Hi every one. This is a great site. I need help on what I should do now. The I129f was voided the moment you got married. Simply notify the agency that you are now married and cannot continue with the 129F and are currently pursuing an R visa.

Agree. The only thing I would add is that if you have enough savings to be thinking of purchasing a house right away, you might have enough in assets to meet the financial requirements without having a co-sponsor. I don't think your wife's income in the UK will be at all helpful. However, a letter from your current employer stating that you will continue employment with them might.

Thanks again everyone. I always get such good information on this site, even if I don't ask the question.

I've rewritten the letter and bullet pointed everything like a timeline, and I've gotten it down to just over two pages. I've looked back through my emails and was able to find a whole lot of stuff that I can send, short things like "What do you want to do tonight?" and other stuff. I've got good evidence there, but as I was looking through them, I realized how few I have from the last year. I didn't have a computer at home until a month or so ago, right about the time the internet went down across West Africa. Anyway, we really started to rely on phone calls then. In these next few weeks we are going to have to just email back and forth a lot. That's not an issue because now the phone system isn't working very well. It's always something in West Africa!

I'm going to email the lawyers to get a quote about a consultation. Thanks for that suggestion.

Anyway, I'm feeling a little more confident about the whole thing. I want to have everything ready so that as soon as he gets here we can send the petition package out the next day.

I understand everyone's point about the emails. My husband's written English is limited (even though he thinks he could pass the toefl without even trying- HA) so most of our communication has been over the phone. And we aren't a very verbally demonstrative pair. What makes our emails so personal are details about the politics at my work, financial information, information about our families, personal and legal, etc. But I could black that out, as I now know, but what would be left might not be very helpful anyway. We mostly just call each other names and insult each other in our emails. "Hey Butthead, why haven't you sent that letter yet?" "F you, Dickwad. I told you I did that last week." You get the picture. I could certainly cherry pick a few that would reflect our affection for each other, but would a handful of emails, say half a dozen to a dozen, over a 7-year relationship raise more flags than it would lower? How many should I include for such a time period?

I would LOVE that. Does it also retrieve deleted videos? And does it retrieve images that were deleted years ago even if the card has been used thousands of times since? That would be fantastic. What's the program? It's not just pictures of us that were lost. Pretty much the only photos of his mother, who is now dead, were among those pictures.

We won't have trouble proving comingling of lives for the first 5 years of our relationship. We lived together in China for nearly the entire 5 years including the first 3 years of our marriage. He was on a spousal visa through my work after our marriage. He was on my health insurance, etc. And the embassy probably has several letters from me to them on file. I sent one each time he was applying for a tourist visa explaining why we weren't applying for an immigration visa. I have actually spoken to several COs from that embassy, but they have all moved on since then. I don't know how meticulous their record keeping is, but if they do keep records it should work in our favor.

I think the CO at the embassy in Benin will be pretty open to our marriage, though I'm trying to prepare for the opposite. I'm trying to prepare for a Nigeria-like experience. In our favor is the fact that very few R-visas are processed there each year. I think only 2 spousal visas last year. And very few Beninese immigrate to the US period. They prefer to immigrate to France.

But I'm also worried about getting through NVC. Don't they make judgements before it even gets to the embassy? Or is their role only to make sure all the papers are in order? I can't figure that out from the guides.

One other thing. He is coming in a few weeks for a 6-month visit. I'm going to wait until he arrives to get his signature on the G-325a and send out the petition then. I won't be able to include any evidence from that visit in the petition packet, but he can bring some with him to the interview in about a year or so.

I'd still welcome any other thoughts. This is such a nerve-wracking undertaking. The more feedback the better.

There are several issues that will probably raise some flags about our case.
1.) We are a May/December couple,
2.) We only had a civil ceremony with no family and there are no pictures from that year.
3.) We have been living in separate countries for the last two years of our 5-year marriage.
4.) We haven’t started the process yet.

