Removing Conditions on Residency General Discussion	I 751 Question	v333k, thank you so much for your reply. Currently, I was adivsed that maybe she is a US Citizen and she cannot became illegal. Removing Conditions on Residency General Discussion	I 751 Question	I have two questions about the conditional permanent resident card of my daughter. Nobody from the USCIS customer service line was able to help me. We called 3 times and they transferred us to other employees and everybody gave different and dim answer. The situation is: In 2007 I came here with my daughter on K3 and K4 visas and we applied for AOS. The daughter is a biological child of my husband. He is an US citizen and we had I 130 approved - for both - me and my daughter. We applied for I 130 for my daughter because the father became US Citizen two months after she was born. That's why we were not able to obtain US Citizenship for her and had to apply for I 130. I applied for AOS and she was included in my application. In 2008 we had an interview and the IO told us that everything is o.k. and we are going to receive the cards within 3 weeks. Two weeks later we received a card for my daughter (the card was conditional), but not for me. They told us that the case is under further review and they need to check some documents about the marriage. I received the card 90 days after those of my daughter. Now, I have to file two separate I 751 and to pay the fees two times because the card of my daughter will expire before the time I am allowed to apply. Her card will expire on March 12th 2010 and I can apply not earlier than March 19th 2010. So, she cannot be included in my application because she will became “illegal” I believe that something was wrong with our process. First - why they gave her conditional card? She is a biological child and there was approved I 130 for her. What is the condition for her. She is a child of the petitioner despite the marriage. Second - if the case was under further investigation, why they granted the card to my daughter? If something was suspicious and unclear they had to postpone her approval too. Moreover, when I read USCIS guide about removing conditions, it is stated that the child has to file separate I 751 if it is approved 90 AFTER the parent. There is no situation the child to be approved BEFORE the parent. Can anybody help me where I can file a complaint and what I can do. IR-1 / CR-1 Spouse Visa Process & Procedures	Alert NVC changed processing for cuba	miriam, first of all, my comments were not dictator like. if they had been i would have said, shut your mouth, you don't have a right to vent. but since i'm not a dictator, you have a right to complain just like i have a right to criticize you. i'll state it again so that you can understand...it's not fair that the nvc changes the rules in the middle of everything without notifying anyone. however, life isn't fair and you won't get any simpathy from me for complaining that your process could take an additional few weeks when you really haven't waited as long as others have. you're upset and want to express it? good for you. i say, keep things in perspective, it could be worse, a lot worse. you could be like xuemei who has been waiting for 10 months without a NOA2 approval and without an explanation as to why there is a delay. this process is not fair, deal with it. even with this delay your case will be finished a lot faster than most so your whining is falling on deaf ears, at least mine. you are right about this...this forum was not created so that you can read what you want to "hear". this forum is great for gathering and sharing information but not everyone is going to agree with you or even sympathize with you. you may not believe this but i sincerely hope that you can get the additional documents like i did quickly and send it to the nvc so that you can keep the process moving. while it stinks that the rules have changed, you aren't going to get a "poor baby" from me for having to wait a few more days JK If it was you, we would all have to hear about how unfair it was for you. I think the person that needs to change perspective here is you buddy. Maybe she did her paperwork better than you and you ###### sucked at yours... you ever think of that? Maybe she had more proof of the validity of her relationship whereas the governement is suspecious of you... Maybe she had someone who was sitting at a deak and was in a good mood while you got the pissy one who woke up on the wrong side of the bed... The reality here is that you don't know why she was approved faster than you and why should she be any less upset than anyone would be given her circumstances? Just because you have to wait does not make it her fault... Just because you have to wait does not entitle you to look at the other cases that are process and lay your thick judgement on them because of your own selfish jealous thoughts. She still has to ache for her man like the rest of us people in here and your lack of compassion to see that just shows everyone here what a royal dumbass you are. You can sit there and look at everyone who may have had "better luck" and think "well what do they have to feel bad for, at least they aren't still waiting" or you can choose to support the people in here that are going through the same pain that you yourself should know and understand. If you don't understand that pain in one day or one year, then maybe people should be questioning why you are here. When you are upset because somthing happens regard to your case, I would support you despite if you were in a better situation than me or not. You are only showing people that you are not willing to do that for another person. If this was your wife, then you would beat the ####### out of an ####### for talking to her like you are talking to this fine lady here... if your wife was in tears because of missing any moment with you, you would see this different. You have no right to judge people based on how the government has processed their case. You have no right to judge anyone for that matter. You are only making yourself look like an idiot and if this is how you think, then I feel sorry that your wife has to put up with you. I agree with jediknight, you got married in january and you didn't even send the 130 until march. Your case will be done very soon. Your husband will be in the states in a few months. Be patient. Most Cr1/Ir1 cases take a year or more, it looks like yours will take only 5 months. Good luck and I'm not trying to sound like an a$$hole. I hope your momentum keeps up. You are the same. All of us have our waiting time and all of us have our poain and all of us have to suck it up and deal with it and all of us have good and bad. You would want support if something upsetting happened to you. You would not want discrimination because the government choose to push you through faster than anyone else and quite frankly you people make me ###### sick. I am surprised to hear such strong and ugly words by you Rings. I know that every day of waiting hurts but you don't have right to sue JK. He was waiting 5 months for petition to be approved. May be you can't imagine how he was feeling and you forgot how you were feeling before a week. It is so ugly. What you will say for my family. May be we don't have sufficient information about validity of our marriage too (we are married from a year and we have a child). The policy of USCIS is so discriminatory, cruel and inhuman. There is not difference among the feelings of people from different nationality. Really it is not fair someone to wait 5 months and other to wait 10 months without no reason. Please don't be rude. But you must be happy because your process is going so fast. For example we are waiting approx. 