Waivers (I-601 and I-212) and Administrative Processes (221g)Which option to choose from?, I have been deported 3 months ago. Left my fiancee in US.

People responded to you yesterday. You do not qualify for a CR-1 since you are not married. K-1 you do qualify for. In either case, your visa will be denied due to deportation, etc.... it's all in your previous thread.

Sorry if i didnt explain, my fiancee is with me right now, and we are trying to figure if we should marry now (civil wedding) or she returns to US as a fiancee. the problem i have is that one lawyer says it is better to do K-1 and another CR-1.
Apparently with the K-1 all happens in the embassy or the CIS overlooking that embassy, and with CR-1 it is with USCIS in the states, and there is a chance of the whole thing taking way longer, mainly because of the jurisdiction matters. did you hear of any such thing?
thanks, i hope to make some sense smile.gif

These days CR-1 taking shorter time, but you are missing one big point which is in either case, during interview processes you will be denied for any visa because you have been deported. You might need to wait 10 years (or may be 5 years) to be eligible for any USA visa.

Asia: SouthHow to get out of long long AP
Being a USA citizen, I applied for my parents consular processing and they went to US Embassy in Islamabad. My father was put on AP (security check) and I had tried every thing from writing/calling/visiting US Embassy in ISB to contacting US senators of my states and also, my sisters contacted their states senator but nothing good come out and AP lasted more then 3 years. What I have learned is that US senators/congressman have no authority and power to do any thing except get the status of you case.
Then finally we had to hire a lawyer to file a lawsuit against USCIS director, Secretary of the dept of homeland security, Consul general of US Embassy Islamabad, & FBI director. The lawsuit was to make decision on my father visa case.
It is worthwhile to mentioned that I have been living in Pakistan for last 3 years. Couple of lawyers said that while living in Pakistan I can not file a lawsuit in USA, and they were right. Finally we came across to a good lawyer who advised that if one of my USA citizen sister who is living in states and myself can jointly file a lawsuit then it might work, as both of us were suffering not having parents in USA with us, as I had to leave my job to be with my parents in Pakistan and my sister is away from their parents. Long story short, within 90 days of lawsuit defendants has to reply as per law. With in 3 months of lawsuit, my parents got call from USA Embassy in ISB asking to submit their passports, new medical test and latest police certificate ASAP as their visa is ready. It took my parents a week to submit all this and within next week or 10 days, they got their passport with packet IV.

The moral of tell all this is that if you stuck in AP or any other unjustified delays for quite long time then the only way to get out of it is lawsuit. By filing a lawsuit, they have to either reject your visa based on some valid grounds or move your file up for fresh review. UCIS/FBI/homeland security, they do not want to go through court fight for straight forward case which has no solid grounds to reject.

Hoping by sharing my experience dealing with USA embassy in ISB might help others who are going through long delays.

National Visa Center (Dept of State)Interview date assigned: a short notice
Yes, you can scanned and email her visa interview letter. Once she get the scanned letter from you, she can setup a medical appointment. Try to keep the interview date as it is. Medical can be done in 2 hours and reports are available next day. So your wife should be okay. Scanned copy of letter are just fine. In case if someone asked, she can explain the whole story. I am sure she will be okay.

I am US citizen, married to Pakistani & we are living in Pakistan for last 3 1/2 years. I have applied I-130 at NVC. But I instead of K3, I have applied for permanent residency (IR-1) for my wife through consular processing.
I am dual citizen (Pakistan and USA) and did not have work/resident visa for Pakistan on my USA passport so I was not allowed by US Embassy in Pakistan to applied PR of wife through DCF.

Hello Friends,
Does anyone have experience for Parents Interview in islamabad, I am USC and applied for my parents, NVC have schedule visa interview on 11/18/09 at 8AM.
My father is 63Years and my mother is 56Years, please share your exerience of interview for this kind of case.
thanks

I had pretty bad experienced with my parents visa interview 4 years ago at ISB embassy. My father had to go through AP for 3 1/2 years for no reason. I had to filed a case against ISB embassy, NVC, USCIS, homeland security etc to get the case moving forward and finally we got it done successful.
Recently I had pretty good experience with ISB embassy for my wife IR-1 visa interview. Things are not that bad and you might encounter AP for you father but these days it is taking around 6 weeks to 3 months time frame for AP.

Good luck!

Just looking ahead, does the consulate in Pakistan allow the beneficiary and petitioner to interview?

