K-1 Fiance(e) Visa Process & ProceduresLack of english a problem at interview?
I don't know for sure, but in their minds, and in mosts minds, I suppose they see communication as a vital part of a marriage. They'll look to see if you two can communicate, because if you can't, they might question your relationship...

I don't know for sure, but if I worked in immigration that would be my idea.

just buy her a ticket and see her to the airport...BUT learn a lesson - maybe make sure you aren't just trying to find an asian woman just to find one...if that makes sense.

Make sure you can communicate WITH JUST THE TWO OF YOU - without a transator.

That said, I am sure you are heartbrokedn and i'm sorry :( I hope everything works out. Best of luck

miranda - I am a guidance counselor, but we are on a teacher's salary scale.

Where do you teach?

Anyway I make about the same you do - and with just my husband and I in the household, we are fine...

Not sure how many you have in your household.

K-1 Fiance(e) Visa Process & Proceduresemployment
Well I have always heard 3 - but nonetheless. What was he doing BEFORE he bought the business? Was he working? He needs to prove that he can make enough to support you - 125% above the poverty line...which you can find that info somewhere on this page. He will have to show income from the last three years, or an explanation as to why there was no income for the ones before he bought the business (ie he was in school - or medically unable to work, etc etc).

There is a REALLY good guide on the affadavit of support and I recommend reading it in entirety.

They are very particular. Stewart had the wrong kind and they wouldn't take them. He had to get them re-done.

It DOES matter ... in AUstralia anyway.

K-1 Fiance(e) Visa Process & ProceduresDOES ANYONE KNOW???????
my husband had a CR-1 visa, but he needed his passport with visa, his big UNOPENED envelope, and his xrays nearby....in his carryon or something. They didn't ask for them but told him to bring them.

i, personally, would be worried. I'd want more. I would think they'd be skeptical that there is NO record of anything...not even your passport stamped...they looked at my passport to see i'd been to Oz.

K-1 Fiance(e) Visa Process & ProceduresDone and Over
Be clear on one thing - IT IS NOT YOUR FAULT. Presure or no pressure - that's who you are and he should love you for you and all your faults. Don't for one second think "Oh if I had done this differently..."

You have the right to be concerened about your future...and the right to NOT have to play the waiting game until He's ready..

I'm so sorry and I hope things work out for you

K-1 Fiance(e) Visa Process & ProceduresGF is worried about coming here alone
Girls in general can be silly - I don't think it's just those from the Phillipine's :)

I've flown back and forth from Australia by myself three times. It's fine. While, yes, I do speak English, I think getting a translator if she's nervous is fine!

Good luck and I hope she gets here soon.

K-1 Fiance(e) Visa Process & Proceduresis all the hassle worth it??
If you even have to ask the question "IS IT WORTH IT" then I'd say for you it's not.

If you aren't willing to do the work, take the risk, do the research...nope. Not worth it at all.

K-1 Fiance(e) Visa Process & Proceduresnew to the topic and to the forum...so some quick questions

Also, he will be quitting his job here in London to come live with me permanently in the United States, does this pose problems for showing evidence of financial support?

not sure about all your questions but I can say this.

1. I wouldn't EVER Set a date before you KNOW your visa is approved. It's just asking for trouble. There are no guarantees - little things could set you back months - and making deposits or telling family members ahead of time...i wouldn't...

2. His income has nothing to do with your financial support - it's all on YOU, the USC, and your income or your co-sponsor.

K-1 Fiance(e) Visa Process & ProceduresFiancee's child learning English. The best way?
depends on when they get here. If they arrive during the school year and the child is not enrolled in school (in florida anyway) it's illegal to NOT enroll the child. Children MUST be in school here - so you'd get in trouble for NOT having her there.

As others have said putting her in school is the BEST idea. I am an educator. the "full immersion" theory is totally right on. She's so young she'll pick it up - also all teachers MUST be trained in ESOL so they will know how to work with her. In addition most districts have additional ESOL departments that will pull her out and work with her (Again, they do in florida anyway.)
Tutors are well and good - but nothing replaces the learning environment and socialization opps of BEING IN SCHOOL

don't know about most of those, but I do know the employment letter does NOT have to be notarized but it does have to be specific and on letterhead.

In my opinion getting things notarized will never HURT you

I'd say either way. My ring was an heirloom so there was no receipt. As long as you have heaps of OTHER evidence it will be fine.

K-1 Fiance(e) Visa Process & ProceduresWhats the best way???
There is really no "one size fits all " answer...you'll have to read all the guides and see which is best for you, your fiancee, and YOUR situation :)
CarolineMFemaleAustralia2006-05-13 13:53:00
K-1 Fiance(e) Visa Process & ProceduresWhat to do?
well if you file DCF you have to be married - so if it failed you'd be married...so a fiance visa wouldn't work

CarolineMFemaleAustralia2006-06-25 08:24:00
K-1 Fiance(e) Visa Process & ProceduresWhich process will be best for us (K-1 or K-3)?

I just don't like the fact that I have people pointing out 'red flags' in my relationship when they only know our relationship from a few short paragraphs.

It's no problem - we've dealt with worse ;)

In all honestly they were only telling you what MANILLA is going to see and think...not personal judgements on you. Like I said in my post, Manilla is no Sydney...they will scrutinize not just the few paragraphs you've given us BUT EVERY LITTLE BIT of your relationship. Just having evidence isn't enough. They see that you've only known her a short time....you've only been together for a short time...she's been married to a US citizen before. They WILL Judge your relationship and that' s all anyone was saying :)
CarolineMFemaleAustralia2006-06-29 11:01:00
K-1 Fiance(e) Visa Process & ProceduresWhich process will be best for us (K-1 or K-3)?
I think what EVERYONE is saying is this

1) No matter WHAT visa route you choose (family) they ARE GOING to ask if there are previous marriages. She can't lie...well she could I guess but the consequences would be disastrous. Just because she doesn't think her marriage "Counts" doesn't mean us immigratin will feel the same. THey'll ask...she needs to be ready to tell the truth

2) People are just warning you of what is to come. There are so many girls trying to get to the US from the Phillipines that that consulate is a tricky one. They are extremely meticulous, not always nice, and VERY picky...People HERE are pointing out red flags because in Manilla they CERTAINLY will do the same if not with MORE scrutiny then we are...they aren't judging you - they are just cautioning you about you journey.

Also - just someone who PM's you claiming to be an expert...also suspicious. Do your OWN research and don't trust the word of just ONE person...like with a doctor...get a second opinion...

and finally...be prepared to wait, wait wait and then wait some more.

Good luck with whatever you choose.

K-1 Fiance(e) Visa Process & ProceduresWhat is "touched"?
It means that someone did something with your application I would think...doesn't mean anything major has happened, but it's not just sitting there gathering dust.
