K-1 Fiance(e) Visa Process & ProceduresWhen will I receive my first contact?
I'm a bit confused. Do I receive something from Texas or once my packet gets to VT? How long does this usually take?

I know that my packet made it to TX and was picked up on Friday - I got delivery confirmation from the USPS...but I was wondering when they would first acknowledge it...thanks :)

K-1 Fiance(e) Visa Process & ProceduresHow long until the NOA1????
I used a money order instead of a check.

But, good to know it takes longer than just a few days! Thanks :)

K-1 Fiance(e) Visa Process & ProceduresHow long until the NOA1????
I sent in my i-129f last week, and with delivery confirmation, I know that they received the packet at noon on Friday, however, I haven't received my NOA1 yet - and yes - I signed up for electronic notices. Should I be worried about this? I have seen on some timelines people received their NOA1 the next day...I know it's a MUCH longer wait for the whole processes - I just want to make sure the process at least gets started!

K-1 Fiance(e) Visa Process & ProceduresIs this normal???
Okay - so I know that I previously posted about waiting for my NOA1 - but I just called the bank to see if my money order had been cashed yet, and it hasn't! I have delivery confirmation that they received the packet last Friday - so it will be a week tomorrow. Does it usually take that long for them to cash the check? I just feel as though I see timelines saying they received the packet and 2 days later they cashed the check. I've looked through my photocopy of the packet I sent and can't find anything wrong or missing...waiting to hear from them just to know the process is started is killing me. I I know I have a much longer wait - I just want to have a start date to work with!!! :(

AND - if this is not normal - what could be the reason for them not cashing the money order?

K-1 Fiance(e) Visa Process & ProceduresDoes credit score affect K1?
Phew! That's good to know! Thanks for the quick responses!!

K-1 Fiance(e) Visa Process & ProceduresDoes credit score affect K1?
So, just wondering, do they check your credit in your background check?? My credit is on the mend from my college days - and I was just wondering if this would have an affect on our visa? Financially I am set now, meet the requirements of the income guidelines, my credit score is is on the high-average side but not stellar. I'm just worried past choices might have a negative affect on this....

Trying to figure out if getting a second job to pay off all of my debt in the next few months, and breaking my back to do so, is worth it???? (our NOA1 came today - so would it even matter if I did it now?) Or, should I just keep making my regular payments?

K-1 Fiance(e) Visa Process & ProceduresPolice Certificate Question
Thank you - this is EXACTLY what I've been telling him...

Hopefully I will be able to convince him to see it my way - I guess I have a few months to try and work my magic!

K-1 Fiance(e) Visa Process & ProceduresPolice Certificate Question
Sorry if this is not the right board to post this on (I'm never quite sure!)

My Fiance has a very high level of security clearance for his past job (this clearance is good for some time)...apparently this security clearance involved a very in-depth check - including looking into all police records - and was issued from the UK.

For some reason, he thinks if he brings proof of this clearance - it will suffice in place of a police certificate from the UK...it is a topic we discuss A LOT as I just want him to follow the rules and get a police certificate. I'm not fighting it too much right now as we just received our NOA1 - but, I want to be ready to persuade him if need be! Lol Do you think proof of this high level of security clearance is enough okay - or should he also get a police certificate?

I just don't want him to be denied at the interview b/c he did not have the police certificate...

K-1 Fiance(e) Visa Process & ProceduresWhat's next?
Kristen - one more question. Which affidavit of support did you fill out? I notice on the site you shared it suggested the I864 - but I thought I had read somewhere else that another one was sufficient. Thanks again :)

K-1 Fiance(e) Visa Process & ProceduresWhat's next?
Vero & Chris - thanks :)

Kristen - Great information, thank you. So other than the affidavit of support, there is no paperwork on my end? When we receive the NOA2 - will we also get instructions on what is next, or is there a place on this site I'm missing that explains all of the steps in full? I just like to have things written out! Thanks :)

K-1 Fiance(e) Visa Process & ProceduresWhat's next?
While waiting for the NOA2 -is there anything I can start compiling? I tried searching at the top - but couldn't find a checklist for this portion of the visa process.

I know that I need to fill out my affidavit of support and that he needs to start collecting police certificates. What else is there? That can't possibly be it.

Also, how does the medical exam get setup? Does he have to do that? Should he do that now?

Btw - he will be coming from Scotland and the embassy we will be using will be in London. I've found the board so helpful in preparing the I-129f, and I'm sure it will be helpful with this step, I just can't seem to find the right place to look!

K-1 Fiance(e) Visa Process & ProceduresHow do you know when you're "touched"?
I see a lot of "touched" updates in signatures and such - how do you know when your case has been touched?

I signed up for email notification the USCIS website - but when I check my status it just gives a general "your in review"...am I looking in the wrong place?

K-1 Fiance(e) Visa Process & ProceduresVisiting during the visa process??
I am under the impression that it is okay for me to visit my fiance during the K1 visa process. I live in the USA and will be traveling to Scotland to see him this summer. Are there any things I should be aware of at customs? Do I need to bring proof of the K1 process with me? Proof of a job? Etc? Just want to be prepared!!!