It depends on CO. Normally you can get in to the Embassy and waiting area. It is not required for petitioner to be with the beneficiary at the interview. Mostly CO at ISB Embassy do not want petitioner to be with beneficiary at the interview. They might call you if they have any question which need clarification from you.

Normally you get original documents back at the end of visa interview (same day). My wife got all the original documents back after her IR-1 visa interview by the CO. Her IR-1 visa interview was successful and visa was approved without AP/AR. She got IR-1 visa on her passport in couple of days.

Hey guys, I thought I read on here recently someone wrote the whole process for the interview, like how to get on the shuttle and where we go and how early we should go n stuff like that. If you know where that is, plz note the link for me, otherwise if anyone can just let me know where exactly we go in the morning before the interview and if I (usc, wife) am allowed to attend with my husband? We are living in Islamabad so no need for a hotel or anything, we are pretty near to the embassy as well..plz let me know guys, thanks.

I have been to USA embassy at ISB several time but not for visa interview. As per my understanding:
At embassy bus service center, they start issuing tickets at 7:00am. So you can get there accordingly. You can not take cell phone, car keys with remote locks, any big bag. Once you get in the embassy building your name will be called for finger printing and then second time for interview. Bus ticket cost Rs 200/- for round trip. The new location for embassy bus service is opposite to lake view park. I am not sure if you are allowed to be with your hubby at the interview window, but I am assuming you can get in to the embassy building by showing you USA passport.

Here is someone reviewed his/her ISB embassy experience at : Link

Review Topic: IR1/CR1 Visa

we came to isl on 10 aug, for our interview on the 12th at 8am. we flew shaheen air which was surprisingly good, nice food n good service + on time. We stayed at The Residence guesthouse which is in F6/1 street 30, house #2,phone#: 051-2873218, 0300-5151569 its located 15 mins away from the DSS (diplomatic shuttle service). The place is decent n the food is AWESOME- perfect for a short business trip to isl. So on the 12th we woke up at 4am - we had arranged for a metro cab which came to pick us up at 5:10am. We reached the DSS by 5:25am and waited there till 5:45am to get inside the gates. There was hardly anybody at 5:25am except for a handful of ppl so it was an excellent time to get in first. Then the guards opened the door and we went to get the bus tickets. We were third in line. waiting there was a completeeeee pain. We had to wait from 5:45 to 6:45am as the ticket counter had not opened yet. once we got the tickets we had to deposit our mobile phones. they took our dates(khajoors) as well~

We boarded the shuttle after waiting for 5-10 mins in a queue after buying the tickets RS200 return trip. there was a security check before boarding. It was a 15 min drive to the diplomatic enclave - after getting there they put you in one of two separate lines - immigrant or non immigrant visas. The guard let the non immi ppl go first then we were let inside. We had to go thru another security check n they took our oreo cookie box at this point which pissed my husband to hell! then we went inside to the offices. the guard told us that i had to get my fingerprints. he didnt let my husband in and he was asked to wait outside for me. We reached the diplomatic enclave at 8:10am and got my finger prints done by 8:45 as the guy who takes that wasnt present earlier. that was the longest that i had to wait once i made it into the office. then me n my husband were asked to go into the consular section waiting room. its a hall like place n there are windows on two walls. one wall is reserved for non immigrant and the other wall windows were for immigrants. They called my name in only 5 mins n the guy asked me in which lang i would like to take my interview - he then had me sign DS230 part 11. i had to sit and wait for 3-4 mins then my name was called again and i had to deposit my passport & medical reports. then i waited for another 3-4 mins - my name was called again and We went to the window where there was an american lady on the other side - she asked my husband to wait in the waitng room while she asked me a few questions - we had no clue that this was the actual interview n we thought we were only asked to submit some other documents as at previous windows! so then my husband left n she asked me these questions
tell me about ur husband
where does he live in US
where does he work
when did he go to US
arranged or love marriage
how did we meet
n then she said anticlimactically - CONGRATULATIONS. your visa is approved and u will get it in around 10 days from the amex office in khi. I COULDN'T BELIEVE what she was saying since she didnt ask for anyyyy evidence whatsoever - the entire interview took all of 5-7 minutes! she handed me a pink slip on a white paper which lists the address! i went to the waiting room and told my hsuband we got aprroved, even he cdnt beleive it!
overall, it was a surpirsingly enjoyable experience for the both of us, save for the shuttle ticket wait and the initial wait outside the gate to get inside the shuttle service point. i should mention that there were some weirdooos present there!!
anywayy, we r having lotssaaa fun in isloo now! best of luck to everybody! hope all of your cases turn out the way ours did...

