As far as I know you can't get a visa to a country you are already in. You could just adjust status now on a tourist visa by getting married filing AOS.

It would be maintained after coming to the US. I don't have any family members in the US who could help us, its all up to us. He's been making the income since December 2011 and no sadly he doesn't have $55850 in assets. Is there nothing we can do/is there anything besides a co sponsor we could do to help our odds? IE money saved or anything?

Maintaining the job would mean that there would not be much break in the income. Such as working for the same company overseas or having a definite job offer. However, as a K-1 entrant cannot legally work until they file AOS with EAD he will not be able to work for several months after entering.

This is a link to an old thread on the topic. He would need to have considerable assets to be able to self sponsor. It seems to be 5x the amount needed. So $55850 in assets.

They want to see sustained income, not just started making that. They do occasionally accept the beneficiary's income if it will be maintained after coming to the USA, but given he's just started making this money its pretty iffy they'll accept his income. And they want a USC on the hook as the sponsor. Even with no income, you have to be the sponsor. You're probably going to need a co-sponsor. Now to add a bit more trouble, sorry, the embassy is not required to accept a co-sponsor for K-1 visas. They are required to accept co-sponsors for a CR-1 visa. The local UK forum can give you an idea of how accepting they are of co-sponsors at the UK embassy.


UK will accept both joint and self sponsors.

Hello all! My fiancé and I hoping to get some advice and help with our K-1 visa!

First a quick run down of our situation:

I'm the US Citizen and he's the UK Citizen

My fiancé and I met in November 2006 shortly after we started dating online. Seven months later he flew out to america so we could meet, he stayed for 3 months then went back to England, 20 days later he flew back out for another 3 months then again returned back to England. Ten months later he was able to fly back out again and stayed for 3 months. Upon his arrival customs held him for 2 hours and told him he can stay for the 3 months but would not be able to come back to america without a visa, and if he tried it again he would be de-ported. So we looked into visas, and at the time the student visa seemed like the best option, our local collage had a program and we got everything all okayed by the school. He even booked another flight to go home a week early so he would be able to make it back in time for beginning of the school year. My family said they would support him and provided a bank statement along with all of the other necessary paperwork. His visa was denied because the interviewer said her friends wouldn't give her that kind of money and she didn't think it was creditable. Due to financial reasons and the visa being denied we weren't able to see each other for 3 years but talked every day and was able to keep our relationship going. This January we were finally able to see each other again and on March 1st I flew out to England! I arrived and we decided to apply for the K-1 visa so we got engaged and we submitted I-129F, on March 29th they received it and sent us our NOA1. We decided to change my flight so I could stay the full 6 months (I was already planning to stay 3) and hopefully I'd still be here for the interview. Looking back that might have been a misjudgement? I'm still not entirely sure. I'm leaving for America on August 27th.


Our only concern for not getting our visa the income. He has his own business developing apps and makes more money than the government poverty line but he only started making that much at the very beginning of this year (hence being able to see each other again since January it just took time to get my passport and everything all planned out), meaning he doesn't have tax returns for the past 3 years showing enough income, just this year, are we doomed? :| :(


We really don't want to be apart again as you could imagine, lol 3 yrs apart is long enough! Is there any likely hood that we could get to the interview before I have to fly back?

And if not is there any way I could come back if the interview happens after I have to go so I can be here for the interview? ie if the interview happens in October could I fly out again for the interview?

I'm also slightly confused by the process of it all, We sent off our I-129F and received our NOA1 and to my understanding the next step will be getting our NOA2 and then he'll have to have a medical and gather all the documents and proof we have for the interview? Is this correct or am I missing something?

Also I've read a lot of interview questions and some slightly confuse me, one person was asked when their wedding date was, how are you supposed to plann everything before you even know if your going to get your visa?

Probably no likelihood of having the interview before you fly back, but for the UK, the US citizens don't typically go anyways. This flow chart is helpful: http://www.visajourn.../content/k1flow. You as the citizen need to be the one to sponsor, you need to show your income and can use a joint US sponsor if needed. Questions in UK are usually general, if you don't have a date give an approximation. Not required as they know the circumstances.

Anyone can be. A high prevalence of people from the middle east seem to be put in AP but it could be anyone, especially if his or her name is similar to a known threat (past or present).