There are reasons for 2-4. Number 1, I cannot explain. I still don’t understand how I ended up in such a relationship. blush.gif

Number 2 was basically by design, but despite our plans to "elope," some of my family flew to join us. However, his mother died before we left China for our wedding destination, and so we had to postpone for another six months, and no one flew back the second time. Then, our computer crashed taking all our pictures of the first 2 years of our relationship with it. mad.gif

Numbers 3 and 4 have long, involved reasons that probably wouldn’t make sense to anyone but ourselves, and sometimes not even to ourselves, but I feel the need to explain them to the people who will be deciding our fate. There is no reason except the separation and delay in applying to doubt our marriage. The reasons for the separation and delay are financial, organizational, circumstancial, and legal. wacko.gif

Would you send an explanation letter in this case? I’ve written one, but it is 9 pages long and I can’t figure out how to make it shorter.

Or should I just let the evidence stand for itself?

-Our daughter’s birth certificate
-Her baptismal record with my uncle listed as the priest, my brother and his wife as her godparents, and pictures to mark the day
-pictures of my husband with my family including a professionally-taken family portrait of all 32 of us - my parents, siblings, siblings-in-law, and nephews and nieces on the beach during our annual, week-long, family reunion under one roof (My husband, being the only Black person in the portrait, stands out.)
-pictures of our daughter with his family in his country and pictures of me with his friends and family
-pictures of the party his countrymates in China gave our daughter
-a link to a website with my family tree prepared by a distant cousin dating back to c. 1600 that includes my husband, his birthday, our wedding day, and our daughter’s birthday, etc. (I could also include a photo of the handwritten family tree in my parents house that includes my husband)
-a picture of a "family tree" cake that my sister-in-law made that depicts my little family with one pink face, one tan face, and one brown face hanging off of one limb of a 9-limb tree.
-affadavits from one or two of my sisters, my parents, and another couple who are Canadian/Beninese and whom we knew in China and remain very close to.
-I can include passport pages including two visas to his country.

We don’t have phone records because we use pre-paid phone cards, and we don’t have emails because they are very personal, and I don’t want to share them.

I can't tell you definitively. But most people on here say the K-3 is obselete. I'm pretty sure you've gotten through the part that takes the longest, so it would make sense to go for the R-1. I don't think it would take less time to schedule an interview for a K-3 than it will for an R-1.

As for the embassy in Athens, I can only tell you about my sister's experience, but they were filing DCF. She said that the only thing that held them up was getting her husband's papers. They got the visa almost immediately once they had the papers straight. I can't remember if she said they picked it up the same day or later. But it's hard to compare a DCF with a petition filed in the US. The reason it takes less time with DCF is because you bypass NVC, and you're already finished with that.

My advice would be to drop the K-3. It will save you money and your husband will be able to work almost immediately, so that means it will save time as well.

From what I understand, once your wife activates her visa by entering the country, she can leave again almost immediately. And she can stay out for months at a time. I think there is some limit, but I don't know what it is. I also know that she can get a special visa that used to be called a white passport that allows her to keep her greencard without actually living in the US, but I think it is harder to get since 9/11.

I've had several friends who have lived for years and years outside of the US and still maintain their greencards, but they had the "white passports" before 9/11.

I guess I'm totally ignorant. I would have thought no expiration date would be a good thing. Anyway, I think the expiration dates are uniform within a country. Whatever the validity is for Pakistan should be the validity for any PCC without an expiration date. But what do I know? This has confused me from day one.

There is no reason to delay activating your IV. You can activate it October 1 and then return to home to your country October 2, then reenter the US as a PR in January. Why wouldn't this work for you? You still get to travel to the US but not permanently move there until January.

I don't think the other way will work for you. I don't see any border agent going along with this as it is totally unnecessary.

