Last Dec 9, Vermont acknowledge us they received our RFE response & case process resume.. Till now were still anxiously waiting for our NOA2, What do you think guys, Do we have to call Vermont RFE section about our status for fallow ups? or just wait for CRIS email notice, or check website update? need your comment here.

Cin, if they did not update our status in the website, Is it possible also that they will not send us notice in email? Because our previous notices was in email, ''CRIS notice of RFE ''& ''Case processing resume''. So i assume it will be in the email when they give notices. Hello Vjers in behalf of my husband(petitioner) & his co sponsor(his sister), I would like to ask you what appropriate answer to this question No. 10 & 11 in Affidavit of Support 1-134 to avoid mistake. Note; I am bringing my 19 yo daughter along with me in the consulate interview.
Here it is : For my husband 1-134

If none, state none: Should I put the name of my daughter here aside from me? i was thinking I was the only one mainly petition by my husband in the 1-129F, although she is my derivative & her name was listed there.

The requirement for filing an I-130 for your daughter as his step-daughter is that your marriage took place before her 18th birthday. If it did, she can obtain a K4 visa and adjust status or obtain a CR2 visa and enter with conditional permanent resident status and you can ignore the next paragraph.

Otherwise, no I-130 filed by your husband can be approved. She can potentially obtain a K4 visa and come to the USA but her legal status would end on her 21st birthday. To stay beyond that time, she would need a student visa or other way to remain. She cannot adjust status based on a marriage that took place after her 18th birthday.

Waiting for NOA2 sucks, It is a pain in the butt, It is filled with sadness, loneliness, pain, anxiety, uncertainties being apart from your husband/wife. This is the hardest part I've experienced so far. But when you get your NOA2 it is a pain reliever, no more worries. Like me, i get good sleep every night than before & its getting better & better even daytime i can sleep good now. After almost 1 yr of waiting. Whewwww. we are now on our final journey. Hoping for the best.

because the USCIS thinks people who havent made that "leap" yet should have presedence over couples who are already married and have made that life long commitment. heh heh

honestly, i have NEVER understood this logic. AND, to add insult to injury...k-1's can get an EAD stamp at the POE, & can renew their EAD online. They have it so much easier. silly us for wanting to be married first. laughing.gif
k-1's get married and then do AOS, just like we do..the only difference I see is the place of marriage and the wait for reunion.

I dont have ANY problems with our k-1 brothers and sisters going through the journey, but I dont get the logic at USCIS.


Who says couples who are not yet married have not made life long commitment or their relationship is somehow less valued than a couple that has signed a paper?
Maybe with K3 visas more paperwork and checks need to be completed because they are already married and they have to determine if the marriage is bonafide. It can be lot more complicated once the spouse enters the US and decides to run away or file for removal of conditions etc based on VAWA as opposed to a fiance(e) who enters and if does not get married has to simply leave the country or is an illegal (will not legally become a public charge)

Hummm, do you know that 1 of my vj friend here been in the US for almost 2 mos now on a K1 Visa & they were approve in just a few months, I can tell she's just for convenience, she has no plan to marry her Fiance' & want to runaway after 90 days. Do u think that she will not be legally become a public charge?

K1 allows people to come over and get married, then they have a ton more paperwork afterwards! K3 is A LOT longer of a process because you're already married and now there's a lot of background stuff to be done. Hang in there, it took us a very, very long time to be approved too! But...we're finally there! If you're past the typical timelines, check in with your senator or congressman. Sometimes they can help!

USCIS approve K1 faster but what happen sometime when partner don't marry the girl runaway & hiding, the implication is to go illegal. More often than not they dont return to their country. This add to the million illegal in the US.
On the other side, K1 approve faster because FIance V fee is higher than Marriage V, & if the couple dont marry in the US, the petitioner has the previlige to find another Gf & reapply, so thats another fee $455.
Humm its just business.

Husbie was able to get a hold of USCIS representative after several attempts and as usual she told my husbie whatever it is that we already knew! Useless!!! She even told my husbie that we need to wait for another 94 days because we are not yet out of processing times!

Hey Wendy, take it from the song '' Its not time to make a change, just relax, take it easy", its just not your time yet . just be happy, I can sense you will be approve sooner than the other.

I am now preparing all the documents that I got, mine is already complete, I just want to ask comment from you guys about these document that I got from my husband(petitioner) & our Co-sponsor.
Do you think this is enough tax document from them:
My Petitioner:
1-134 filled out & Notarized
Cert. Of Employment
Complete Pay stubs (2008 gross Income file)
2007 Tax Transcript
2007 W2
Explanation Letter why he has low income in 2007
Bank Statement

Co-Sponsor:
1-134 Filled out & notarized
Cert of Employment
ITR 1040 - 2007 & 2006 (the form show her huge gross income)
W2 - 2008 & 2006 photocopy..... NO 2007 ????
F 1099 R - 2007
Pay stub 1 ONLY, most recent... (said she lost her previous pay stubs)

ARE THESE TAX DOCUMENTS ENOUGH?

Thanks God he is so good to me. our interview go smooth and the Consul assign to us was nice lady, she approve us without even asking a Co-sponsor, considering that my husband's in come does not meet Poverty income requirements, but the thing is that he is currently & continuously working (I arrange his 2008 pay stubs from Jan to the current date, in separate sheet of paper I did make a breakdown). I guess its a plus factor that my husband is single, no kids plus when the consul ask me whats my job I said I have been through a lot of work before I was once working in an office, become self employed, I also tell that i have a home business. So maybe she think that I can be a potential rather than become a public charge. Lastly, i ask her ''Mam when can I get our visa, She said don't worry everything is fine except to just furnish me with your NBI Clearance in your previous family name (late husband family name i used before) She said once you submit it your visa will fallow. told her '' you know Mam my husband is so lonely waiting for me since we been apart for over 1 yr now, She smile & said Yes I understand your situation but don't worry, smiling at me & my daughter. Alam nu mga guys un pre screener na assign sa booth #25 was so mataray to me. Pero I keep quite nlang. But anyways thanks for everybody wishing me well in my interview.
