I was approved Dec 30th so I guess I can technically qualify to post in this thread.

I do have a question for those of you who have their interview dates already or are getting there. I see there are a plethora of shortcuts for getting through the NVC does anyone have an estimate for how much time those actually save?

Have people been successful in pursuing both the K-3 and CR-1 and then having the K-3 interview switched to a CR-1 interview? I believe we will go for the CR-1 but I am trying to understand if that is a poor decision and if I have to go through the shortcuts or not.

K. Noi as for the K-3, they will not accept cosponsors on an I-134 at the USEM in Bangkok for sure.

I don't have much an experience here on this, but maybe you can try to go for an interview for K-3 first? Then wait for IR-1 to be schedule for the interview anyway since for IR-1, you can have a co-sponsor for an I-864.

I just got my interview date today from NVC, it is on May 4.

This is the best news I have heard in days. Congratulations on your interview. So much for assigning interviews only the second week of each month. This is two weeks after the second week of March and two weeks before the second week of April. I guess they are getting an early start. I am really excited for your interview. We are so much further behind you. If we could only get a May interview my problems would be solved smile.gif. Thanks for your advice. I think that this is what we have decided to do is to attend the K-3 interview and then wait for the IR-1 interview.

Concerning co-sponsors in BKK...

I am not sure when but the Bangkok Embassy has stopped accepting co-sponsors on non-immigrant visas (I already posted on SAWASDEE). I have heard there are other embassies with the same policy and thought perhaps people might have some solutions or suggestions concerning this problem.

According a an email from the Bangkok embassy they will not accept cosponsors on an I-134 because it is not a legally binding contract as in the case of an I-864.

In our case we have applied for a K-3 which includes the IR1. Because of a family member being ill we have decided to pursue the K-3 while we wait for an IR1 interview, case is complete at NVC. All this to say my co-sponsor filled out both an I-864A for IR1 and a I-134 for K-3. Also my co-sponsor is a household member... if that might make a difference.

As a student for the past 8 years I require a co-sponsor for income requirements. In addition to my cosponsor I have signed a contract for a job starting June that will make my yearly income much above the requirement.

Does anyone have any advice in this situation. I know some Embassys use the I-864 for the K-3, is there anyway I can convince the BKK embassy to do the same?

We still plan on getting the IR1... we were going to fly back for the interview... I believe this was exactly the intention of the K-3. But we really would like the K-3 so that my family member can see my husband again before she passes away.

Our interview is scheduled for next month... we are going knowing we might be denied on these grounds but I thought I would see if anyone has any advice or experience.

If you only filed the I-130 and not the I-129F as pushbrk stated you are track for the CR1 visa. You can find the LingChe guide to the NVC in the wiki section. Even if you don't follow the shortcuts of the guide it is a great overview of what happens at the NVC. Now that you have your approval, also called NOA2, your case will be forwarded onto the NVC. This can take up to two weeks but I think it averages about a week. You can call the NVC and use thier automated voice response (AVR) system to check on the status of your case. You will see peolpe say to only speak to an operator, and not use the AVR. I personally disagree, the AVR was updated for every change on my case within 24 hours. I prefer not to bother an operator until I really need help, that is my opinion.

Now a choice of agent form should be generated from the NVC and sent to your spouse in Thailand. We actually never recieved this form here in Thiland and so it was good that I went ahead and emailed it. It took a few days for the NVC to accept the email but it worked for us. I could explain the rest of the steps of the NVC but it would probably be better if you took advantage of the aforemention guide (LingChe).

Hopefully the completion of your case goes well.

Be thankful for your quick approval with the I-130. You don't need to incessantly bother the operators. I have found that the AVR is usually updated 24 hours after the event... people wait months, 24 hours, isn't that long. You can't do much of anything in 24 hours anyway to further your case. I was approved and it took 10 days before it was entered in to the NVC system and a case number assigned, 11 days before AVR indicated this. Let the operators deal with people who actually need them. If you have a problem and need the operator's help, you will hope they are not gumpy because they have been dealing with people incessantly calling all day about things indicated on the AVR...

Today was our K3 interview, the Embassy received our CR1 filed approximately a week prior. We made no contact with the embassy concerning the so called switch we simply showed up for our K-3, with everything prepared as if for the K-3 and they knew to issue us the CR1. In fact we had yet to pay the K-3 fee (because of post office being closed) and so we said upon arrival this was the case. We went to the post office after turning in our documents to pay the fee and there a U.S. embassy worker shows up and tells us not to pay, our CR1 file is there and we would be interviewed for that.