Can you get a letter from your school stating that you share an apartment? Is it in your contract, perhaps? Is one of you listed as the spouse of the other on your work visas? I know that the teaching couples at my school were only allowed to list their bank accounts in the husband's name, but there was some sort of visa documentation showing the relationship. Perhaps you can ask the HR person at your school. Perhaps there are other benefits they offer you. My husband was given health insurance as my dependent, and he was also given travel expenses and other benefits. And, after his student visa expired, he got his resident visa as my spouse. All that was in my contract and I had insurance cards in our names.

I think you put N/A for 14. But I don't know what you do for 14A. I'm a USC by birth and I put N/A for 14, but I checked NO for 14A. I was told not to leave any question unanswered. Hopefully someone with the same situation as you will answer your question.

Totally agree with this. Plus, if your lawyer has already submitted an I-129F (regardless of the outcome) it will be difficult to prove there was no intent to marry on a tourist visa (VWP or B2). If you file the I-129F now you could be together within 9 months (sometimes significantly less) at no risk to your relationship - any other way carries a risk and however small people are commenting that risk might be it is still what it is - a possibility you will find it difficult to remain together in future.


I was going to point out the same thing. I think people do get away with this. In the beginning, I was mislead by two of the questions on the I-130, questions 14 and 22, and I thought about my husband coming on a B-2 and filing an AOS, but then I read a little more and realized that would be fraud. We are still planning on my husband coming on a B-2, but only for a visit. In your case, the fact that you have already filed a K-1 would seal it if they decided to question you.

I know it is hard to wait. Believe me, we all know. We have a 16-month-old daughter. She will be almost 3 when her father can finally join us for good. (My fault. for not filing sooner. It's a long story.)

hello. it's been 2 weeks since my fiance sent out the petition to the texas lockbox via USPS priority mail. according to the post office it should have taken 2 days for the package to arrive.

but we still have not received a noa 1, despite the attached e-notification form g-1145. neither did the check cash.
i read it usually only takes a few days for the check to cash, so i am starting to ponder.

did this happen before to anybody else?
what could be the reason?

If the petitioner's income is sufficient there is no need to use a co-sponsor. The co-sponsor cannot augment the petitioner's income, they need to be able to provide support on their own based on their household size. In other words if the petitioner's income is short, the co-sponsor cannot just 'add' the amount they have in savings to help. They would have to fill out their own support form, and meet the poverty guidelines for their household size plus your fiance.

When I filled out the I-134 for my fiancee, I only included my income. I had my employment letters, paystubs, and last 3 year tax return transcripts. I also included a co-sponsor, who only included his income, employment letter, transcripts and paystubs. I included a co-sponsor as a 'just in case', because although my current income is over the 125% mark, my past income was not. At my fiancee's interview, as we gave them all the paperwork, they handed back my co-sponsor's information--they didn't need it.

If your co-sponsor has enough in income to support their family PLUS you, then you don't need to put any information down about their savings. You can't use their house if they are living in it because it would create a hardship. If their income is barely sufficient, or maybe even lacking, then including assets such as their savings will help.

yes. he will definitely look for a job. i'm just trying to figure out what exactly the deal with the I-134 and co-sponsors is still.

If they accept a co-sponsor, there can be only one. You will need one co-sponsor that has the required income for their own household size plus the foreign fiance(e). There is no combining of incomes with the I-134.

i'm anticipating the news of my NOA2, and i want to get prepared for the next steps ahead of time.
so i was reading up on the I-134, affidavit of support, forms and might have stumbled upon a problem.

my fiancé is currently unemployed, but he has had several jobs in the past and has savings. also his family members would be willing to be co-sponsors.
i myself was a student until recently and am not employed myself, but do have a bunch of savings and financial support from my parents.

could it cause a problem with my visa, that he currently does not have a job? or that we both are unemployed?

what i found out so far in my research is mixed information. perhaps somebody has had a similar case or any experience with this situation. thanks a bunch!

You can just go to the USCIS website and see the month that they are currently processing at. They update it once a month.

