I would say the touching is probably a good sign. I can't comment in ref. to FBI done or not because my cases have never been touched. The ultimate sign used to be a new fingerprint notice if the fingerprints were expired.... but it might not apply if not 18 months yet.

Suggest you start writing letters to Congressman, Senator etc. My congressman got me the official FBI Status: "Processing". Not really helpful... You could get FOIPA also to see if there is any FBI file. My FOIPA took about 60 days and there was a file: 7 pages with some portions blacked out and 7 more pages not released to me.

I thought they were processing FBI faster these days... Often the only solution when they refuse to go forward is to file WOM.

Yeah. The best plan would have been to make an infopass immediately or attempt a walk-in to the DO. (It worked for me without an appointment, you just need a good story) An IO can change your appointment and provide a handwritten new appointment sheet. Then you can go to the fingerprint facility. I got mine for the same day which was a week or 2 my scheduled time. Later that day I boarded a plane and went overseas.

You can also try to walkin to the FP Facility, but in Santa Ana they don't accept walk-ins, so it probably depends on the particular facility.

Yes, I was denied a walk-in. However, I went to the local DO (without an appointment) and an IO was able to schedule my finger prints that same day. It was a hand-written template appointment letter with the original notice stapled to it. I then went back to the finger print facility and was processed the same day.

Becoming an American Citizen, is rather unnecessary for most Canadians. However consider this. I resisted for years but then found myself in a situation where I needed it and couldn't get it for a long long time.

You never know, you may also find yourself in some situation where it would be desirable to have US citizenship. For example: A lot of jobs require it. If things don't work out with your US spouse, it would be much better to have the choice all of North America to look for a job. What if you can't find one in Canada?

You never lose your Canadian citizenship. so whats the problem? And the fun part is you can act like a double agent. Use the Canadian passport going into Canada, and the US one going into the US.

I recommend keeping the Canadian passport current. It can be handy for travelling as US citizens often get hammered with extra fees or are simply banned. Case in point: Day trip to China from Hong Kong. Canadian can get instant visa at the border. US Citizen.. forget it! Pay $300 and wait a week.

Wouldn't it be extremely unlikely to have a clear xray after having TB? I think sputum tests are likely... with an 8 week delay. (but I am no expert)

My understanding is that you should call NVC and verify that "The DS-3032 has been generated". Then do the barcode and send it in. Alternatively, you can email. See instructions. Personally, I would not trust any email process but I guess it has workd for others.... Key is that you should not send in the DS-3032 too early.

In my opinion, 6 months is too soon to get representatives involved. Its just barely out of the normal processing time. You should exhaust all avenues available to you first. Infopass, 1-800 number etc. Ombudsman (they won't help but it will show that you tried) Also be aware that representatives may have limited influence on your case. What they should be able to do however, is get a clear status of where the processing is. All this said... You have nothing to lose contacting them, so you might as well go ahead. Just don't get your hopes up too much...

In my N-400 case, my congressman was able to get me the "official" FBI name check status. It was merely a spreadsheet that said "processing". I kind of knew that already!

Do you think Fedex-ing (overnight) the DS-3032 with a bar code might be faster? or at least the same? Overnight fees are no issue for me after waiting all these years. Hard copy documents are "stonger" tham email. I tend not to trust email or automated systems after my experience wth USCIS. Both cases were data-entered once at the beginning but never touched or updated in any way. So far it seems that my NVC case is following in the same footsteps. Not in AVR yet after 9 days. (Monday will be 11) Looks like I will need to be speaking with a person. I see a timeline with NVC number the next day after USCIS. How is that possible? Please verify that any successful email of DS-3032 was done without an attorney assigned.

Also, do you think there is any link back to the USCIS system or that they get a hard copy and start from scratch? I am starting to think that my system problems at USCIS are spilling over to NVC.

USCIS is the enemy here. And I think its fair to say my cumulative anxiety is 10 fold any one who has only been waiting only 6 months. Got the Dr. records to prove it. Think about it. 2 1/2 years since getting married. 4 years since meeting. How would you like a taste of that medicine?
Just don't like to see the system bogged down by frivolous complaints... slowing down proper and real enquiries. Anxiety is normal. USCIS time/speed is not measured the way a normal person measures it. It takes a while to understand this...

Since the last few years they don't process LPR petitions until a few months before a visa is available. (actually I read that they might change this a little this year and start processing them sooner as they have some resources freed up)

You need to figure out how to get the attorney off the case records (as mentioned) so you can receive the correspondence. Maybe somone else can help with that. Regardless of attorney situation, nothing stops you from making an Infopass and checking on your own case. At least you can find out if the case was ever upgraded and if approved they can print you out a copy.

You won't get any notice about the upgrade. This is why you need to follow up. You should be able to get enough information via an Infopass to give yourself a warm-fuzzy that the upgrade did indeed happen. Ask for the history at the Infopass. If the history shows movement, then the application is likely in process. (example: application moved to I-130 Adjucation Room) It might be prudent to call the 800 number and Fax in the upgrade request again right away as getting an Infopass may take some time. (worst that can happen is that it wasn't necessary)

P.S. Note that the Fax number is always busy. Verify the fax went through.

Yes. You need to write a letter stating your intention with your tax return and fill out the appropriate forms for TIN. See irs.gov. This has worked highly in my favor since my wife has no income!

The TIN that my wife received has basically only been good for taxes. It could be used to fill in the SS section of life insurance. too - it replaces the SS. but I have been unable to get any bank account yet since she is not here to sign - and I know a brokerage account required passport with visa for her to get an account.

Filing status depends on your choice of treating your spouse as Resident Alien or Non-Resident Alien. Note you will likely have trouble adding her to a bank account in the US if she is not physically here to sign etc. The TIN should be fine for purposes listed. (but maybe you have to wait until next tax season to get the #) You have to send in the passport to get the number, plus the correct forms, plus the tax return.

Check is better for your records and in case of a dispute. However I have heard you can save a few days using a money order because in the case of a check, they wait for it to clear before moving forward.

Believe me, I would love for them to see my complaints here.. but I seriously doubt they have. I favor drafting and sending letters to officials in charge - at least someone probably reads it.

If one doesn't have a loved one in process... would you still look at this site? Most wouldn't including them. JMHO
