That's what we got on our NOA2 letter. Ours got approved on the 8th August and we called the NVC 5th September and they were able to give us the case number. I, like you was confused about the NVC thing too as the letter stated nothing about being sent there. Luckily someone here helped me out and I got my fiancé to call them. I guess give them a call at the end of each week to see if they can give you the case number.

Congrats though, at least it's on it's way!!

Through which service center was your case processed? From what I'm seeing with the timelines here on VJ, not one approved case from CSC in the month of Aug has been forwarded to NVC. Other customers, with dates even after our approval but processed through other service centers have already been received at the embassy.

Hello everyone,

 

I received NOA2 approving of my I-129F petition from CSC in only 41 days, approved on 08/22/13. However, after being told by my USCIS status to follow the instruction on the notice I am confused. It states:

 

"The above petition has been approved, and forwarded to the listed consulate. Please contact the consulate with any questions about visa issuance, or if you..."

 

It makes no mention of NVC as all of the sample NOA2 online have shown and as I was expecting from the visa journey flow chart. Has anyone else seen this status and figured out what happens next? I'm calling NVC everyday, sometimes twice and they just say 8 weeks. When I call USCIS customer service they give me the usual line about 'automatically' forwarding to NVC but that they don't track the shipment?

Hi all,

So we sent our RFE reply last April 15, 2013. On April 22, we received an email from USCIS , checked our status and it says "RFE Response Review"..The next day we checked it, it was back to "Initial Review"..
Is this normal? Or should i start to worry again. Our case has been long overdue before the RFE and i don't know how to handle another delay..

Any input is much appreciated..


Through the initial process for us, the Initial Review was showing (Except for the RFE Time) all the way until we went to the interview. It seems that the website status is not always accurate. I would not worry yet.

Huh? Op i think you got it wrong. Read the replies carefully.. She can file for citizenship after about 3years from the time her ir visa was activated. If she is in the us for 17 months.. She has 18 more months before she can file for citizenship. But she can be outside the country as long 18 months is spend in usa

Out of 3 years she was physically in USA for 23 months, she was never question why she?s out of the country a lot

I?m only sharing you her experience

Before she travel to Manila my wife filed for her N-400 and approximately 7 or 8 weeks, I received a letter and date for her interview, she came back for interview and traveled back to Manila, then 4 weeks later I receive a letter stating the date of her oath taking

During the interview she was asked 7 question all related to either laws or history of the US and was given 2 English words that she need to write a sentence

You only need to be in the US for at least 18 months and the rest you can be in Manila or anywhere else

Note: you cannot be absent for more than a year

i.e., you can go to Manila for 3 months then back to USA and again you can be out of the country again, but make sure you need to be physically in USA for at least 18 months to be eligible for Naturalization

An applicant may overcome the presumption of loss of his or her continuity of residence by providing evidence to establish that the applicant did not disrupt his or her residence. The evidence may include, but is not limited to, documentation that during the absence:[11]

 

  • The applicant did not terminate his or her employment in the United States or obtain employment while abroad.

  • The applicant?s immediate family remained in the United States.

  • The applicant retained full access to his or her United States abode

 

Even if you are absent for 6 months it will not affect you application if you have good reason to be away for 6 months 

I know because my wife did it, she was gone for 9 months, however she provided the following upon returned

Her current credit card/s statement

Proof of joint ownership of the house

Her car registration

Her checking account

You could be out of the country; however you need to be back when you receive a letter from USCIS

i.e., interview appointment letter or any document/s pertaining to your application, on the other hand when you received your interview appointment letter, you can write to them and request for another interview date

There?s no such thing 6 months rule, however you cannot be out for more than 1 year

Your best bet, read the N-400 instruction

if you want to fly to HKG-SFO on 18, 19, 20, you should be ok

 

even if your non-rev but you are flying your own airline with 24 years seniority, I can almost guarantee you will be on the flight, I only been flying for 6 years and do not have much seniority, fly to Manila 6, 7 times a year not once I missed a flight, although sometimes I need to be at JS

