i'm a single mom and my fiance and i are planning to bring my kid along with me to the states.. can we do that with a fiance(k1) visa?? my daughter is just three years old. i'm new to this, and i have no idea on the how-abouts.. so as my boyfriend. he doesnt know where and how to start. as of the moment he is waiting for his passport to be released. he is also new to this kind of stuff. we need help. thanks


You are actually going to need a K-1 for yourself and a K-2 for your child. This website is GREAT and will help you get the process started. Your fiance needs to start the petition process. He can go to the guides tab and select K-1 and K-2. The guides are pretty straight forward. If you have any country specific questions, go to portals and select your country. You may post any questions you have during this process here. Basically, your fiance will file a petition with USCIS. Once the petition is approved by USCIS, USCIS will forward it to NVC (National Visa Center. Once the NVC approves the petition, they will forward it to your respective embassy. Then, the embassy, will send you a letter stating that they have a petition for a K-1 visa for you. The embassy will send you a letter requesting your K-1 application and additional documentation. Once you submit the required documentation, the embassy will schedule an appointment for an interview. After the interview, they will ask you to return for your visa and all you have to do next is fly to the US.



Sounds easy and fast, but it is not. It takes a lot of patience and attention to detail. But we are here to help.

Dear fellow VJers,

At the embassy interview, do you give the CO copies or originals of the Boarding Passes, Reciepts, ect...

I worry if I were to give them the original Boarding Passes and Receipts, and for some reason the visa is not approved, then they might keep the originals with them and I am left with no original Boarding Passes and Receipts that I might need for a second round at the finace visa process.

Bring copies, but the CO will want to see the original birth certificate and translations. At least, she asked my wife (then fiancee) for hers whenshe interviewed for her K-1. My wife provided the CO with copies and the CO just wanted to see the originals for a few minutes. The CO kept some copies and she returned the originals back to my wife.

Thank you. I'm hoping that someone can point me in a direction, either here on VJC or elsewhere so I can confirm the one year allowance.

I would think one would have to have a pretty good friend to co-sponsor. If things went bad, and the person ended up receiving welfare/medicaid or some form of public support, wouldn't the powers that be hit the co-sponsor if the sponsor for any reason could not pay?



Please be aware that the Bangkok embassy normally does not allow cosponsors for K-1 visas only for CR-1. Good luck!

It stops at the NVC first. So check with NVC a week or so after your NOA2 date and sometimes it takes a few weeks. They'll give you the case number for your embassy. Sometimes you get a letter from NVC but I'm not sure people always get it. There are lots of posts on here about how to contact NVC.

Darnell, I can explain the medical forms. The embassy had not updated the two hospitals in Bangkok with the updated medical forms or the two hospitals received the forms but gave out the old expired medical forms. Pui and Bee went to the same hospital about a week apart back in April. When Pui had her interview she met a lady who had the same problem but from the other hospital in Bangkok.


Matt, hopefully you will hear something soon. As everyone says it is a good thing they kept her passport. Keep us updated.

I forgot which hospital in bangkok Nan went to, but they didn't make us redo it. I hope that the new medical forms don't came back to bite us in the butt during our AOS. So far no RFE, but then again, we just started.

Just got off the phone with the NVC.My K -1 Fiance visa was apporoved on March 24,2011.It was sent off to the NVC on the 26th.They told me on the phone there is a wait time for acceptance,Is that normal? That is correct if you do not proceed with the application process before Sep 10th, your NOA2 will expire. Have you gotten the packet 3 yet? I hope everything else is ready. You should have applied for the passport before you even petitioned. In fact, I am surprise that your petition got approved without her passport. As I remember in our case, a copy of my wife's (then fiance) passport was required to be submitted with my petition (but of course, I could be wrong).

Hi Everyone-Finally submitted my 129F and have NOA1. Want to get everything in order for next phase and could use some help/advice on a couple of things:
1. Is there a document that describes in Thai the Packet 3 and 4 requirements. Looked on the Bangkok embassy website but did not find...in English anyway, a translated Thai version of the directions. Would be great to give to my Fiance!
2. Recommendations on how to get a thai birth certificate. My fiance was born at home and claims to not have a birth certificate. Any suggestions? She has her ID card and passport.
3. Any recommendations on a Thai language translator in Bangkok or in Buriram province?

My fiancee and I are in Ecuador now. We just got his NOA2 approval, and we are looking through the Packet 3 requirements before our interview. He lived in England for 1 year, and during that time got a police certificate when he was applying for a US tourist visa. He still has the certificate, although it is from August 2010. I looked on the Ecuador embassy websites and saw nothing about when I should get the police certificate. Would this one be valid for our interview, or do we need to get a new one? Thank you!

I just received NOA1 hard copy in the mail and they misspelled my fiance's last name even though on both the I-129F and G-325A her last name is spelled correctly. I swear this happens all the time, even with my name. Should I be worried about this? Should I contact the USCIS or something and let them know it's mispelled on the NOA1 hard copy?

I have tried to read all possible on the K1 process and everything about it. My NOA1 went to the CSC and arrived on 07/14/11. The case was “updated” on 08/09/11, with no change is status. On VJ’s “time trends” the CSC is processing visas from 70 days ago, approx. July 6th. Can anyone tell me what is going on? Or how long “processing” takes once a human looks at the application?


The truth is that no one can really tell you. Every case is different . You can see my timeline below, but my case was expedited. USCIS goal is 5 months from noa1 to noa2. However it is not uncommon to take 6 and 7 month. In a few cases even longer.

