K-1 Fiance(e) Visa Process & ProceduresK1 Medical and Interview

For London, you book your own medical. They don't send that to you. You'll get a letter with an LDN number on it, which you need to be able to call up and book the medical.  For K1 - they do not schedule your interview until they have the results of the medical, so it's in your best interests to book that as soon as you can.  Packet 3 will have what you need.

See this thread (K1 NOA2 to medical to interview thread): http://www.visajourn...terview-thread/

And this thread (about medicals): http://www.visajourn...bridge-doctors/

Yeah, its London.

I should have packet 3 any day now and will get on it as soon as it arrives.

Cheers

K-1 Fiance(e) Visa Process & ProceduresK1 Medical and Interview

Hi,

We're in the process and just waiting on packet 3 being sent or delivered but looking online, i'm getting conflicting stories about the medical and interview.

Some say....   You will not be given an interview date till your medical is completed and the results have been sent to the Embassy?

Other's have said...  I will get the medical and interview dates at the same time but they will be at least a week apart to allow time for the results to be sent to the Embassy?

Will all the information i need be in packet 3?

Any help or info would be greatly appreciated!

Thanks..

K-1 Fiance(e) Visa Process & ProceduresK1 Visa - DS 156 & DS 230

Hi,

Filling in forms DS 156 & DS 230 prior to my interview  for the K1 Visa and it asks in both about how many times i have visited the United States. Since the age of 14 I've probably traveled to the US about 30 times but don't remember all of them, as i am now 40!

Do you have to enter or tell them every single visit?

Thanks

K-1 Fiance(e) Visa Process & ProceduresIrish vital records...

good  morning.  I'm curious about something.  I know the US has specific official divorce documents that can be ordered from your state's vital records offices, but I'm wondering, what about Ireland?  I'm not seeing anything on the internet for this, and very new to the K-1 visa process, I'm worried that the divorce documents we each sent in won't be accepted.  They were the actual divorce papers that the judge signed (His Irish, mine from Michigan), but not an official certificate like a birth or death cert.  Is this all we need?  I know that if I was getting married in another country, I'd need a cert with a special seal, so these papers seem like they won't cut it.  What did you all previously married people use?  Thanks in advance!

K-1 Fiance(e) Visa Process & ProceduresK-1 Fiance Visa / Green Card Questions and Help

First, and most importantly, I'm a former night elf druid. :)

Second, yes, GET EVIDENCE of meeting the first time.  Before I came to this site, I threw away my boarding passes (duh!) not realizing this was a really good piece of proof of meeting.  So I scrambled to find receipts, etc that proved when we met (pictures count, but as secondary proof since the pic could be 5 years old).  I have sincerely thought it would be great to have taken a picture together with a newspaper of that same day where the date is readable.  Seriously.

Third, when she comes to visit DO NOT, I repeat, DO NOT marry her.  It may be the fun, romantic thing to do, but you will have then committed fraud, and it'll only increase the timeline, if not ruin it.

I love this kind of story.  :)  Good luck!

K-1 Fiance(e) Visa Process & ProceduresWhere to set up interview for my fianc'ee

We're in a similar situation.  South African living in Ireland with dual citizenship.  We chose the embassy in Dublin.  It's where he lives.  :)

Tina and JohanFemaleIreland2014-03-02 20:38:00
K-1 Fiance(e) Visa Process & ProceduresGetting documents collected before interview

This is what we're in the process of doing (also using the Dublin embassy):

~Police certificate from both Ireland and South Africa (his home country. That one is supposed to take months)

~vaccination records for him from SA and for his son from his son's doctor in Ireland

~My information for the AOS he'll need for the interview (happily, I will be hand delivering this to him in April!)

~starting to go through emails, texts, receipts, letters, pictures, etc for the "this is our bona fide relationship" requirement  :)

~he's filling out the documents ahead of time that require all his previous addresses, etc.

He's leaving the medical until he has word from the embassy.  While he's here visiting in April, we're getting passport pics taken at the local post office.

I would love to have an answer to your police certificate for the UK, as I have that same question.  We're about a month behind you.  I got our NOA1 on the 7th of Feb.  Good luck!

That said, he is also from a low fraud country, so our experiences may not translate as well to a couple from a higher fraud country.

(Honestly, our biggest dilemma over it all was that Australia and the US print on different paper sizes. That irritated our academic OCD natures something fierce.)

Us too!  on both accounts.  I didn't even know there was different sized paper out there until I received his paperwork from Ireland.  What the heck size is that?!?!!  lol

I don't expect to actually go to any of these places any time soon (apart from maybe Hawaii).  My sister and brother in law have a place on the Big Island); I was just merely brain storming.  My future in-laws all live in South Africa.  I was thinking of possible options that might make long-distance travel easier on them.  I didn't know about the traveling through other countries.  Good to know.   Thank you all for the replies.  :)

I know that once my fiance comes to the US on his K1 visa, we will need to get married in the US, but does that include territories: Puerto Rico, the U.S. Virgin Islands, American Samoa, Guam, the Republic of the Marshall Islands, the Federated States of Micronesia, the Commonwealth of the Northern Mariana Islands, and Palau? Or can these places be visited while waiting for the AP once filing for AOS after marriage?  More just curious, but also trying to learn about what we can and cannot do.  thanks in advance!