If you get legally married in Thailand, he can apply for a non-immigrant O visa. That's what I did. It's a one year multiple entry Thai visa. I had to apply for it at the Thai embassy in Singapore. Check out this website: www.thaivisa.com


But it is that you have to reside for a certain amount of time on a non-immigrant visa. So wouldn't the clock start when he got the new O visa.

Actually you two could get married in Belgium and file DCF that would get you there faster and cheaper and you would enter a permanent resident. Check to make sure that Belgium allows DCF, I believe they used to at least.

I assume you do this all under that table, correct? In that case you have no proof to send in. You can send in a letter explaining yourself, but it will not do much to prove income. However with a co sponsor it really doesn't matter.

Hmm, but these 2 sites for Wisconsin say out-of-state residents can apply, but only in the county where the marriage will take place, though it could be different for each county:

Hey guys. First off, I'm new here as you can probably tell. I'd like to start by saying that you're all really awesome and a great help, and this site is an absolute godsend!

As you all know the process of applying for a visa is incredibly stressful, and my journey is only just beginning. I'm currently in the process of putting together a K-1 I-129F package with my fiancée whilst she is here in England with me. I feel like I've gotten to the point where we're almost ready to send it but I had a few specific, and slightly random questions to ask, and thought I'd better run them through those with a good amount of experience. I'd also like to break down our package so far to see if it's considered worthy enough of sending at this point, if that's alright. Here goes:

Starting with a quick overview of our package thus far:

Cover letter, signed by petitioner (needs to be dated?). Yes

I-129f, signed and dated.

I-129f supplement (Q. 18), signed and dated. For this one we outlined how we came to meet each other (online through a mutual friend) and then we made a small timeline of all the dates we've visited each other over the past 3 years, with little details underneath. Is this too much or is there no such thing? No, that's good

G-325A for both of us, with pictures in plastic wallets attached to a sheet of paper behind corresponding form.

Scan of Petitioners birth certificate.

Letters of intent, signed (needs to be dated?). Yes

Proof of having met/ongoing relationship. This is a big one of course, probably the cause for concern with most people. Here's how I compiled our evidence (hopefully it's okay to do it this way). I made a separate document in Word for each time we've met in the past 3 years. In this document I have supplied information that's related to the specific trip. For instance, one of our visits went from December 15th 2009, to January 6th 2010. I have attached two pictures to the document and labelled them with captions stating the date and location they were taken. Beneath the pictures I have paperwork from the flight that's been scanned, it clearly states the date, my name etc. We've basically done this six times, for the six different visits. Is this enough evidence to provide? Does it also prove that we have an ongoing relationship or do I need more? We have chat logs but they're from MSN, and I feel it'd perhaps be a little useless and/or annoying to take a screenshot of all of our chatlogs in a folder and use that. Not really necessary to provide the chat logs. The pictures and boarding passes are good

Now for some specific questions.

When filling out the forms, I-129F, G-325A etc. should we leave boxes blank that do not apply or should we fill all boxes with N/A unless stated otherwise? Put N/A or None, don't leave things blank

Should we sign the papers we compiled as evidence or is that unnecessary? No need to sign anything other then the forms and letters

We plan on putting the package together by hole-punching the top and using split pins, then using plastic tabs at the bottom of the entire document to provide easy access to specific areas of our petition. Would this be relatively hassle free for the guys handling our petition? They take apart everything so that would probably be a hassle. Paper clips are good. They take them apart and punch two holes in the top and place them in a folder.

I'm an English citizen moving to America (obviously). Is there any specific tips from those of you who've been through this already regarding the process? Is it going to be any easier for me (here's hoping :lol:)? UK is pretty simple I suppose. Straightforward process and a good supportive community here to guide you for the embassy things. Look at the embassy info at the top of this page for that info.

I might think of some more things to ask before we really finalize our package but this is it so far. I'm literally just trying to clear my head at the moment. Any and all help is welcome, and thanks a lot for taking your time to read this. Cheers! Good Luck!

It's definitely not him, and I know it needs to be returned and reissued if it's supposed to have a photo of him on it. I ask because I've never had a visa with my photo on it for any country I've been to and he could be describing to me a historic figure pic or something that goes on all the visas.

So, someone who has seen one, or has one, please confirm - a US visa does in fact have a photo of the passport holder on it?

There are two different processes going on here. The K-1 petition wants to know that you have met within the last 2 years. You can establish this by using boarding passes and passport stamps and pics. However, for the embassy you need to show that you have an established relationship. This info can included in your petition which is know as frontloading or it can be brought to the interview. This can include all info about your relationship that you want to include.