Pk3 is a package sent from the embassy to the Applicant where the embassy notifies the applicant that they have received an approved petition on his or her behalf to apply for a k visa. In the pk3 the embassy also requests that the applicant submit a list of documents.

Pk4 is a notice from the embassy stating that they received the applicants submitted documents and also Informs the applicant of the interview date as well as provides a list of documents to bring to the interview

I got an RFE in the mail today stating that I didn't submit all the required evidence needed so they're asking for "proof of legal termination of marriage". My question is I sent them a photocopy of my fiances divorce document {front and back} so am I missing something here? Is it because it's in Russian it needed translated? Could they have lost the copies I sent? I'm really confused about this because I know 100% I did send legible copies. Any info would really help...thanks!

Been reading several posts on here, and was wondering if there is a perferred option of airport for POE? What airport is the easiest and less hassle?

I have heard that people who have entered JFK, have been automatically been issued an EAD (employment authorization document), without having to apply for it or pay for it. Is this true, or simply a rumour?

They stamped my wife with and ead, but turns out that you can't use that stamp to work.

Ok guys i am back with an other question! :bonk: I complete the forms for the embassy and i wanna be sure i send back to them the right forms lol, silly me... :bonk: On the instructions they say to complete and return DS 230 I, complete and not sign DS 156 and DS 156 K and with the pencil they say complete and return also DS 156, one picture and a copy of passport. So as i understand i have to send back DS 230 part one, unsigned DS 156, one photo, a copy of my passport and sure the checklist. Make me not feel blonde and say i am right lol. That doesn't sound right. How can you depend on someone and then sponsor someone? I would ask his father to take him off as a dependent. I'm assuming your fiance is over 18( has to be) so why is he a dependent?

My fiance went to get his shots today and receive his documentation to take to the Embassy for his interview. He was told that the envelope he was given was to be given to the Embassy, but he also received x-rays that he was told he should give at POE. Is this true or should everything be given to the Embassy instead? Did this happen to anyone else?

How SOON can you get a copy of your Appointment Letter after you scheduled for your interview via online? Do you get to print it as soon as you finished scheduling? or is it something that the embassy will snail mail/email to you few days/weeks after you scheduled online?

Please, hope you can answer my query coz i am trying to figure out when is the best time to have the interview (been staring at the calendar for a while now) and ensure that i have ample time to prepare (and give embassy more than enough time to send me whatever it is that they're supposed to send to all beneficiaries).

I am not really worried about the packet three (3) coz i know i can just print it out anytime i want. But im thinking about any other mail that i need to get from embassy prior to my interview (something that i need to present to the guard to get in). I just want to have everything ready before the BIG day.

You need to bring your evidence and copies to the interview. Make you you send everything they asked for in the pk3

K-1 Fiance(e) Visa Process & ProceduresHas Anyone Waited OVER 5 Months For Their NOA2?

One week from now on September 26, 2011. I will reach my 5 month limit. I received my NOA1 on April 26, 2011. I have still not received an NOA2! I called my Congressman and I have to wait till Monday to hear any news from him about our NOA2.

I am just completely pissed off right now because there's no one to tell me anything on why it's delayed. If I did anything wrong I should received a RFE by now. I have not received anything! I thought I was very detailed in preparing our I-129F. I followed the guides and had a relative (fellow VJer who is in the USA now after K-1 approval) look over our paperwork with me. I double checked, triple checked, I had everything neatly organized and had a table of contents and all that #######. I guess none of that matters... because I read posts on here where people don't even follow the guides and have barely enough evidence get approved in 3-4 months.

Anyway, sorry for ranting... I have not slept well for the entire month of September because of the whole NOA2 mess. My question is...

Has anyone ever go past the 5 months limit for K-1 Visa NOA2 approvals? Did they ever give you a reason for the delay?

So, I know I've read on here to be careful about wiring money from the beneficiary to the petitioner during the visa process, as it will cause red flags...so what is the best way for my fiance to get his funds moved to my account? We want to have a shared bank account, however, my bank said if he brought it all over in pounds it could take 3-4 weeks for them to process it if it was a large amount. So, they suggested he wire it right before the move.

Thoughts, suggestions or ideas on what the best way to do this is without causing a huge red flag would be great :)



I am not sure, why that would be a red flag. In fact, during our K-1 process, I transfered funds to my fiance via bank wire transfer and I submitted that information with my package. We had not red flags, no RFE's , and no questions rised.

When they say "each applicant" do they mean beneficiary and petitioner, or just beneficiary and if they have kids?





The answer to question one is yes, you can use the printed version, we used the electronic version in the embassy website.



The answer to question 2 is only the beneficiary has to fill it out. During this part of the K-1 process when you read applicant, it is the beneficiary. Good luck. By the way. I strongly advice your fiance not to change his name before marriage. Talk about complicating things even more. Good luck.

My husband has a high level of security clearance and is in the military. It has definitely affected him and his job.

He has to have a special form from the FBI stating he is allowed to marry me and has to have a waiver from them. He also has to do several forms and tests from the military and his security clearance etc. I also have to have an FBI interview every time he needs to renew his security clearance. I may also have to have one for my ROC and citizenship testing.






I also have a military security clearence, but didn't have any problems and it has not affectted my clearence nor my job. My wife not being a citizen only affects me if we want to be stationed overseas. Basically, we wont' be able. Also, my mother and sister are both non US citizens who live in the US with Green cards. Again, I have not had any problems with my security clearence.
