Have you ever heard of a situation where a person (out of jealousy) wanted to ruin a person's Embassy plans? They send letters to the Embassy with false allegations regarding the Petitioner; with the intent to cause "red flags" that can result to a denial of his/her VISA. How would the USCIS handle such a situation?


Yes I have heard of this and actually went through it recently. What I did first was talk with USCIS about the "threat". The person I spoke with told me that USCIS receives calls, letters and emails every day from ex-spouses and others attempting to derail the petitioners petition with numerous allegations against the petitioner or beneficiary.. She told me that they ignore all of that correspondence because the person sending it has no authority with the petition. She also shared with me that a caller could allege marriage or immigration fraud in which case the allegation would be sent to ICE for investigation. She shared with me that unless the allegation had a reasonable basis for immigration fraud that ICE would ignore it as well. I called ICE and they basically confirmed what I had been told.
The person that I spoke with at the US Embassy in Manila gave me the same answer....that they receive these type of calls everyday but they ignore them because the caller has no authority with the petition.
My advice...call them for yourself and listen to what they say.

Yes. The USEM interview phone line is open 8am-8pm M-F. Call a few times each day and ask if any interview appointments have become available due to cancellations/rescheduling. Keep in mind August 21st & 27th are National holidays in the Philippines and that may affect the call center hours on those days.

Hello everyone !

Well the good news is that I got my MNL case number yesterday from the NVC. I excitedly raced home, and tried to call the US Embassy in Manilla to schedule my interview. I was met with a recording that said:

"press 1" if you have filed your F160

or

"press 2" if you have not filed your F160.

It is my understanding that K1 Visa Applicants need an F156, NOT an F160. I also thought this can be filed AFTER your get your Interview Date. I am stumped... how do I get through to obtain an Interview Date. I want to call Sunday night (US Time) before they send out her Packet 3, because her address has changed and I need to have them update her address before they mail it!

(Yes, I have read the K1 Process Flowchart... but step 7 only mentions calling the Embassy to see if they received your Case from NVC... it does not provide instructions on getting your interview date, or any mention of an F156.)

Any help would be appreciated... I want my interview date so I can schedule my flights... I plan on being there with her for the interview.

Congratulations!
First, pay your Interview fee at BPI. Then wait about 4-5 hours and log on to ustraveldocs.com/ph to schedule.
Go to USEM website and download forms 156, 156K, 157 and complete them,
Go to SLME website and preregister for medical exam.
Go to CFO website and preregister for CFO seminar.
No packets will be sent to you from USEM.

Now,our question is will we receive an RFE or will USCIS rely on the criminal background checks that they will conduct on both of us for an answer that question?

As the others have shared, the adoption process will proceed through the Court system following the State laws that are currently in place. Here, in Arizona they call this type of adoption a "step-parent" adoption, and they are processed through the Superior court. There is no fee and the County Attorney's office will complete all of the documents, file them and schedule your final court appearance.
One requirement in Arizona is that you have been married a minimum of three years.

Hello...Diane and I just received our NOA2 yesterday and we are both ecstatic! We filed on March 8th and received our NOA2 in just 120 days. Shortly after our filing we realized that we had made a number of mistakes on our Petition. Our mistakes were pretty significant:: I failed to answer I-129F part C Question 2 which asks if you have ever been convicted; We failed to include letters of intent to marry within 90 days; I failed to provide certified copies of my divorce, and, I failed to include a copy of my US Passport identification page.
Of course we knew that we were destined to receive an RFE. I posted a number of questions here on VJ and everyone advised me that we certainly would receive an RFE and that there was nothing we could do besides wait for the RFE and then submit the corrections.
Out of curiosity, I called the USCIS National Service Center and inquired if there was a process to submit corrections to an accepted petition. My call took a while but eventually the CSR found a protocol in his database that provided for a process to submit corrections. The process was fairly simple: The CSR told me to gather the corrections and omissions and write a cover letter that included the following: The title was "I-129-F Correction to Accepted Petition"; next was the receipt number WAC1290XXXXXX; next was the I-797C Notice of Action date of March 13, 2012; next the name of the Petitioner; next the date of birth of the Petitioner, and , last the Alien Fiancee name.
The CSR told me to address the letter to the California Service Center and include an opening paragraph stating that I was submitting corrections to my original submission I-129F, Petition for K-1 Fiancee Visa, for Diane (my Fiancee) and to write that I was directed by the CSR at the USCIS National Customer Service Center to file my correction in this manner. I then listed the five corrected items that were included with my letter (corrected I-129F Part C Question 2; two letters of intent to marry, one from each of us; Certified copy of my divorce decree, Copy of my US Passport ID page.)
I sent all of the above to the CSC on June 8th. I never received and text or email update that my file had been touched. What we did receive was an approved I-129F Petition for Fiancee on July 11th.
It is our hope that this information will be of some help to all other Petitioners who have filed the I-129F and realized that some mistakes were made.

Start calling the NVC on Monday. Give them your USCIS NOA2 approval number. Don't listen if they tell you to wait for weeks. Call every day. I received my case number in 9 days.

With regards to paystubs, i would say, the more recent it is, the better... maybe, you can send your fiance a pdf copy of the paystubs that he could print out. in addition,if you think of it, recent paystubs will also serve as back up to the employment letter which will say you are still employed...it's just my take. I myself have employemnt letter dated 24th of July (interview is 10th of September), and it's PITA to get another one; so I will get the latest paystubs to backup my employment.

Maybe other members here will give more feedback about how recent the employment letter should be.

Our K1 interview was August 14th. We supplied Tax Transcripts, Employment letter dated July 25th and Pay stubs through July 15th. All were accepted.