We did not think we were going to be able to see each other this summer - but thankfully it has happened!! I will be visiting him for TWO weeks in August!!! I can hardly wait!!! <3

Thank you, thank you for your quick responses!!! I was starting to really stress out for a second!!
cmoore25FemaleScotland2011-05-27 13:14:00
K-1 Fiance(e) Visa Process & ProceduresQuestion about I-134
So, I am prepping for when the NOA2 arrives (a bit early, but it gives me something to do!)

I have noticed various suggestions and guidelines as what to submit with the I-134. My fiance will be interviewing in London. What do I need to send with the I-134 for his interview? I was planning on sending 3 years of tax transcripts, 3-4 current pay stubs and a letter from my employer.

i guess I should also state that I meet (exceed, actually) the 125% poverty guideline levels. Do I NEED a letter from my bank? I have very little in my checking/savings due to the fact that I'm in grad school...well, that and I just about cleaned out my savings for a trip to visit my Fiance in August! Is this letter an absolute must? If so - can the letter just state the opening date and the amount deposited this year - does it HAVE to include my balances?

Thanks :)

K-1 Fiance(e) Visa Process & ProceduresWhat do I have notarized?
I am starting to get stuff together for the next step in this process, which, is to send everything to my fiance for the interview. My question is, what needs to be notarized? I saw in one post they suggested to have the I-134f notarized. I was also planning on having the letter from my employer notarized. Anything else?

K-1 Fiance(e) Visa Process & ProceduresEarning Above the Poverty Line
Photomile - it is unfortunate that you earn enough to support her in the UK and she is not moving there. However, she must earn enough to support you here - as you will go 60-90 w/out being able to work. After you are legally able to work, who knows how long it will take you to find a job - so, the US has to make sure it covers itself - and you will not require gov support (as it's already drowning in supporting the citizens of this country!). I hear you though - it's frustrating. If your fiance does end up taking a job that is $7.55/hour, then she will, indeed, need a co-sponsor in order to complete the process successfully. Good luck!!! This is not a fun process and there are many hoops to jump through - however - it will all be worth it in the end! :)

K-1 Fiance(e) Visa Process & ProceduresBackground Checks - freaking out a bit!!!
Thanks - I'm hoping you are right. I'm still on hold to take care of the situation. When I read this letter the first thing that came to mind was the visa - I got so sick to my stomach thinking that my overlook 2 years ago could cost us an NOA2 - and that we might be denied b/c of it...strange thing is - I filed the following year and got a return!

I saw a post below about bankruptcy and a denial and freaked b/c I didn't know if this would show up on a background check too...

BTW - I wanted to thank you again for the packet of info you emailed me regarding the process after the NOA2...I think you emailed it to me in April or so...we are now almost complete prepping everything and owe the smooth sailing to your email!!!! So thanks! :)
cmoore25FemaleScotland2011-07-08 09:51:00
K-1 Fiance(e) Visa Process & ProceduresBackground Checks - freaking out a bit!!!
So - I'm slightly freaking out right now!!!

I was cleaning out old files and came across a letter I had never opened from the Massachusetts Department of Revenue...this letter is from 2009 and was tucked away in another letter!! Anyway! The letter says that I owe them a little over $100 b/c my tax payment for 2009 was $100 low...I'm on hold with them right now to fix the problem (I would like to know why I haven't gotten another letter from them in the 2 years since...strange!!!)...

Anyway...will this affect our chances of getting a visa? I am at the 3.5 month mark and according to Igors list should receive an NOA2 anytime...but now I'm freaking out that this will possibly show in the background check and we will be denied b/c of a simple overlook on my part 2 years ago.

As I stated, I'm trying to fix this issue now, but it might be too late if the background check is already done...

Thoughts?????

K-1 Fiance(e) Visa Process & ProceduresNOA1 date question
So, I just realize that my NOA1 has two dates:

Received Date: March 25
Notice Date: March 31

Which one do I go by for my NOA1 date?? On my timeline I have April 1st, which is the day I actually got it...which, I now see, is not right...

K-1 Fiance(e) Visa Process & Procedures4-5 month wait until noa2?
Settle in for some waiting. 5 months does seem like a long time - and right now VSC seems to have slowed down again - they were on a roll for a bit! I am currently on month 4, however, I have a friend who is on 5+ months. It varies. My best suggestion (or at least what works for me) is to keep as busy as possible, talk as much as possible and find a way to enjoy the process (I like surprising my fiance by mailing him random letters & care packages)...good luck!

K-1 Fiance(e) Visa Process & ProceduresBackground & Credit
Okay, great, thank you!! That gives me peace of mind for the NOA2!!!

The closer it gets the harder it is to wait and not think about every possible reason to get an RFE or denial! I need to chill out!!!

And yes, now that you mention it, I think it was the visa not the petition!

K-1 Fiance(e) Visa Process & ProceduresBackground & Credit
I recently read a post on here about a man's visa petition being denied because of filing bankruptcy. And I know I have asked about background checks and credit before - but his post made me worry!!

