You may want to include a copy of her NSO issued birth certificate. Some K1 filers from the Philippines (and from other countried) received RFE for it... just to be safe.

K-1 Fiance(e) Visa Process & Proceduresprimary or secondary evidence?

Hi! I know some might consider this as a dumb dumb question, but i would just like to ask if the Letter of Intent to Marry is considered as a primary or a secondary evidence? Do you get an RFE if you fail to submit one? And does the service center put the petition on hold until you submit the letter? thanks so much :)

wife2be

We included letter of intent in our packet. It's not a primary evidence nor a secondary but one of the necessary documents. But I think others didn't include it in their I129F packet and didn't get RFE... And I haven't heard of anyone who got RFE just because they didn't include it... that's as far as I know. If you have it, might as well include it, if you don't, you might want to make one, but if you've already submitted your application without it... there's nothing you can do for now but wait and see...

Good luck!

how much does the whole journey cost starting with the k-1 visa??? im not sure if any1 can answer this question but its worth a shot...any way what do u do after the visa is in hand???lol..thanks

Depends.

$455 for petition, $131 for visa fee, medical exam...varies greatly, police certificates...varies greatly, $1010 for AOS + $600 for every child under 14 or $1010 for every child over 14 (all fees are "per person") Plus any travel expenses for the finacee, yourself as you deem appropriate.

I believe the medical exam required for the k-1 is ALWAYS $213.35, in the local currency at the current exchange so it is not something that varies much.

The trips to disney land, jacuzzi's, fast cars, etc, are not necessarily required, it depends on the couple... but you can pretty much expect that marriage will increase your expenses one way or another, for me the big expenses before the marriage were travel, it's not cheap to fly to pretty much literally the other side of the world, if you just have to drive a car across a border it's a lot cheaper. My biggest after marriage expense, health insurance... it costs $350 a month to add my wife to it, over a year this will make the travel expense a minor thing. Germany is not a poor country so most likely you wouldn't have to cover as much of the costs as you would if you were marrying someone from a poor country and had to pay the various local fees ($213.35 is probably a minor annoyance in germany, it's potentially someone's life savings in other countries).

K-1 Fiance(e) Visa Process & ProceduresMedical Exam
I think that's only if you have something show up on the x-ray. I've seen posts by people here where they had a scar or some other sign of tb in their lungs and had to wait a few weeks to verify that it was stable/unchanging. The three month thing is only if you actually have TB, not just for a positive skin test but actual TB, someone who has had tb in the past probably can expect a delay because often something shows up on the chest x-ray and they have to take another x-ray after a certain amount of time to compare (this is just what I understand from reading here, I am not a TB expert).

Your medical and interview are in your own country. You can come to the states on visits while waiting for the K-1 approval.

In Missouri, we need social security # to get a marriage license.

I'm in Missouri and my husband didn't have his social security number when we got our marriage license. We just showed his passport with the k-1 stamp.

It is hard to say exactly - before the new form was uploaded (mid-July) the requirement was 4 pages - we believe it is still 4 pages, yet the PDF only prints one. Wait and see - if they want 4, perhaps they can walk over to the copy machine rather than send you an RFE. Try not to worry in the mean time.

Thanks... It's hard not to worry tho. sad.gif

K-1 Fiance(e) Visa Process & ProceduresNative Arabic Language used on K1 Visa Forms
QUOTE (jennifernhoussine @ Jul 7 2009, 03:27 PM) <{POST_SNAPBACK}>
My fiance lives in Morocco, and his native language is a dialect of Arabic, of course. However, Morocco tends to use French for business/address/etc.
On the forms required for the K1 Initial Petition, there are sections stating "If your native alphabet is other than Roman letters, please write your name/address in your native alphabet."
For those of you with fiances in Morocco, please tell me if they had to complete those sections in arabic, or if it was acceptable to leave those sections blank (as all the info is provided in the forms using Roman letters)?

Thanks!

Ohh, awesome question. I wonder! I had him type it in Arabic and I copied and pasted it in the document?! It's been 7 days since I submitted our Petition, no notice nor has my check cashed... eeek

It's only been 7 days since I submitted our K-1 Petition, but my check hasn't even cashed. I expected atleast to have seen that come through the bank.

