K-1 Fiance(e) Visa Case Filing and Progress ReportsMay 2012 Filers

Hey guys,

Thank you for all of your kind words and support. They really do mean the world to us.

She had the CAT scan yesterday and the doctors told her that originally she had 5 tumours (we thought it was 3), but 3 of them have returned. Two of them are fortunately benign, one however is cancerous.

She also appeared to have had a mini-stroke on Saturday evening, which is why she had no memory or recollition of what she did Saturday. Thankfully she did remember who I was!

Her next appointment is on Tuesday to discuss what her options are.

I will keep you guys updated. Thank you all for your support they are helping us alot.

Goodluck to those who are still waiting for their K-1 to be processed (which is most of us I beleive lol!)

Brock, I hope you have some good news soon. How is she doing? I can't imagine she feels particularly good about things at the moment, shes a lucky girl to have you though. Make sure you follow up with the expedite. work on getting things you need ready for your packet 3 and 4 if you haven't already. I'm not sure what it is exactly, yet, but when you have a moment, start looking it up. perhaps in the UK forum? The more prepared, the sooner you can get there. best of luck.

We sent our application last April and got our NOA1 last May 7
I thought I belong to April filers. :bonk: LOL

Hi and Welcome.. I just noticed you are a military fiance.. I'm assuming you are the beneficiary? where is your fiance based? and what part of the military is he? curious.. I don't notice too many military fiances really, mine is Army, based in Hawaii. :)

Well, it looks like those of us CSC won't have too much time to ponder our navels. I just saw an early April filer approved.

having said that, while I'm quietly doing an internal excited dance, I sincerely hope, for the sanity and harmony of those whose files were directed to VSC, that things will change over there soon. :star:

Hi guys,

Sorry that I havent been on for a while. A lot has happened to us recently.

We just found out that some of my fianceé tumours have come back. This time it maybe cancerous. Its just so hard not being there with her, just even to cuddle her or to hold her hand really breaks my heart.

Some good news though, in light of this she has been approved for an increase on her disability income, and the judge who ruled this said he will put my name down as her legal carer, and because of this he will forward this on to the USCIC immediantly so I can be approved.

Her CAT scan is tomorrow. I just hope she pulls it through in time for our wedding...

Hi Brock, sorry to hear about this, it can't be easy being so far away, I sincerely hope your petition is expedited immediately. hang in there. (F)

Patty, I saw the March approvals this morning! If CSC keep up their approval rate, we'll be there in no time at all!! shame about VSC though, heres hoping they pick up the pace soon for everyone else.

I'm flat out at the moment with packing up. I've managed to sell most of my furniture and think I have a buyer for my car. its exciting putting things in boxes to go into storage, the next time I'll open those boxes will be in Hawaii!! I found out that you can't send household goods/personal effects until you are in the country, they even need a copy of the visa to comply with the US laws. the storage is pretty cheap and my work will pay for it anyway. I'm supposed to be leaving for New Zealand on Tuesday. I won't move back until early December, and hopefully that will be for just 1-2 weeks, give me some time to say goodbye to my friends here.

I'm hoping to go over to Hawaii for a visit early September, sucks its so far away, but hopefully that will be the last 'visit' and next time it will be permanent!

Yeah, that's why I want to work on my own place on Sunday for a much happier reason. Saturday is going to be tough, I know it.

Wow, you much be going crazy with suddenly having to deal with packing up now.

I think staying busy is going to be the key to getting through these months of waiting....

I know.. and about a week to do it! I'm definitely going to be calling on favours from friends through this.

part of the reason I'm happy about taking the assignment in NZ is that its going to keep me busy and the time will fly. I'm also going to be living completely on expenses too so I'm going to save a ton of $$!!

