Pretty much but generally if you go in there smiling and say hello and stuff they are pretty nice about it. I have had a couple super jerk Officers but who knows what their problems really were. I also found once we started the CR1 it got easier too because they see you're doing things the right way.

 

That has been our experience as well. Always have documentation on you, but my husband has never been asked for anything.  Just be friendly and honest -  it is up to the discretion of the border agents, but what I have read in this forum, it is rare for people to be harassed too much.  I think that if you have been going back and forth it makes it even more clear that you will be going back to Canada because you have a history of returning. Also like dfitz wrote - having the CR-1 application in process shows you are going about it the proper way.

As a Canadian you are allowed to visit the US for up to 6 months without a visa.  If you are in process of getting the CR-1 visa, it is the same deal....just have proof you are returning to Canada - evidence of ties like job letter, lease, so on like mentioned above.

 

Always be honest and friendly and you shouldn't have problems.  My husband has been back and forth many times, always had his proof/evidence & copy of I-130 app, but has never been questioned or asked to show documentation. It all depends on the border agent, but seems as though most of them are pleasant and don't give you a hard time.

If there are years she did not file (because she was not working) there would need to be an explanation as to why she was not required to file taxes for those years...student, unemployed, etc.

 

As far as I know, you do not have to meet the poverty requirements in the previous years, but need to prove that currently she is meeting those requirements.  However, if you have a co-sponsor that would be ideal since there is not much history of income. It may depend on what her total income was for 2013 - for instance even if she only worked a partial year if it was above the poverty requirements and she is continuing to work, that is positive.

 

If she has not already filed for 2013, she should take care of that.  Once that is filed you can get tax transcripts from the IRS website - those are better to use than sending in the W2/Tax return. http://www.irs.gov/I...or-a-Transcript

 

To prove her current income you would definitely want to make sure that she has paystubs to show her current income as well as a letter from her employer (once it gets closer to filing to I-864) that states her salary, position, hire date and so forth.

I like the idea above, but I would start with the basics.  Young people make misakes, that's the way they learn.

Write up your history and explain when you stopped doing marijuana.   Go to your doctor and get a hair screening and blood screening to confirm no drug use in the last six month period and ask them to put it in writing to submit with your application.

You will, no doubt, be asked questions about it at the medical and interview stage, but provided you are honest and the evidence supports your statement, I don't think it's a big a deal as lying about drug use and being caught out in that lie.

Yes you can have your medical done in BC with Dr Cheema and take it to Montreal. I believe they give you the results in a sealed envelope. Just keep it sealed to take to the consulate.

My husband will be doing the same thing :)

I can't remember how long the medical is good for, but you have to wait until you have an interview scheduled in order to make the medical appointment.

Also remember that if you get your vaccinations prior to the medical, you won't pay as health care covers those shots you might need.  Whereas I understand you'll get charged for them at the medical for immigration.
So get your doctor's blood test results and update some shots if you can:)

As far as co-sponsoring that is not a problem. As long as they are a citizen or resident who lives in the US and has the required income, they can co sponsor :)

I got married a month before we sent in the I-130 application.  I sent in marriage license, 2 color photocopies of pictures (had 4 on each page), 3 affidavits, and I changed him to the beneficiary for my life insurance policy/401K at work.  Also maybe 5 or 6 emails from different months to show ongoing communication. 

 

I stressed about this too!  But it was totally fine.  Canada is low fraud and also if for some reason they wanted more evidence, you will be able to provide more as time goes on.  They will not just straight up deny an application for lack of bona fide evidence.

I sent in certified copies of marriage cert, birth cert, death of spouse doc, and kept the originals. Only photocopy I sent was of my passport bio page.

Marriage certificate doesn't have to be an original or a certified copy for the petition filing. Only for the NVC. Also in the instruction you're also providing a link to they ask for a copy of the naturalization certificate - not a certified copy. When they want certified they mention it explicitly.

My answer is based on I am under the assumption that you are applying for a spouse that is currently living in another country and you are not both living here in the US....

I put in bold the requirements you have listed that you need to send for the I-130.  The other items that have to do with the beneficiary or AOS are not a part of USCIS process.  Beneficiary information is required at the NVC process when they beneficiary fills out the DS-260 application and you fill out the I-864 AOS.

