I received today an email saying that my case was approved and sent to the NVC. The awesome thing is that I sent my petition on may 22.

Completely agree with Gondola on that, although it's a way off there's plenty more to pay and prepare for. I've pretty much completed my NVC package now, just need my immunisation records for my medical and I think I. Have everything prepped.

I'm other news, today is the second day I've had norovirus so I'm cooped up in my bed, vomiting every few hours... So tired!

I will fill the form I-130 and I'm confused. I do not know if I have to fill out one for my wife and her son. If I have to fill them separately, what documents should I have?
She did not marry the father of the baby, do I need to present evidence that there was no marriage?
How is the process of translating the documents?

If she does not have a job, Do I have to put 'NONE' or 'UNEMPLOYED'

 

Question #17

List spouse and all children of your relative.

In this question, Do I have to put my name as his husband?

 

Question #18

Address in the United States where your relative intends to live.

Do I have to put the address of where we are going to live together?

 

Question #19

Your relative's address abroad.

Do I have to put her address?

 

Question #21

If filling for your spouse, give last address at which  you live together.

Only I have visited her, we have not lived together.

I am assembling two packages I130, one for my wife and one for my stepson, and I have doubts. I do not know if I'm doing it correctly.

 

My wife package includes:

  5. Translation of my wife birth certificate.
  6. My wife Identity and Electoral Card.(is in spanish)

  11. My wife  passport-type photo.

  13. Photos of our marriage, honeymoon, trip together.
  14. Hotels bills.

What else do I need?

 

My stepson package:

  2. Copy of my birth certificate.
  3. Copy of marriage certificate.

  5. Copy of the child's birth certificate showing the child's name and the names of both parents.

This is the g325 of my wife she was unemployed before her first employment, do i have to put that?, and do i have to put the full address when unemployed?

The process is individual or they process both of them as one?

The process for my stepson from this point is the same as my wife?

Could I be the sponsor for my wife only and have another person to be the sponsor for my stepson?

The forms are in Spanish. I called to request a translated version, and their response was, I had to print the form and staple it in English.
They have the W2 attached to them, and only have and electronic copy.

To the OP: The household size on your wife's I-864 will be 3 (you, her and your dad) and the household size for your stepson will be 4(you, wife, him, and your dad). So don't include your stepson in part 5 no 4 in your wife's I-864, and do include your wife on part 5 no 3 on your stepson's I-864.

You need a joint sponsor.  If you live with your father you can combine incomes.  I"m not sure about your mother.  I think it would be odd not to include her.  Does she work? Does she make more than your father?  Can she not be your joint sponsor?  I wish pushbrk was here because he really is the best at this.  

 

Is there no one else who can be your joint sponsor?  A friend or someone who makes more money?


 

Step children DO NOT go on the I-864 for a spouse because they have their OWN petition.  I do not believe they are not considered dependents for tax purposes until they live with the step parent in the USA.

You don't include your stepson on your wife's part 3, and you don't include her in your stepson's part 3. They are both separate cases so you cannot list them here.

 

Yes, if your father lives with you, you are able to combine your income with his in order to meet the 125% level requirements. Keep in mind that he has to be included in your household size. So you, your wife, stepson, and your dad would be a household of 4, assuming you don't have any other dependents or persons you have previously sponsored. You have to make $29,812 or more for a household of 4. Your dad would fill out I-864A and he has to submit proof of current income (a letter from the SSA, which you can get online), a letter explaining why he isn't required to file taxes, and proof of your relationship (birth certificate) and proof that you live in the same residence. If you guys don't make the required amount, you would need a joint sponsor.

I'm earning $12,800 YTD but in the past year as I was starting in this job I only made $6,649 as stated in my W2. My father received $14,991 last year. I'll make like $18,700 this year. I'm good with that or I need a joint sponsor.

I have some questions related to the form AOS Package. 

I requested my wife and stepson (3 years old). I already paid the AOS fee. 

I have the employment letter. 

I have my last paystubs.

 

I asked my cousin for the paper that he needs to have in case I need a joint sponsor.

 

 

Form I-864 

Part 1: Basis for filing Affidavit of Support. 

1. My Name

1.a I have to mark this, because I'm the petitioner, right?

Part 2: Information on the principal immigrant. 

I have to fill the info of my wife for her I-864 and the I-864 for my stepson, right?

Part 3: Information on the immigrant(s) you are sponsoring.

This is the part I get confuse. 

How do I fill this? I got not clue on this part.

Part 4: Information on the Sponsor.

Ok, this part is about the sponsor. So, I have to state my full name, mailing address (What I do if the address is longer than the field?), place of residence, other info.

If I need a joint sponsor, he have to fill a separate I-864, right?

Part 5: Sponsor?s household size. 

How do I fill this part? for my wife and stepson?

 

Part 6: Sponsor?s income and employment.

Help on this please. 

 

Also, I earning only 19,000 this year. I have a cousin that could be my joint sponsor he fills his taxes with her wife.

Do I have to wait more time for the invoice appears? I think they're holding the cases so everyone has to pay the new fees.
