 125% is about 18,000. As of January of this year, I started making income over the 125% of the poverty guidelines. Problem is, where does it say the length of time they expect you to be working and making over that 125%?

We're nearly at 6 months of waiting for our NOA2, but I don't want to get to the interview and we're denied because if income requirements. What is USCIS official statement about the length of time needed to have a sustained income exceeding 125% of the poverty guideline? If there's a good chance of denial I would rather just do the DCF visa option to have a more secure option.


Did you get anyother source of income, student loans, pell grants, child support...think of anything that can be counted as income. Also, you can always write a letter and explain your income last year, you were a full time student and now you are working full time and are above the poverty level required. Give proof...letter from employer and/or all check stubs showing current income.

Gowan my husband has been in Security work for 17 years. So we answered like this. "While I would love to find a Security position in the US. I will work an job that becomes immediately available to me until a better position presents itself."

We beleive they only wanted to know was he willing to work and would he try to find employment right away.

On phone records, I included about the first three months we talked in 2010 and highlighted the incoming and outgoing calls to and from my spouse (fiancee at the time). Then I included a copy of all phone records for 1 year to date. We have been together 3 years...to add that many records was just to much. My husband will take the full record will him to interview incase they ask why any was left out. HINT: Just make sure to highlight your incoming and outgoing calls. This kept me busy an entire week! :rofl:

I also included our hotel receipt from our first visit, all the recepits from where we ate out, second year we rented an apartment, so we also included that.

Instead of sending individual photo's, I photocopied several in color on one 8-1/2 by 11 sheet (about 8 pages) and included some photos of family waiting here for him.

Affidavits from my mother, sister, cousin on my side (personal letters from them) and affidavits from his brother, friend and a government official he was raised with on his side.

In otherwords, think of this as court...everyone thinks your guilty and you have to provide as much evidence as possible to prove your case.

Don't worry, take your time, be very orgainzed and take your time. Hope this helps. ~Dana

What to send to your fiance(e) once the I-129F is approved (Receive NOA2):
1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).
2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.
3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).
4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.
5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.
6. A copy of the NOA2 that you received in the mail.

is there a particular form they will need from my job stating my salary? Or can my Human Resources person just type up , the general, how long I've been there and my salary??

I know a friend who withdrew her petition,they are married (IR-1/CR-1). She withdrew because she was upset at her spouse. Now they are starting all over again because they were denied. "Yes", this decision will most definitely affect you, him and your unborn child for life. It will also be part of a deciding factor if you file another petition. So weigh your options carefully.

If you know your fiancee is coming here with no other intention than to immigrate, then withdrawing your petition is not going to make your situation any worse. A child does not make it "a must" to marry the man who helped you create him/her, but know, you will, most likely, be raising the child alone, and without support of any type. ON AN ADDITIONAL NOTE: If your fiancee is coming here for immigration purposes only, you will be raising this child alone, and most likely, without any type of support, anyway.

If this is just a spat, I would suggest dropping it now and both of you should really think about if you are ready for marriage. If you marry, neither of you should ever use the immigration process as a means to threaten the other person or make them feel that you will leave them, turn them over to authorities, make false petitions or accusations, etc., as part of a fight. That is petty and cruel and is a form of verbal abuse.

Think wisely and make decisions only when you are thinking clearly and not angry. I wish you both all the best and Congratulations on your baby. Children are a blessing!

I took two Britta single water bottles with me in my carry on. No matter where I got the water from, I put it in the bottle and drank out of it the entire time. No problems because it filtered up to 120 bottles of water for the one filter.

Just don't forget to run one bottle of water through before drinking the first one. I, of course, gave the second one to my hubby. He loved it so much I had to leave mine too.

The CDC guidelines can be confusing and its a ton of information. Save yourself some time. Contact your local Health Department, tell them where you are going and set up all vaccinations with them. Health Departments are required by law to follow current CDC guidelines. Take your vaccination record along with you to ensure you are up to date on childhood vacs, you may need a booster or two.

Personally, I have been asked each and every time "before I leave the airport" for my vaccination record. They have asked specifically all three times for the Yellow Fever vaccination and they look for the stamp from my local Health Department.

Malaria medication is optional. If it makes you feel safer, then take the medication along. I took along insect repellent and sprayed it religiously right before dusk each evening, especially if I was going to be out late with my husband.

Indoors, if there is air conditioning, it is usually not an issue. Cover the basics well and have a fabulous time!

As long as you can track it, either should be okay. I would think a heavier package would be cheaper to ship through DHL, if it is documents under 1 lb., shipping through FedEx will run about 80-140 USD usually. Just weigh your package and check both avenues.