K-1 Fiance(e) Visa Case Filing and Progress ReportsMay 2012 Filers
Its Saturday already here. I've had a hectic few weeks too. my fiance was in Australia with me for a week, then the day he flew out, I had to fly to New Zealand for work for 2 weeks. I found out a few days earlier that I was going, I got back from New Zealand last night and I'm told I'll probably be back in NZ in a week.. for 4-5 months. so in doing that, I pretty much have to make attempts to pack up all my things, sell what I don't want to keep, ship to Hawaii what I plan on keeping but don't need now. so much to do. my brain is fried. I'm a little overwhelmed.

so thats the start of my weekend plans, listing furniture on ebay!

so I'm doing similar to you I guess Patty, cleaning out the house, though I imagine doing yours is going to be a little emotional.

K-1 Fiance(e) Visa Case Filing and Progress ReportsMay 2012 Filers
no real thoughts on the date, it depends on when we get approved really, if its November, then I'll try for POE early December, otherwise maybe wait till January - mostly due to work and bonus time - every penny helps since I won't be working for a few months. but plans will be simple, we'll hop on a flight to Vegas for a weekend - then have a few friends and family in Hawaii for a quiet celebration later. I'd be happy to just have us two, but I have a couple of friends and my cousin insisting. hang on.. whose wedding?  really, I'm fine with obliging them as its a good excuse for them to visit.

what are your plans Pinkrlion?

Patty, organising sounds fun for you.. its nice though that his Mom is keen. :)

Patty, sorry to hear of your father's passing, but I'm glad for you that your fiance was there with you. (F)

as for time passing, its been a month, and it hasn't felt too awful, but I'm not in a huge rush anyway. as much as I want to be with him as soon as possible, I have things to sort out before I move countries, if I was to get an approval today, I still don't want to move before early December, I feel like I'm in a good position. I doubt an approval will take longer than 6 months. and basing May approval estimates on January timelines? things can rapidly change anyway, I don't think there is any need to get anxious prematurely.

I hope every one is doing ok. just be patient and enjoy the time you have living in your own country as its alllll about to change. :star:

OMG can I please come to your wedding that sounds awesome!!!!!

I would love to do something like that, but my fiancee and I are looking for a venue in her state of Tennessee (due to her disability). It's rather challeneging to find something that will cater for her and my family.

But in my mind I'm like "You know what, its our day so we will do what we want! Maybe even do a pirate vs. ninja theme wedding!" LOL coming from a family of lawyers and doctors I don't think that will do down too well!

Erm...don't mean to be stupid but what is Packet 3? Is that before or after NOA2? Who recieves it?

Oh and I know you live in NZ (land of the sheep, no offense!) but do you have any ties to Australia? If so I (L) NEIGHBOURS!!!!!

haha.. well I wanted a midget Elvis but fiance said 'no' seriously there is a midget Elvis in Vegas, but I don't know if he does weddings. I just want to have a fun day for us. I have never been a big wedding kind of girl, and hes not keen on one either.

a simple, but nice wedding in Tennessee will be lovely, a theme wedding will be fun. thats my kind of thing for sure.. having a laugh, I don't want pretty and traditional. but we are not planning on having family really. maybe my cousin and shes allll for the theme wedding. haha

packet 3 is the first lot of documentation after your NOA2 from your foreign consulate.

well just to confuse you.. I'm from New Zealand, but I live in Australia. however... I'm currently working in New Zealand. seriously. its confusing right!

haha you Brits.. you all love Neighbours!! thats filmed in Melbourne, Home and Away is Sydney, where I live.

HAHA! I knew you woulda known! Everyone knows about the delorean!!

Why not make that daydream into a reality? (Yes I used to be a salesman many years ago!) Right now I am going through with my fiancee the wedding plans (dress, rings, dudget, venue, flights, flowers, catering etc...) and i tell you that is making the time fly by!

With all the bad news right now about her health problems looking and planning for our future is the only good thing we have going. Randomly saying this but OMG i saw a user on here that got her NOA2 in 16 days!!!!!!! She sent her petition off something like November 11th 2011 and got it on the 27th!

Wish we could be that lucky lol! :hehe:

I didn't know it was called a delorean though.

we are talking about that, but both of us are not too keen on something big and fancy, we are deciding between Las Vegas (I have this thing for a wedding officiated by a fake Elvis) or Hawaii - but that was also my fiance's first wedding. It will be winter and kinder to my friends/family to come to Hawaii. I'm contemplating Vegas for us, then tell people to come to Hawaii for a celebration.