 

a lot of employee either took their retirement or buyout after UA merges with NW, I believe that was 2011

 

and yes your nor-rev, but non-rev passenger has access to check load capacity, you should be able to check your load before planning your trip

I don't think she's coming as a companion pass, I believed she is a register guest

 

I was able to take my wife with me via CX to KHG almost every 2months without issue (before we got married she's under my register guest), I'm not sure about UA agreement with CX since UA is under Star Aliance, I work for AA and CX is under One World

 

To play safe get a confirm flight from MNL-HKG, I'm 100% sure your fiance can get you on UA easily,

 

MNL-HKG to US mainland is my regular route via CX I hardly take UA since they still use the old 747-400 and they won't allow me to JS 

 

P.S. if HKG route doesn't work, try MNL to GUM to HNL to either SFO or IAH via UA, this is 100% free with possible upgrade to first class

my fiance works with an airline company so he enrolled me under his flying benefits, thus we don't need to purchase a plane ticket going to the US, hopefully at the end of Oct when he's back to get me. however, we are planning to fly from DMIA Clark, Angeles going to Hong Kong for the main reasons that it will be hard for us to get a seat if we are flying from NAIA since we are chance passengers and Clark is just 30mins away from my place. we just have to purchase Air Asia tickets for that trip. and from Hong Kong, we will board a trip of United Airlines going to SFO as my POE. my question is, won't there be any problem if i won't be flying from NAIA? do you think the flight plan will be fine as long as i have all my docs, CFO stickers and paid any necessary tax/ fee at DMIA airport? i know we need to pay a tax fee at the airport before the departure. i just want to make sure i won't have any hassles at the airport in going out of the country. TIA

I'm assuming your spouse work for UA, I believed UA has agreement with CX, you can fly out from NAIA via CX to HKG

I believe UA leaves 11am so you need the first fly out from NAIA, you can also try MNL-GUM-HNL- SFO or IAH via UA

This is low peak season, you and your spouse should be able to get out there easily, flight are good until last week of October for non-rev 

Another thing when I pick-up my wife and since we are holding U.S. issue ticket I didn't have to pay travel tax, but I did paid for terminal fee

I may be wrong on travel tax to play safe bring 1700pesos

A divorce obtained by a Filipino in another country, like the USA or Japan for example, is not recognized here in the Philippines. In several decisions, our Supreme Court has ruled that a Filipino who obtains a divorce abroad and gets married here again, is liable for bigamy.

[1] People v. Schneckenburger: The Supreme Court held that the accused, who secured a foreign divorce and later remarried in the Philippines (believing that the foreign divorce was valid), is liable for bigamy.

[2] People v. Bitdu: The Court carefully distinguished between a mistake of fact from a mistake of law. A mistake of fact could be a basis for the defense of good faith in a bigamy case. On the other hand, a mistake of law does not excuse a person, even a lay person, from liability. In this case, the accused had obtained a divorce under Mohammedan custom. The Court held that even if the accused honestly believed she was not committing any violation of the law in contracting her second marriage, and that she had no criminal intent, these did not justify her act.

The Court also ruled that everyone is presumed to know the law. The lack of knowledge that the act constitutes a violation of the law does not exempt a person from the consequences.

I like the idea about purchasing a one way ticket.   It just makes me a bit nervous if they ask for the return ticket.

 

I'd like to believe they would let you in with the VISA excuse.  If the don't can you just buy a ticket?

he is 8 years when he travel to Philippines

 

just because one of your parent is Filipino citizen, yes the child is Filipino you still need to do paper work, i.e., registering your child to either Philippine embassy or NSO if you are in Philippines

 

I didn't any of those procedure and the child is already 8 years old when he went to Philippines

 

The only reason I applied for him to be recognize is because we cannot transfer the property little of his grandparent due to he is USC