So, my question is, do they do a credit check in your background check? My credit is not awful - but it's not 100% amazing either. I have recently finished a debt consolidation program due to debt accrued in college. Will this be a reason for a denial of the K1 petition?

Thanks for the information!! According to the VJ timeline I am only a few days away from being in the time range for an approval - so I'm paranoid about everything the closer it gets to a possible approval/denial/NOA2

K-1 Fiance(e) Visa Process & ProceduresAnybody know how they process K1s?
I suppose that vacations, sick time etc make sense. Just seems like a lot of people who received their NOA1's around me (both before and after) are being approved...so I'm just anxious. Thanks :)

JimVaPhuong - thank you!!!! That makes sense!! Yes, I am only looking at petition approvals from VSC, where my case is at! I learned a long time ago to not even think of CSC - as they process so much faster and it would just drive me batty!!
cmoore25FemaleScotland2011-07-18 11:42:00
K-1 Fiance(e) Visa Process & ProceduresAnybody know how they process K1s?
I'm just wondering if anybody knows how petitions are processed. I've noticed that some people who received their NOA1's after I did are being approved (huge congrats to you guys btw!!) and one of my friends is still waiting to hear something and she is a Feb filer!! My case is pretty easy as far as I can tell from what people have posted on here regarding red flags....so why the petitions being processed out of order??

I know that I have not reached the 5 month mark yet - and I am prepared to wait until then to get really super frustrated - however - if I knew why (or possible reasons) petitions are processed out of order - it might make the wait a bit easier!

THANKS :)

K-1 Fiance(e) Visa Process & ProceduresNOA2 notifications....
Are NOA2 notifications by text/email sent out at different times during the day - or are they all done at the same time? I just noticed 2 people from the FB group received their NOA2's about 1/2 hour ago. Is that if for the day, or could their be more notification sent out?

Okay - I'll try to make this my last question for the day!!! Lol THANKS!!

K-1 Fiance(e) Visa Process & ProceduresLetter from Bank - is it needed???
San diego - well, I make no where close to the amount you do!! Lol Do you still think it's safe not to include the bank letter? I currently make $37k (teacher's salary, geesh!). Thanks for your fast reply - I had just seen many post about including the bank letter, so I wasn't sure...

K-1 Fiance(e) Visa Process & ProceduresLetter from Bank - is it needed???
So, I exceed the financial requirements by almost double to sponsor my fiance. I have the last 4 years of tax transcripts, 3 months worth of paystubs and a letter from my employer. How important is the letter from the bank? The reason I am asking this is because my bank sent me the letter, which never got here, they finally faxed it today - and after looking at it my address is wrong!!! UGH. It's only the apartment number instead of 132 it shows 13. Big deal? My guess is yes. Also, they showed my checking and savings account. My checking account is fine, however, I keep a very limited amount of money in my savings account b/c this bank charges me fees to use it if it's in savings. So, my current balance shows about $200 where the average for this account is $14.00 Lol Seriously, I hate being charged to use the money - so it all stays in my checking!!! Will such a low balance and/or average in savings look bad??

Do I need this letter? If so, should I pay an additional $10 to have the address fixed?

Thanks!

K-1 Fiance(e) Visa Process & ProceduresMilitary background - will it take longer??
So, just a question. I'm still waiting for our NOA2 (month 4)...but a friend who is going through the process and is 5+ months contacted her congressperson as to the hold up at VSC. The congresspesron gave some good information - but also said that if you have a military background this could slow down the process as more checks are needed. Is this true?? Aren't background checks done on military servicemen & woman while they are in the service? Why additional checks?

I'm just wondering because my fiance was in the Royal Marines - does this mean our approval could be delayed due to additional background checks needing to be run??

Oooooo this process is testing my patience!!! ;)

K-1 Fiance(e) Visa Process & ProceduresI-129F - HELP - Question 18
I agree - mine was short, sweet and simple. Such as: Allan contacted me through an email on Dec 29, 2009. We emailed, fb'd, skyped until we decided to meet. We met Nov 20th in Boston where we spent 10 days together. I then flew to Scotland in February for 8 days where he proposed.

I didn't add much more than that in my question 18 and my NOA2 arrived today w/ no RFE.

K-1 Fiance(e) Visa Process & ProceduresBest way to file/Sign paperwork while seperated by long distance?
When we were filling out our petition I had planned to fill in the required information, email my fiance a copy of that paperwork, he would sign it then send it to me in the regular mail - I would add my signatures once it got to me. It would at least save money & time from mailing the paperwork 2 times.

I'm not sure if that would actually work (although, I see no glitch) though b/c I was lucky enough to end up taking a trip to see him right when we were preparing - so I brought the papers with me by hand, although, that option is QUITE a bit more expensive then mailing them! ;) Good luck!

K-1 Fiance(e) Visa Process & Proceduresone month and 4 days since rfe reply :(
There might not be a red flag - it might just take a long time...the closer to getting the NOA2 I got the more I started questioning and doubting things - "What if they didn't like this..." or "What if I forgot to sign this sheet..." It's easy for you mind to play games on you. Try to take a deep breathe and go with the process (I know, it's harder said than done). And know that others have gone through these types of thoughts before too (well, at least I did!)
