K-1 Fiance(e) Visa Process & ProceduresSome concerns about visiting the US again...
I don't foresee any issues arising from your impending approval. Like you, I went to visit my fiance while our application was processing, and we actually received the approval while I was visiting him in the US. The subject of my application never came up while I was clearing through immigration - the officer was more interested in the length of my stay and the reason for my visit.

Be sure to bring with you evidence that shows the proof of ties that you have with your home country (rental agreement, proof of return ticket, etc) so that you can show intent of returning at the end of your trip. The only issue that may come up to the officer is that you'll be unemployed at the time of your trip, which might raise questions about how you'll support yourself while in the US.

Keep in mind that you run the risk of being turned back, even with proof of ties to the home country. But this question comes up every week - a lot of people visit their US fiances while their application is in process, and the majority are successfully cleared through immigration with no trouble.

Good luck good.gif

K-1 Fiance(e) Visa Process & ProceduresPassport Question
QUOTE (~Laura and Nick~ @ Oct 2 2007, 02:08 PM) <{POST_SNAPBACK}>
Hi smile.gif
So just wondering..I've been down to the states like 4 times since I got my new passport in January 07 and they only stamped it once...my June 21st trip.
Will this matter when I'm photocopying the pages of my passport for evidence and I don't have stamps for those dates? I have the boarding passes from all the visits, just not the stamps in my passport pages...so I'm just wondering. unsure.gif

Sigh, why can't they stamp them every time? blink.gif

I'm going on Friday (2 days!!!!) they better stamp it!!!! devil.gif

Thanks
~Laura

Laura, it's a common occurance for us Canadians to not receive the passport stamp when we're visiting. As long as you've got the boarding passes, you're good to go. good.gif

K-1 Fiance(e) Visa Process & ProceduresAre all canadian interviews done in Montreal?
QUOTE (desert_fox @ Oct 2 2007, 03:01 PM) <{POST_SNAPBACK}>
I do believe that if you are married, that you have to go to Montreal. If you are a fiancee, then you can choose between Vancouver or Montreal.

K1s and K3s are processed in both Montreal and Vancouver. It's CR1s/IR1s that are only processed in Montreal. smile.gif

The USC doesn't need to attend the interview, but definitely has the option of doing so.

I don't foresee any issues with using your visa halfway through its validity period. Otherwise, they wouldn't offer a 6 month period for it to be used, right?

Generally most people use the 6 month period to settle their affairs and say goodbye to their loved ones, if they haven't done so already.

K-1 Fiance(e) Visa Process & ProceduresWhere do I get the receipt notice number and the A-Number as an identifier?
The Alien Registration Number (A#) will be assigned to the non-USC when the visa is filed, providing that one hasn't been issued from a previous visa. Just leave that section of the form blank if there isn't one already.

A#'s can usually be found on the NOA1s or NOA2s.

A lot of people haven't been receiving their NOA1s due to the mad sweep of people filing right before the fee increase. You can call USCIS customer service, but most likely they're going to give you the brushoff, and their telephone system is like trying to pin the tail on the donkey through a maze.

Hang tight - you'll get a response soon. good.gif

K-1 Fiance(e) Visa Process & ProceduresAlien number + NVC letter
1. Yes, the A# beside the beneficiary's name on the NOA2 is the alien registration number.
2. A copy of the NOA2 is sufficient enough for the embassy.
3. The birth certificate of your USC fiance is usually not needed for the embassy, but you can contact them to double-check. If there's no mention of it on your Packet 3 then it should be okay to do without.

I'd get them redone - that rust is really visible in the photos and you can't retouch the photos once they've been taken. If you decide to use them in your application, you will probably get an RFE.

Is the best thing to do - to wait until his divorce is final and then apply for K1 - but this could take a long time.

If i was to go there for an extended period of time - and then apply for the K1 visa - is that a better option.

As moxcamel mentioned, you can't file for the I-129F (k1 visa) until his divorce is final. You also aren't able to file for the K1 and stay throughout the entire process as you'll have to have your consulate interview in Canada. Canadians can usually stay between three and six months in the US, but it's best to bring proof of ties to the home country in case the border officer suspects that you have intent to stay permanently in the US.

I'd definitely read through the guides and see which option is better for you. Both the K1 and K3 visas take roughly the same amount of time to process, and they have their advantages and disadvantages.

Good luck! good.gif

QUOTE (China Rob @ Oct 23 2007, 11:08 PM) <{POST_SNAPBACK}>
Ok Let's stop here... the required vaccinations are not $10 or less, where did this come from.... When we were waiting for the interview date, we were required to get the following; MMR, TB, TD and Varicella, and if she is Asian then the TB test will be positive and you will have to get a chest xray and have it read. The Civil Surgeon can administer the vaccinations also. Usually at the same costs as the Health department, which is about $300 NO MATTER WHERE YOU GO. Beleive me I spent two days calling all the CS's around and the Health Department. They got you and they know it. So do your homework.

blink.gif

I'm not sure where you got the assumption that all Asians will garner positive TB results... and I don't know how you had to have a TB immunization as that's not required either.