Teacher here too, and I am not getting tenure until the end of this school year.  I hadn't thought of that being an issue at all.  I would see "temporary" as a long-term sub or maybe IF you work at a district that is susceptible to layoffs and you'll be getting a pink slip come March 14th.  But I think if you follow the example above (as I plan to do) then really all you need is what's already stated there. I would think the only way it wouldn't work is if you're on some sort of suspension with your district.  Just to compare notes, are you planning to get this from the district office or your principal?  I'll be doing this in the next few weeks.  :)  Sending positive vibes your way for the interview!

K-1 Fiance(e) Visa Process & Proceduresquestion about the DS230 addresses since age 16...

Why are you filling out a DS-230? Did you receive specific instructions from your consulate to do so? You should only need to fill out the DS-160. The DS-160 replaced all other DS forms last Oct.  http://travel.state....ance-k-1.html#6

Ooops.  I feel like I have "research overload."  cray5ol.gif It's the DS160 I'm asking about.  I looked at your link.  Do we no longer need the addresses since age 16?

What about the police cert for a country you traveled in for more than 6 months, non-consecutively, but were not a resident of?  Should we get that, or is that unnecessary?  Any advice is appreciated!!

Tina and JohanFemaleIreland2014-03-22 18:38:00
K-1 Fiance(e) Visa Process & Proceduresquestion about the DS230 addresses since age 16...

Here is what the document is asking for:   "List below all places you have lived for at least six months since reaching the age of 16, including places in your country of nationality.

Begin with your present residence."

Here is my question: if the person filling out the form traveled back and forth between multiple countries for more than a year, but didn't stay in any one place longer than the 6 months consecutively, does he or she need to mention traveling in those countries?  Can they just put their permanent residence in their home country, and then pick it up again with the next residence he or she lived at for over 6 months?  And also, do they need to get a police certificate for any of those countries if they didn't stay in the country for more than 6 months consecutively, but were there off and on for more than a year?  Between hostiles, and other places to stay, like boarding houses, there are a TON of addresses, and I can't imagine remembering them all.  :(   Can you/should you obtain a police certificate for a country you visited long-term, as a preemptive measure, even if you didn't live there for the required amount of time, in consecutive months, especially if you worked in those countries at all?

This scenario is causing a lot of stress, and any answers from people who have experience with this would be greatly appreciated.

I know you said that he didn't have internet after 2006, but did you keep in touch at all between then and 2013?  letters sent in actual mail?  This could help prove that you have a bona fide relationship, I would think.

Tina and JohanFemaleIreland2014-03-10 14:00:00
K-1 Fiance(e) Visa Process & ProceduresDealing with a previous marriage in a high fraud country.

a marriage contract my fiancé had me sign that is not legal, but is a spiritual contract in Islam.

Would this fall under the "too married" for a K1 visa, but "not married enough" for a spousal visa?  I have limited experience with red flags, etc, but I have seen some people who've had this problem where the embassy considered them "too married" and denied the visa because it was the wrong type.  I imagine someone with that experience will chime in.

On the other hand, if he was legally divorced and free to marry (no time constraints post-divorce), then I wouldn't think that his being married before would be a problem.  Lots of us have been married before.  Good luck!  I'm anxious to know how it goes, as would people filing with Egyptian fiance's, I'm sure.

So i have heard everything from one sentence to the above list.

Does the declaration of meeting go to the HCM Consulate? or is the above in reference to paperwork to take during the interview?

I wondered the same thing.  This seems more like what you'd bring with you to the interview to prove a real relationship.

K-1 Fiance(e) Visa Process & ProceduresPossibility of ex-spouse creating problems at the Embassy

We have almost the same situation here.  He  has gotten full permission from the court to relocate with his son (before we applied for the K1), and his ex-wife agreed to this, before knowing that we are planning on them moving here to the US.  I'm interested to see how your embassy handles this.  We frontloaded the court documents with our petition, but now I wonder if we'll ALSO need a signed and notarized letter from his ex.

Good luck!  :)   I can't imagine you having problems relocating your children when their father doesn't even live in Portugal.

K-1 Fiance(e) Visa Process & ProceduresProof of having met in the past 2 years

Itineraries are not proof of anything other than buying a ticket, it is not evidence. They want physical proof that you boarded the plane with corresponding passport stamps. A printed itinerary means nothing

You CAN, however, contact the airline you used and request a copy of your boarding pass.  My airline did that for me, in the form of a letter, stating that I bought, checked in, and used my airline ticket on the dates listed.  It worked out great.  :)

Tina and JohanFemaleIreland2014-04-04 10:41:00
K-1 Fiance(e) Visa Process & ProceduresProof of having met in the past 2 years

If you are talking about needing evidence for meeting within two years of petitioning, then you would include things like boarding passes, hotel receipts, pictures of you two together, passport stamps.  Basically something that will put you in the same place at the same time after April of 2012 (presuming you send it this month).  The "evidence of the relationship" is for the interview at the embassy.  That's when you'd need things like Skype call records (I took screenshots of our chat history), whatsapp texting, Facebook posts, other pics taken between filing and interview, cards, gifts, other receipts, etc.  People sometimes frontload their petitions, but it's not mandatory.

