I called Dr. Seiden's office a couple of weeks ago and asked what I needed to set up the medical appointment. They said just the case number. So, I called back today with the case number. She asked which visa we were applying for. I told her. She got dh's info and asked if she could call me back. She called back about 2 minutes later and said that they can't do the medical until we get the interview date. She said she just called Immigration and they told her not to do the medical yet, until the date is set.

What is up with that?? I thought some of you were able to get your medical before your appt. was set. I know it's no rush and we have time. I just figured it was one more thing we could get out of the way.

I'm so excited! The lady from the courthouse called yesterday and said she had our info ready! I am so grateful that she stepped up for us and got it done. She must have put us at the front of the pack, because she got it done in 2 days. biggrin.gif So, we're going Friday morning to pick it up. I'll post as soon as I get it!

You guys have no idea how much the support means! I was telling dh about you all and had him read some of the posts. I told him about links that have been posted. He said "wow, these people are awesome!" So, thank you to all of you who are helping me try to figure all of this out and for just the support. It really means a lot.

trailmix-As always, great advice! Thanks! I actually faxed the courthouse yesterday about getting his court records. She told me it would be 6-8 weeks ohmy.gif I told her the situation and asked her if she could have them done sooner. She said she would definitely do what she could. Now I guess the big thing is finding out if we need a waiver. We're going to start making some phone calls to check about that.

IR5-Thank you so much for the encouraging words!! And thanks for all of those contact numbers. Is that where I would call to find Immigration lawyers? Or do I need to look elsewhere for that?

And if we do find out he needs a waiver (which I'm soooooo hoping and praying isn't the case) do they do that right there at the interview? I know that's when we'd turn it in, but does it take more processing before we'd find out? Or would they tell us right there if it was approved?

I just feel like crying sad.gif This is all so confusing to me! I don't understand all the police/law talk. I just can't seem to wrap my mind around it all. I'm getting my husband to look over these posts in hopes that maybe he can get idea of what needs to happen.

I am so frustrated that we are in this situation in the first place. I know dh wasn't the perfect teenager and he did his fair share of stuff, but he also got into some trouble that wasn't all his fault. Ugh!

As far as the digital fingerprinting. I did call the Commissionaries a couple of weeks ago and talked to a guy there. He said that once it left his hands, it was still the wait time that the RCMP said. He didn't make much sense to me. I kinda wish now we would have just done it and not listened to him. We thought we'd still have to wait the same amount of time.

We sent off his fingerprints on August 20, so it's been about 50 days. Would it be worth it to go through Commissionairies even now? Can we even do that since we've already sent off the fingerprints? Will it mess anything up to do it twice like that? Also, does anyone know the charge for digital fingerprinting?

IR5-Yeah, dh said that it was a couple of security guards. He said they hassled him and his buddies every day after school. There was a lady, whom he told about the beer bottle. That was the threats charge. And then a man, whose hand held radio antennae he flicked. That was the assault charge. I'm going to call tomorrow about getting the court records and seeing if we can get this all figured out.

Ok, we know dh has a record, so we sent his fingerprints off to Ottawa several weeks ago. We wanted to go ahead and get the court papers, but dh couldn't remember the dates and the lady at the court said she needed them to pull it up.

So, we figured we would get a nation wide name check done and see what it would pull up. Even if it was just to get the dates so that we can get court papers while we are waiting for the criminal record check.

Well, it took a week, but we got the nation wide one back from our local police station. It actually shows what charges he had. So, I'm now wondering why this one won't do for Immigration? What makes the criminal record check (fingerprint version) different?

Oh, and will these charges be a problem with Immigration? And will we still need court papers if this says what the sentence was?

I'll post exactly what we got from them, with personal info blotted out of course. Is it possible to use this one for Immigration or not? I would love to be able to send back our DS 230 and checklist.

Only if you have a criminal record. Then you'd need to get the fingerprint version done and send them off to the RCMP.

CanadaI am SO upset!
I emailed the RCMP about the status of our application for the criminal record check. They finally emailed me back today.

We sent it on Aug. 19, they received it on Aug. 20th. BUT, it was not entered into their system until Sept 25!! WHY??? Why would they wait over a month to enter it?? That is crazy and I'm fuming about it! I just don't get it. Has anyone else had this happen? Is this normal?

If you are referring to vanee and misa talking about scanning them, I think they were saying that they had professional passport photos taken and then scanned those.

If you actually take the picture yourself, you have to be really careful. There are specific guidelines to follow. Personally, I wouldn't trust myself taking my own passport photo-type pic.