You can call the IRS and ask for a letter of confirmation of non-filing. They mail it out within a couple days. It took no longer than 4-5 days before I recieved mine. However they will only issue this letter if you REALLY didn't need to file taxes. If you made over a certain amount on a W-2, made over 400 on an 1099, or any 1099 - MISC income then you must file. But really call the IRS everyone I have ever talked to there is more than friendly and helpful.

I heard advice from one of the people who supposedly interviews in Bangkok never to take no for an answer but always ask to schedule another interview. Apparently if you don't pass you can schedule a new interview and hopefully with a different interviewer and they may have different rules or standards.

It is true, this is a policy of the Bangkok Embassy. According to an email I recieved from the embassy regarding this they have stopped accepting cosponsors on all K visas which use the I-134 as it is not a legally binding document. The I-864 for IR1/CR1 visa is however a legally binging document, and therefore is accepted. Plus it is the NVC who approves the I-864, from my understanding, and the embassy has less power to act on the I-864.

THis is the quote from the email I recieved from the BKK embassy "The I-134 is not legally binding like the I-864 Affidavit of Support for immigrant visa cases, so you cannot have a co-sponsor for the I-134?

2) You can always submit a cosponsor, even though the Bangkok embassy does not accept them. From my corespondance with the Embassy they would not approve you if you don't currently (meaning on your '08 taxes, or '09 if your interview is after April 15, 2009) have enough income. They won't pass you on your co sponsor but it won't hurt you to submit it. Do you have recent paystubs... like since leaving thailand and going back to the states? If you could submit those with a letter from your employer, it might be helpful. But unfortunately I am not sure they would approve your visa, but I will hope for you they will.


3) Recently the Bangkok Embassy doesn't even let the American Citizen in for the interview, so it will not in the least be held against you that you are not there.

I would reccomend emailing the embassy in order to find out. They will be closed until the 16th or 17th, but that would be my reccomendation. Otherwise you can attach another sheet, and format it as question 7 listing each of your other employer's and addresses. (on question 7 part a, I would just write see attached sheet). Then in part b of question 7 put the combined income. Make sure you have an employer letter for each of your employers.

I definately wouldn't fill out multiple forms.

Not sure about death certificate, but my wife had no birth certificate. She got a letter from the Amphur stating she was born on this date in this town etc., and that there is no record of her birth. Had that translated to English for NVC. Not sure if you will need the translation or not since it is the Thai embassy.

They sure seem be getting weird at the BKK embassy lately.


Strange indeed. Typically anything presented to the consulate must be translated to English, so I would advise that. Is it possible he was a member of a church that may have a record? Otherwise I think the letter you will receive should be adequate.

You probably should disregard the above advice regarding translations. As you and I (and anyone familiar with BKK procedure) knows, documents in Thai and English are both acceptable at US embassy in BKK. I think that the letter from the local official attesting to your father-in-law's passing is probably a very reasonable starting point to satisfy the IV Unit - if that is insufficient I suppose you'll have to dig deeper, but hopefully that should satisfy them.

I do appreciate your posting however, since it may yet be relevant to our situation too.
We just sent back our Packet3 and are waiting for a P-4 with our interview schedule. Due to Songkran and all the protests going on in Thailand we're bracing for a delay on that. However, when I read your post what immediately occurred to me is that Thanti's father passed away in the summer of 2007. We of course recorded that on the paperwork, but did not include his death certificate (it was never asked for!!). Now I'm wondering if we'll get an RFE type of response, as you did, requesting that. I'll let you know if that happens to us.

I don't think it should affect your timing. They didn't send us an RFE or anything, it was just a little hand written note on the interview appointment letter. I will let you know if they really wanted it when we have our interview. At the very least you could just have it prepared for your interview in case they ask.

We got a letter from the local official but I am not sure it is too convincing. It says something to the affect of I am reporting that two people swear that thier father, Mr. XXX, died in the year of XXXX. There were no dates or anything, we searched through two local offices and neither have records. We think one of my husband's sisters may have his (the dad's) ID card so hopefully we can get that to take. So you guys are probably much better off being that the death was much more recent.

