Referring to each other as husband and wife can definitely cause problems because you are not married -- and NOt being married is one of the basic requirements of the I-129F petition for a Fiance Visa.

If the petition adjudicator believes you are already married, he can certainly deny the petition. There isn't much you can do at this point but wait and see if they send you a Request for Evidence, approve the petition or deny it.

Hello everyone,

I have a problem, on March 20, 2008, my fiance had his interview in Lagos, at which they told him his visa was approve. However, upon returning today he had to bring a copy of his son mother's death certificate and pictures of her funeral, which he did. Unfortunatelly wasn't issued his visa, but was given a letter stating.

"Dear Visa Applicant, We are returning your visa petition to the Department of Homeland Security office where it was approved with our recommendation that the petition be reviewed for possible revocation. Any futher inquires should be directed to that office. The reasons are as follows:

Evidence submitted indicated this is not a bonafide relationship and that the relationship is for immigration purpose only>'

When I call Homeland Security, this just tell me we need to wait 120 days. Has any one experience this, if so what did you have to do?


Oh yeah in 2006 we applied for a tourist visa, which was denied as well, would that have effected the K1?

One other thing the deceased child mother name is listed on the death certificate as same my fiance, however he claim they've never been married. The child mother has been deceased since 2001, but we did not list any information about her on the petition, as I saw no resaon since there's no marriage certificate in his home country.

Another thing, I only visit him once in 2006 in Lagos, because i wasn't able to fly back in 2007, due to accepting another job and relocating to a different state. May 2008 will be 3 years since we've know each other.

Any help is greatly appreicated.

Hello, i'm sorry to hear about you and your husband's problem. I'm not sure if this will help are not, but I read a post a year ago, where the couple has told he was HIV positive, he was also from Nigeria, but it turned out to be malaria parasite." Go to African Sub:Saharan and type HIV in the "enter keywords", then look for the posting by "iwantgiveup." Hopefully it will help you.

hello everyone, I need your assistance please. Here is my situation. On March 30 2008, my fiance had his interview in Lagos Nigeria, at which time he was denied his visa and the petition was returned to USCIS for revocation. On June 7 2008, I went there and we got married. On June 2 2009, we received a 797 stating the petition had been reaffirmed and forwarded to the embassy in Nigeria. We filed an I-130 on March 30, 2009,which was approved on July 22, 2009. Yesterday, I received an email inviting my now husband back to the embassy for another interview on the I-129F. My question is, should he attend the interview that's scheduled for I129F and if he does not attend will we be penalized when we go for the I-130, which we have decided to persue?

Hello everyone, my name is Diane and my fiancée is Ganiu. He’s from Lagos Nigeria. This is my first time posting this forum. I recently submitted me and my fiancée I-129F. How I have a concern after reading an earlier post, where one of the members stated she and her fiancée’ also from Nigeria referred to each other as husband and wife. She was advised to black out those words and never to refer to each other as husband and wife again. However, I had already submitted my petition before reading this.

Hopefully the Specialist that interview my fiancée will see that we referred to each other as husband/wife starting from the very first day we started chatting May 2005 and that there was no way we could have gotten married, because we did not met until June 2006, this is when we became engaged and had our engagement ceremony, NO WEDDING because I was still legally married to my estrange husband here in the states. My divorce was not final until June 18, 2007, which a copy is also included as well.

My question is has anyone else included emails and chat conversations referring to each other as husband/wife such as mine ever been denied the K1 and ask to file K3? Also, November 2006 we applied for a “Tourist Visa,” but was denied, do you think this will affect the K1 as well?

It still seem like i'm in a dream. I could not sleep last night nor could I get any work done today, I kept looking at that approval notice.

I received an email from the embassy today, stating the following:

The information regarding this petition has been uploaded to our system. At this time however, an interview date has yet to be scheduled. Once a date is scheduled, the information packets will be mailed to his Lagos address.

I will inform my fiance that he should take the I-797 and letter from NVC to the embassy this week.

We received our NOA2 approval on December 13, 2007. I received a letter from NVC stating the our petition has been forward to Lagos onn December 19, 2007. My question is how long will it take for the embassy to contact my fiance' about his packets 3 & 4. Also, can he take the approved I797 and letter from NVC to pickup those packets?

I'm a K1 filer, my fiance went to the embassy on Tuesday, January 15, 2007 with a copy of NOA2, letter from NVC and his passport. They gave him both packets 3, 4 and his interview date. Packets 3 & 4, he will take back with him on his interview date. I called the State Department as well, they told me that my fiance could not go and pick-up his packets, that we would have to be patient until they were mailed to his home address, which I found out from several people here that's wasn't true.