If you send int he I-864 AOS, they will not give you and RFE....it just is not required at this time. You will just need to submit an updated version after your NOA2 and you get to the NVC.

 

I sent mine in a similar fashion, as organized as possible and over prepared.  But I didn't have any problems, so yay.  I think you have every aspect fully covered and don't have anything to be nervous about!  I bet they will be happy to see a petition so well organized  :star:

Looks like you have got everything and also are very well organized!

 

I am not sure of your exact application, but if you are just sending in the I-130, you do not need to send int your "Section 10:" I-864 AOS documents until you reach the NVC (after USCIS approves the I-130)

 

That is my only suggestion....and of course, if it is something specific to your application/beneficiary country as to why you would need to include it, then what you have gathered looks good.

I would wait at least two weeks from approval date to call to see if they have recieved the case then call every other or every 3 days. After they recieve it call every other day until case number. But from the NVC filers thread it takes from 2-8 weeks for them to get the case and another 1-4 to get the number. Calling more often doesn't speed them up, you just may find out a day or two sooner, or you may just get angry.

I submitted my I-864 documents through EP as soon as my bill showed as paid.  I did not wait for a confirmation of enrolling in EP (which at the time was required?) - i think that the confirmation for EP was sent to me much later and it really didn't mean anything. Basically you can email the documents in once you have the cover sheet - some people send both I-864 and IV documents right away.  I sent mine after I paid each of the bills.

Basically it means they have looked at/done something with the file.  A lot of times that means you will be approved soon.  

For me, the petition was approved a long time after that update, but I have seen LOTS of people who are approved shortly after that update.

Definitely on the BC and PCC - for Canada the police check is good for 1 year.

 

Things I did when I was waiting -

Made 2 binders (one for me and one for my husband)

Copies of everything sent in with I-130

Originals of documents that will be sent electronically for the NVC (his binder)

Copies to give to the consulate at the interview just in case they ask for it.(his binder)

Copies for myself of all of the NVC stuff

Continue collecting evidence of a bona-fide relationship - plane tickets/pictures so on

 

Get everything for NVC scanned so it is ready to be emailed when the time comes.

 

Make sure you have everything ready for the Affidavit of Support -

Know which I-864 form to fill out based on how you filed your taxes (1040 or 1040A)

Continue collecting paystubs so I have the most up to date for whenever it is needed

 

Get the records of immunization - make sure you have them all, if not get them done before the medical

Check out screen shots of the DS-260 that you will fill out online so you have all that information gathered

 

And for my situation - i had ALOT of time to get things prepared ;)

 

Research things about importing his car

Research about EI that he is eligible for

Alot of impatient waiting.... haha

Once the case was transferred to NVC I gave it a couple weeks then called every 3 or 4 days to see if I got a case #

Once you get a case # it still can take a couple of days to get into the system - that is why I didn't call every day. 

Just make sure you check the guides so you have a good idea of the timeline once things start moving along

Agreeing with all the advice above -

 

I added my husband to my Chase bank account with his passport # and it wasn't an issue.  Also TD is a good option because they have an american and Canadian branch and it makes it easy to transfer money.

 

Bona fide proof of relationship seems "scarier" than it is - I found every bit of evidence I could - but it is hard when you have never lived together/owned things together.  Our main thing was  we got the affidavits from people who know us and also I added my husband as a beneficiary to retirement/life insurance. Just get what you can together and if they end up needing more proof, they will request it.  Dont stress about it - just follow the guidelines  :)

The requirements for spending time together are that you met at least once in the last 2 years.  You and your husband have spent much more time together than that!  

 

My husband and I met, then he visited me 1 time and I visited him 1 time - then we met up in the states to get married.  We had no problem at all.  In fact, you have more evidence by way of pictures with family than we did!  It is completely understandable to not have bank accounts/leases/cars in both of your names since you have not lived in the same place - they take that into account and it does not reflect negatively.

