Out of curiosity Ilona, how did you mail in your application? I always send mine with a signature and/or delivery receipt confirmation request so I can say that it has been signed for in case it gets lost.

And now we are 2! Its been over 7 weeks since Nebraska got my N-400 and my check still hasnt been cashed and of course I dont have NOA! I called them for a 3rd time last week and this time the IO seemed to be a little more inclined to help-meaning she took a little longer to research, but still told me that Nebraska havent entered me in the sistem yet and when I told her my check still hasnt been cashed, just by the tone of her voice I could tell that this is not normal and that something is wrong. Anyway she told me to give at at least 2-3 more weeks and if nothing by then-to call them back! I am now about 90% sure they have lost my papers and what bothers me the most is that they wont do or let ME do anything about it until they meet their time lines!!! mad.gif So, now I have decided to call back on the 1st of october if the situation is still the same by then. I am really curious what they will tell me or what they do in a situation where they have lost somebody's paperwork! What sucks is that I was required to send a original of a document which was hard to get and if they want me to resend everything where the hell am I going to get that document again from?! girlwerewolf2xn.gif But I am going to try to keep my cool and not get ahead of myself, cause I still have a tiny bit of hope left,so we'll see!!!

Ok, don't shoot the messenger but unbelievably Marina received her interview notice letter in today's mail. It was dated 9/9/08, which was one day BEFORE her biometrics were completed.

I don't know what's going on, but her interview is scheduled for October 20th in Chicago.

I know alot of you have been waiting for much longer so I wish speedy processing for all those waiting. Maybe this is some payback in a good way for our long wait for Carina's FBI name check.

You have every right to be angry/frustrated and I give you credit for getting on the phone with USCIS even though their answers are always canned. We went through the same thing with Carina's I-485 (the FBI name check fiasco) and I couldn't just sit by & wait and did everything from an Infopass appointment to contacting the Ombudsman and even writing the First Lady!

Of course I don't think you are quite at the stage to write Laura Bush but I do understand your frustration...I mean how hard is it to cash a stupid check and send a NOA? They have done it for the rest of us and your case should not be treated any differently.

Hang in there...we are all rooting for your case to get moving.

The new (old) mailman delivered Marina's biometrics letter today...whew! I think the regular guy must be back on our route since the summer is now officially over; today's mail was back to being delivered by 11:30am instead of 2:30pm so I got it when I was home for lunch. Definately glad I don't have to call USCIS this week!

My wife and daughter had a similar positive experience at the ASC when they went to get Carina's biometrics completed for her I-751; now we are hoping they will have another one sooner rather than later...still no bio letter for Marina's N-400.

Once your approved at the interview the oath letter most likely will be sent not until you are closer to the 3 year anniversary mark but it will not be a problem that your interview was prior to it.

US Citizenship General DiscussionWill petty theft affect N-400 for in-laws?
In-laws are approaching their 5 year mark as LPR's and now want to apply for citizenship. In April 2013 they were both arrested for shoplifting at a thrift store for about $20 worth of merchandise. They were released to my wife and I with no charges filed, no fines, and trespass warnings saying they could no longer shop at the store.

We just received original police reports that clearly states no charges were filed and "visa letters" from our town showing they have clear records.

We will answer "yes" to question 23 in part 11 and give explanation that no charges were filed n number 29 and attach all police documents.

Does anyone know if this incident can cause the applications to be denied due to the "good moral character" requirement?

I was just looking at the updated form, and I could not find anywhere on the form the rule about a K-2 not being able to file to remove conditions if their GC was approved more than 90 days after their K-1 parent as I have read in many places, including VJ.

The only thing I could see was on page 1 of the fillable part where it says "I am a child of a conditional resident but unable to file together..."

Have the rules changed or is this rule just implied? Seems to me they should be more clear on the application itself. In our particular situation Carina (k-2) did not receive approval on the GC until 1 year after her mother's (k-1) approval.

Your child must file a separate application if your child received conditional resident status more than 90 days after you did."

Removing Conditions on Residency General DiscussionK-2 Removing Conditions Documents
We will be in the same boat as Carina's AOS was approved a year after her Mom's even though they came to the US together. The K-2 would definately check the box Part 2 "B" and then also list the parent's info in Part 4. On page 2 of the instructions it also asks for the K-2 to include a separate statement as to why they need to file separately, which you know the answer to. Otherwise I would just follow the instructions and don't leave any questions blank.

As for the documents I would just send a duplicate of whatever you send for the K-1(and maybe a few documents that pertain to the K-2 only such as school grades, paystubs, letters mailed to the same address)...my experience is that sending more is better than sending less.

