IR-1 / CR-1 Spouse Visa Process & ProceduresVisiting the UK for the first time

I would try calling the airlines to see if they can change the name on your ticket. Some airlines are willing to do this for you if you explain that you made a mistake and put the wrong name on the ticket.

Thanks so much for the advice. I called the airlie and was able to get the name changed on the confirmation....for a fee of course. I would rather pay that then be out my entire ticket price. She did confirm that I would not be able to board if I hadn't changed the name to match the passport.

Thank you to all who replied and gave their advice! ;)

Thanks for the quick responses! I booked the flight in my married name which is different then my passport name. I leave tomorrow and only hope I have no problems. If I can't get through I will be devistated. My fault though if that happens, I should have been more prepared. Oh goodness.....I hope I don't have any issues.

IR-1 / CR-1 Spouse Visa Process & ProceduresVisiting the UK for the first time
Good Afternoon everyone! I have a question and I wasn't sure where to post it so I thought I would start here.
My husband(UK citizen)and I(USC)have filed for our I-130 this month and have received our NOA1 dated March 14th, my question is, will I have any problems going through the airport once I land in Amsterdam and then in Newcastle if my passport name does not match my drivers license? I plan on bringing a certified copy of our marriage certificate just in case. Do you think that will be enough if questions arise? I also plan on brining a copy of my 3 most recent pay stubs showing that I have a job in the US and do not plan on immigrating.
Any thoughts or concerns? I would love any feedback!

Thank you so much!!

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 Question

Joint sponsor will need to make enough money to cover the immigrant(s) and their own household number.

They do not "add" their income to yours. (this could happen if they were in the same household and was a relative).

You will still need to fill out the 864 (even if you do not make the required level).

(as your joint sponsor)

The 125% guideline needs to be met for all 3 years correct?

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 Question
How does the I-864 work with a joint sponsor? Does the joint sponsor need to make the qualifing amount that I need for my household? Or does the joint sponsor just need to make the difference in what my fiances are lacking to qualify myself?
I hope this question makes sense

Thanks in advance for all the replies ! ;)

IR-1 / CR-1 Spouse Visa Process & ProceduresSupporting Evidence
[quote name='CanadaLove' timestamp='1302927131' post='4612136']
@patientlywaiting: I'm not sure if the SSN is a requirement, but he does have to be there in person to sign the account paperwork. I would talk to your bank to see the requirements they have about adding nonresident aliens.

I was able to add my husband with no SS#. I sent him the papers to sign in the mail and when he sent them back I took them to the bank. I have heard how ever of some banks not allowing you to add anyone with out a SS#. I bank with Bank of America and they have always been very helpful. My husband doesn't live her with me so instead of adding him to the lease I just changed my name on my lease to my married name. I didn't however send that in as I changed it after sending in the application. I just figured it would be something to take to the interview or if they ask for more evidence.

Thanks everyone for the quick responses. I did also send a copy of a check from a joint checking acct with my husband. I have also added him as a user on a couple of my credit cards.
I think I will be fine. I am sure you know how it feels when you start second guessing yourself :-)Didn't add him to the lease though but I did change my last name on it to my now married name. I will just be sure to have plenty more when it comes to the interview. ;-)

IR-1 / CR-1 Spouse Visa Process & ProceduresSupporting Evidence
How much evidence do you really need provide with your I-130? I sent pics, affidavats, passport copy, wedding invite, and a couple other things. But a lot of people seem to have added letters, IM chat logs, cards and emails. Are those more useful with the application or at the time of interview? Does it make it faster to add these items with the app?

Thank you !!

IR-1 / CR-1 Spouse Visa Process & Procedurespayment for I-130
Personal check or money order is best, that way you can track it if needed. It also has to be in US funds. The amount that needs to be sent in with the application is $420.00.
I personally sent in a check.

Good Luck with your journey! :D

IR-1 / CR-1 Spouse Visa Process & ProceduresI 864 Sponsorship
Can anyone tell me if they have gotten an approval for a CR1 visa by sponsoring the beneficary themselves but only being slightly over the 125% guideline.?.
On my 2010 tax return I am only over the guideline by a hundred dollars or so. My income for this year will be slightly better but only around $1000.00 over. I am hoping to get my NOA2 around the end of July. Not sure if I will be able to get a co-sponsor but haven't lost hope yet. Also I do not have any assets to use as I lease an apartment and lease my vehicle. I also do not have a savings account. Any insight is appreciated.
Thank you so much !!

IR-1 / CR-1 Spouse Visa Process & ProceduresI filed single on my tax return..
Since she doesn't live with you, you could have filed head of household as I did. It states on the IRS website that if the spouse lived out of the country or away from home for 6 months or longer you can file this way. It is also a good return as well.
Just my opinion for what its worth
(That is if you have a/any dependent(s) or other qualifying individuals.)