Hello, I'm doing a CR1 Visa, and have a question with the Police certificate.

Regarding the police certificate, I sent the ORIGINAL police cert of my wife to NVC who is going to forward it to embassy,

but on my interview letter I got, it says I need another one, does that mean I can show them a photocopy of the original I already sent or do I need to get ORIGINAL once again?

Thanks

I have also done the same for my wife CR-1, but in interview letter NVC is asking to get original police certificate. I did send one police certificate from Karachi and 2 Islamabad police certificate to NVC all three original. (one Police certificate from where I am currently living and 2 from places where I used to lived)
I am assuming that as the validity of these police certificate is only 3 months and by the interview date PC would be expired. Hence, I only need to get latest police certificate again and no need to get other police certificate from places where I used to lived before.

All,

I called Islamabad embassy and nice lady told me that PCC is valid for 12 months. What should I do? Should i get new one or not?she originally got her PCC on april 12 2010 and her interview date is July 16, 2010.
My wife was in the same situation and just before her interview PCC was expired. We got new PCC but Islamabad Embassy never asked us to showed that new PCC. So, I guess no need to get new PCC.
One more question I remembered reading FAQ from Islamabd it says "When you receive an Interview Letter, then have a Medical Exam done by one of our approved panel physicians 2 weeks prior to the interview date"
We did Medical 2 weeks before the interview
Any suggestion what should i do for two above issues?

I mean, does he need a separate Pakistani passport or would they register him on mom's passport?

If you or one of the parent is US citizen then baby can get US passport from US embassy in Pakistan. Make sure you get NICOP card from NADRA for your baby before travelling to USA on US passport.

Hello Guys and girls too.
Congratulations for those who got their visa after long or short AP. Congratulation to those who got their visa without AP. Let me tell u about me, I got the visa in 2006 right after the interview, but i just have to wait 2-3hrs in embassy to get passport. They offer me if i want to go back to karachi so they can send my passport tomorrow, i said no i would wait for couple of hrs, So after 2-3hrs wait i got my passport back with visa. I had CR1 Case.
Now it my parents turn to get visa, my parents went for interview on mid november 2008, i think 11/28/09. interview was combine for my parents, my mother got approval and CO told her that your visa is ready for print if you want but they put my father on AP. they said case is not approved yet and he has to wait for approval, they said document is complete he just have to wait for admin process that could take from min 6 weeks to up. Co said he should wait for a call and then u can submit your passpart to courier, but my mother's visa is ready for print. But my mother said she want to travel with my father so she would like to wait for her husband visa, they said OK and they handed over few papers, purple tokens etc. Now my father is waiting for call from embassy. Let me thell you his age is 62. I called couple of times DOS but they have no answer but except AP. Please share if you have any case like my father, how long it may take? Any comments is appreciated. goodluck guys.....and girls too.

My father was in some what similar situation and were in AP for more then 3 years. Yes 3 freaking years.

Hmm ok I guess I made a mistake in explaining what they gave me. They gave me a Green Sheet, plus the purple sticker stapled on to the Amex office contact info sheet. I thought everyone was referring to the purple sticker as "pinkish" :innocent: Sorry my bad.

I didnt see anyone with pink sheets on my interview day. People were either getting Green Sheets or Blue Sheets (Which said XYZ document is missing).

Did the interviewer tell your husband he's been approved or just that he has been placed on AP. The thing which is bothering me is that the lady said I'm approved and they just need to run some formalities in the system and it might take a few days (she honestly made it sound like I would get my passport back within a week). Its only when i questioned her that she said "well it might be 6 weeks to infinity".

But she did insist that I should listen to what SHE is saying and ignore what is written on the paper as I have been approved (despite the Green Sheet saying that i have been denied until AP is complete).

Btw the beneficiary is Male.

What was written on the Pink Sheet that your husband received?

PS: Thanks for the quick reply. I don't know what we would do if it wasn't for all the great people of VJ!!

After my wife's interview CO lady congrats us and told that my wife's visa had been approved and she kept my wife's passport and only gave us purple Amex slip for picking up her passport. We got call from Amex after 3 or so working days to pickup the passport with CR-1 visa.
So I guess you are going through AP but I am assuming it would be short one.

I also asked her for photographs with white background. For Poilice Certificate she went to the police station and they are asking for a letter, what letter did you guys get from NVC. I just received an email to pay $400 but havent received any email or letter for DS-230.

