My fiance sent off his check list for the embassy in Helsinki on Tuesday and he received an email today for an interview on Monday, this is to fast for us since I want to be there. In the email they are asking him for his 2012 bank statements. My question is why are they asking for this when I'm the sponsor. Can anyone shed any light on this for me.

Hello everyone! Just a quick question!

 

Do you guys think I would have a problem soon on the date of my interview because, I and my husband started chatting February 2013. He came to the Philippines June 1st, and we got married on the 29th. Then he came back to the U.S on July 3rd. Would the consul be suspicious about this because we met for only 4 months and got married right away plus my husband only visited here once.

 

In case you will ask, there's no question for love. We both love each other very much. In terms of the proof of relationship, I have all the evidence needed. I am just worried the consul might think I was just using my husband to get a Visa and a GC. I know I am just being paranoid here but I really would like to know what to expect in the interview so I can prepare myself. I want to stop stressing myself because i already have a lot of it with this Visa process. crying.gif

My interview would be on Monday June 09, 2014 at USEM Manila. Now we have a problem. On the P4 that the NVC sent me Financial Evidence is marked as "I". NVC told me I need to re-submit I-864 of my hubby and our joint sponsor. Only 1 page has a minimal error but NVC told me I need to re-submit all the corrected I-864 forms to the Consul during the interview. My husband mailed the corrected I-864 forms last May 06, 2014 and until now the forms didn't come yet. He mailed them through USPS. We're worried because its more than 3 weeks now and the documents are not still around. I've been checking them through our local post office here but still they're not there. 5 days to go before the interview and the papers are not yet around. We're afraid that they are lost huhu. Our joint sponsor is in Hawaii now for a vacation, he'll be back on June 10 but my interview date has already pass then.

 

Please help us what to do. Thanks guys.

questions,

1. if i allow my visa to expire will it automatically be cancelled?
2 follow up question: can we refile for another k1 or is there any extension for such visa?

A consular officer can revalidate a K visa petition any number of times for additional periods of 4 months provided the officer concludes that the petitioner and beneficiary remain legally free to marry and continue to intend to marry each other within 90 days after the beneficiary?s admission into the United States.
To have the petition revalidated send a written request to the Embassy that includes a statement of your intention to go forward with the marriage.

I have been seeing that K1 (I129F) interviews as of this date are scheduled for April and beyond --- While CR1 (I130) are getting scheduled for February and beyond.

 

Anyone seeing any differently?

Just keep your eyes on the appointments site and check and re-check often ... same thing happened to us, we were offered late April dates but I did not select any ... then all of a sudden January 9th popped up and we are good to go...

...wow ... are there really people like that ... that is for sure one unique way to honor your father's memory ... hope they had a will or her name on the deed  ...  if so contact an attorney to sort things out... short of that, she should walk away from it and let the kids frolick in their greed and compassion.  It will not affect her immigration status

A Filipina friend of ours was married to an American man for nearly 2 years.  He passed away about 2 weeks ago.  His adult children, from a previous marrige, kicked her out of the house and told her she won't get a penny of their Dad's money.  Her 2 year green card is going to expire in June so she needs to start the paperwork for that in a couple of months.  What rights does she have regarding the house, his money, and also will she be allowed to stay in the U.S?   Who does she need to contact for these things...the police?  a lawyer?

 

Any help would be greatly appreciated!

... and by now you probably also realized that it was not not necessary to show up hours in advance as they do not operate on a first come basis ... relax folks and be there 10 - 15 min prior to your appointed time

 

February 6, 2014

3:00 - Had breakfast, stayed at Citystate Tower Hotel for two nights, February 5-7.

5:00 - I walked from the hotel to US embassy - 5mins walk I think, I rented a chair for 30 pesos, we were waiting near the footbridge outside the embassy. While waiting I chatted with some k1 applicants. There were vendors selling cigarettes, ball pens, coffee, some were offering to have 2x2 sized pictures if you don't have them yet. There's also a small canteen inside the embassy.
6:15 - k1 applicants were called to go near the tent we were instructed to prepare the DS-160, appointment letter and passport, d greeter gave me a ziplock bag where the passport will be placed, she asked me if I'm pregnant (I don't know why she asked me that) I said no I'm not pregnant, she placed a sticker on the back of my passport which has my name, and barcode number. There were lots of people already, you will go through the X-ray machine, remember no electronic gadgets allowed, you will go out to another door that will lead you to the ticketing booth, there are 3 windows and I got my queue number 6119. The lady didn't stapled a small paper that has a list of all the requirements to be presented later on, a friend of mine had a small paper stapled in her queue number. We were instructed to go to door #2 if I'm not mistaken.

