An overstay of less than 180 days should not effect the K-1 petition. Also, if she was denied entry "without prejudice" as in - they simply suspected her of immigrant intent, or, they thought she had been here too long in a short amount of time and denied entry - but NOT because of misrepresentation, then the denial of entry should also not affect her K-1 petition.

Would it be a good subject to chat with him about the I693s again? There is this rumor going around that there's been a recently awarded contract and that the new people opening the AOS packages aren't trained very well in handling the K visa packets - particularly, they don't seem to be marrying up our new filings with our POE packets. Generating a lot of RFEs, even if people did things exactly right. (See thread in AOS forum: http://www.visajourn...owtopic=241825)

I know VSC doesn't really process those, so I understand he doesn't have any control, and maybe you'll decide not to bring it up, but I'd be curious if it is a known issue that's being fixed, or could he nudge someone...?

Yes, people from Visa Waiver countries usually tend to visit on the VWP even during the K1 process. I have heard less encouraging results for countries where a tourist visa is required. You are more than welcome to try, if you are willing to loose the money (generally around $131) you spend on applying for a tourist visa.

Yes, even if you have a visa in your passport, you may still be denied at POE if you do not convince the officer that you will return. The visa merely gives you permission to board a conveyance and present yourself to a border official. It does not guarantee that you can get in.

Each couple must individually assess the cost of the airfare and other things and determine if it is an amount that their finances can safely absorb if they are denied at PoE.

My opinion is that you should be honest. I have read that they cannot see any pending visa petitions in their computer.

Our experience (and I have read the experiences of others which concur) is that if you show your NOA1 (this shows that you DO know the legal process AND are following it) and have a RETURN TICKET (with itinerary to show that), people frequently don't have many problems, even if they say the word "fiance"

Other things which are helpful are letters from your employer stating that you are merely on vacation and are expected back by a certain date (should match the date on your RETURN TICKET), lease, etc.

Nik came through Atlanta from Gatwick this afternoon. He had more than just the run of the mill experience through immigration (but he got through, YAY!) (Nik->Seems normal to me though. I guess I must learn to stop mumbling nervously, and make more eye contact.)

So, he got to the podium and handed over his passport and boarding pass for transferring flight to Phoenix (customs form, I-94, etc).

The usual questions followed:
"Business or Pleasure?"
'Pleasure'
"How many days are you staying?"
Nik says he gave a 'shifty' sort of answer (Two weeks "and a bit" and counting days wasn't quickly calculated. I.e. not though to count exact number of days previously).
"Who are you going to see?"
'A friend'
"What do you do? What does she do?"
'IT, she's an engineer, mechanical'
"How did you meet?"
'On the internet'
How much cash are you carrying?
Zero
And support yourself how?
Credit Card for expenses
"Here are your documents, I'm sending you in for an interview...follow the blue line, through the double doors"

The doors were a little confusing, and there was a staff member who never looks up was relatively unhelpful...

2 other guys were in there - 1 just from the row in front of him was there. Also, a Dutch lady turned up as well. The other guy was a full time student studying for his PhD ("What are you studying?" "How long are you staying?" etc)

The officer greeted him pleasantly, "How are you?" etc.
"Who are you going to see?"
'My fiance Heather xxxx' (in full disclosure mode now)
"Is this the person you came to see in March 2008?"
'Yes'
"How long did you stay then?"
'88 days - 90 days'
"Why did you stay so long?"
'To spend time with her'
"How long are you staying this time? Where is your itinerary?"
Did not have it printed out - Printer ink issues - At this point the officer was distracted, and Nik remembered he'd written it all down

He pulled the paper out of his bag, and waved it triumphantly, also explaining that it could all be looked up online! Of course, on the back of the handwritten itinerary was the Hawaiian itinerary (we are going to a wedding next week).
"Oh, you're really on holiday!"
'Yes'
"You have your bag here. May I see it?"
'Yes' *bag plopped on counter*
The officer went straight for the envelope with all the proof of ties I made him bring after reading this thread!! (Nik - the officer's eyes lit up as soon as he found it")
'Ah, thats in case you asked me to establish 'proof of ties'
Front of envelope has his boss's boss's name on it. First page is his letter of approval of leave from XX date to XX date. Second page: NOA1! (The officer seemed to get excited about this!) Yes, we ARE doing things properly...
"Oh, she's alright then, she's petitioned for you."
'I'm aware we can't get married now...' etc.
Then he started stamping things, and he was soon on his way!

Atlanta, March 2008:

Nik was traveling back with me, with the intent to stay with me for 87 days. He?d been laid off, and I some how convinced him that while he had no work obligations, he should come and stay with me - you know, to see if things could go anywhere.

We combined my first trip to the UK with his flight back - so we had the same UK-US itinerary. When we got to Immigration, I asked if, since we were travelling together, I could go into the non-US residents line with him. I figured this way, one or the other of us wouldn?t have to wait very long for the other to clear. We stuck together like any other travelling party, all the way up to the podium!