K-1 Fiance(e) Visa Process & ProceduresVaccinations: which doctor?
Sorry, wrong phrasing. I know that K medicals don't require the vaccinations to be done at that time.

What I have heard though from the boards is that there are some panel physicians who have asked that vaccinations be dealt with prior to the POE and AOS process. I know from my experience that I was asked specifically to have proof of being vaccinated, or they would do it at the medical exam (for a fee). I'm sure that if I'd asked to defer the vaccinations until I reached the US that I would've been able to, but seeing as how it was free with my own health insurance I didn't see a reason to wait.

Moving on...

QUOTE (StoryAngel @ Oct 18 2007, 04:40 AM) <{POST_SNAPBACK}>
For the medical exam for K1 is it necessary to get the vaccinations done by the consulate doctor? That's what a legal adviser told me, because she said they want to ensure the vaccinations are done properly. However, I have health insurance and my own doctor would do these vaccinations and I could claim them on my insurance. If I go this route will this cause problems with the consulate doctor? To force us to have the shots with the consulate doctor just seems like a money-making scheme. I'd prefer to go to my own doctor but not if it's going to cause problems at my medical exam. Anyone got any experience with this?

I got booster shots beforehand with my family doctor and it wasn't a problem. I brought letters and results of blood tests to show the panel physician that I'd been vaccinated so did not require extra vaccinations. The panel physician didn't have any problem with the letters and I received a copy of my vaccination supplement for AOS. I'd check with your panel physician, but if it's possible to avoid the cost of the vaccinations I'd do it.

QUOTE (Gaby&Talbert @ Oct 18 2007, 09:51 AM) <{POST_SNAPBACK}>
K visas DO NOT REQUIRE VACCINATIONS. When you adjust status will be when your vaccinations will be required.

While that's true, panel physicians in some countries (including Canada) will require you to have the vaccinations before you enter the US.

K-1 Fiance(e) Visa Process & ProceduresCanadian police records
The RCMP can provide a Canada-wide police certificate for the time that he stayed in Canada.

If he's outside Canada, he can mail a set of fingerprints to the RCMP and they can do a background check - that can take a few months so be best to do it ASAP.

If he's in Canada right now, he can go to the local RCMP detachment and get it done there. If he doesn't have a criminal record, usually they just do a name check and it takes much faster.

We contacted USCIS and asked them about this question because I, too, had made numerous visits to the US throughout my lifetime. They told us that this question was just seeking to determine if anyone had ever overstayed a visit and that specific dates were unimportant. As a result, I entered "Numerous visits but none lasting longer than 3 weeks." The visa was approved without an RFE.

I also put the same answer down. They asked about this during the interview, but my visa was approved.

I'm probably just going to keep a copy of my entire K1 package. Call me paranoid, but I'd hate that feeling of regret in case I needed to go back to it at any point. (Kinda like when I threw away the old paystubs at one of my jobs before I moved, only to find out that I needed that for proof of documentation later on...)

If you have already submitted it, the application you have submitted will be denied and your fee is gone.

You will have to start again after you have met in person and can provide evidence of that with your new application and a new fee.

Are you sure it will be denied ..and we have to refile and repay them?...about this? do we need to confirm with usins? if yes can you give us the no.?

Provide copies of evidence that you and your fiancé(e) have personally met within the last two years; or if you have never met within the last two years, provide a detailed explanation and evidence of the extreme hardship or customary, cultural or social practices that have prohibited your meeting.

USCIS will deny your petition on the grounds that you haven't fulfilled the 2-year meeting requirement. Once you two have fulfilled that requirement, you'll have to refile again which will cost another $455.

I'm a little lost when it comes to this stuff. All I know so far is what is in my signature, that it was received by the VSC on Oct. 9, 2007 and on Oct. 17, 2007 I received the I-797C, I'm not really sure what that is, I thought I was going to receive an NOA1, sooo confused.

The I-797 you received is your NOA1. You'll get a similar I-797 as well saying "notice of approval" which is also known as the NOA2. smile.gif

QUOTE (JKD_88 @ Oct 28 2007, 06:47 PM) <{POST_SNAPBACK}>
What if she shows proof of the pending case?

Even if she shows proof of the pending case, that doesn't offer proof that she intends to go back to her home country at the end of her visit. A filed I-129F doesn't necessarily translate into a return flight home - it might in fact add more suspicion on her part than anything.

If your fiancee can't get enough solid proof to prove that she has intent to return home at the end of her trip, then it'll be a wasted plane ticket. Usually people bring proof of a return ticket home, rental agreement papers, or letters from your fiancee's employers stating that she's returning back to work at the end of her trip. Even then, that kind of proof might not be enough.

It's not impossible to visit - with a denial under her belt though, chances are that your fiancee isn't going to get in with just an impending I-129F as proof.

Black and white is fine. The only reason why you'd need 2 copies of the entire packet is so that you and your fiance can each have a copy in case of an RFE (and peace of mind!). Most often than not USCIS won't be seeing the other copies.