Went inside door number 2 (I think) another security check.
Sat down and waited for my number to be flashed on the screen. The numbers showing on the screen was random. The funny thing was, number 6120 flashed on the screen d lady went to window 34 I said to her "my number didn't flash" so I followed her to window 34, I was behind her and the Filipina officer asked "who is she?" I said I am number 6119 ma'am and she is 6120 and I said to myself "omg I just remembered the number shows up randomly". Lol. So I went back to my chair and I kept looking on the board/screen for my number to be flashed. I was having crossed eyed. Lol.

7:40 - My number showed up on the screen, 6119 window 53 for biometrics. The American officer asked my number, my full name and date of birth and then took my biometrics. The officer told me to sit down and wait for my number to show up on the screen.

8:20 - My number showed up on the screen - 6119 Window 43
Filipino Officer asked me for the ff:
1. Passport
2. Birth Cert.
3. CENOMAR
4. NBI Clearance (with USA VISA purpose)
5. I-134 Affidavit of Support
6. ITR - 2012
7. VA & OWCP (my fiancé asked for a copy last October, so the date of these docs was October 2013). The officer asked "oh he is a pensioner" I answered: yes sir but he has another house and somebody is renting it, so I handed him the LEASE AGREEMENT.
8. Visa fee receipt (the officer handed me back the other copy).

Filipino Officer asked me the ff questions:
1. Where did you meet and what year?
2. What site did you meet?
3. How did your relationship start?
4. Have you been to another country?
And then the officer asked if I am related to Mr. So and so who is teaching in UP because we're the same surname. He asked me if I need interpreter for the final interview I said no Sir. Then he told me to take a sit and wait for my number.

11:10 - My number showed up on the screen - 6119 window 66
American Consul told me to raise my right hand and read the oath.

The American consul asked me the ff while scanning our I-129F package:
1. Where did I meet my fiancé and what year - I answered the American consul - I met my fiancé thru Friendster in 2009
And then he gave me a pamphlet about domestic violence abuse.
2. How old is my fiancé
3. How old are my parents, I answered the American Consul - he then asked "isn't it weird?"
- I answered the American consul truthfully that it's not weird for us and my parents met him already and they always talk on Facebook and Skype etc etc. lol
4. Who is (name of the person), and why her name is on the money order - I answered him " xxxxxx is my fiancé's daughter etc etc... But I didn't answer it right about why her name is on the money order. Lol. The American consul told me 'that's not how it works in the US"... I just said to myself ok sir.
5. If my fiancé did petition someone years ago
The American Consul said Okay take your sit and wait for your number. I responded okay Sir thank you very much and have a good day, he says thank you, you too.

11:25 - WAITING

12:00 -1:00PM Lunch Break

2:00 - My number showed up on the screen: 6119 Window 71
The guy asked for my number and said "you're okay, and asked Home Delivery po noh?" I said Yes Sir, and he handed me my appointment letter I gave before entering the US Embassy, he encircled the HOME DELIVERY on my appt. letter and there's an IMMIGRANT stamp and he said "okay you can go home now".

Lol! I think I was approved.... ? Lol!!

Status since Friday: READY

I worked in Bangkok at the time...and me and my now wife traveled between MNL-BKK 3 times without CFO after she received here K-1 and when we finally traveled to the US, we did depart out of Bangkok...she has a rather thick passport with lots  of stamps ... maybe they did not notice her K-1 visa????... what you say actually makes sense so who knows.

 

 

 

 

Serious?  Your fiancee left the Philippines with her visa and no CFO, flew to (your example) Thailand, then had another separate flight to the USA?

That is totally untrue!  And for sure very bad advice.  

 

If you have a U.S. immigrant visa (k-1 is viewed as an immigrant visa) in your passport, NO MATTER where you are traveling to outside the Philippines, when exiting the Philippines you will need the CFO sticker.

.. nope, that is not the case ... CFO is just bureaucracy in the Philippines but is not required by the US ... you can leave Philippines without CFO by traveling through a country that does not require visa for PI citizens ... for example Thailand since no CFO is required to go there ... and then boarding a flight to the US from BKK.   For the child ...  if he has a US passport, no need to go backl to the Embassy, but she needs to go to the Philippine Immigration and get clearance to leave

Isn't the CFO seminar a requirement? If it's a requirement she cannot enter the US until she has completed the seminar.

AOS was filed February 12, 2014. We received NOA1 2 weeks later. We had to delay her original biometric appt by 3 weeks due to a scheduling conflict on our part, which was no problem to do. Her bio meeting was held March 31, 2014. Her interview took place on June 10 and we received her conditional green card on June 17, 2014, a tad over 4 months from the filing of AOS.