4 months and even our petitions are not approved. And I don't have an idea when USCIS will approve them. It is so disturbing. We are married from a year, have a baby and live divided by USCIS and our life is depending on USCIS. Hello fellow VJers, so...after telling myself to just let this whole approval process run its course without obsessively checking USCIS...today I checked...and the "Last updated" date is 06/10/2007 ...does USCIS work on Sundays?? I mean yes I want to get excited and hope they are actually processing my application...and MAYBE going to approve it inshAllah...but is it possible for them to approve it on a Sunday?? Or do you think I would hear something tomorrow?? Because I know many people get a touch...and then receive the approval notice the next day... please let me know what you think and thanks!! Well I owe some and I am going to check YES on the question they ask related to that and have also applied for a payment plan from the IRS (fingers crossed). Anyone else been in a simillar situation? You shouldnt take a chance.....the question is "Do you owe any Federal, State or Local Taxes that are overdue". That covers all taxes that you owe. You can easily be rejected if they find out. I feel bad for you and think its unethical for USCIS to cash checks without doing a preliminary investigation into basic eligibility. I would contact a lawyer for consultation only. I doubt if you just applied for an I-751 you are eligible for citizenship, however you can apply for citizenship if you meet the following conditions regardless of if you're I-751 petition is approved or not: 1) you have been a Permanent Resident for 3 years (you can apply 90 days before the 3-year mark) 2) You gained permanent residency through a US Citizen spouse 3) Your spouse has been a US citizen for 3 years or more. The State Department Processes same day passport creation/renewal etc. if you are able to prove to them it is an emergency. They generally just require a confirmed air ticket. My wife got it done from the Philadelphia office....but it takes time, she got there around 9:00am and had her passport around 3:00pm..... US Citizenship General Discussion	Interview experience at Mt. Laurel	Before I begin let me just say that I was not happy with my case going to the Mt. Laurel office instead of the Newark Office, but now let me tell you it’s way better than Newark, NJ. Less hassle getting there, less crowded and the people are wayyyy nicer. Now that that’s out of the way, my interview was at 10:45am today. I got to the USCIS office at Mt. Laurel around 10:30am and parked at the free parking within their premises less than 50ft from the main entrance door (another benefit of the Mt. Laurel office). After the security check I gave my appointment letter to the smiling receptionist (a rarity at USCIS) and before my butt even warmed the seat, my name was called out by an IO and I followed him into the back offices. After the usual oath I was asked to present my passport, green card and driver’s license. I explained that I had gone for an interview to remove conditions in June and though I was approved I have not received the GC yet. He confirmed from my file that I was approved (a relief) and then told me that not having the GC won’t be blocking this case since they had not even produced the card yet (a great relief). He then asked me a question I was actually not prepared for “What does taking the oath of citizenship mean?” I hesitated and said, “Be loyal to the USA and abide by all laws.” He said “And you will renounce all other loyalties, your loyalty to USA will come first, you will bear arms if needed.” Somehow I didn’t know they asked this question but in any case it wasn’t part of the test. I was then made to sign the last portion of the N-400 application which you’re only to sign in front of an IO. He then made me sign the photographs I sent with my application (I had not taken extra photos as people usually do). Then we moved on to the test…all 6 questions were good….then English part came later which went well also. Overall a good experience…and even though Mt. Laurel does same day oaths I am not eligible until I complete the three year Permanent residency on Sep 6th. He said I will receive the oath appointment by mail and that there’s a big oath ceremony on Sep 26th in Trenton and that I should get that (fingers crossed). He said otherwise my application is approved. So it is highly possible my dealings with USCIS will come to an end very soon at least for myself personally. US Citizenship General Discussion	N-400 June 2009	Finally got my oath letter today....set for Oct 26th....guess the only thing I'm worried about is that I never received my GC from the removal of conditions application. Guess theres not much I can do now anyway, but I am going to USCIS tomorrow to try and get my I-551 stamp renewed. Anyone have any other ideas or suggestions? I just tried getting an infopass appointment for my 10-year green card to arrive (yes I have bigger problems) and apparently it depends on where you live. When I give the zip code for the area I live in, close to Princeton, the appointment comes up for Mount Laurel. However, when I give the zip code for the area I work in, Westfield NJ, the appointment is for Newark NJ Office. Second its in Mount Laurel, NJ (who knew that even existed) and I'm not sure if they have same day oaths, not that it would matter. US Citizenship General Discussion	N-400 June 2009	wow this is great news.....things are actually moving.....Congrats to those who received their letters... I was just a little concerned though and I'm sure this applies to others, if we receive an interview notice for August and we're not eligible for Citizenship until September (3 years to complete as PR), will they delay the oath until then.