NOTE: Tip Regarding Vaccination Records


The K-1/2 beneficiary will be required by the embassy to have a "medical" done prior to the visa interview. Part of this interview will require that previous vaccinations are documented and potentially additional required vaccinations performed. Once this is complete the doctor will note this on a DS-3025 form that will be sent to the embassy. During the medical appointment request an official copy of the vaccination records from the physician (or a copy of the completed DS-3025 if they will give it to you) as this will be helpful to have on hand in the future (specifically it can be helpful when filing for Adjustment of Status if your DS-3025 form is not available).



After the K-1 Visa is Approved:

Upon entering the US on a K-1 Visa, the visa holder must get married to the original I-129F sponsor (for the K-1 Visa) within 90 days. If the marriage does not take place within 90 days or the K-1 Visa holder marries someone other than the original US Citizen who petitioned for them, the K-1 Visa holder will be required to leave the United States. Until the marriage takes place, the K-1 visa holder is considered a non-immigrant. A non-immigrant is a foreign national seeking to temporarily enter the United States for a specific purpose. A K-1 Visa holder can not obtain an extension of the 90-day time limit.

If the K-1 Visa holder intends to live and work permanently in the United States they should apply to become a permanent resident after the marriage. Please note, K-1 Visa holder will receive conditional permanent residence status for two years. Conditional permanent residency is granted when the marriage is less than two years old at the time the Adjustment of Status application is processed.

Note: A K-1 Visa holder can enter the United States only one time with this visa. Upon entry, the K-1 visa is cancelled, and the I-94 form issued upon entry becomes the controlling document. If the K-1 entrant leaves the U.S. before marriage to the original petitioner, re-entry into the U.S. might not be allowed without a new visa. Also, if the K-1 entrant has applied for and is waiting on approval of an Adjustment of Status petition, the K-1 entrant should not leave the U.S. without also having applied for and received approved Advance Parole -- doing so could result in the inability to re-enter the U.S., and it indicates abandonment of the petition for Adjustment of Status. (Note that even approved Advance Parole does not guarantee re-entry into the U.S.)

I really beleive you are going to regret it if you pull this petition. I have seen one other person do this and then later come back to petition again. This can not only cause you a huge expense if you pick it back up, but it can also cause you issues at interview if they notice you have pulled a petition then refilled again for this same person, or even another person. Nigeria is possibly the most difficult embassy there is to get an approval. So know concretely that this is what you want to do "Before" you actually do it.

If you are truly considering it, I'd go the "expire" route before I'd go the "pull the petition route".

I'd say as tough as Nigeria is with K-1 Visa's...I would definitely NOT file K-1. If he wants to remarry and petition, he'd have a better chance with that route.

If he is denied on K-1, and he has to go through a review, his original petition will expire before his fiancee can go back for a second interview. It's risky...even when RED Flags such as this are not involved.

That is all good information to prove that you met in person, especially the full passport, page by page, and the plane tickets/itineraries, etc. The photo's are another big plus. If you have receipts from where places you toured or visited while your fiance was visiting and receipts from restaurants or vendors where you ate or bought gifts, that is also helpful. All the additional information you are providing is just a plus to what you already have.

Just remember, the time limit on your "facetime" together is within 2 years. Sooner to the filing date is better and a planned future trip to add to your facetime is even better. Especially if you have only met in person one time.

IMO that shouldnt have been something she kept to herself (being engaged to another man in such a short time and confessing her undying love so fast to another US citizen). For some consulates this causes a more intense review, they like to think How could a younger man love an older woman. Go into an interview with your head held high and be completely honest and confident. Many couples have succeeded with this process no matter how it might look to "others". No one here knows the outcome and I wish you the best. I do have friends with this kind of age difference and they did get their visa but it took a little more time and a lot more stress. Glad to say they are together and happy now. Just be confident and positive. :)

In other consulates this raises many eyebrows if it is the reverse. I have many friends from middle east and it almost always comes with scrutiny. I wish you the best and just be honest on all questions and bring an adequate amount of evidence and you should do just fine. If the woman is older they see it a little different but that is nothing new.

I have seen it from both sides and different countries. Try not to worry about it too much and focus on getting everything in order and ready for the upcoming interview. :)

My husband and I both sent money back and forth to each other....when I needed a little extra to pay for my kids passports or I was a little short on a utility he would send me some. I would send some when he needed it for unexpected computer repair or to buy something for his family (from me). I sent money to him in the slow months of his work, since it was driven by high traffic tourist months and low ones. It is about love and helping each other, but not sure how I feel about her giving you money to send to her to show a relationship. If you do for any reason send any or she sends you any then you can submit it, but I would concentrate on other types of proof like some others have suggested.

I think its pretty simple....and straight forward. Of course, you never know how the interview will go, I dont see any immediate red flags. Im Christian and my husband is Muslim and that was never an issue. You dont have a duge age difference, you dont have kids, equal on education. I think you need to relax and just take a deep breath. In my opinion you should be fine. If they suspect anything you will know it by the complexity of the interview. Just make sure you take all your proof on everything. Best wishes and good luck. I just read the reviews for the UAE consulate and most of the reviews only took the latest tax return (2010) and letter from employer about current pay. One post did say they had 3 yrs and handed in all 3 years ( I think if it shows stability then doesnt hurt to take all three). I would read the most current reviews for tips on what you do and dont need...etc.