Being in NZ is helping the time pass, if I get secured in an assignment here and have to pack up my apartment in Sydney, it will also help. anyway..

I imagine the quick approval was an expedite. I doubt it will happen, but the trends I've looked at from last year is that May filers get approved alot quicker, it all depends on how fast they work on the approvals before us. estimating the 5 months will keep you sane though. don't hope for earlier, if it happens, consider it a blessing. prepare the info for Packet 3, have that plan in place. I wrote that out last night.

The Delorean is the model of car they used in the films for the time machine. It's a very nice piece of work, even if it has certain '#######' bits in the design.

ahhh so its the model of the car.. no wonder, loved the movies, never got into that much detail. :P

^^^ I actually took that photo driving down the Freeway here in So Cal a couple months ago.

anyway... so I had a great week with my fiance, he left on Sunday and what sucked intensely, was that I had to fly to New Zealand for work, 3 hours before he flew out. I feel like I was cheated out of 3 hours. Though somehow living in a hotel in a different city/country has make it less "in my face" that hes not here.

the good news is, that its almost 4 weeks since NOA1 ... heres hoping the next 17 or so.. goes just as fast!

May is over...! I saw that one May filer already got NOA2. I don't think it was an expedite either. tossed in the wrong pile perhaps. I don't mind the wait, gives me time to pay off my credit card and save money.

so how is everyone keeping themselves busy and/or preparing for the move?

I'm at home. I'm 'on the bench' for work, in other words, in between assignments and have to be available at the drop of a hat to meet with clients who want me to work with them. I get paid though. so my days are spent on ebay selling stuff I won't need and browsing this site! My office has told me its most likely going to be NZ or Singapore for my next assignment. I'm not sure how I feel about that. luckily they know I'm going through this process at the moment so will work with me to bring me back when I need to - medical/interview etc. and my fiance is here next weekend! just for a week, but it will be nice all the same. :)

I currently have an obsession about this place and checking timelines, it doesn't help that my consultancy has me 'on the bench' at the moment. Assignment start date is pending, so I'm at home.. with little to do, but wait for several big parts of my life to gain momentum. I'm making an attempt to keep the time passing with listing unwanted items on ebay, and sorting through some of the junk I own. I'll move to a friends place to live late June after my fiance has been for a visit, that will save money on rent. And the assignment I'm doing next for work is in NZ, I just don't know when exactly I go and for how long. Way too much contributing to a significant state of twitchy-ness.

I don't even have a NOA1 yet. of any form. and I'm already religious about checking timelines of those getting NOA2.

Please share your experiences with your spouses when they get here as I am curious if you are/will go through the same thing and how you handled it.

We leave Saturday morning for Vegas and then get married on Wednesday!! Keeping my fellow Marchies in my prayers!!!!

Got a busy week so bye for now!!!

Hi.. congratulations on things going well, even though it was difficult to get him there, its nice that he is there for Christmas, my fiance forgets that he needs to be a little patient, I've been here 2 days now, and even though I'm from an English speaking country and I've been here multiple times, there are some things i need help with. last night at dinner, I over tipped the waiter, seemed small, but I don't like feeling cheap, and we don't really tip in Australia, well we kind of do, but its as and when we choose, if we choose, its never expected. I need to adjust my behaviour as I'm not employed at the moment, I paid for dinner as it wasn't too expensive, and my fiance will be paying for most things, i figured I should while I still can!

anyway, i noticed you are getting married in Vegas, we are aswell in 2 weeks. I will be curious to see how quickly you get your marriage certificate back.

That is truly heart wrenching and my worst nightmare at the moment. However, trying to see the positive in this, you were not denied, and requested to reschedule for a second interview. So, it seems as though they have not made up their minds, they just have some doubts. It sucks beyond measure having to justify your relationship to these people. With all the evidence you are gathering, you are fulfilling their requests and they can hardly deny you again. I wish you the best. Just a thought, and I am sure this is a long stretch as its costly, and none of us need to spend extra money at this stage, but any chance you could go over there, to the next interview? Just might be worth it. (F)

Moscow embassy says the want originals on the I134 .. pff

I was thinking about your problem with getting documents to the embassy today, couldn't get it out of my head actually.