 

Here are the things I submitted and it was accepted -

 

Marriage cert, letters from family, pictures from the 3 times we were together in person, pictures from our ceremony (which was only us, no family/friends), boarding passes, emails, viber chat logs.  I used a few as examples from different points in time - 1 email from when we first met, then basically 1 per month up until the time the I-130 was submitted. I added my husband as the beneficiary to my life insurance policy.  The suggestions about adding in receipts for wedding, honeymoon etc is a really great idea.

 

Add a cover letter that explains the items you included and a brief summary of your story. It does not need to be a novel - but I suggest a timeline of different milestones in your relationship. Met, talked, realized you were in love, proposal, trips, when you met each others family, so on so forth.

 

Don't stress!!!  You have good evidence of a bona-fide relationship per the requirements. Submit everything that you can - and if for some reason that is not enough, they will request more from you.

We had 4 - one for each of us while we were still in different countries, one for the I-130, 1 for the interview just in case they wanted it (not required to give it to them, just covering my bases).  I am paranoid like that though haha! Papers get lost all the time, and I would rather have an extra than have to try and rush to get a new one.

As a person who scans a lot of documents for work...definitely use paper clips as recommended above. Never fun when there is a surprise staple in the middle of a set of documents. haha. Also the small binder clips work well - they feel more secure than a regular paperclip, but don't have the downsides of staples.

Personally I would rather be over prepared than under prepared and I would get an updated letter if you are able to. However technically the one from August along with your paystubs  should be fine since the paystub will show your current income.

We are starting to get everything together for our I-129. I have a few questions.

1. For the USC birth certificate. Is the one you typically would have enough? I don't believe it has his parents name or anything, therefore it's not long form, is this enough for the petition? Photocopy? 

2. Do we send off anything for our cosponsor right now or is that later? Our issue is, my fiancé is currently in Canada right now and has no income in the states (long story) he has never had an income in the states as he is 22 and has been here for a while. His dad will be cosponsoring and makes more than enough. Will my fiancés lack of income be an issue? What would we put when it asks where he's worked recently?



1.  Yes you would need the long form - photocopy is ok, just keep the original/certified copy on hand for the interview or if it is requested.

 

2. As long as you have co-sponsor that meets the requirements/has enough income then your fiances lack of income will not be a problem.  However, since your finance has not had income in the states and I assume not filed taxes (?), you would want to include an explanation of the situation / why they have not been required to file.  If for some reason your fiance was required to file US taxes and has not, he would have to file those.  As far to put in regards to where he has worked - write in what he has been doing - working in Canada, going to school, unemployed - whatever your situation is.

What I did was print out emails, some skype/text messages, trip itineraries, and just printed 2 pages containing 8 photos (4 from travels and 4 from the wedding).  I wrote on each picture the date it was taken and where we were.  I highlighted the dates on each of the emails/chat logs.  Pretty much a sample - like a couple from each month.  I sent a copy of my pension/life insurance policies that I had him added to as the beneficiary along with affidavits from my dad and a couple of friends about our relationship. I also included a time line with each time we met and a few personal details just to make it feel more human and less like a list I was writing to meet requirements ;)

 

I was recently approved with no issues.  I don't think you would get an RFE for putting in TOO much evidence, so go with what you are comfortable with.

The first two replies are a bit misleading. You asked if your fiancée can petition you if she lives in a state where same-sex marriage is not legal - the answer is YES. Your fiancée can file an I-129F petition as long as you two marry within 90 days of entering the USA on a K-1 Visa in a state where same-sex marriage is legal.

If the problem with your parents refusing to co-sponsor is that they haven't met your fiance/don't know him very well, why not rectify that before you make the huge decision to withdraw half or wholly from your studies? Coming from someone who spent years (and is still IN) graduate school, I can attest that withdrawing from classes can also become an issue, financially and emotionally.

 

 

This is really good advice.

 

Even if meeting your fiance does not change their minds, I am sure it would be good for them (as well as your fiance) to have some time to get to know each other.  In the long run that could help with your fiance adjusting to coming to this country.

 

You have some difficult decisions to make, but whatever you choose, you have a long process ahead of you. You are wise to be thoughtfully weighing the different options that you have.  It is important that whatever you decide to do, that you and your fiance are on the same page.  This helps make you both able to support and love each other through the whole ordeal.