 

Our Experience: We applied for employment, AP and AOS at the same time. You will receive 2 appointment dates, one for EAC/AP and one for AOS. You can do both at the first appointment regardless of which appt it is that you attend first. At least in Hawaii, there is no need to attend 2 different appts.

 

Another note, our schedule had cleared for the original appointment date during which we had received only one confirmation of a new appt date (the EAC/AP). We decided to show up "Just In Case" to make sure we didn't "miss" an appt. It turns out we ended up with 4 appt dates, (2) original and (2) new. Well, that didn't matter to security. As long as we had ONE paper showing we had an appt at that time, they let us in. The immigration officer then said it was no problem to take care of everything regardless of when the appointments are. Painless. We were there for a total on 50mins, 20 mins wait time, 10 min interview, 20 minutes talking story about life in Hawaii and how it has changed.

My wife received her conditional green card 2 weeks ago! Only took a week from the interview in Honolulu. Awesome! Her name was incorrect but we already received the letter to correct this. As this was a USCIS error, there will be no additional processing fees for the replacement card. Yes! You do have a 15 minute recorded phone call verifying identity and course of action with a USCIS representative, no problem! I guess we won't be posting here for another 2 years when the condition release moment arrives. :joy:

 

Now, fo all da (new) bruddahs and (new) sistahs hea in 808.

I recommend Mabini Mansion in Ermita  .. it is a 10 min tax ride from MOA ... it is not a fancy hotel but they have really big rooms with a fully equipped kitchen and I have stayed here about 30 times. Rate is around $30 on Agoda.

I just want to ask an advice from you. Do you know any cheap hotel nearby Mall of Asia? I am planning to move to a hotel closer to Mall of Asia so in case i need to pick up my visa it will be faster for me to get there. As much as possible i would like it to be walking distance, if not.. maybe less than 30 minutes drive by jeepney.

I have only stayed in Manila a couple of times, So I am not familiar with the area.

I only know EuroTel on Pedro Gil street in Ermita.

Is this place close to SLEC?

I think Eurotel runs about 2300 peso per day. Any suggestions for a cheaper hotel/better hotel closer to SLEC.

Well, it is finally here. After the medical delay that added 60 days to our time line, we are finally here.

 

Talk about being a nervous wreak. I am sitting by computer in case something comes up and she needs to get ahold of me from the internet cafe across the street.

 

I been sitting here for 2 hours and the embassy is not even open at this time. Not taking any chances.

 

Yahoo email open : check

Yahoo instant messenger open : check

Skype at READY status : check

 

Well, I am ready on my end, I pray she is ready and in good form this morning.

 

She slept 2 hours last night, woke up at 2:00 a/m, left the house at 3:45 a/m, arrived about 30 min later. Poor thing been sitting or standing and waiting.

 

The anxioty must be simply killing her.

 

It is going to be a very long day ( for her ) and very long night ( for me ) at this time.

 

I am not going to bed until she is back at the house and calls me on Skype. The good thing is that our condo is close to the embassy.

 

Our interview is today ( Jan 02) at 7:30 a/m.

 

Sending out prayer request that all goes well. Bear and I have had a very long road to this point. Whew, we are both exhausted and ready to move on to the next stage in life.

 

Please pray for her. She is so nervous and scared at this time.

... some are fast and some take longer ...   I don't think anyone really knows why in spite of many theories ... in our case ...  we filed for K-1 on October 10, 2013, received NOA1 on October 14 ...  NOA2 on November  15 and had interview in Manila on Jan 9 ... visa in hand today on Jan 13 ...  so exactly 3  months.  I think the key is to have all documents in order and solid evidence ...  we had been dating since April 2011 and met in person 18 times so there was no questions at all about anything significant during the interview...basically take fingerprints, and the oath... and off to  window 72 and where to send the visa...real easy and painless process overall ... good luck

Me and my boyfriend met online last March 2013 and meet 4 times in person. We went home twice and introduced him to my family and will be finally engage next month when he arrive. We applied for a K-1 visa and was already link to the check. Now we are waiting for the documents from USCIS and hopefully will start getting the  requirements needed and submit them. How long will the K-1 visa be approve? We are hoping that I can come with him back to States next month. Or maybe not?

 

Would you think the the sort of time we've known each other will affect the approval?

Dude ... think, think and think ... tell her that there is no need to get a new K1 and that you want to go live with her in the PI instead ... and you will  find out very quickly whter you or the greencard is her priority. 

Thanks. This is very helpful. Just needed to know if we could start the application process here. I am hoping we get an interview date within 6 months, theat way she only has to return to the Philippines for a short time.

Does anyone know if a hardship waiver might apply in this case. I am a disabled vet and her leaving for an extended period of time will be an extreme hardship for me.