Also no one answered but will NVC schedule my wifes interview or ISLAMABAD

Here in Isb no one asked for any letter for PCC. Also, in Karachi I have paid Rs to get PCC in 2 days.

Normally NVC is the one who schedule the appointment. Once you get the appointment from NVC you can ask ISB embassy for early date if any opening available.

Marriage Certificate Orginal in Urdu
Marriage Certificate Original translation
Birth Certificate
Copy of Passport Biographic
Police Certificate Original

is there anything I am missing and also i see people saying over here that NVC schedules their interview i guess that is not the case for Pakistan. For us the US Embassy in Pakistan schedules it correct. And will they also send my wife a letter for Medical or does she have to go herself?

I have a question, i received an instruction sheet with the visa packet and it says i will have to bring x-rays with me to the POE.Thats sux cuz it wont fit in my laptop bag and you cant carry it in check-in luggage....i read somewhere on VJ its not required to take your x-rays to poe for k visas any idea?

I don't think it's a requirement.. just advised, 'cause you might want to give them to your physician in the states. I looked up a couple of threads, and looks like no one has been asked SHOW their x-rays and the people that tried, no one was interested in taking them. It's just a convenience thing. And they are x-rays.. haha.. you can always get them taken again by ANY doctor in the US.. how big ARE they? you could just mail them to your fiance in Cali, but that's probably expensive.. x-rays are usually given by doctors as a convenience, 'cause it's not a diagnosis or anything, and doesn't hold any conclusive medical information by itself.. smile.gif you'll be fine if you don't keep them.

Naz & Omi - Did u get your visa - I have been out of touch lately

not yet, probably middle of next week smile.gif it takes about 10 days for mail to get from Islamabad to Kabul.. bleh.. must just put the package on a camel and point it in the right direction, hope it gets there... wink.gif what about you, any news?

Thanks alot for the links ,I think i will just roll it up and try to fit it in my other carry on bag( just incase). Also , manila envelope they gave me is like 2lbs its pretty thick..... i was also wondering if i can get DL abstract online i wanna get the license rightaway. What will happen to my SSN(I already have one since i was in NY on F-1) i know it will always be the same but do i have to call social security administration?cuz obviously DMV require ssn, would i be able to use it right away or i will have to wait...not sure but i am sure i would need DL as soon as i get there.

For DL you need to take written and driving test. Search google and you might get DL links.
For SSN, you keep the old number and use it without any issue but you need to apply for replacement card which dose not say that you can work with INS permission, as your old SSN card mentioned. (Normally for F-1 student, SSN card has this note)

Hey Riz are sure i will have to take the road test as well?I called DMV in Cali and they said just bring in NYS driver's license abstract and they just want me to take written exam,i can get the license same day.I can call NYS dmv and request for the abstract but i was thinking maybe i can get it online as well.My social security card doesnt say "not valid for employement" i know if u on f-1 it would say that.

My bad, I though you do not have DL from USA. In your case you just need to go through eye test, pay fee and done. I am not sure if you even need to take written test. I used to have IL DL and when I moved to KY I got KY DL without any written test.

OMARK & MumtazG,

I am assuming you guys will have some extra baggage with you when you move from Pakistan to USA for good. What would be the best and economical way to get that extra baggage to USA? I am planning to pay some extra $$ to airline for excessive baggage and take it with me. I might be having 2 30kg (70 Ibs) each of extra suitcases.

hello all, my parents had CR-5 (immigration) interviw on August, 28th 2009. My mom got visa on spot whereas my dad was put on AP. We received call yesterday (November 12, 2009) in Pakistan from Islamabad# and no one was home. So, I called DOS and they told us yes the call was to ask for passport.

Questions: Do we just mail the passport or we have to wait for some letter from ISL or some information. How do we send the passport back and with what information. Any information will be much appreciated.

And faisal, it seems your turn is about to come soon too.

Thanks to call for contributing to this forum - very helpful. I got a lot of good pointers from here.

I am not 100% sure but passport has to go via AmEx. Just give your father passport to AmEx and they suppose to give you a receipt, which you needed later to get back passport from AmEx. Make sure to mentioned your father case number.

just curious......will we still be receiving a call from the embassy when our case is done even if they had taken the passport at interview? it just seems that people only get calls when they are required to send in their passports....was wondering whether we would still get a call from the embassy twice...once letting us know visa is ready and lastly telling us to pick it up? or will we not get any such call and have to call the embassy ourselves hoping upon every hope that someone nice picks up and lets us know?