For example, as of the last update in February, CSC was processing July 2012 filers. Hopefully that will move to at least August 2012 when they do the March update.



i don't think the USCIS website is that accurate of an information source. the stated "july 18th" simply means that is the case with the earliest date they're working on. not that they're working only on july filers now, as far as i understand. f. i. august and september filers have been approved recently.
also, their graphs about the visa volume and trendcharts haven't been renewed since december 2012, so i don't know how seriously they take those monthly updates.
it sure is a help, but not a very big one.

It would be nice to think that the lack of NOA2s for CSC is because of people not updating their timelines, but why would there be a difference between the compliance of VSC filers vs CSC filers?

i agree. i am certain it's not the only reason for the little updates concerning the CSC. but it's still helpful and comforting to see CSC filers get their NOA2s, so we know at least something is happening.

So I still have at least until August to hear back about my NOA2 but I'd like to be prepared. I would require a co-sponsor for my visa IF I am still working part-time when the NOA2 arrives. Can someone tell me what the process is like when you have a co-sponsor, what stigma it puts on your case? I'm young and broke due to college loans and education debt. How badly does this reflect ? What advice would you give? What steps can I take to prepare?

first you will have to find out if ghana accepts co-sponsors. if they do, you should be good. you can look at the country's portal site here http://www.visajourn...p?country=Ghana or call the embassy in accra.

i have the same problem with my fiancé being unemployed at the moment, and we are still waiting for the noa2. so i called my embassy to enquire about co-sponsors.

it's the same with me. i also never received an A-number, but apparently they changed the system sometime in october. so instead of getting your number assigned towards the end of the process, filers now get their A-number when they get their NOA1.

you will get your A-number close to your NOA2 date i suppose.

what documents does it come down to?

would it be enough if our co-sponsor only includes a letter of employment and at least 2 years of tax returns? 


his annual income is well above the poverty line, so there are no bank statements needed. correct? i read that you only need bank statements, when you put down assets, which is not necessary when the income is sufficient. 

also i read if the letter of employment includes when he started to work, what his annual income is and if the employment is permanent or not, you don't need to add recent pay stubs. is that correct? 


also, does the form I-134 usually need to notarised, or does that depend solely on the consulate and country of the beneficiary?

and another thing, this january 2013, he came to the Philippines and weve seen each other but that is after we filed the application. should we call the uscis, tell them our story and asked if we could just send evidence that were together? this is driving me crazy.. we were left hanging.. all we want is to get this over and done with..

Hi everyone!

 

 i filed on sept 27, 2012 and on april 20, 2013 uscis changed the alien registration number. i checked the other 4 cases with the same date as mine. 2 had been approved and the other 2 were asked for RFE. im not sure as to why our case has been left behind but i think i have an idea. my fiance got his USCship thru Naturalization.

 

so here's the thing:

 

my fiance and i have known each other for 9 years, we were college classmates turned into lovers. after graduation, he had to go to the states but we promised each other that we will continue our relationship. he then stayed in the US for more than 2 years so he could get his naturalization. one day he asked me to marry him while we were skyping. i was excited and we were so inlove so i said yes. we waited until he was financially stable and got his naturalization before filing for a fiance petition. while gathering all the documents i then noticed that part of the requirements is that the petitioner and the beneficiary should have met physically within 2 years before filing the petition and if they havent, they should provide an explanation. we explained on the application that i, the beneficiary, tried to apply for a tourist visa but was denied and the petitioner was completing the 5 years stay in the USA to get his naturalization and couldnt visit the Philippines because he just started working and doesnt have enough savings. as soon as he got his naturalization he applied for a fiance petition and didnt waited another days to come and go without doing anything to make us be together. i was hoping that this would qualify for the extreme hardship thing but reading all the comments and suggestions here, i think that would cause for a red flag. isnt it?

 

does anyone here have the same experience as mine?

tell me if im such an idiot for hoping that we will get approved!