I would, first contact the embassy in Moscow, explain the problem, they may allow scanned/notarised copies of the documents, if not, then check if its ok to send the docs directly to the embassy since that is not 'individual to individual' or another option, go to your local USCIS office and see if they could send the docs to the embassy in Moscow on your behalf.

Best of luck!

K-1 Fiance(e) Visa Case Filing and Progress ReportsSame Day Marriage Certificate California or Nevada

just wanted to post quickly about my experience in vegas: we asked the minister at the chapel if it was possible to get the official marriage certificate the same day, or the day after. he said it was no problem, he´ll carry the paperwork to the office the same day.

so we thanked him with a little tip, walked in the recorders office the next day and held the official certificate in hand.

so anyone interested in getting married in vegas go to graceland wedding chapel. we had a really good time, they were friendly and fast und we could file AOS two days after getting married.

This is key.. ask the celebrant/Elvis or whomever to file the paperwork straight away, we asked and even tipped Elvis a hundred dollars to do so, but it took him several weeks.

IR-1 / CR-1 Spouse Visa Process & ProceduresPolice Certificate and New Zealand
I can only speak from my experience, though someone direct through NZ and applying for CR1 will answer.

Individuals cannot apply for the appropriate NZ police clearance required for the US visas, it is done through the consulate. So it is correct that the US Consulate will provide you with a form - (yours looks similar to the one Sydney gave me), which they will then obtain the clearance on your behalf.

IR-1 / CR-1 Spouse Visa Process & ProceduresGetting married in USA after getting CR1

Thank you for your reply
I haven't had an interview yet, having it on 23rd October.

If I change my passport now, what happens with the changed passport number?
All of my Visa documents, and medical check will be on previous passport number.
Will it be a problem?

As far as a civil service goes, what I heard is if you are only married in south korea technically you are a single in US.

If that were the case, then why would the USA be considering issuing you a visa based on you being married to a USC?

Itineraries don't prove you made the trip, just that you booked the trip. Photocopies of the foreign immigration stamps in the passport, and boarding passes, either one, do.

Yeah I assume, if the website says approved, then we have nothing to worry about. Just strange to get an email the next day saying we'll get an answer sometime in the next 21 days. But that's the government for you!

They could be just assuming you are not checking the website, and its an automated email they send regardless of positive or negative decision that the physical NOA has been sent. that would be my guess.

I'm sure someone more knowledgeable, or perhaps someone in the Australia forum, will comment on your first question regarding the beneficiary's criminal record and its impact at the interview.

On your second question, the requirement isn't that you have to know one another for two years. It's that you've met within the two years prior to submitting the petition and supporting materials. There are many of us who have known our future spouses for less than two years.

Petitioner has the criminal record.

Correct Shaunna?

K-1 Fiance(e) Visa Process & ProceduresScheduled Wedding before receiving K1 Visa
Have the party. send out a 'oops' note to your guests, tell them it will be a celebration but not the legal wedding. do everything as you have planned except the legal ceremony. Friends and family will understand and will probably be happier than if you cancel or reschedule. plans are made if you have guests from overseas coming. tickets probably booked too. And if all goes well for you, chances are, you could have your NOA2 by August, maybe even the interview date, that can be part of the speech, part of the toasts and even later, have the photos of your legal wedding be your thank you cards. Turn the distress into the wedding people will always remember. Get creative.

as for your fiances entry into the US, use the honesty policy, if you have your interview scheduled, you can explain to immigration the mistake you made, and that you have your interview date now, why would you run off and get married when you are so close to the end? He could have a copy of the interview letter, a copy of the cancelled or rescheduled celebrant/priest (whichever), a copy of the 'oops' message you sent to friends and family. even letters from all your guests! ask them to write a little note about it! it could work?

if you do it this way, then if by some small miracle your visa is approved before your wedding.. it wouldn't be too hard to quickly organize the legal side of things and make it a big surprise.

Good luck!!
