I had my interview June 5th in London, my husband had an email a couple of days ago to say I am ineligible for a visa due to overstaying visitor's visa in 2005/2006, even though I applied to adjust status, checked with an officer at the immigration place that we were allowed to do it, he said yes as long as I started the process before my 3 month visa expired. We gave up on the visa at that time as would have had to sell my UK flat from the US within 90 days to secure enough funds. Anyway I am waiting (here in UK) for a letter of instruction on how to apply for a waiver and have to get a further interview. Has anyone any experience of this, and how long it takes? I presume it will be costly and time consuming. My husband has now moved back here to be with me as we were apart too long and now we are wondering if this was a wise move as he has given up his US work and address, so how do we ever get back there?

Go to immigrate2us.net and start reading. It is a wealth of information for those involved with waivers. If you oeverstayed, you need to file an I-601 waiver. Why did you leave the US? We left as my husband was not allowed to be my sponsor, even though he was in full time employment as a teacher, he had retrained to do the job and so did not have previous year's earnings, as he had been a student. I could not find a co-sponor, I was told I could use the asset of my UK flat, but would have to go sell it and put the funds in a US account within 90 dyas, something that ws not possible to do, so we gave up and came to UK, where my husband supply taught and I retrained to be a teacher. Yes we were married in the US, but had left to teach overseas and came back and then applied to adjust status. I know the ban goes into effect when I left, the officer told me that, I left July 7th 2006.

I went for a 2nd visa interview on August 15th and was told I had overstayed my visitor's visa in 2006 (we started to file to adjust status and gave up, not realising the mess we would end up in) and need to file a waiver or else sit it out and wait till the 3 year ban expires July 2009. My problem is , my husband is now here with me in the UK as we couldn't be separated any longer. He is a teacher and is contract ended at the end of the last school term in US. I asked if I needed to fill in a new I 864 and stuff for either the waiver or else the wait it out till 2009, the officer said no. But I can't understand how they won't ask me where he is working etc? Plus what address does he complete for the waiver forms if we decide to do it. It costs the same for both as if we wait I will need a new police report and medical. How can we put in stuff about the hardship of separation if we are together? I mean we can put in the stuff about his kids and father being in US and also the huge financial loss to us staying here and moving yet again.
Any thoughts on how to go ahead would be appreciated. huh.gif

Well we finally got the visa in Jul 09 and moved here in Aug 09. At the last interview the officer actually admitted they made a mistake and should not have refused my visa in 08, of course the original officer is no longer there and I have nothing on paper so it's just our crappy luck. Now we have spent thousands of pounds/dollars doing this, we are here at the worst possible time and jobless and homeless, just watch what you wish for. I wish we'd stayed in UK, he'd got a UK passport and we could then go to Italy and live, much better than here or UK.

Heathrow will probably detain him a bit but they're not unreasonable. Make sure he brings a copy of the NOA and application to show the intent is to immigrate to the US and not vice versa.

I have come thru heathrow 7 times in the last 9 months to see my fiance and never had a problem. the most they have ever asked is if we know the visa process, and what our intentions are etc. never been asked more than 2 mins of questions. Hi, my husband is a US citizen and is now back in US, has been since August to start a job. I am in UK. We started visa application in March. He is coming for a visit over Christmas and has a return ticket, he is a school teacher. I would like to hear from anyone else who has had their US spouse for a visit, what kind of questions are asked at the UK airport? I mean when he replies to, what is the purpose of your visit with, "to visit my wife", I am worried they might think he intends to stay and make it hard for him. Am I worrying unnecessarily? He is going back, he does have a job and is bringing with him his contract to prove this.

To be honest I haven't kept track of my timeline and odn't know it all in such detail as everyone else does, i know I started this end of March 2007 and that's about it. I made mistakes with forms I forgot to send my husband's signature on original I864 (I'd just lost my dad and wasn't exactly thinking straight0 and then I filled in a form with where I had stayed since birth instead of since I was 16, they sent it all back cos I had the wrong year, then they lost my passport photos, I sent them last March and they wrote about Feb to say they didn't have any,so it's been a catalogue of disasters.