Pictures don't really prove anything, and they aren't listed on the I-751 application. Best evidence of a real marriage is "financial entanglement." Joint bank accounts, investment accounts, car titles, mortgages, title to the home or a joint lease, credit card statements, insurance, etc. Affidavits (which anyone can write and say anything) and pictures don't really say anything...we didn't include anything like pictures or affidavits or any of the 'secondary' items at all, and we're not worried about it in the least...


Aren't the affadavits a requirement? That's what it looked like to me when reading the instructions...

I noticed that the example letter is from/signed by the US citizen spouse. I am assuming this is because it is a joint petition as opposed to the AOS.

Has everyone pretty much followed this example and sent the I-751 with a smilar cover letter signed by the USC spouse? I guess it would solidify the petition since it would further "document" the relationship, but at the same time it is the non-USC that is asking for the removal of conditions on their green card.

I am trying to calculate the earliest date we can legitimately file for Marina's removal of conditions and at the same time in time to beat the July 30th rate increase.

Her card expires 10/25/07, so it appears that if we file Saturday July 28th that we will be within the 90 day window. The rate increase memo's from USCIS state that the applications must be filed or postmarked prior to the 30th to qualify as prior to the rate change. We plan on stopping at the post office Saturday morning the 28th to drop off her package at the USPS for overnight delivery to Nebraska.

Are my calculations correct??

I just want to make sure the address on the application is current since I am trying to beat the rate increase and don't want any snafus.

Paper clip the check to the I-751 form.

Cover letter on top, then the I-751, and then the rest of the evidence in no particular order, you can order it the same as the list of contents that you may have on your cover letter.


We stapled our check to the I-751 application...new fees or not I think the government should be able to afford a staple remover of some kind. For the rest of the paperwork we 2 hole punched it at the top and used the ACCO fastener just like our previous applications.

Regarding the fee increase, we are also right at the 90 day window, and will be mailing our package this Saturday morning and expect the post office to postmark our package 7/28/07, thus beating the rate increase. We are sending 2-day priority mail since as long as the postmark is prior to the 30th then the old fees should still apply.

Below is what we included in our package with the cover page on top and the application behind it...good luck to all!

Ok, I just wanted to update this. I searched last night about how to answer Part 5 for my mom's I-751 and we had a disagreement about it.

So I called USCIS today.

The agent said that we only needed to list the children whose natural birth mother is my mom and exclude all other children, meaning none of my stepdad's children should be listed. When I asked him how to designate in the application that we will not be removing the conditions on MY GC (because it expires at a later date), he said that I should NOT be listed then.

This seems a bit doubtful to me despite the fact that he is a USCIS agent.

Any ideas?


I have no ideas but just wanted to thank you for calling USCIS about this. Once again this is another example of why they need to do a better job of adding a little detail to their petition applications so we are not left wondering what the heck we are supposed to enter as the response.

I mean, Yodrak is right that it says to enter ALL CHILDREN and that I made up the "only if" part, but at the same time you are getting conflicting information when you call the help line, and all of us are left to just hope that our response is ok.

In our case I put Carina's name, full address, that she lives with us, and when her GC expires so hopefully they will get the point that we are NOT including her in the petition. Our cover page and evidence also does not include anything about Carina.

We'll see.

Maybe they can use the money from the fee increases to create a clearer application? :wacko:

Agreed...but back to my original question. How do they determine if we are trying to manipulate the system? I will go ahead and list her but I will indicate her expiration date too so hopefully they will not think we are asking for her removal of conditions too. She is our only child so that makes listing her stand out even more.

They could make another box that says "check here if applying for removal under this application" and make things a whole lot easier.

Or they could have just approved her as a K-2 when her mother was approved and all of this would be a moot point. Damn name check BS strikes again.

Thanks for the feedback. I am just wondering how they determine if we are or are not applying for removal of conditions for these children that we have listed. I mean, I do not want them to think that we are trying to manipulate the system for an early removal of Carina's conditions.

Just seems like the application itself is clear (ALL CHILDREN) but the instructions themselves are more vague and lean towards listing children only whom you are including in your application to have their conditions removed as well.

These applications are so vague sometimes. I mean I know the instructions say to list her only if filing, but then on the actual application it says IN BIG LETTERS TO LIST ALL OF YOUR CHILDREN with no disclaimer about only if they are filing too.

Attached application is an older version but it says the same thing.

I am a Notary in Illinois and I don't charge a dime for notarizing. If someone is charging $100 then depending on the laws of the state in which they are a notary it may not even be legal.

From page 6 of the Illinois Public Notary Handbook:

"The maximum fee that may be charged by a notary for a notarial act is $1. A
notary is not required to charge for services."