I handed the immigration officer my passport (A man between 35-45 - very serious/stern, but not mean. At least he spoke at a reasonable volume so no need to ask for repeat questions!!) - I imagine looking quite giddy at taking my boyfriend home with me, and was asked if this man was my husband (I think I surprised him, expecting a foreign passport when I handed him a US passport?) Well, no, he wasn?t. So, Nik was asked to go stand behind the ?next in line? line. I naturally was let in with no problems, and he indicated that I should go along towards customs while he motioned Nik forward?.

I?m not sure how much I helped things by standing impatiently (obviously) just 25 feet away. I could hear all the questions. He had the usual questions - Why are you visiting. Obviously, to visit me. How long would he be staying, 87 days (raised eyebrows). But we DID have a return ticket/itinerary with us, and there was an indication that 87 days were chosen in case of some airline problems, he could still be out within the required maximum stay. What sort of work do you do, and possibly a question or inference about what sort of work that allows 87 days in the US with one?s girlfriend!!! He answered that he helps his parents out in the shop they own. Perhaps he thought that parents at home might be good enough proof of ties more than the ?job?. Fingerprints were taken, passport was stamped, and after this short delay, ?welcome to America? There were no jokes. All business, and I don?t remember the guy ever cracking a smile!

It seemed to take forever, so maybe I can?t remember the other questions he was asked (if any - obviously not memorable), but I don?t remember any admonishments not to get married.

3 tricks:

1) ask direct questions, yes and no answer. Do not ask when, where, etc. The person answering the phone is allowed allowed to answer specific questions on the case. Most of all be polite, but ask questions such as you would in as if intrrogating someone in court. --get specific answers, do not ask for them to speculate.
is there a reuqest for RFE?
is there a note on follow up needed?
is there a note on needing more information?
Has the case been sent to NVC?
When was the last time someone looked at the case?

2) if you have a letter of expedite approval, track your case online at USCIS. You can expect a decision in your expedite case within 7 to 10 days (typically 2 to 3 days). with a letter in a couple of weeks. If there are issues, expect an RFE. From the looks of it, the case may be closed and sent to NVC, or may be completed. typically, having no information is a good thing.

typical expedites are for humanitarian reasons. Such as family members in hospital or flooding, earthquakes, natural disasters in area, or a case of civil unrest in the area. When asking for an expedite, you have to match the reason to the condition. Mismatching the request to the section of expedite asked will cause a denial.

Best of luck, at least you are moving forward.... NVC will take some time though. get ready for another wait.

NO not really. He has rental income but it does not show as his cuz the rental property is in his father's name.

So I dont think that's count.


What is his current income?

 

He is on Disability now, when will he be able to return to work?

 

He is expecting the same income as 2013, 20k/yr.

Current income is what counts, but he is just barely over the line with no prospects at improving his income. They will see the 2 kids (which he does not qualify for) and put it all together.

 

How can he expect to raise a family with that income?

 

So what's the best choice for him now?

 

So no bright possibilities that he would be approved?

 

They are thinking if she get approved, she come to US first, then work asap, get their income stabilize together then petiton for 2 kids later.

Not for me, this is for the guy I know Please suggest what to do!

 

His k1 just got approved last month. The girl has 2 kids but planning them FOLLOW-TO-JOIN later since his earning is not qualified for 4 household. His plan to bring his fiancee only. But here's the real problem that he is depressed about.

 

He is on SSDI and his earning last year 2012 doest not look promising. (TAX 2012 only $15K).

Although, his 2013 he said he is speculating to be making $20k.

He plans to delay the interview next year until he files the tax 2013 that way he can be qualified for poverty guidelines.

 

He is worried that he might not get approved because his last 2 years earnings were only around $15k.

 

Will this cause problem even tho his recent income 2013 is at least just above poverty guidelines for just his fiancee $20K.

 

What do you think guys?

Shall we go ahead and have interview now with 2012 income only $15k

or wait file 2013 tax (speculation earnings is at least $20k in 2013) first then continue the interview next year?

As far as I know, for K1 Visas, they don't accept co-sponsors.  At least that's what happened to fiancé, and now husband.  The CO, refused to take any other persons income other than mine.  They said, it is the fiancé's responsibility to support their future spouse and not anybody else.  Therefore, providing a co-sponsor is useless because they will not even look at it.  Hope this helps. Philippine Passport Name Mispelled Found out After Paying K1 Visa, What to do!

 

This is from a friend of mine who is not member here. Here's her situation.

 

She renew her passport then when to pay her K1 visa yesterday.

She tried to fill up DS-160 it says her name did not match.

So she check her Passport, turns out that her Passport Name was mispelled.

