My fiance is colombian, and has been told there is nowhere he can get his certificate showing he has never been married in CR?
We thought the civil registry? (He is legally there, but in a state of asking for asylum until our visa comes through. If he stops "asking" for asylum, he will be told to leave the country.) Any non ticos out there ever get a K1 or spouse visa out of CR?
He IS the father of my daughter (a dual US/CR citizen) You would think it would be easy to get this certificate, but I know how things in CR can go....or NOT go rather......I lived there 2 years.....lol

canadian_wife is right, my 6 month old was born there as well......I had to prove enough US presence MYSELF for her to be granted US citizenship, also that she was MY daughter, midwife's report, etc.....evidence like HS diploma, taxes, etc. from US (proof of presence)because i had lived in CR for 2 years (even if you havent lived there any length of time)......then go to interview with other parent, then wait on her passport(took about a month)........if you can prove that, child will get citizenship, once given passport, you have to go to CR immigration, with other parent, and get permission for the child to leave CR......also again in airport we had to do the same, luckily my fiance decided to come in the airport or we wouldn't have left..lol........they take children leaving the country very seriously.......which they should........was a hassle, but not complicated...better to get your child the US citizenship...good luck!! my daughter was born early october, i applied in november, we were here for xmas......

wow..thanks.....i would love the link! I was sending off my I129F package tomorrow.....incomplete it seems.. lol........phew.. I was confused especially seeing how it's so difficult to become a costa rican resident.......I even had a daughter born there, it would still take a long while and tons of paperwork for me to be a legal "resident" otherwise, you have no legal right to work...cant even get a cell phone in your name.........guess thats why i stayed away from claiming "residency" in CR on that form.......

To nica_chica3......my fiance also did some jobs of that sort in costa rica at some points, but i'm sticking to "none" on my form..because none were really official, and had not much evidence paperwise, meaning I have no way to prove it really........

hello! Where did you find out that visiting over 6 months counts?, if i may ask. or do you mean "legal residence of 6 months or more "....I was wondering about that question myself, having spent alot of time in Costa Rica, just under a year on one visit. I figured, my "residence" to still be in the US, because I am not a legal resident of Costa Rica.

Hello, I am about to start the whole K1 process, and it is all overwhelming!!.....my question is, Are things handled differently at all when we already have a child together?
My fiance is colombian, living in Costa Rica, our daughter was born there, and given a passport at the embassy, me, our new daughter (now 5 months old),and my other daughter ( 7 years old) have come back to the US. I read so much info about bringing over someone else's child with your fiance. Does anyone know if there is anything different i need to do? Thanks....

Ok i'm getting step 1 ready for the K1.....

My questions are

1.) Does the letter of intent by fiance (or myself) need to be notarized, and/or translated into english?..(my fiance speaks only spanish)

2.) I read to only use his father's last name on forms because he (and most other latinos) has the hyphenated "father-mother" last names, has anyone done this, or ever had issues with the last name?.... (I plan on stating/explaining his FULL name on the cover sheet)obviously they will also see his whole name on birth cert. etc..

3.) The 325A,since it is in english I guess I just help him fill this one out over the phone, He signs it and sends it to me... anything special i need to know about it or special instructions, in concerns to him not speaking any english?


Sorry if these answers(im sure) I could find with a little searching, We were hoping to DCF so I was concentrating on another visa which is not easy with 2 kids, one a new baby...and could have done the DCF IF i hadn't have come back to the US!!! :( just my luck!!!
any help would be appreciated!!!

After seeing that it is 100 or so days at LEAST between NOA1 and NOA2.. :( i was thinking of going with the kids to wait there with him before the NOA2.....I am confident we will be approved, there are no issues whatsoever with either one of us.......has anyone run into issues with the USC not being in the US while waiting on NOA2? he only got to see our new baby for her first month, shes already 6 months old....and was hoping to just wait it out down there...all together.....any advice?

Hello. any info would be appreciated...In the US, I applied for TANF (temporary assistance for needy families) and was accepted because my daughter's father (my fiance) is in Costa Rica, and cannot help pay for our daughter while there (he is colombian, and his immigration status DOES NOT give him the right to work in Costa Rica. I was hoping that would be sufficient for a financial expedite? , Not sure, but I have papers from the child support enforcement agency that state I will receive XX dollars BECAUSE John is out of the country. It takes the place of his child support. I also receive support for my other daughter because her biological father is deceased. I am not employed because our daughter is still very young. My father is cosponsoring for the visa.
Is there a good link or list of the expedite request process?
Do i request an expedite when i send in the first packet? attach evidence with the I129f?
Not sure of how to go about it,
