IR-1 / CR-1 Spouse Visa Process & ProceduresWhich one?
Hello,

My fiance aaron (canadian citizen) and I (USC) were completly positive that we wanted to go the K1 route, until I had about 80% of my I129-F prepared that is. I discovered that with a CR-1 he would be able to work right away when we move to the US, which is a huge plus. Basically I am just asking for your opinion on which would be a wiser decision.

We originally met online in 2007, talked to each other quite often, our talking became more and more frequent, and in 2009 I decided to go to Canada on a study visa. We met in person on September 5, 2009 and have been together ever since.

My main concern with the CR-1 (and potentially the K1 also) is proving a bonafide marriage. We are not married yet so we would be filing as soon as we are married, would that look suspicious? In our two years of online chatting, neither of us saved any of the IMs (kinda sad). We have been living in an apartment together, and already have a joint bank account, and a bill in both of our names. Would these few things, along with some pictures of the two of us, be enough for evidence?

I have study and work permits that allow me to stay in Canada until 2013, so speed is not our main priority, although I miss home so much, and can't wait for the day I get to go back, with Aaron.

We were originally planning on living in Canada once we married, but after much consideration we decided that living in the states would be better.

I dont believe we can go the DCF route, as I am not a PR of Canada?

pushbrk: I do believe I will need a cosponsor, as I am a student and working ALMOST full time hours. I read in another forum that if you were listed as unemployed, you would need about 54,000 dollars? If I find a cosponsor, what requirements would they need to meet? My mother would prbly cosponsor, but she does not make 54,000 dollars a year.

Hello,
I am new to all of this but here is a little bit of background info...

My boyfriend and I met online four years ago, two years ago i decided to go to Canada on a study permit, the two of us met up and hit it off! We have been together since September 5, 2009. We currently live together in Thuner Bay Ontario. If all goes as planned I will be done with school next May, and ideally the two of us would like to go back to Pennsylvania and get married. I have just a few basic questions/concerns that I have been searching for answers for, yet could not find...

- can i file the I129-F while studying in Canada or do I have wait, graduate, return to the US and then file?

- if i can file while in canada the one form where i have to show financial support, all my employment history along with money, resides in Canada with me, would this be a problem?

I'm sure I'll have many more questions throughout this crazy journey, thank you for your help :)

Since you don't need marriage license for the K-1 process, I don't see the fact of having it. It could potentially affects the k-1 process, because K-1 is for fiancé(e) not for married couples. Why you want to take the risk? Take out marriage from the K-1 process. And I don't think the City council will give you the license without you get married.


we WERE going to get married, we applied for a license but never actually were married, all we have is a paper that we would take for the JOP to sign, but it is still unsigned.

Just getting a marriage license won't matter. They will expire, usually in 30-60 days. Without having a legal marriage that is registered with the courts, it won't have any impact on your K-1.


so do you think i would need to wait until it expires to send in my 129f packet?

My fiance and I have been going back and forth between wanting to get married and apply for a cr-1 and just go back and get married in the US on a k-1. We even went as far as applying for a marriage license, however due to a few family problems back home I would like to get back sooner rather than later. I was just wondering if having applied for a marriage license would affect our k-1? We never actually went through with getting married.

I am just making sure I filled out my 129-f properly:

First off, I am the USC and living abroad with my fiance in Canada, I go to school and work here. Should I use my address in Canada or the address that I used to live at in the states? This is my mother's address and where both my fiance and I would intend to live for a little once we return home.

Second, my fiance has been to the US twice so far so I checked the yes box for question #11 "has your fiance ver been in the US?" but I am confused on what to put for #12, he is currently NOT in the US so what would I put for the arrival/departure record?

Now for proof of having met in the past 2 years ... we have been living in the same town since september 2009 and together since may 2010 ... we have our lease agreement with both our signatures on it, but other than pictures that is about it. we have only driven across the border and our passports were NEVER stamped by either country :( ... i thought about maybe going to the mall or somewhere and both buying something at the same store within minutes of each other and sending those reciepts? i'm not really sure what to do here...any comments, advice or input is greatly appreciated! thanks :)

I (the USC)am currently filling out my G325a and and it asked for an address abroad that I have been at for over a year ... I have been living abroad in Canada for almost two years now, but I have not been at the same address for one year, at least not consecutively. I did live in university residence for two school years (16 months total) but lived at a different address in the summer right in between of the 16 months ...I dont know if I should the school address, or perhaps my current address? I did just sign a new lease in April, and will be here for a year ... but again as of now, its only been 2 and a halfish months...

Has anyone filed the 129-f while living abroad? ...I need help with what address to put where. On the 129f itself one member advised me I should put my US address, however my mother recently moved, and I have yet to even step foot into this house. Therefore it appears nowhere in my past five years of residence on my G325a, and then for my letter of intent I am not sure which address I should put, my Canadian or US? ...The address in the US is where my fiance and I would be living when we first return to the states. Ugh I am confuseddd... any advice or input is appreciated :)