Her name is Jamille and she did not notice it until today but the Passport was printed as

Jamilee. Now she went to DFA and they told her to renew her passport is the only way to

rectify the mispelled name.

 

Here's the question:

 

Should she contact USEmbassy to report that her name on her passport which she uses to pay

k1 visa was mispelled?

 

She is afraid that she might have to pay the visa again since she paid the visa using her passport with mispelled name?

 

What should she need to do in this case?

Being he has his 2013 ITR the embassy does not care about 2012 or 2011, the embassy ONLY wants to see the most recent tax return which you stated is for 2013 at $24,500 gross income.  DO NOT bring other years of tax returns to the interview, they are not asked for, nor wanted, per the embassy instructions letter.

I think it is discriminatory for them to be asking this. Anyway, we are waiting for NOA2. We said we would be married in New York, but then also did not specifically state that it was legal in New York or provide their laws. Let's hope they are smart enough to realize it is legal in New York!  I will be SO annoyed if we get an RFE for that. 

 

 

It is rather odd for them to ask for that.  Well, as I said elsewhere, we simply noted we plan to marry in California upon arrival to the US, and didn't get an RFE for not including a copy of state law, so hopefully you should be fine!

When we filed in July, we included in our intent letter that we plan on marrying in California, but did not include any legal reference. We got our NOA2 with no RFE. That's odd that others are being asked to do so. Why can't USCIS just keep a list of states and check each letter against that?!

I just received my Noa2 and am starting to do the paperwork needed for the interview.

I have two sources of income.  One which pays 9,372 a year and the other which pays 6,907.

This totals up to 16,279 which leave me a bit short to satisfy the 125% of poverty level needed.

I have around 60,000 dollars in my bank in the USA so I wanted to use this to make up the shortfall.

It appears to be enough but then I read on Visajourney that assets perhaps are not good enough.

I found the follow quote on this site below.

 

The USCIS looks VERY CLOSELY at current income
and not just the assets.

 

Have other people found this to be true?  That is my assets might not satisfy the CO.

The embassy in Vientiane, Laos appears not to accept a joint sponsor either.

Has anyone else been granted a visa on the partial use of assets?

You are reading correctly. The issue is that when you file the I-1864 for AOS, that follows the 125% poverty guidelines. This means that many embassies choose to use the 125% guideline because it will be relevant later in the process for that visa applicant.

So, the embassies can not follow federal guidelines?  Does anyone actually know what the guidelines are at various embassies?   I am getting a bit worried about my own finances.  Where would I find the guidelines?

You will need to up your income or savings or prepare for getting a no answer.  If you can't get the financial side together now I would stop the process instead of spending all of the money for the interview.

I am presently in the same boat as you and am scrambling.

I have try to find a weekend job but no success yet. Plus my school work is very demanding. I am trying hard to find more tutoring job.

We have been approved for NOA2. I wanted to take step to prepare for the i134. I am currently a master degree student, I will graduate in May 2014. I worked at school during this year but it is not that much. Maybe around $5000 at the end of this year. But last year I collected $12,000 unemployment benefits (does that count as income too?). I have three years past income that is over the poverty guideline as well. Also, after I get out of my master degree, I can go to phd school. Which will pay me $18,000 per year for 4 years. But I wont have that letter of approval and information until Jan or Feb. So do they take future income into consideration? And the perspective that I am going for PHD degree, and afterwards it wont be hard for me to find good work at the university I am attending.

When do you have to submit the 1-134? Please help! thank you!

Thanks.  That was just what I wanted to know.

Once they've assigned you a case number, you can check the progress of your application on CEAC. That will tell you when NVC has forwarded it to your consulate so you know when to expect the Package 3 and to schedule your appointments.

I received and was told my petition was being forwarded to the NVC.  I noticed that they assign a case number but have no idea how I would find it.  And once I have it what will I do with it.  Can anyone let me know.

I recently received my NOA2 and am trying to prepare for the pending interview.  I am using a pension from a USA county government and assets to make up the difference.  

In regards to the pension is just providing pension stubs enough or do I need something else?  I see people use the term pension statement but I am unclear what that is.  Do I make the statement or do I need to get something from where I receive my pension.  If so does anyone know what that would look like?

Thank you for your response. I already have received my NOA-2, and my case is at the National Visa Center now. I have heard lawyers don't take cases this far along. I'm not worried at all about anything but the i-134. All of my family has been to Mexico, and have been close since the beginning so I have a lot of evidence. . I will start looking for a cosponsor now. I will start researching the taxes thing, because I am clueless on that. But I will make sure I file this years taxes before I go to Juarez.

File taxes this year even if your income is low. You can file no matter what your income is.

The first thing I would try to do if I were you is to find another job fast.  You will need one that pays 19,300 a year in order to ask as a sponsor.  That isn't too hard to find if you are in Phoenix.  If that doesn't work look into finding a joint sponsor.  Just make sure the consulate you are using allows one.