Any ideas?! Of course I want to worry and ONLY think the worst. sad.gif

I saw someone else online knew within two days of submitting her K-1 that she had received her NAO1. Bummer for me.

For a recent AOS I filed it took 8 days for the check to clear. The WORST that can happen is that you forgot something really major...like forgot to sign the petition or forgot to sign the check. In this case they will return the whole package (usually within 2 weeks) and you correct the error and resend it. MUCH better than getting an RFE

PHewwwwwwwwww it cashed yesterday. Also looked online, says that, "we received this I129F PETITION FOR FIANCE(E), and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you." Is that an NAO1?

Sorry for sounding, umm dumb! innocent.gif

Yep, that is your NOA1. No worries. This process makes us all crazy at one time or another! Good luck on your journey!

When entering in the United States on a k1... how long is it valid for? I have heard that you must get married within 90 days. So I assumed it was only valid for 90 days, but I have read where it is valid for 6 months. My second question is, after entering on a k1, and after getting married within 90 days, how long after his arival do I have to pay the AOS fee? I think its somewhere in the ballpark of $1,100. Does this have to be paid within 90 days? Or within 6 month? Wondering how long I have to save up for that BIG fee!

You need to read the Guides since your questions are very basic and indicate you do not understand everything. Click on the Guides button at the top of this page.

The beneficiary has 6 months once they get the K-1 visa from the Embassy to leave their country.

Then at the Point of Entry, they are given a I-94 Visa and that is good for only 90 days.

Yes you must get married within 90 days or they go back.

You file the AOD documentation as soon as possible after you marry. You don't have to do it on day number 89 or number 91, but you should do it soon after the 90 days. DO NOT wait until 180 days after the 90 days is over because then you may incur an overstay and risk deportation and bans from future visas. You should have this AOS fee saved up BEFORE you even start the K-1 process.

Umm.. that was quite rude. She wasn't asking for your opinion but to simply answer the question or pass it up. She is asking for help, the guides are there to be used but anyone can ask a question.

The cheapest plain ticketI have found was on orbitz for $1,200.00. I generally check other website, and orbitz always seems to be the most inexpensive.

Hmm... how do I do this?

It is working now, I am on it. But I had to do a full system restore and I lost everything...

If you did a full system restore on the same hard drive, then you've likely lost everything that was there before. It's possible you might be able to recover some of the old data from unallocated sectors, but you'd have to shut off the computer now and remove the hard drive. The drive could then be analyzed for recoverable file data on another system. You cannot do the analysis with the drive installed in your computer because your computer is using the drive as the SYSTEM drive, and is continuously writing new data to it. This is complicated, and involves looking for data in unallocated sectors, and using heuristics to guess how the sectors were linked into files, since the original file allocation tables and directory structure were overwritten when you restored the system. I don't know if the fine folks in the Geek Squad are equipped to do this, but it wouldn't hurt to ask.

Your chances of recovering any usable data depends on the amount of the previous data that got clobbered by the restore.

This would have been vastly less complicated if you'd tried to recover the data BEFORE doing the system restore. As long as the hard drive hadn't crashed, you could have taken the drive down to Best Buy and had it backed up on an external USB drive. Then you'd could safely clobber the drive by restoring the system, but you'd still have all of your files on the external drive.

I called Best Buy and they told me that it would cost anywhere from $250.00 - $1,600.00!! OUCH!! I think I will just start fresh and hope for the best.

I was not able to provide any msn chats prior to a 'certain' date so when I submitted my K1 I enclosed a lettter that due to data loss I was not able to provide chats for a certain time period. Storing your chats on a flash drive is completely safe. Just when you save them to the flash drive just check and make sure it saved. You can get a 2GB for approximately $12.00. And a 4GB for probably $19.00. The proof you can send in replacement of chats phone records, emails, and snail mail, and pictures. If you use a calling card, contact the calling card company and request a list of ur transactions. Since you just recently submitted your K1, you will have atleast 4-5 months of chat to be able to include for proof. When you sent in your original petition last month, did you include chats with your petition? Im sure that they realise that sh_it happens... just make sure you back up with other proof and start saving to a flash drive and u be ok.

