Apparently you can go to the U.S. to marry your fiance/e. Apply for AOS and stay there for the rest of the entire process. But you can't go on intent to stay there (probably not hard to lie about since you can just say "Hey I have all my stuff back at home, I'm renting, so I never intended on marrying. It just happened!")

I could do that myself. But I'm doing the fiance visa route... It just seems faster to go there, marry them and stay for the rest of the process (risky?)


My fiancé's 10-yr multiple indefinite tourist visa just expired.... so we decided that it's best he just waited on this process rather than try to renew that. On the tourist visa application there's a question about whether he has immediate relatives here (fiancée is considered as such) and whether he has a pending immigration application (not that the k1 is that, but still)... If he said yes to those he would probably be denied his renewal, so we're just going to have to wait. :(

In a way yes and in a way no. The paperwork still goes to NVC and NVC forwards it to the consulate, however, when i called NVC they told me they only do minimal processing for K-1 Visas and everything is supposed to get forwarded within 72 hours of input into their system. Doesn't always work out that way, but then again more often then not that is just how it is.

Thanks all.. I called USCIS today to find out if I had any options. I was told that I can send a letter to the processing center my case gets assigned to and request for it to be withdrawn. Something she said though seemed conflicting.... She said the I-129f takes a shorter time period because it doesn't have to go to the NVC, instead it goes directly to the foreign consulate. She was therefore saying that lessens the time period because of the direct transfer to the consulate. Was she giving me wrong information/

There is also a "visa fee" and Affidavit of Support Fee you are missing in your calculation. There are more fees than just the I-130 for a spousal visa. Probably still cheaper than K-1, but your calculations are missing some things.



Figured my calcs might be incomplete, but like you said, it's probably cheaper than the I-129f....

Thanks for your responses.

It appears that the I-130 is definitely the best alternative, even if I've thrown away $340 already. In the long-run, the I-129f process fees (for the I-765 and I-485) would total about $1,790 while the I-130 would be around $420 plus the $340 donation that I've already given to the government for the I-129f. Not that the financial is an issue, but overall it appears to be less headache after he arrives in the states. There would be no need to adjust status or apply for work permit.

I filed I-129f last week, but I still haven't received the text or any notification of receipt. I'm aware this may take some time. My fiance and I are discussing getting married NOW rather than waiting for him to come here on the K1 visa. Which means I would go to his country and we get married (as soon as 3 weeks from now). If we go this route, I'd then have to file the I130 form.

Has anyone ever done this? What are the implications for doing this? I want my baby here as quickly as possible! I know either one takes time, but just wanted to know which is better. Financially, it appears the I130 is less money in the long run (no need to pay for work permit application is one example).

Any help and input would be appreciated. Thanks!

The Texas Service Center is not the same thing as the Dallas Lockbox. The Lockbox will process your payment and then forward on your petition and supporting materials to the appropriate Service Center -- as already noted, either California or Vermont. Whether you send it to the PO Box or via FedEx/UPS to the street address, it's going to the same place.

If you file a petition for the K-1 Visa and get married before it's in your hand, you will essentially void the visa and will have to start over again with the IR-1/CR-1 visa process. The K-1 is for fiancé(e)s only!


Exactly. K1 visa wouldn't be applicable anymore if you get married before. I was told this on a call recently with USCIS.

I sent my packet for my fiance off Monday. I live in Louisiana so I sent it to the Texas Service Center. He lives in the Dominican Republic. I know that he loves me but reading some of posts scare me and I am starting to second guess starting this process. Are there any success stories with true love and what should I expect?



Why did you send it to the Texas Service Center? The latest I-129F form shows that ALL applications are to be sent to the Lewisville TX lockbox, no matter where you live. At least I thought so....

Yes... You get the I-94 (with your customs form) on the flight to the US (POE). This is given to the Immigration Official at the POE and he returns the small part of the card, which is to be kept safely.

anyone out there also file the I-129F K-1 fiance visa in March? the form is edition 11/23/2010 with expiration date of 2/29/2012. I got rejected because it was an outdated form. but the website says it is still accepted.

I think this has already been addressed, but a case won't be automatically denied if the couple hasn't met in person IF "the requirement to meet your fiancé in person would violate strict and long-established customs of you or your fiancé's foreign culture or social practice or it is established that the requirement to personally meet your fiancé would result in extreme hardship to you." From the I129f instructions.

Wait until you receive an email from USCIS. That email will have instructions on where to fax your evidence.

Hello everyone!
I am new here, I am from Spain and I am in the K1 process. My fiance is doing the Affidavit of Support form I-134 but he is not making the money that shows the HHS Poverty Gidelines.
Could he has a co-sponsor? I have read in an old post that only one person can be sponsor with the form I-134 but I am not sure about that. Could his father be my sponsor instead of him? or his co-sponsor?
What will they need to show (papers)?

Please help me, I am very worried about this.

Yes, he can have a co-sponsor and he'll need the last 3 years of tax returns of the person filing the affidavit of support.

I just read a post that recommended sending additional evidence of relationship with your 129F to USCIS so that it gets sent along to the embassy and they have the evidence in hand as they begin to review the other paperwork. I submitted a couple of photos of us together with my original application, but I've been back to visit since and have a whole photo album now. Has anyone done this? Recommended/not recommended? Thanks in advance for your help.


I'm considering sending photos to USCIS because I only sent the required 2 passport type photos with my I129f application. I sent no photos of us together at all - I actually forgot to put them in the package. I also sent copies of my entire passport with stamps, boarding passes, rent-a-car receipt showing his address, plus the other evidence of qualifications.. After reading VJ though and seeing that everyone sent photos, I'm now prepared to send some photos with a cover letter to Vermont. The photos will be ones that were taken before the application was submitted. I have a lot more photos taken after the application as well, but figure they don't need those at this point...will keep them for the Embassy appointment. Whether or not it makes it to our file, so be it, but I'm still planning to send it this week.

I think K1 petitions are sent to NVC, but it doesn't stay there long because the actual visas are issued at the consulate. For CR1/IR1 visas I believe those are issued at NVC, which is the reason those stay there longer. Plus some other processing reasons...

Nothing is wrong with that, but if you apply, most applications need your social security number and most ask the question about being legally able to work in the US at the time of application. At this point in time, you're not legal and you would therefore be dishonest. Just keep that in mind. Also keep in mind that the K1 visa isn't guaranteed until you have it in hand. So many different things can happen....like not getting approved or bring stuck in AP or whatever.

I think he should send an expedite request to the Consulate because this is an emergency. I'm sorry if others do not feel that way. I'm sure he would like the closest person to him with him at home while he recuperates. It doesn't hurt to request it. He would probably need to include proof from the hospital, etc. So sorry this happened and hope he gets better soon. Whether or not you'll get through with a non-immigrant visa, no-one knows unless you try. Just be truthful in your application. Good luck.

The screening process for K1's is no easier than it is for CR1's. The only substantial difference between the two is that a CR1 has more processing at the NVC stage, while a K1 has to go through adjustment of status after coming to the US. For my wife, that meant TWO interviews - one to get the visa, and another one to get the green card. She was screened by the consulate for the first interview, and screened by USCIS for the second. I don't see how that's easy compared to a CR1.