Thanks for that, I am very nervous and anxious about having all the right documents, I am going to the medical and staying with friends and family in England till the visa interview, so when I leave on 30th I have to make sure I have everything I need.Think I'll call them tomorrow cos the letter they sent was not that clear.

Yeh, just call, they scheduleyou in quite quickly, i think you should just go ahead and get it doe... Mine is tomorrow, and even though I've never had any medical probs, I'm quite nervous!

I know your interview is Thursday too, what are you doing about the medical results? Did your appointment letter say bring them in a sealed envelope? But I have called the medical folk and they said they courier them,just wondered what you were doing and to check the doctor's place hadn't handed you anything.

well that's why I posted this on the UK site,hoping a recent interviewee would answer.anyway I can't do any more now,the medical people said they are sending it by courier, I will have to believe they will do that and concentrate on getting all the papers in a coherent order.

Don't know why the letter would have told you to bring them. Knightsbridge couriers them to the Embassy direct, and you never see them, except for the hugeazz X-ray envelope that's given back to you at the interview.

Was that wording on your Packet 4 interview letter?


Thanks, I called the medical place this morning and they confirmed that they do indeed send them by courier. I don't know how you know what packet number you get, I have never been able to work that out. But it was the one that said I had an interview and what to take with me.

OK, I have had the medical on Friday and due for interview June 5th. I asked when I had finished if I needed to collect any paperwork, no they said. Then on checking the letters sent from Medical place it said they would courier over the results before interview, oh good I thought, then proceeded to read the letter from Embassy, telling me what to bring, it said to bring "medical exmination results in an envelope sealed by the medical office". Too late to call for help as it was after 5pm, the medical office would be closed till Monday. So I thought maybe to put me out my misery and stop me panicking other folk on here would be able to shed some light on this. How do I get these results? Am I given them when I turn up at the embassy? Are they sending them to my home address? I am not at home, I am staying with friends near London so I don't have to go back to Scotland and come back down again. Any help would be appreciated.

My husband visited me for Christmas and New Year and I posted a similar question. He also brought a copy of the notice of approval and copy of his contract of work,but thee was no hassle at all at Heathrow. he was asked who he was visiting,he said his wife,asked for how long and he said 2 weeks,that was it. I wouldn't be worried at all.

Have you chased it up with the Embassy at all, it might worth emailing them.

if I have an interview for a visa on a Friday, if I am granted it when can I expect the passport back? I would want to fly back to Cyprus as soon as I can after it as my husband is there and then we will fly back to UK and sort out our stuff and fly on to US.

Just follow the format on the interview list that is already set: By clicking "reply" on the post with the most recently updated interview list, you can delete the words: [qoute] from the beginning of the post and [/qoute] from the end of the post to make it a new post. Add interview dates:
Just type in the interview date in the format shown and high-light the entire entry and click on the blue color in the color options menu tab.

Add the shiny red approval star: On the bottom of the interview list is the "Legend" which tells you that the red star=APPROVED. Just copy the entire link for the red star and paste it next to the name of the interviewee who has recently been approved.

Everything else is pretty much self explanatory in terms of typing in new information/deleting information/changing colors.

I hope this helps anyone who is interested in taking over the "Interview List" or just as a reference to anyone who would like to enter/delete/add changes or dates.



Finally after 4 years I got my visa, IR1 on July 24th and entered the country August 16th in Orlando, Florida with no problems, lovely folk at immigration.

do they ask you at the interview about your intended POE? I mean the visa is valid for 6 months, surely you may change your mind where you intend to fly to? I thought I'd ask as we are unsure where we want to fly in to.