I was wondering how long you have to reply to an RFE. I haven't received it yet but was told today by a tier 2 rep that they mailed it out on 6/24.
Not sure what it is for either. Can I call USCIS and get that info or do I have to wait for the hard copy? I would like to be ready to send it out when it comes in the mail....try to be ahead of the game.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 - Five and a half month in waiting

Request for Evidence

Call the 800# for USCIS and let them tell you the status of your case. After that ask to speak with a tier 2 rep. The tier 2 rep has more info on your case then the general rep whom answers the call first. They only have access to what you do on the USCIS website.
Good Luck

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 - Five and a half month in waiting

I sent my I-130 on February 2 and on February 7 it was received by USCIS. And on February 14 I received the I-797 Notice of Acceptance 1 (NOA1). Since I live in New York, my case is with the Vermont Center. It was been five and a half months and I have not received anything regarding my case. I called USCIS and they told me it is still in the Initial Review, and when I asked what date are they up to in their cases load, he said May 15. I have no idea what's going on. Any ideas, suggestions, or similar stories.

When you called USCIS did you ask to speak with a tier 2 rep? That's what I did and found out they had sent me an RFE. If I wouldn't have called I would have never known as the 1st RFE was lost in the mail. They had to resend it.

IR-1 / CR-1 Spouse Visa Process & ProceduresRFE QUESTION
just wanted to update any one who went/or is going through the same RFE request as I did for the UK divorce decree.
I sent in a b/w copy of the divorce decree along with a letter stating the following:

TO WHOM IT MAY CONCERN:

Please find enclosed certified divorce decree absolute, as collected from the ( PLACE OF DIVORCE, UK) where the divorce proceedings took place.

Having checked with the clerk, I was advised that in England divorce decree’s DO NOT carry a signature, and pointed out the stamp of Her Majesty Court Services to prove that it is certified and legal. It is a one page document. It has a stamp at the top right hand side with a crown symbol in the middle with the county court name.

The clerk also pointed out the paragraph which includes the statement “it is hereby certified that the said decree was on the (INSERT DATE ON THE DECREE), made final and absolute and that the said marriage was thereby dissolved”.

Please also see at the very bottom of the page, on the right hand side of the page the document is called a D37 DECREE OF ABSOLUTE (DIVORCE)

USCIS received my response on the 20th of July and on the 29th I received my NOA2.
I will admit I was worried about not sending a color copy but looks like I did just fine with the b/w.

Thank you to everyone who has helped me along the way so far.

IR-1 / CR-1 Spouse Visa Process & ProceduresRFE QUESTION

If USCIS tier 2 won't issue another one, make an infopass appointment and ask for an extension due to not receiving RFE. You can schedule the appointment beforehand so it'll be around the time the RFE response was due.

Well it sounded like he was going to have another one sent out...I thought. But the info pass appt sounds like a good idea. I have never done that so I am not sure how to get started on it.
Thank you for your response!

IR-1 / CR-1 Spouse Visa Process & ProceduresRFE QUESTION

Based on what I read from this post reguarding the RFE.
If it was sent 6/24 you should already received it. I also think the Customer Service Rep was incorrect about 30 Days to respond or the Petition is Null and Void.
I know its a pain they won't tell you what the RFE is over the phone and you have to wait for Mail.
IF YOU HAVE'NT RECEIVED IT YET IN THE MAIL. Request that is LOST in the Mail and Not Received.
KEY NOTE: The RFE will have a Response Time for a Reply. " Carefully Open the Envelope and NOT TEAR the USPS Stamp which indicates the Delivery Date".

The tier 2 rep said that he would let the CSC know that it was never receieved and try to have them give me more time. He said I should hear something from them by 7/26.
Always just a waiting game :(

IR-1 / CR-1 Spouse Visa Process & ProceduresRFE QUESTION
I just hope I don't get denied due to the time frame. I don't see why I should considering I never received the document....but I also know that things do not work like that.
The funny thing is I wouldn't even have an idea that I received and RFE if I hadn't of called USCIS. My status online is still "initial review"

IR-1 / CR-1 Spouse Visa Process & ProceduresRFE QUESTION

CSC has been very slow due to summer vacations. So you can expect the RFE in a couple of days. To just to let you know how slowly things are moving at CSC - CSC generally takes a week to 10 days to send the approved cases to NVC but are now taking around 25 - 30 days now.

Pars, RFE means Request For Evidence - when USCIS needs additional information regarding the I-130 application, they send out a RFE calling for those details.

What about the 30 day time frame to send back what they are requesting? That is what worries me the most. I can produce what ever evidence they are looking for just not sure I can get it to them in time.

IR-1 / CR-1 Spouse Visa Process & ProceduresRFE QUESTION
Still haven't received my RFE that USCIS says they sent out on 6/24. I called today since they couldn't do anything about it until the 15 day mark. The gentleman said that he would send a service request out and I should hear from them by 7/26.(is there anyway to follow this request?) I asked how long I had to respond to the RFE and he said 30 days. I asked him how that was going to be possible since it had already been 17 (sat was the 15 day mark) and I still have to wait to receive the new one in the mail. Plus have time to get together what ever they are requesting.
USCIS said that if I don't send in what they need with in the 30 days my application would be denied.
Has anyone else ever ran into this problem? Is there anything I can do about the time frame?
Thanks everyone!!
