Hi everyone,

Both my I-130 and I-129F were approved this week, they sent the approval notices today!

My NOA 1's are respectively June 16, 2008 for the I-130 and July 29, 2008 for the I-129F :-) So anyone who's NOA's 1 are around those same dates must surely be receiving good news soon.

Funny thing is that we (my husband) changed his address with USCIS over the weekend, and on Monday our files were touched. Then again on Tuesday! I feel as though when we changed the address they noticed that we were due for an answer and quickly decided on our petitions.

I am so happy, I've been crying and laughing out loud for the last 30 minutes!! I am going out to celebrate with my family and friends tonight!!!

I sincerely hope and wish that everyone who's still waiting gets their approvals asap!!

is ur child the child of an american? If yes, I was told that they will not process the child as an immigrant. They want to process them as a US Citiizen so you need to start by filing a Consular Report of Birth Abroad. It is a form DS-2029. It requires certififed proof of child's birth certificate, US parent's citizenship, etc.

Then I guess they issue a US passport to the child.

Of course all of this is irrelevant to you if your child is not the child fo the US Citizen.

Good luck with the visa interview when it comes to evidence of bona fides. If you have to come here and tell us you don't know if your spouse filed an I-130 for your child insead of simply asking your husband. He either filed an I-130 for your daughter or he didn't. Ask him and answer appropriately.

He should have filed a separate I-130 for your anak. If so the answer is yes.

If he didn't file a separte I-130. Have him do so ASAP. She'll need it when you both adjust status when you get to the US.

Hello everyone please advice us we decided to stick the k3 not Cr-1 coz my husband haven’t file separate petition I-130 for my daughter and if he file now it takes long time to wait again to approve that and I don’t want to leave my daughter alone in my country..But we already paid the $70 for AOS and I sent already thru snail mail the ds3032 but we just received email from NVC that want us to pay the $400. Have you filed the 130s for the children? Are they approved? This could be the source of the problem.

Ask your husband to call and ask if your k3 is in "administrative processing" It sounds like it is. Im sorry, if that is the case.
If you are indeed in AP at NVC, you should be released and the case forwarded after 50 days(+/- a day r so). Find out if it is AP, as some people have found that they wont tell you unless you ask straight out. Then you can find out what day they received it and start the 50 days count from there.

My wife said that when they take you back to the another room it is called the "X" room. She said that some people don't even bother going back to the other room because the visa is about to be denied. The whole idea is to try and get you to sign something saying the relationship is only for immigration. That way they have a stronger case for the refusal.

It will no doubt improve your case if you continue your relationship so keep a record of everything. You or your husband need to call and try to find out why there was a question about your application and that you are wanting to immigrate because you are married and your husband lives and works there.

It is their job to try and determine if a relationship is for the purpose of immigration. My understanding is that there is one and only one valid answer you can give if you are asked why you got married or why do you want to go to the US?

Thanks for all the comments, i did sign because they will ban me for the whole life not just me and the entire family cant go to usa, My husband has k1 petition of his x that havent cancel at that time and also i had tourist application before that was denied they really dont believe me that i love my husband because husband just came here ones then married immediately then 1 year didnt come back after marriage,i explained but they dont want to believe me so the conclusion was immigrant purposes only, the consul said why i didnt apply for immigrant why i choose k3 , consul told me i have to withdraw because im not capable to apply for k3 visa because its really many issues came out during interviewed husband cant reach poverty level,they dont accept my co-sponsor either,husband filed bankcruptcy,husband many debts,husband dont own a house, husband didnt cancel x k1 petition.
The only thing im worried my marriage is it still valid after signed that statement that they wanted me to signed that married for immigrant puposes only and no love?I told them i dont care if his poor i married him because i love him, i said we can start a new life and solve the problem but they dont wanted me to become a public charge that's what they explained to me so i withdrawn and the word BAN makes my head crazy. after signed the statements the consul said anytime i can apply immigrant but i have to tell my husband to cancel the k1 petition that still active and he have to visit me sometimes here in the philippines, By the way my immigrant petition at that time was approve but we choose the k3 so that i can bring my daughter with me.well hope evrybody can understand me now

Hello fellow members I’m here again ,I’m very sad all the time if thinking my last k3 interviewed that I withdrawn of what I did sign in the embassy during interview inside the Fraud unit because they don’t satisfied my our relationship is genuine and came out so many issues, they don’t believe that no love at all , so in my statement I signed I married my husband for immigrant purposes and married no love but I know god knows how much I love my husband and my husband knows that too ,but what always bother me that maybe because of that statement make our marriage void please please enlighten me for those who has the same situation of me like that during interviewed .Is there any possibility that statement I signed make our marriage void?but our marriage is legal recorded in NSO and we still love each other and in fact my husband visited me here after withdrawn my k3 application because I’m so sad. Good point Joe. I've also read posts from other members where they are being told that the I-134 will no longer be used and the I-864 will replace it. It looks like it will depend on each embassy so best thing would be to contact them for now or check their site to see what they say. I also went to the USCIS web page and no, the I-134 no longer has the notarize portion on it anymore.

This is just misinformation spread through misunderstanding. It's against the law for Consular officers to accept an I-864 from a K visa applicant. They are not required to use the I-134 and some don't but they are not allowed to use the I-864 for anything but an immigrant visa.

Hello guys thanks for the replied I really appreciate for that ….u know her dad he signed at the back of her birth certificate ( acknowledgement) .when she was born my child using my name but when the law was change that illegitimate child can use the family name of her dad ..So We filed a first endorsement to transferred to her dad’s name so that’s why she using her dad name...but u know even we broke up her dad he didn’t abandon her his still supporting our kid. My question …… do u think I will ask for father consent? But he has passport now...Our interview is very soon do u think the consul will ask about that?

As long as he didn't sign anything on the kids birth certificate,no consent or anything..I'm also a K3 and K4.I have my other kid named after his biological father,but other kid is using mine although both kids has the same father.