We are getting ready for our interview this coming Friday. We are both scared but hopeful. I just hope the protests don't shut down the Embassy. Anyway, hopefully your interview will come soon. The embassy recieved our P3 on a Friday. I emailed them on Monday to make sure they had it. They replied on Tuesday they did, and WEdnesday they sent us an email with the interview date. So hopefully you will hear something soon... and as you mentioned it would be sooner without the holiday and riots.

We didn't have any medical records. We went to the hospital with the medical papers printed from online and photos, they asked for no other information from the USEM, but I was with my husband and so perhaps it was more convincing.

Can't tell you what they usually look for, wish I knew myself.

Your evidence sounds good, alhtough I haven't passed an interview so you will have to ask others.

Don't forget that the American Citizen has to prove domicile as well.

Removing Conditions on Residency General DiscussionI-751 January filers
I won't quite make it into this group I don't think. Our conditional (2 year) permanent resident card expires on 5/1/11 so I think we can file starting the 30th of Jan. I do have a question for people here. We were planning a trip out of the US over the time which the green card will expire. My understanding is that the receipt of the I-751 gives you an automatic extension of the green card for an additional year, but are there any restrictions on travel during this time?

Just wanted to say I had the exact same experience twice in applying for the K-3. Both when I sent the 1-130 to the Chicago Lockbox and then when I sent the I-129F to the California Service Center. Both times the USPS automatically redelivered on the next working day. If you have any questions or concerns you can actually directly call the post office where the package is sitting and speak to the person in charge of that route. They can check for you and make sure that it is in that day's out going mail to the NVC.

You are correct, no notary just the translator and his statement, at least in my experience. The general rule that can be followed in thailand is that you have you have papers legalized which are used in Thailand but not for use in the U.S. including the visa process. So for example in order to register a marriage in Thailand you have to have the certification of being single from the U.S. embassy because this is used in Thailand it must be legalized. That rule has proved true on several occasions for me and helps with all the confusion.

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC Scheduling Interview Date for April 2009
To the person trying to switch a K-3 interview to the CR-1 interview there are many posts on VJ addressing this topic. The rule is that if an embassy has your completed case from the NVC they cannot interview you for a K-3. You do not need to contact them and some times doing so results in them cancellign your K-3 interview date, according to previous posts. So as long as your NVC case shows up to the embassy before your interview date, and it should, they must interview you for the CR-1. Hopefully the situation works out in your favor.

Mommy, I was really hoping you'd get an interview. I am still hoping for you. I am behind you in the process and so the sooner your are assigned an interview the sooner I am assigned an interview- have you spoken with NVC again?

To all - there have been lots of questions as to how interviews are assigned. I recently had this explained to me by the NVC. Each Embassy sets a quota, each month. So each month every embassy tells the NVC how many interviews they can assign and when the slots are open. The NVC then fills this quota. The start the process in the second week of each month. Some embassies quotas are filled within the first day of the second week. Either because they set the quota low, or there are tons of people waiting from many months prior... this seems to be similar to the situation in Bangkok. Other embassies have higher quotas, and or less applicants so sometimes there are still open spots into the third week of the month for that Embassy.

It would be interesting to know what the quota is for each embassy. What is more infuriating is that, at least in Bangkok, more preference is assigned to K-1 visa interviews... many more are done than the quota of IR-1's so we sit here and wait. Also Bangkok's quota for April is reduced because of Songkran.

Well I hope many people get thier interivews assigned that were hoping for them and Congratulations to all those who already got an interview date.

She may fill out the I-864 even if they live in the same house. If son and mother need to combine their two incomes to qualify AND they live in the same household, that's when she files the I-864a.

The way the NVC scheduling works according to a few people I have talked to at the NVC is that each embassy sets a limit for how many interview slots the NVC can schedule. As Mommy said the Bangkok interview is pretty backed up. Mommy recently did a calculation and it was something like 15 weeks from case complete until an interview being scheduled. I have an interview scheduled for May 26th and my case was completed in March. I would assume that you guys would get either a June or July interview being approved at the begging of April. Perhaps a June because it seems like Bangkok was less backed up this month as I really didn't expect a May interview (but am very thankful for it).

