At the time I petition for my husband I had been inbetween jobs, which allowed me to travel to spend time iwth him. By the time the interveiw came I had made enough to sponcer him. I did not plan on the process taking us this long.

His borther here in America was our cosponcer. My husband is now here in America. We did get put on AP though for document verification and a home visit. Did the fact that his brother psoncer through up a red flag???? Possibley, but did it warrent a denial? Obviously not.

I only spent 10 days visiting my husband. Only knew him for 8 months total. He was put on ap for document verification and home visit. This could be on of the reasons for the further investigation that i am thankful for.


It plays a role, but not the primary role.
They take it into consideration with your other evidence.

What a mess. Well it does sound like you are in AP. The incorrect answer could have triggered it, but the fact that he asked the questions really fast sounded like he was going into AP to begin with. Same thing happened with my husband interview. Fast questions she didn't seem to be paying attention to the answers.

IF it is AP though usually they give them a piece of paper stating that. My husband at first said she didn't give him anything. But after further prodding he produced the answer i was looking for.

If you already have a cr1 appointment, the consulate will not accept you K3 petition.
Why is your interview scheduled so far out? Most of the time it just takes 2-3 months for an interview. Although its been a while since I trended the NIgerian interview time frame.

If you come to the contry on a K3 you cannot return to teh coutnry to do the cR1 interview.

AP is not the problem. She has accepted the sercumstances.

But taking into consideration that she has to do the time, why not take the IR or CR1 for the better visa to enter teh US with.

So she wants to know if she can requestion USCIS forward her CR1/IR1 to the embassy. But taking that into consideration she doesn't want to mess anything up.

AP is a given in Pakistan. AP is becoming more comman in Nigeria becasue of fraud cases being reported. My husband was put in AP. 2nd interview is (from experience) just a way for them to tell you if you have been approved or denied. In Pak they just call you on the phone.

he will likely get a home visit and verification of documentations. they will knock on doors and speak with neighbors, family and friends.

Just to educate some of the posters on Admin Processing in Nigeria. Her SO was put in AP. AP in Nigeria usually consist of home visits, document verification, checking of records, interviewing neighbors, family and friends to see if they know about the marriage or other marriages.

The age difference and the fact that he has children is probably what prompted the AP.

Her SO would not have been put in AP, if they said..he has kids so he must be married. If that was the case they would have denied him at the first interview.

2nd interview at the Nigerian Embassy is just to say you got the Visa or you did not get the visa unlike in other AP prominent countries where they just call you to come get your visa, because AP is complete.

My husband was put in AP. He got through the investigation, because he used his brothers address. No one are his neighbor hood knew of his past.

She is so lucky to be a God follower. She knows that only in his time.

2nd interview in Nigeria is typically just to tell you weather you are approved or denied. AP in Nigeria is for home visist and documentation verification.
Not sure how to advice. Typically with a good immigration lawyer that is farmiliar with denials.

I filed K3, but my lawyer made a mistake. What I read way bak then was that if the CR1/IRI catches up with the K3 consulate will move forward with the CR1.

The system is automatic. When nvc sent approved CR1 they automatically scheduled the appontment. But once everything is together he will fall under the same standards as the K3 interveiw. Although people used to think that the k3 standard interview was easier because he was only getting a temp until USCIs interviewed.
But your so was put in AP so he got the highest standards and there will be no additional consideration for the type of VIsa he comes on.

Asking him to come in is in responce to the AP. You do not actually get a seperate interview, because you filed a different petition. Technically they will schedule one going through the mostions, but he is the sam eperson so the same responce will happen. They will just adjust it when the give him his Visa. Make sure he has proof that you paid the fees at the NVC.

You visibly were put in AP because of medicals not being finished. You knew that going into the interview, but now you know the AP consisted of more. He was going to be put in AP whether he had his medicals or not. Has he ever applied for a student or visiting visa??? If you answer yes, call me on that one. So did my ex.

Comming in sooner could be good or bad. There is not justification either way. The home visit and neighbor interviews went well and he got the Visa or they went bad and he is denied.

You can't get confused with the 2nd interview. Even if he made it to the interview for the CR1 in Janurary without being out of AP, he could still remain in AP.

Your situation is very unique so it is difficult for people to give you advice.

I have been touched for the last two days. Last night when I called them/USCIS to find out how to remove my lawyer from my case, she/customer service rep stated that my case "could not" be worked on for another 49 days. Like it was the law or something. hhmmmm I am in the right time frame for approval, but your case is new considering they just received the petition. Seems like a lot of touching going on at the USCIS.

When I seen my case was touched on Wednesday, I had to blink because my case had not been touched since it was received. I hope you have good news.

Visa lawyer's work of fear and intimidation. As mine did, but I am not fearful or easily intimidated. They take advantage of peoples ignorance ot the process. I received all my documents back today along with a $1000 refund. I am almost done the process. My lawyer stopped talking to me after he realized i learned more from visajourney then he knew.

see if he is a member of the immigration lawyer association too. I threaten my lawyer that I would make a website telling my experience using an immigration lawyer and pay top dollar to have it show up at the top of ever search engine. I told him I would make sure that it showed up before his and tell everyone about visajourney were 1000 of people do the process themselves and faster then an attorney does.

I fired my lawyer in the middle. You have to write a letter to the USCIS to remove them from your case. I also used the change of address feature to change the lawyers address to mine. I just put his address as the old address and mine as the new. so both address were mine. this was suggest from a uscis operater.

You do not nead a lawyer unless you have a sticky case. My lawyer did the same thing to me as they did to you. they really know nothing more then many experience and seasoned VJers.

I second Chipsa's notion. You are not 100% then do not do it. The fact that you are desperate enough to post for an answer shows that you have concerns. Until those concerns are addressed whole heartedly I would not take the risk.

Are you in the same emotional state you were in when you met your husband? Looking for the same type of person to fill the same expectations? Often we are fed what we are looking for by the con person. I have been conned by a US citizen emotionally & spiritually, I can look at my state of mind and see how that happened to me. Nothing we can say here will give you 100% clarity. What if he is using you for Visa fraud? How would this effect your emotions and spirit? Is it worth a risk? These are question around you that you can answer that will help you make your decision that is in your best interest.

Visa fraud is common and people who have been duped find it is running ramped.

I could not find my NOA2 at one point. They will issue you another copy for free was my understanding. I thought there was an option to request a copy of your NOA2. That was a while ago though.
If you did nto get a copy at all, they should send you a new one without charge. Chit happens.

Sylvia, if you are in AP/AR you are not denied. This is commin your SO's country. It is just part of the process. You should not worry right now, because they are jsut verifying your SO is who he says he is and that he is not married to someone else.

My husband wanted to know hat tribe is your SO from? And what dialet of that tribe? He said that if he accept the throne he is not allowed to live anyplace other then where his tribe is. If the embassy caught wind of this, they might use this against ou in your case.

Right now things are looking good for us, my Senator has gotton involved and after much fuss and the embassy literally attempting to throw Stephen out (on Thurs, Mar 26th), he got what he wanted, an "inquiry" for another interview, he was told to return on Monday, Mar 30, 2009 for his next interview date.