No, I did not send any chats or emails. I sent in airplane baggage tickets, and boarding passes along with photos. I do have awhile to build up chat logs, but worried about the laps of time. biggrin.gif

I use yahoo email, and as they do not have a limit on storage for your mailbox you can just attach files to messages and save them. There are other ways to this as well, just don't rely solely on your one lonely (and crash prone) hard drive at home.

Let me sound a little stupid - why do you say 90 days? I am actually getting this done now, and our petition hasn't even been approved... so it will be well over 90 days when he actually submits it with his interview. I had heard of some individuals submitting it with their petition, and I had never heard of an "expiration date" or even the time frame of 90 days.

There is no guide for the I-134. The I-864 requires all documents be within one year, BUT also specifies that "more recent documents may be requested" I have never heard of a consulate requesting information more recent 90 days, they could, but not to my knowledge. Beyond that you are pushing it. Consulates can make their own decisions on this matter and do not have to be consistent.

I would not prepare an I-134 until you have an interview date. In my case I completed mine 2 days before the interview and it was "current" within one week. Consualtes from high fraud ountries (Morroco...OH YEAH!) will consider "old" information on the I-134 a "red flag" I wouldn't push it with Morrocco

Lovely, just paid $40 to have the bank write that up!

Write WHAT up? A bank letter? Are you kidding? I wrote my own bank letter, took it to the branch president and asked her to type it for me on letterhead while I poured myself a cup a coffee and waited in her office. Had she suggested I pay $1 for it, the next thing I would have handed her was a withdrawl slip for the balance in all my accounts.

Bank letters are optional anyway.

I am not kidding one little bit... they called it an "Immigrant Letter". I am not worried about it being "old" many from Casa have not even been asked for it, he will have it if they need it. I am not paying more money to have another letter written. In the letter it included all the information the Affidavit of Support asks for; current balance, deposits over a 12 months period and when the account was opened. The bank said they could get the amount deposited over a 12 month period so they would have to send it off to the "major" branch and have it written there! Oh well..

I am actually getting this done now, and our petition hasn't even been approved... so it will be well over 90 days when he actually submits it with his interview. I had heard of some individuals submitting it with their petition, and I had never heard of an "expiration date" or even the time frame of 90 days.

Well if its going to hurt my case then I most definitely dont want to do it.. I have thought about the idea that it would help us but then might seem a little TOO put together..

I had already planned on doing the same thing. I think it's a great idea, especially if your family can't travel to meet his family.

Hi everyone,
First I want to thank you all for all your help and advises on this important site..Today I got my packet 3 and the interview is scheduled on january 14th,2010 and I hope everything will be ok at that time..Well I know I need to prepare the required documents and evidence.I can say I have already everything and about evidence on ongoing relation I have:Letters,e-mails,text on my cells, pictures,so do you think that is enough because I do not know how to record our conversation from skype since we donot type and weuse only the mic..Thank you so much and hope to hear from you..

I am not for sure about Skype but I know for MSN, even if Bijad and I only use the mics it has a log when we "called" each other and when we "hung-up". Check under options on Skype and see if you can save your conversations; in the conversations is where it will also save the log of calls. biggrin.gif Hope this helps, but probably not. Haha!!

It asks for all the educational institutions my fiance has attended.. Would that mean just college or universities, or does that include high schools? Just need to clear that up...

Oh, I am glad you asked this. I would have assumed just universities... glad someone knew the answer.

K-1 Fiance(e) Visa Process & ProceduresMy fiancée ended relationship after visa approval - cancel visa?
I'm sorry to hear about this, I hope you can get the matter resolved and move on.

QUOTE (knight_owl @ Nov 17 2009, 12:51 PM) <{POST_SNAPBACK}>
My fiancée decided she did not want to come be with me in my country and has ended the relationship. I suspect she has found another man. Our visa had been approved and sent to the consulate in her country. Should I just contact them to cancel it? Thank you.

K-1 Fiance(e) Visa Process & ProceduresHow many G-325A should be submitted with I-129F?

Yes - the new form has 1 page.

However, several calls to USCIS gave conflicting answers (they want 1, they want 4 - even with the new form) - and no one posted a success with just sending in one form.

I only sent in one form and the petition was approved. :D