And if I totally misunderstood and this isn't what you were asking, then just disregard. wink.gif

I called a couple of weeks ago to schedule dh's appointment and they wouldn't give us one without our interview date mad.gif Not even with our case #. Many people here said to call back. I just haven't yet. But wondering if they gave you a hard time and what was said.

IR5-Is what dh has considered moral turpitude? Or is that what we're trying to figure out? I just don't get all this termanology! huh.gif If it is considered mt, then we mark that on the ds230 right? Will they even look past that when we send it in? Or would the waiver be sent in with that? This just gets more and more involved!

And IR5-You were right on as far as the crown decided to proceed with indictment. Dh said that she was trying to get him sentenced more than what he got. He said the judge at Superior court actually scolded the crown at the hearing (or whatever it's called.) The judge asked her why she brought his case to that court, that it should have been at the provencial court. The judge told her she was wasting his time as well as the courts time. Then he gave the 12 mo. probation sentence.

I dunno, all of this is so confusing to me. Thank you all for being here for me! It really helps to know that I'm not alone and have support!

trailmix-Thanks for reminding me that we WILL get through this! smile.gif We were just really hoping it would be over much sooner than later. It is SO hard being up here with no family. I so desperately want to be back in the states so I can be around my family. I miss them so much! And now that we have kids, it makes it even harder. They don't have any family up here to visit or to visit them and it's just so sad. My daughter (3 yrs) always talks about her nana and wants to talk to her all the time. She wants to see her so bad and it is just so sad to me to know that we still have to wait a bit.

Ok, so what EXACTLY do I need to ask for when I contact the court again, since she obviously either misunderstood me or totally doesn't know what she's doing?

As for the waiver, we just fill that out and then take it with us to Montreal just in case? And is it up to the officer we talk to, to decide? Or is it already decided depending on the charge?

Ok, my name...daisy, because it's my favorite flower, and lynn, because it's my middle name. Real name is Tammy. I'm the USC, dh the Canadian.

I met dh online in a Christian chatroom in Sept. 2001. We chatted every day online and occasionally over the phone. By December, we were talking marriage. My mom and I drove up to meet him (I lived in NC) in person for the first time in April 2002. He proposed to me. He and his family drove down to see me in May 2002. Then we were married in NC in June 2002. It was a whirlwind! I moved up here to Ontario as soon as we married.

I started Immigration up here and got my Permanent Residency in Feb. 2004. We had our first child in June 2004 and have since had 2 more kids. They are 3 yrs, 21 months, and 3.5 months.

All of my family is still in NC and Virginia, thus the reason we are moving back. Dh isn't close to his dad or sister, who live 30 minutes away. His mom died a couple of years ago and his brother is in Alabama. So, there's really no reason for us to stay here.

We are filing for an IR-1 through DFC. We received our packet 3 a week or so ago and are just waiting for dh's police check in order to send it back. I can't wait to have it all over and be back around family again! It is so hard being up here with no family and not much in the way of friends. I stay at home with the kids and some days I just want a visitor! It's so hard some days sad.gif

We finally got the police record back (fingerprint version, so of course it took awhile!) Annoying things is that it said EXACTLY the same thing that the local police cert. did. Why is it that we needed the fingerprint version anyway? mad.gif

I'm getting ready to send in packet 3 but have a couple of last minute questions. I'm sure I've asked some of these before. I've tried to go back and reread some of the posts but there was conflicting advice on some of them. So, I just wanted some fresh advise before I send this in.

DS230 #30b CMT-What do I check? Dh was charged with assault and uttering threats. There was suspended sentence and probation 1 year for each charge. I am afraid if I check 'yes' that they won't look any further and we won't be granted an interview. But if I check 'no' and they decide it was a CMT, will they say we lied? Or will they just think we didn't think it would be considered that? Can we leave it blank or is that bad too?

#33b- Consent to Disclosure-Do I check 'yes' here?

On the back of the checklist, under Applicant's Statement, It says, "I intend to apply:

-alone
-together with my spouse
-together with my spouse and the following minor children

For some reason, when I first filled this out (months ago) I thought it meant who would be going with dh to the interview. But since then I've realized that it just means who is applying for the visa. But I already checked the 3rd option. Can I cross all of that out and initial it? How do I correct that?

I think that's it. I am SO excited to finally get this packet 3 sent back in!!!

So, we thought we'd have to wait until he got his visa and then really look for a job. Can he travel down for an interview even while he has his visa, without moving there yet? How does that work?

As far as I can remember, we had a certified photocopy of his birth certificate and copies of his tax returns - so you should be fine my jittery friend wink.gif