As far as the expedite, I know that at this stage it is difficult. At the USCIS stage it is a bit easier, and after you have an interview assigned it would be a bit easier. It really depends on the severity and urgency of the medical problem. And who is the person with the medical problem. And why getting an interview sooner would make a difference in the medical condition, at least this is what i have understood from my reading. At this point the NVC has to schedule your interview so I would reccomend contacting the NVC but make sure you have prepared a concise, clear, well written explanation and evidence (doctor's notes, etc).

The way that it has been explained to me as I travel through the visa process is that the translation certificate is sufficient for USCIS. However anything official within Thailand needs the additional stamp from the Thai government certifying that it is a correct translation.

What I have been told about Igor's list and was true for me is that when you are less than 100 you can be approved at any time. I don't know if that varies from VSC to CSC. I did a K-3, there are not as many people on Visa Journey doing that so there is less data so I actually always looked at where I would be on the K-1 list and one day I looked and was 90 and the next day without any touches I was approved. So hopefully that helps.

According the statement that you sign a sponsor must:

1. Provide the intending immigrant any support necessary to maintain him or her at an income that is at least 125 percentof the Federal Poverty Guidelines for his or her household size.
2. Consider your income and assets available to that person, in determining whether he or she is eligible for certain Federal means-tested public benefits and also for State or local means-tested public benefits.
A. This provision does not apply to public benefits specified in section 403© of the Welfare Reform Act such as, but notlimited to, emergency Medicaid, short-term, non-cash emergency relief; services provided under the National SchoolLunch and Child Nutrition Acts; immunizations and testing and treatment for communicable diseases; and means-tested programs under the Elementary and Secondary Education Act.
3. If the co-sponsor does not provide sufficient support the immigrant can sue them for that support.
4. If they do not supply the support and end up receiving a means-tested public benefit then the government can sue you for reimbursement.

So my reading of this is that this would not mainly include means-tested public benefits. You can also call the NVC and just ask. The last few times I have called them I have gotten the nicest and most helpful people on the phone.

Calling Thailand from the states I use Mobivox. It is great for me, I can call from any phone to a local number and it is only 1.9 cents a minute without needing internet. I call from my cell, house phones, hotel phones and because they have local numbers all over the U.S. it is often a free call from even a hotel. You can find more information at www.mobivox.com and it is really user friendly.

From Thailand to the U.S. I usually use a CAT PhoneNet card. You can call free from any cell phone company so you don't need to have any baht remaining on your phone to use it. And it is only 1 Baht a minute to the U.S. they charge per second and there are no connection fees.

First of all I think everyone is correct. Unfortunately we often learn too many lessons the hard way. The next part of the process you will know more.

About timing there is a huge range represented here on VJ, and VJ is just a small portion of all the people applying for visas. Also no case is the same, just as no two people, no two relationships are the same. Sometimes by comparing to others we just become disappointed and frustrated. My personal approach was to expect the process to take a year start to finish and be thankful for everyday which gets taken off of that year long time.

But you are correct the current processing times range from about 1-6 months and then about 1-1.5 months from the approval of your K-1 at UCSIS until the interview. Some people get approved really quickly and others much slower, only God knows why. As mentioned before make sure you have plenty of photos for your interview.

Hopefully you get a rapid approval.

Wow, I step away from the forum for a few days and there is only good news. This is great. I see that many people are moving along. Congrats on the interviews to everyone who has been recently approved, that is so exciting. Did I really read that even Hyena got an NOA2? Hopefully that is true and he will join the approvals soon. Scandal so glad to see that you hope to have her here by July 4th, actually came true.

I just started a new job, Joe is finding it difficult to adjust to being alone alot but he has found things to occupy him. We finally got the greencard in the mail yesterday so that is exciting. I know the stamp in the passport counted as a greencard but it is just much more satisfying to have the real think in hand.

Also I completely agree that health insurance should be mandatory. Working in the health field I feel especially strong about this. There is a higher chance of new arrivals getting sick from things we are used to here that thier body's have not seen. Lots of Thais have skin problems when they arrive, and unfortunately you just never know what will happen. So get your fiance a policy the temporary ones are really cheap, so there is no excuse.

You can get Durian here... at least I have found it frozen a few times. Not sure how it comes out though, is it even mushier than normal?

Our weekend plans were kind of shot with the huge storms, or "severe weather" as they choose to call it. Camping just seemed not as fun so we chickened out. We were able to get Joe a fishing license (he LOVES to fish), pole, and some bait to hopefully set him up for fishing while I am at work. Hopefully the sun comes out before our whole garden dies... too much rain.