Edited to include:  For our petition, I included these things:  copy of my stamped passport showing entry into Ireland, hotel receipts for the stay and for meals there, pictures from our Dublin ghost tour (pictured in front of the bus which reads, "The Dublin Ghost Tour"), receipt for the tickets purchased for the tour, copy of hockey tickets purchase in his name with a receipt of a hockey jersey I purchased at the game (both showing the same date).  I (foolishly!) threw out my boarding pass, but I was able to contact Aer Lingus and get confirmation from them that I bought and used my airline tickets on my travel dates.

K-1 Fiance(e) Visa Process & ProceduresHow long do you have to respond to an RFE?

I think what Tina is trying to say is that EVERYBODY sending the I-129f sends their application to the Dallas, Texas Lockbox or Lewisville, TX if sending by Express mail. Then, depending on which state you live in (which you are in Indiana like I am so we are sent to CSC) your petition gets sent to a service center. You were not sent to TSC, then transferred to CSC. You were simply just sent to CSC to begin with. It will state this on the NOA1. :) Hope this helps!

This is my thinking exactly.  :)  My window passed as of Friday.  :(  But I remain ever hopeful! (What I'm really thinking! ---> :ranting:  )   I'm hoping that a. you won't get an RFE at all, and b. if you do, it'll be long before your trip abroad.

Tina and JohanFemaleIreland2014-04-06 14:33:00
K-1 Fiance(e) Visa Process & ProceduresHow long do you have to respond to an RFE?

This is what I am meaning.  Here is my email from USCIS notifying me of my NOA1: profile_mask2.png

"
Feb 7
cleardot.gif
Your case has been accepted and routed to the USCIS California Service Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number..."

So, I put this for my timeline:

K1 Visa Event Date

Service Center : California Service Center

Transferred? No

You have this as your timeline:

K1 Visa Event Date

Service Center : Texas Service Center

Transferred? California Service Center on 2014-02-13

MY question is, did you first get TSC on your NOA1 and then they transferred it to CSC?  Or are you mistakenly putting TSC as your service center because you sent your petition to Texas (like everyone else does)?

Edited to reformat the post.

Hi there.  I was looking at your timeline and I'm wondering...  did you put Texas service center originally because that's where you mailed it, then put "transferred to the CSC" because that's where it then shipped?  If so, and you fix it, I think you're timeline will adjust accordingly.

Right, I've looked at the whole thing about the warsaw us embassy.

So basically once I have the new case nr I go online and fill that form ds 160? Is this how I schedule the interview.. And do u think should do it once I arrive in (end of may) or whenever we get the new case nr from the nvc, even when I'm still in America.

I think you can now fill out the DS-160 when you get your case number.  You can do it from the USA or from Poland.  If YOU schedule your interview, as opposed to the embassy scheduling it for you (it varies by embassy), then I'd suggest scheduling it for a time beyond your return, allowing enough time for you to order your police certificate, military records (if any), a copy of your birth certificate (if you don't already have it), etc.  If THEY schedule it, I'd suggest waiting to fill out the DS-160 until you are home and have the above documents ordered or already in your hands.  Until then, though, get your fiance to gather his paperwork for the I-134 for you to take back with you, and also putting together your "proof of relationship" information, whatever you choose to include in that.

A personal  note:  my fiance was here shortly after we received our NOA2, and was here when I got our case number from the NVC.  Our petition is on its way to Dublin right now (I got this information from the CEAC website I linked earlier), and he is waiting to get his police cert before going further with filling out the DS-160 or scheduling his medical exam.  He wants to be 100% ready for the interview so his visa can be issued ASAP afterward.  Good luck with what you decide.  :)

Right. But please just tell me if I got right or not. What we do now is:
- call the nvc in about two weeks to find out whether they got our petition and ask for the new case nr

Correct? But what do I do after this. After I have the new case nr. How long does it take for our petition to get to my country? This wasn't mentioned anywhere

Correct.  :)

prepare documents mentioned in the checklist and fill online form DS-160 (Which you fill in online at https://ceac.state.g...IV/Default.aspx ).
From Poland, you will need to have:

birth certificate(English translation if the applicant is not Polish)
police report(translation if needed)
medical examination results
2 photographs. (passport size)
affidavit of support form I-134 with original signature (from the petitioner)
Proof of relationship
Proof of visa payment

OK, well I'm in America til end of may so I'll probably be here for when we get out case nr.. I'm an alien fiance, so I'll have my fiance call. So from what I understand we do not get anything else in the mail, we are just supposed to call the nvc in about two weeks, correct? Asking for new case nr. So after we get the number, I call us consulate in my country to schedule interview?

This is from the Warsaw, Poland embassy information link I posted:
