I contacted USCIS today and this is a tough lesson learned. They will either 1. Return the I-129F to myself via mail for correct routing or 2. Forward it to the Dallas lockbox. Worse case scenario is they can "hold" it for up to 30 days prior to returning or sending it on.

Hi Everyone. I completed our I-129F and I sent it to the CSC servicing center for my state (OR). I just noticed that in the VJ flowchart it states:

"U.S. Petitioner sends compiled I-129F package to the USCIS Dallas Lockbox which will forward the package for processing."


Does this mean It will get returned to me or???

Its good to be a deep thinker and think different levels.. Kudo's to you. The above reply from Caryh sounds pretty valid...

Question 1 Re: I believe this means I've "filed" and would be required to file a waiver. I believe your right, just by what I have read on VJ and not searching past similar incidents.

Question 2 Re: I believe that meets the criteria for "had a petition approved within 2 years"... Again all things point to this is also correct to presume.

Question 3, (first part of the multi question question LOL) I agree, it seems immaterial to withdrawl now or later.

Question 3. (continued) Yes if (1) does not require a waiver, then this "point" is clear and you have only filed "once".
That being said if you do withdraw from (2) "and" (1) still not requiring a waiverr, then 2 should also be clear because it has not yet been "approved". ("Approved" being the key word in the sentence)

Your correct to presume that is IF you dont withdraw.. then #2 would still be "valid" and your answer would be "yes" and you will need a waiver for any future endeavour.

Regarding your continuing statements about "future" and "no future", I sympathezise with you being in this position, and i wish it on no one. Tho you didnt ask opinions on this, heres mine :)

IF theres any hesitation, then I'd say stop the process, call it a day, and let your self realize your gut feeling is telling you something, and its usually telling you right. I hate to throw that out there but i wouldnt sugarcoat this one and have YOU make the wrong choice.

And let's say u stop the process and you all work it out and want to continue forward. Consider it part of the "trials" that you all go through to make sure it really IS the right thing. It doesnt mean keeping someone set up in a nice home during this time period, but rather let it be like: she goes back to her ways, you go back to your ways, and you all start the email or chat exchanges again.

Good luck to you in this complex and difficult decision... Let yourself make the choice, dont let time passing by dictate your future abilities.

OK.... So I have my K1 visa in process. I listed the chilldren on the K1 application as well and we were thinking of doing the 'follow on" so that we can have things situated here. They are still minors also. Im unsure how this will work ( even after reading). Our goal is to bring the children as soon as possible ( within 12 months). <BR><BR>1. Are we doing the correct process ? <BR>2. Should they all travel together on the K1 visa or is it required that the children wait until the marriage is officiated? Any good advice is highly welcome :) thank you

Thanks all for the advice.. I am still waiting on our NOA2, and am gathering all necessary paperwork in advance so the next paperwork is pre-staged. Tho we thought about doing the follow on in a few months, I guess I should heed the advice and try for the single interview / trip process. :) :) :)

Initially, it was a temporary come over here kind of thing, and we were going to decide what to ship back to the islands, retire early and just set up house there. but I still love the job here, and the benefits of sticking around for a few more years far outweigh early retirement.

I guess its time to break out the calculator and see what a fam of 4 will cost coming this way (I-129F and I-130's and medicala, etc etc...)

Good Afternoon / morning / evening all.

Tho we are still waiting our NOA I to be reviewed, I am trying to be proactive in accomplishing all the paperwork for my fiancees children, so it is in hand and in a packate form and just ready to submit.
I cannot for the life of me find any place on the VJ website or others that provode clear information on which documents will need to be accomplished, etc etc.


I do not know if they should
1. go to the initial interview at the embassy with my fiancee
2. wait for another date/time because they will be a follow on but it will be soon thereafter.

The concerns I have is that if my fiancee comes here on the K1, and the children will follow on via K2 processes, would they then be required to fly fron Cebu to Manila for their own individual interviews and medical etc etc ? They are minors, the eldest is 15.

I need some good solid advice on which path to follow for all this to occur.

I have my affadavid of support completed, and the ability to support isnt an issue, I just dont want to be making short to no notice flights from the US back to the Philippines in oprder to complete their processes if their is a better way to accomplish this...

You didn't petition for the children. You petitioned for their mother. The approved petition makes her children eligible to apply for derivative visas. The reason the consulate usually wants to see the children listed on the petition is because they want proof that the petitioner is aware that the children exist, and acknowledges by this that they know the children will be eligible to apply for derivative visas.

The children submit their visa applications at the same time your fiancee submits hers. There should be instructions in packet 3 for derivatives. The consular process for K2's is usually the same as for K1's, but the forms and documents required are usually a little different.

The K1 or K2 nonimmigrant visa is US$240 ... So for myself thats 240 x 4 ( fiancee and 3 children) = $960 total for visa application fees ?

I-130 ? :blink: Are you thinking about I-134, Affidavit of Support? Check with your interviewing consulate for their specific requirements. For Guangzhou, I had to supply a signed original I-134 for each, K1 and K2, but only one set of supporting documents (in duplicate).

There is some information about the K-2 derivative visa for children available from forum threads. Google forum search can be your friend. You are on the right track by previously including them in your approved K-1 petition. The DoS Nonimmigrant K-1 visa FAQs provides some information. Namely, visa applications/forms/medical exam/fees need to be completed/paid for the children as for the K-1 beneficiary. Check the site's embassy info page and the Phil regional forum for any specific information.

Hiii Thank you also .... I "finally" saw it in writing on the wall here that the children are "K2" visas... seriously,,, its been hard to find anyplace that said it in black and white... This is a huge relief to me knowing i follow the k2 path for the children, exception some minor differences...

We recieved our NOA2 approval !!!! Im still waiting on the paperwork to reach my home and I'd like to start other paperwork now. The children were included in the original I-129F application (part B, item 13). Now, Im not sure which flow i need to follow for ensuring that her childrens paperwork is the right paprtwork to use and fill out.

You just need to keep the children's last name spelling the way that it is used everyday. This should be the spelling any documentation you might have to include will use. This is a common subject with filipino naming conventions. The US Embassy in Manila is very well aware of the different name spellings for the same person that can be common in the Philippines.

Our paperwork is at the NVC

All paperwork submitted up to this point has my fiancees childrens names listed according to the NSO Birth certificate's.

Possible Problem: Her last name is spelled with a "z" in it, and the childrens Birth certificates (including her name on the birth certificates) have a "s" instead of a "z". (they should all technically be with a "z")

Do I continue on with the spelling thats registered with the NSO? ( I think we should) .. We need an answer so we can get their Passport applications started... so we can have the DS156 and DS157 completed.


Going to the registrars office and starting name changes will for sure hold up the process...

Am I being over cautious ?

I agree... IMHO, an attorney doesnt have you at the top of their list in accomplishing the steps you need accomplished and they have other clients to consider ( and its usually based on what $$ comes into the firm).Sure, some have greater experience than you in completing the forms, but attention to detail and the urge to complete as soon as possible will place you months ahead (with regards to attorney priority verses your priority). VJ, its forums, portals, and people are a much better and more up to date resource.

You can do this your self, don't waste the money on an attorney unless you have a major problem. You will be OK, just decide if you want the K1 or get married and apply as such. If you can wit an extra month or so, get married then apply, saves a second application etc..

Still working on the passport(s)... When DFA asks for "other supporting documents" they mean it, but i think its based on their individual attitudes

Who knows why but "baptismal certificates" ( not birth certificates ) were asked for regarding her children. This would be a 3 month wait from the main church on Luzon.

Hopefully this will be resolved this week ( where its not needed ) otherwise ...I'll just have to run this request up the DFA ladder personally.

It's time to pay the visa fee, schedule the interview, and complete the medical. :thumbs:

Because we initiated the paperwork as spelled according to the NSO birth certificate spellings (from initial I-129 and onward) we were advised by DFA to continue to do the same, as errors in spelling are taken into consideration and since they wernt major differences and she provided all necessary documentation, all we needed was a letter of explaination from a lawyer... Theres different threads out here that pretty much summarizes the same :) Thanks for the reply !!!!! ( and helpful ) advice :) :) ed

I myself got the same problem..correction of errors in my Birth Certificate.
for I just have noticed that my mother's name is diff. her name in my
BC is Lucy and her real name is Lucia which is used in all her documents
and Identification and in my forms and MC.

I went to our Local Registrar Office and applied for correction of
error that will take like 2-3 mo. process not included the indorsement
period to NSO. but also requested for a certified true copy of my BC
then request an Affidavit of Explanation from the Lawyer while my
BC is on process. we are currently waiting for our case to complete
at NVC.

I don't think it really needs a Lawyer, all you need to do is go to Local Registrar office
and then file for correction of error. and they will give you check list of requirements
to bring so you can process. in my case they requested a copy of my original birth certificate
then a copy of NSO of my BC, then proof of documents that my mom's name is Lucia and not LUCY
so in my checklist for her is my Mom's BC, MC, her Identification Cards)Passport, Senior Citizen ID,
Postal ID, my sibling BC and a copy of our Baptismal Certificate and School record.

Hello Fellow VJ'ers...

My situation is this:

My K1 NOA2 has been approved and should be at the NVP Center waiting on them to do their processing.

My Facts are this:

Our I-129F Petition submission included the childrens names with the spelling "as written" according to their registered birth certificates. (with a "s" as noted below)


The question's we have are:


1. Although phonetically correct, the last name on each child's birth certificate has a "s" instead of a "z"
(example for part of their last name: _____osa v/s _____oza). The mothers name is also spelled with a "s" instead of a "z" on the childrens birth certificates as well).

(the mothers birth certificate and passport is with the "_____oza")

- I read most all threads regarding similar questions going back to 2006 and the concensus from those who have "succeeded" in getting their K1 and K2 family members over without delay would be to hire a lawyer and have an "Affidavit of Explanation" accomplished and for us to have ample documentation to back up the Affadavid should their be any questions.

- Do experienced VJ'ers concur?

- My other option and I consider this my last resort would be to initiate NSO Birth certificate name changes, but this delay might place us at risk of falling outside the NOA2 4 month valid approval window.

(As a side note: Two of the children's "local" birth certificates have already been recorded with the NSO with the misspelling. It is presumed the third child did "not" have the local birth certificate recorded with the NSO but this isnt completely verified)

2. Child #1 and Child #3 also have an extra "L" in the middle name of the mothers name on their birth certificates. Again these are phonetically correct, but with a spelling error.

- Regarding this issue, I prompt myself to refer to the same guidance as in #1 (above), exception that I will have a separate Affidavit of Explanation" accomplished for this along with the same type ample documentation to back up the Affadavid should their be any questions.


As I have read in so many places, we should accomplish all paperwork according to the individuals name according to the NSO registered birth certificates, as this is where the passport information will be verified against. This has been the path we have taken even with the I-129F.

So yes, I am at a standtill right now. The passports were going to be accomplished this week for the children, but we would like guidance (and a sanity check) prior to submission of paperwork. I know this will satisfy the NSO and Passport applications, but want to make sure that I am in good keeping with, USCIS and Immigration requirements on proper documentation.

I think if I start requesting corrections to the childrens birth certificates now, that this will only add confusion and unnecessary delays along with possible re-submissions of paperwork.

If your fiancé passes her Medical They will give her a date to come back to SLEC and get her results and medical will CD of chest X-ray

On the interview date she will have a time most likely 6:00 - 6:30 AM to be at the Manila USEM. She needs to have all her required documents in hand, appointment letter, and passport. Again refer to K1/K2 Interview Preparation Instructions as for what is needed. Make sure she has all papers organized. It makes for a easier processing at the embassy and shows seriousness. Buy a organizer with tabs. Label the tabs for each requirement.

Once at the embassy, she will fall in line. They will take her appointment letter, check passport and assign her a number. At the embassy they don't allow any electronic devices.

You are not allowed to enter the U.S. Embassy/Consulate while carrying any of the following items:

battery-operated or electronic devices such as mobile phones, digital diaries, digital watches, pagers, cameras, audio/video cassettes, compact discs, MP3s, floppy disks, laptops, or portable music players
large shoulder bags/purses - only bags that can be carried by hand will be permitted
bags such as travel bags, backpacks, briefcases, suitcases, leather, cloth bags, and zip folders - you can only carry plastic bags containing application-related papers
food items (refreshments are available for purchase in the waiting area)
sealed envelopes or packages
cigarettes, cigars, match boxes, lighters
sharp objects such as scissors, pen knives or nail files
weapons or explosive materials of any kind


If she needs her cell phone they will ask her to check it in at the security section. They will give her a card so she can retrieve at the end of interview.

They will give her a form to fill out on how to deliver the passport with visa. Either it's deliver to her home address or she can go pick it up at a 2GO location.

Once inside, she will need to look on the board for her number to be called. She will go to the window and ask for her paperwork. Then she will be finger printed. They will tell her to wait again. Once her number flashes again, she will have her first interview with Filipino consulate. They will ask her a few questions and check and process her documents. (MAKE SURE SHE HAS ALL REQUIRED DOCUMENTS). If all is in order she answered all questions to satisfaction. She will then wait again for her number to flash again on the board. Then she will have her final interviewer US consulate. Consulate will process her paperwork and ask a few questions. If all is in order she will be told to wait again for her number to flash. Then she will go to the 2GO window where they will take her passport. They will give her a receipt (make sure to ask if they do not give one).

That's it for the USEM interview. You can now breathe a little easier.

Now if there is a problem. They will give a 221g form and state what the issue is. Now you will need to get them whatever they want in order to proceed. Now this is pull a long process when your in Admin Review. Look on VJ for Admin Review stories.

It will take 5 - 10 days for 2GO to receive visa and passport from USEM.

Once you have received your passport with visa. Now its time for CFO (Commission on Filipinos Overseas). Now CFO seminar can be done in the beginning before obtaining the visa and passport. You will need to return to get the CFO sticker and Stamp in the passport after receiving the visa passport upon approval and delivery.

CFO is to inform fipinos about the country they are traveling to. The Good, Bad and Ugly. They will ask her some questions and issue her CFO sticker and seminar certificate.

Original and photocopy of Immigrant Data Summary for US bound/ Confirmation of Permanent Residence for Canada bound/ Certification of Eligibility (for Japan-bound);
Original CFO guidance and counseling certificate;
Duly completed emigrant registration form; and
Payment of the authorized registration fee.

You will pay a fee totaling PhP 650.00. The PhP 250.00 is paid as counseling fee at SMEF-COW or PRISM while the PhP 400.00 is for registration at the CFO.



If you fiancee is under 25 yrs. She will need a written consent letter from her parents or a parent will need to be there with her to give consent of there child's marriage.

> If you are between the ages of 18-20, CFO may require you to submit a letter of parental consent to marry.

The quote above is from the section where they are talking about getting married in the Philippines. However, the CFO has been known to require parental advice or parental consent from K-1ers.

It's all on the Consular's discretion whether they require consent from a parent or guardian.

You will need to pay a NAIA International Departure Fee: PHP 550 mandatory at NAIA.

Also when you book your flight. Check to see if all airport taxes are include in the price of the ticket. If not, your fiancee will need to pay the " Filipino Travel Tax " of P1,620.

I bought a inexpensive pdf editor, scanned, tweaked, modified, added arrows, pics, etc... That worked great for me, and then I saved it all as pdf's, That way she would have no problem accessing internet from a print shop to make additional copies ( if ever needed) ...

2nd... if I can add something else here,,, In using our technology to help us all get things accomplished a lot better, Loida and I also use the "Notes" section in Facebook as a way of knowing who needs to do what and when either of us has accomplished the task, we update it accordingly.

We "ONLY" have our notes shared with ourselves.

As you can see in the following example, I have copied and pasted requirements and this is how we track and manage each others responsibilities to make sure we have whats needed:

Hi....I would personally just go through the lists of requirements from USCIS, make sure you meet "all" requirements without a doubt. I wouldnt have trusted anyone but myself to make sure its just like they wanted it. By giving it to someone else to check, well they have no vested interest ( even lawyers)... if your uncertian of something by all means ask here,,, Sole responsibility for correctness I wouldnt pass on to anyone :) ( my 2 cents )

Hi...

We all have different situations.. some similiar in many ways... so let me add some thoughts to your thinking... But realize... our lives are fluid and things do change. I was going to go the Philippines to stay / retire/ whatever you want to call it and Loida and I were going to make a good life there. Thats all cool, but it also would have severely limited us on her ability to fly anywhere internationally (including the US) and it would apply to you too. if for exampls an emergency came up and she needed to go to the USA, the odds of you getting a visa "quickly" would be real hard to do. Another example would be if she were to be ill in the USA and you cant be by her side... Dual citizenship is a gift. I think the k1 option might work with a co-sponsor and proof of ongoing and continuous travel.

The other option would be to marry and then apply based on marriage. Im sure others more knowledgeable in this will have better advice.

Personally though, take the actions so that you both have the ability to freely travel singular and jointly if the need arises.

Im a Filipino citizen (living in the Philippines too) and I want to marry my girlfriend, what do I have to do? They said we have to apply here, then once approved we need to marry within 90 days in America. What if my girlfriend doesn't live or work in America? and we want to live there for good. thanks