I have another and hopefully final interview July 24th, had been banned for an overstay and so ban is lifted July 23rd, will fly to UK Friday to get ready for it. Am very nervous as I reckon we won't try again if it fails this time. This time round we are in same country, so we won't be separated, in Cyprus now but based in UK.

1. I need to know before filing in London for a spousal visa, does my husband need to be in the US with a job first, or can he be here in the UK with me? If he is abroad, does that mean he won't come to the interview?
2. What exactly is the benefit of an attorney?
3. I have an abandoned case from the US as my husband couldn't sponsor me as he hadn't sufficient income for the previous 5 years and I needed to sell my UK flat to raise funds. I have an approved I-130, can I use that in
London or do I need to start over with everything again?
4.How long does it all take and how soon after approval must you leave? I mean if I was studying here on a course that ended next June and they said in March I could go,must I leave then?

Can I ask you a question please? I read you timeline and note that you were married in US and then he came to visit you in UK. Well I am in the same situation. I am a UK citizen, living in UK, my husband is a US citizen and had to go back to US for work and while we applied for a visa.That was in August (although we started process in March). He is coming back for 2 weeks next week. He is flying in to Heathrow. I am worried about what questions they will ask him. I called the British Embassy and they said as long as he had a return ticket and proof of work to return to , it shouldn't be a problem, did your husband get hassled when he tried to visit you? Just to put our minds at rest.

I didn't know there was a difference, at the start of this dreaded process my hsband was living and working in UK.March 2007. In August 2007 he left for the US to work,thinking I'd be there before Christmas, in the end he had to come over for that, I then went back for a 3 month visit to wait for the interview. Back now in UK as visitor visa ran out.
I first of all completed a I130 form and therafter filled in whatever I was sent, I was sent I864 and DS230. They are still faffing with I864, have already asked about it last November and I explained why tax year and school year don't balance as that is what I was told to do when I called,so we thought it was all sorted,he has just had another letter from them asking him to redo I864 and to send to me, not back to visa folk as I am shortly going to be contacted re the interview, that was about 2 weeks ago. His job runs out end of May but will be paid till August as it was a teaching post and he is paid for the holidays.So we still don't knwo even if he finds a job before the interview if I will be allowed to use my funds and so get a visa, we are now about to start the UK visa process, much quicker and we are running out of patience and only have a few months until yet another school year starts.

I am very confused and the visa interview is coming up soon. My husband and I attempted the visa via adjustment of status in 2005, we couldn't do it as he had insufficient years of earnings as he had retrained to be a teacher and so had student years,even though he then was employed and would be the following year. I however owned property in the UK, the visa officer guy said that could be counted but I had to go back,sell it and put the money in a US account within 90 days, as well as apply for permission to get back into the country, in other words, impossible. So we gave up, came to UK for a year,he then went back at start of teaching year Aug 2007,we restarted the application March 2007(yes still waiting)I sold the property and have the funds in a UK account at the moment. Now his job is almost ended, he had a one year contract in a school, he is applying for other jobs. He has been contacted by visa folk and told they are still confused about his paying of taxes matching his stated income, of course they are different as the tax year is different to school year and he only worked one year in US and did some supply work in UK before that. My question is,does he need to have a job even if I have funds in a bank account in order for me to get visa? If he gets a job will I still get a visa or will they still insist on a co-sponsor, even though last time they said I needed either a co-sponsor OR to sell my prop wacko.gif erty?

Yup you're right, I sent my £10 away in November for the original certificate and had a letter back in March, yes 4 months later,saying I needed the other certificate, I was not amused,I thought I'd be with my husband by now at least, we have waited over a year now,and it seems like a lot of that is for nothing, we should have been told about this new superduper certificate (which cost £70 for a rush job and then I had my mother mail it to me by Fedex for a further £30). I was on a visitor visa in US while getting this done.

I have an email address from the letter I got from the police acknowledging my subject access request - I have emailed them asking for comment on this change.

For now, don't waste your £10 on the "old" method as it appears that the US consulate will no longer accept this kind of report for the purposes of visa applications.