Today we made our weekly calls home (thailand), it was great to talk to all the family as usual. At first Joe wouldn't call as he thought it would just make him miss home but I think he is starting to see it kind of just keeps him in the loop and makes him feel more connected.

Speaking of connected we bought a book before we left LOS which is called Put your best foot forward: US of America, or Gao Bai kang Na yang mun jai SAHARATAMERIGA by Mary Murray Bosrock (sorry to those who like the gov't transliteration, I don't transliterate well as I learned Thai characters before I learned to transliterate). It is in Thai and for my husband who has never been to the U.S. and didn't have a great grasp of the culture here it has been great. It really has made him feel much more confident and comfortable. I know alot of your SO's are more familiar with american ways than Joe but if they feel uncomfortable we would both really reccomend it. That along with the pic dict scott reccomended are both essential for Joe.

I am so happy to hear such great news. Congrats to the newly approved couples, Ray and Kat, Pete and Nern... you made it!

I have never heard of anyone having issues picking up thier visas. They told us to be there at a certain time and they gave us our brown envelopes 15 minutes late but as promised. And as they mentioned you get a passport, a sealed manila envelope (remember not to pack it as you have to give it at the POE before baggage claim), and a couple papers explaining things in Thai and English (for example social security numbers, and for us on a CR1 what it means to be conditional permanent resident).

It really sounds like Bangkok embassy is back to normal... hopefully it stays that way.

Hello all, there is some great news on this thread lately. I am so glad to hear that. So I guess there is perhaps a benefit to some of your interviews being delayed if in fact some nicer interviewers are on the scene. We finally have a place of our own, not too fun to rent but the best option for now. And we finally have internet, and some furniture. It has been fun to be able to set things up together rather than Joe moving into "my" house. We planted a vegetable garden and some flowers. If anyone is passing through Grand Rapids, MI we would love to visit. We went to Soc Sec Admin today because we never got the SS card. We are still waiting on the GC as well (1mo+). Joe found some gardening jobs, which he loves to garden so it is nice for him to have something to do.

UsCandual, we are not too far away in Grand Rapids and would love to have company if Thanti doesn't want to be alone.

Danny, don't know what you decided about the phone but I would say that I don't know if it would be worth it I know you can't use a phone in customs even if she were to have a problem. I don't think you can get att in Bangkok (I have looked). Being that I have been outside the U.S. for 5+ years and usually upon visits back don't have a phone I can tesitify to people being really nice about borrowing thier phone. I would say have Chada ask someone if she could use thier phone. I am sure it is easier for me to ask being that I'm American and English is my native language but I am sure people would be willing to help her out especiallly after sitting next to her on the plane forever smile.gif. And most airlines help with the re-checking of bags through the POE.

I used Mobivox for a while and loved it, it was perfect for me.

Sorry for another post. Because I packed all my documents away I won't be able to get to them for a while so I thought I would ask here. When is the social security number supposed to arrive by? What was the time period after which we could go to the office ourselves? We have been here a month and still no GC or SS# have arrived.

Danny, congratulations.... that is exciting. Perhaps there really has been a shortage of interviewers and they found people to start right away and can schedule the unscheduled interviews. I guess we can only hypothesize. You guys are totally prepared. Our interviewer wasn't interested in much but the photos. I think I killed a tree but he didn't look at anything besides our photos. So don't stress if you don't get some things printed out... just work on the photos.

Ron, we are in Michigan, we came via Chicago but we both got sick and so weren't much fun for the week we were there. Now we are freezing in the Michigan spring. We haven't made much contact with any other Thai people. My husband is satisfied with the online newspaper for now. We just dug up a plot of land to plant some vegetables at our new place. Our stuff arrives tomorrow so we will finally be moving into our own place. My poor husband we have been staying with family and friends... mostly people he didn't previously know. I think after 1 month in the US he is more than ready to have our own place.

I am so excited for all of your interviews. Another piece of advice I heard that my husband felt was relevant was that the interviewers are on a power trip. So just go with it. Vent, rebel, whatever after you have the visa in your passport. So tell your SO's to try to be patient and humble and if the interviewer is rude so be it. As daboyz said you can go in prepared for the worst and it will only be a sweet surprise if it is otherwise.

I can't wait to hear more good news.