#3. You need to check the consulate in UAE to see if they require the 3 previous year tax returns, it can also be beneficial to you if you are trying to show that you have stability in providing for the household. You current pay needs to show you make sufficient income to support your household or need for co-sponsor. A letter from you current employer showing you income on the job is helpful also. We did have to submit 3 years of tax returns for our interview (I would check with people who have just had interviews at the consulate you will be going to for your interview). Of course this is just my opinion. Its better to have too much info for NVC and the interview then not enough.....to wait to submit paperwork just causes delays.

I agree....I would take it all and if you need it, then you have it. Any extra evidence in a K1 can help. Being denied a tourist visa because you didnt have strong ties to bring you back isnt a bad thing, and from what you stated you told them the truth. I wouldnt send the originals of airline tickets,phone cards ect...copies did fine. There will be certain documents they dont want a copy of and will want the originals.

I agree with Rina, Egypt is definitely more strict on requirements.  I have never seen them approve someone who didn't meet the minimum requirements because you are the one responsible for them when they get here...well you and co sponsor if needed.  I have seen them hold papers waiting for new co sponsor.  They will look at it this way:  if you don't make enough money then how will you support them when they do get here because they can't work until they get the AOS also.

The reason why i said that was because the information provided on VJ for the embassy website in Tunis says that we can't attend the interview..hmmmm..I might just give them a call. I wasn't expecting to go in anyway..I just wanted to be there for support more than anything and if nothing else, the fact that i'm there would still look good.


Everything will work out just fine. My husband had his interview and all I did was kept phone contact with the head consular there. Don't worry it all will be alright. Good Luck!! Inshallah (F) Barb

First let me tell you, my fiance is 12 years younger than me and this is not my first 129F application. Back to 2008 I filed for a sucker (excuse my french) then he came in March 2009, he took off after getting his 2 years green card. I sent a certified letter to CSC that approved the AOS and one to VSC which is my jurisdiction and one to my local office (Boston). I even went to Boston office twice to let them know that I don't know his whereabouts and the copy of my divorce filing. I met my fiance now, we are so much in love. We went in Dominican Republic for the first time 10/06/11 and went again 05/15/12. That same day I arrived at the hotel, I received a call from my sister in Boston, that my mom passed away with heart condition. I couldn't find a flight back on AxA to Boston right away, I bought another ticket through Jetblue to proceed with mom's funeral arrangements. I filed for my fiance on 07/10/12 which I thought the process will go faster and VSC took forever. I thought of traveling to Haiti but I said what about if NOA2 showed up...all these crazy thinking.
To get back to the interview process today, those are the questions:
1. Who's sending for you? My fiancee so and so
2. How did you guys meet? Social network...
3. How many times that you saw your fiancee? 2 times in Dominican republic October 06, 2011 and May 05/15/12, we stayed at this hotel..... The CO said I see
4. She didn't come to see you in Haiti? No, because we chose to go exploring somewhere else(DR)
5. Have you met her family? Yes, I met her brother (first and last name) who came to Haiti in July 2012
6. Did you know that your fiancee was married twice before? Yes, and she got divorced
7. So what happened to the second marriage? The guy took off and she never know his wherabouts then she got divorced
Then the CO said "Ok Mr X(my fiance), you are not qualified, this not the end of the world. You can still get married.
I feel that this is very insulting. Does Immigration can tell me how many times to get married? Does Immigration can tell me "Hold a gun on your fiance's head to stay with you? Does Immigration can tell me or my fiance "Marry someone your own age? Does Immigration can tell you to look for someone in the states and make sure that someone has a green card?
I only filed I-129F once and the relationship went bad. I worked in my job for 23 years, I paid taxes and never been in jail or either been accused for domestic violence. Never, Never, Never so I leave any comments or suggestions from you VJers for me what's the next steps...Thank you and I am very Saddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddd.
Should I go to Haiti and get married? but my fiance said to me" Baby, I am afraid if we go the I-130 process, will they look at it the same way. He said again "Baby I swear that I answered everything, all questions" He added "I feel bad that outsiders look at Haiti as a poor country that people might use other people to enter the USA but one thing, the CO deny the real lovers" That breaks my heart and my fiance said to me "What about if you come to leave with me because I know in my mind, there was no such thing and I want to prove them that Denying us can't break our relationship.

I am very sorry you all are going through this. I know what you are feeling. My fiance now husband and I was apart over a year. Find out if you can the reason for the denial and go from there. They can give advice but the decision is yours and his. God Bless and Good Luck (F) Barb