If like me you are part-way through the I-130/visa process this is a bit of a nightmare, and it requires some clarification.

I will post back as I get more info.

Not very likely for this election.

You can apply for naturalization no earlier than 90 days prior to the 3 year anniversary of becoming an LPR.

If you GC issue date is 8/16/09 Then you can apply May 18, 2012 or later. Processing takes a bit of time.


OK thanks anyway, just thought I'd ask as I didn't know and it took 4 years to get the visa to come here so I didn't actually think it likely :unsure:

OK I know I am really early in asking, but I arrived in the country on Aug 16th 2009 on a permanent resident card, married for 6 years to a US citizen. Lived in US since arriving 2 years ago and want to know earliest I can start applying for naturalization as I imagine it takes some time. I would like to be able to vote in the presidential elections, or is that just not going to be possible as they will be in Nov 2012?

OK I have a question about maintaining a physical presence in order to apply for citizenship. I am here as a permanent resident, married to a U.S. citizen and have been since Aug 2009. I know I need to live here for 3 years before I can apply for citizenship. I know also that you shouldn't leave the country for over 6 months or a year. However, we are considering our options right now and as we are both unemployed teachers living off of ever-dwindling savings and have been since we arrived here apart from a few brief months of substitute work, we may take jobs teaching English in S.Korea. Our son lives there with his Korean wife. I can't find anything that says you aren't allowed to work overseas, but I feel that may be the case as I see they state that it is OK if you work for a US company, which this wouldn't be. We are only renting, so obviously wouldn't still be paying rent if we left, so I don't know how we would show we intend to return, except store our stuff and pay our taxes. We have 3 other adult children, my husband's dad and brothers in the U.S. Any input would be very helpful as we don't want to mess this up and end up stranded in S.Korea and unable to return to either of our home countries.(I am a U.K. citizen)

Well, if you lived at place A from date D1 through date D2 and then traveled from date D2 through date D3, I would put place A as the address from date D1 through date D3 since your addresses during travel are temporary; i.e., always use the last permanent residence preceding the periods of your travel. Just my personal opinion how I would handle this.

I know you don't need to own a home, my problem is having no actual address for a few months as we travelled. I don't know what to put down in the address part of the form.

Might look odd. Which addresses did you use on your federal and state tax returns (if you filed them), or what is on your driver's license etc.? Since you are applying based on marriage, they will want proof that you and your husband lived together. Proofs are tax returns, bank statements, lease/mortgage payments etc. So you might have some trouble if you just indicate that you camped around and lived in your car.

Tax return in 2010 we put the address in Arizona as that was where we were in April 2010, April 2011 we were in Washington and put that and April 2012 we are at the address we are in now. My drivers licence I didn't get until Dec 2010 when we lived in Washington. Bank statements were sent to my aunt when we were travelling, she got all our mail.We had no mortgage. So if you had no home then that is just tough luck? I guess I won't apply then.

I will have been a permanent resident by August 2012 and would like to start preparing my form to apply for citizenship. I took a look at it to see what was needed and note you have to put your address for the past 3 years.
We arrived in Aug 2009 from the U.K. (my husband is a USC)and travelled about until
we lived in Nov 2009 to Dec 2009 in Washington state,
Arizona Jan 2010 to Jun 2010,
again travelled until lived in Washington state again (different town)Nov 2010 to Sep 2011
and then to another town in Washington from Sep 2011 to now.
So for the travelling, living out of our car and camping periods,(Aug 2009 to Nov 2009 and Jun 2010 to Nov 2010, what do I give as our address? Officially I gave them my aunt in New York state, so they had something on record but I never actually went there or lived there. I only advised USCIS of our proper address in Nov 2010 as we had finally settled then. I know this is a muddle but can I just put, living in our car and camping or will it look odd? We were hoping to buy a cheap foreclosure but we never did and ended up renting in several places and looking for work.
Thanks for any insight anyone can give me.