Going by the info on our spreadsheet I'm getting the feeling that the call to submit passport comes round-about a month from the interview and the day to pick up the passport comes 15-25 days after that....looking at the most recent (given) info about CR1's or IR1's in particular, that is...for example the people before Taj's (Kami and mzj). Although what puzzles me is Taj's case (which is the one right before ours) in which it has been 1 month and 18 days so far and no call...although they did take the passport at interview....so I get tempted to assume that in the next week or two (going by the recent spreadsheet info) she should be getting a call....what do you guys think???

If you are in Islamabad, you get call from AmEx to pickup your passport with visa documents. I am not sure how does it work in other cities where they do not have AmEx.

Guys, something I forgot to ask you. The original Peshawar PCC that Ali submitted will be expired sometime next month. The CO officer didnt tell him he needed another one until Ali said something. Ali offered her a new PCC, but it was the wrong kind (ruppee paper). So she said he will just have to send in a new Peshawar PCC but she didnt say when. Do you think they wont start his AP til he sends the PCC? It's just weird cuz she didnt say anything abt it til he did so what I'm thinking is they will just ask for it before they print the visa? What if we send it now, will it find its way to his file or do u think it will get lost or something?? Thoughts?

My parents case was in AP for about 3 years and before issuing visa (in August 2009) ISB embassy called my parents and asked for new PCC but only from the current place of their resident. Once my parents submitted new PCC ISB embassy issued them visa within 10 working days.
So, I think wait for the PCC until you get call from them. But if you can easily get PCC from Peshawar then submit one now and get another PCC.

Congrats Riz,,, Is this the first time ur wife n kids will be in america? Are they excited?

Thanks!
Yes they will be first time in USA. Kids are too small to feel any excitement. Wife is some what excited but for me it is mixed feeling. I am little bit worried about getting new job in USA during these tough time, but I am confident I will find a good job in a couple of months. Good thing is that my whole extended family is already in USA.

Well, an other good news, ISB embassy working in full swing. My wife had successful IR-1 visa interview on Oct 20, 2009 and I got a call from AmEx to collect her passport with visa. Is it not so great? Within 2 working days they have printed the visa and AmEx delivered to us. WooooooooooooW!
Now, I have to decide when to quit my current job, wrap up every thing here and move back to USA. I have time till April 19th, 2010.

Riz, you had to be the ppl in front of us... you were with ur wife n two kids? They called my husband, we didnt hear it n u told him where to go?? Anyways, congrats on the visa.

Yes, that was me. I recognized you guys from your profile pictures.
I think by default all Pakistani male are going through AP, but good thing is that time frame is within 3 months. Few years back it was pretty bad and people had to wait 9 months to several years to get through AP.
I think the same CO (middle aged lady) on window 3 took your hubby & my wife's interview, right?

My wife had IR-1 visa interview this morning and it got approved without AP/AR.
Here are some details:
My wife, two kids and my self were at the diplomatic shuttle transport service center (DSTS) around 7:00am. We took the token number for issuing shuttle tickets and waited in the waiting room for about 30 min or so. We bought the bus tickets for PK RS 500 each and proceeded to the shuttle after our number had been called.
We were in the embassy around 8:00am after security checks.
I went with my wife for the interview but did not go with her to the interview window as I was taking care of my two kids in the waiting room. Also I have seen in many cases CO have asked petitioner to wait in the waiting room and not be with their spouses during interview process.
First, my wife gone through finger printing process, then turn in her passport to another window, third time they called my wife's name for medical reports and finally fourth time they called my wife for interview. CO was a middle aged lady. She turned out to be friendly and nice.
We organized all of the documents that we could think of but not a single document were asked. I also got the new Islamabad Police character certificate (PCC) as we got REF from NVC to bring new PCC on interview. Again, except medical reports not a single extra document has been asked during the interview.
As, I have been in Pakistan since 2006 with my wife and kids so I was prepared for questions regarding my USA domicile and during interview CO asked my wife if I could come to the interview window and answered few questions regarding this. which I gladly did.
CO's main concern were about our intention to move back to USA and she wanted to make sure that we are 100% positive to moving back to USA. Once I cleared that to CO, she congratulated to my wife and said you can collect your passport from American Express in Islamabad with in one to two week time frame. She gave us American Express token number for collecting my wife passport. No blue, yellow or any other form is given which mentioned AP/AR.
I am glad it went pretty well.

Thanks for all those people who answered my queries here on VJ.
