It is my understanding that the forms are readily available on this website http://ciudadjuarez....ianceforms.html. Mexico does not send a packet 3, instead they send an open appointment letter advising you that they are ready for you to bring all the paperwork necessary for the interview. How did you get a hold of the Juarez consulate? Did they tell you that your open appointment letter was sent Dec 1st or what did they send to you?




We did not receive an appointment letter. We called the Juarez consulate by phone and they said the letter was sent and i believe the packet also. And, if by the 21st we don't receive anything to just call again.


Well if you go to the website I indicated you can fill out all the forms that your fiancee will require at the interview. What number did you call to get a hold of Juarez consulate?

Just wanted to say thanks to this helpful forum! My fiancee was approved on the 6th of Jan in Juarez! Our interview was on the 5th and we were lucky that her passport/paperwork was ready the next day! If anyone has any questions feel free to ask!

Answers to you questions are:

1) No. The K1 becomes null and void because it is a fiance visa for your Mexican fiance to marry you in America. The K1 is out the window, and you will need to start again and refile for the CR1 or a K3.

2) Yes, it certainly does count.

3) Yes, it really does matter. See #1.

Why would you do this when her case is already at the consulate? You are almost done -- don't throw it all away.

To my knowledge you can enter through any POE (Port of Entry) into US territory. I know for fact that this is the case for land borders from Canada.
I believe it is the case from Mexican border crossings as well.

I received an approved NOA2 and a letter from NVC about a month ago stating that my case would be forwarded to the us consulate within a few weeks, I called NVC today and they told me that they had sent the packet back to USCIS. Has this ever happended to anyone? What could this mean??

an RFE was supposed to be issued for this, workers that work at USCIS are humans too and they do make mistakes so maybe thats why it was overlooked... just wait for USCIS to get it and call them to follow up, mostly likely they will issue an RFE this time...

Hello,

I applied for a K-1 Visa back in January 2009 and it was approved on March 2009. Then it sat at the NVC for about two months and after that it was sent back to USCIS for further review. When I called to find out why it was sent back they told me that I had not answered a question in Part C Question 2, the one about convictions on the I-129F (I just overlooked that question! and USCIS did too they never sent me a RFE to correct it!) OOPS. Then my packet sat with USCIS until the petition expired and I recently received a letter from USCIS NOTICE OF DECISON for the review. The letter stated that since my four months expired they would not revalidate it! It also states that I can choose to file a new I-129F. My question is how can I go about refiling? Do I need to wait a certain period of time? I know in the instructions it talks about people who have had an approved petition before need to file a waiver? What is the deal with the waiver?

My fiance and I already went through the whole process and she received her K1 Visa in early January. My question is why did USCIS send me another NOA2 for a different validity period after the visa has already been issued and my fiance already has her K1 Visa??? Has this happened to anyone else??
