We submitted our visa application and civil docs on 17 Nov by email to NVC.

My foreign spouse is from Taiwan. We reside together in Canada, each on our own respective Canadian temporary work permits that expire in March. We will probably extend the work permits in March but cannot do so sooner.

Today, we received an email from the NVC containing a list of documents we need to send. The only document they have requested is a Canadian visa for my foreign spouse with validity of at least six months that gives her the right to remain in Canada for at least six months. The problem is our current work permits have only 4 months left. We will probably extend the Canadian work permits in March but cannot do so sooner.

So we have two choices. Put our US visa application on hold until March when our Canadian work permits are renewed for for another year. At which point, we will send a copy of the new Canadian Work Permit to NVC and proceed with a Montreal interview.
Or, we can just have her paperwork transfered to Taiwan and she can fly to Taipei for her visa interview.

Our question is...how much longer will the paperwork take to get to Taipei and proceed with the process there? Or is it better to just wait until March and proceed with this in Canada?

According to those instructions, you *may* qualify to use I-864W or I-864EZ. But, if not, you'll fill out the I-864.
Depending on your circumstances, you *might* also need I-864.

My husband was denied a tourist visa to come visit me (we weren't married at the time) in 2009 because he didn't bring sufficient papers to the interview.


We are in a similar situation. Wife was denied a F-1 study permit in 2009 and her then-active tourist visa and a prior & unused F-1 study permit was cancelled. She subsequently applied for a tourist visa and was further denied. Both cases issued 214b letters. We specified this on our DS260 application but we do not believe this will adversely effect the application as (1) she did not enter or remain in the US improperly at any point in the past and (2) The CR-1 is an entirely different visa category.

Our interview in Montreal is expected next month and if there are any problems, I'll be sure and return here and report.

We sent the copy of the final judgment with the i130 but at NVC time i went to the courthouse and told them i needed a certified copy of my divorce decree... they used the final judgment but on top they had a paper that was sealed with gold stamps and signatures declaring my final judgment as a true copy no RFE or issues


Same here. Just got a certified copy from the courthouse and they also attested that the divorce order, now 12 years later, is in it's original effect. No flags raised at any point so far from either the USCIS or NVC.

You don't need Skype World Unlimited to call the US from outside north america. Get either an unlimited US plan or put money on the tab and pay the 2 or 3 cents per minute.

I am wondering if Google Voice could be used as that gives FREE calls to US and Canada. I know you need to be in the US to register for the account so have someone in US register. You can still log on from outside the US. I'm just wondering if you can place calls with it when logged in from outside the US.

It just seems like that this process will take until april or may and i wanted to know if she can come here on visitors visa...in feb?


See my earlier post on this in a different thread.

The only case I know first-hand for someone coming from a non-waiver country with a pending I-130 did this by booking an air ticket this month to Mexico with a stopover in Los Angeles was successful in getting a transit visa for ~36 hours. This will allow them to leave LAX terminal on christmas day, enjoy time with family in the LA area and then board the flight the next day for a quick holiday in Mexico before heading home.

This is, at best, a gamble as the US consulate worker has absolute discretion in approving your transit visa. There is a chance of approval. There is a chance of denial. If denied, you have an air ticket in your hand you can't use.

I suspect the answer to my question is largely dependent on what location my spouse will be interviewed.
She is to be interviewed in Montreal next month.
I understand I cannot be with her at the actual interview session...correct?

Is it important for me to travel to Montreal and go with her to the consulate?
This is quite an expensive proposition for us. Is it really a deal breaker if I don't go?

It seems to me that it makes sense to apply for K-3 IMMEDIATELY when receiving the NOA1 just in case there is a delay in processing the I-130. You know... just for backup.

Obviously, there is no general information regarding this. If a problem does arise from a missing/included period after Ma. then it will be due to the interpretation of the individual processor who is reviewing your documents. Highly unlikely there is a specific policy concerning this. Hopefully someone with specific experience with this will respond here.

We were just wondering that last night. We've followed the appointment letter sent to us by the NVC.
There was a document list on the last page and that's what we're bringing.

It says to bring originals of the financial documents sent previously. For us, that is last year's tax return for me but I'm also bringing the previous two years' just in case. The letter explicitly said my (petitioner's) birth certificate not needed so I'm not.

Am I missing anything to be brought that wasn't in our letter?

Hi,

I (the U.S. citizen and petitioner) live in Canada with my Canadian spouse. I would like to file the i-130, however I was just reading the instructions for submitting the filing fee, and it said that the check or money order must be drawn from a bank or financial institution in the United States. How am I to obtain that if I am currently living outside of the U.S.? I can't just take a jaunt across the border to go buy a money order... any advice is greatly appreciated!

Yes, that's what we did. I first sent a CanadaPost US$ money order which was promptly RFE'd back to me.
So, yes, we next took a cross-border shopping trip, got a US US$ Money Order drawn on a US bank, all nice and legal-like, and they accepted it. I think I saw somewhere that they'll also take a personal check drawn on a US bank but I never tried that. Could have though.

Is what I listed above enough? I am worried a lot, I miss my wife :(.


The amount of proof seems to very GREATLY from consulate to consulate. Like real estate, it depends on 3 things: Location, location, location.

If I were asking this question, I would place the greatest value on the feedback that comes from people working with your consulate or at least those consulates in the same the country.

If there are stories around in your country of people where were denied the visa at their interview (issued 221g letters), find out what was missing in what they submitted as proof of a bona fide relationship and start generating the paperwork you can submit. Leases, bank statements, documents proofing you run a business together, any financial obligations you share, pictures (including pics with you & spouse's family) are necessary in some places.

It wasn't necessary to submit this much detail at our location. We just submitted a lease for our home in both our names. But I know in some places, this would not be enough.

The amount that defines what is enough depends on the level of what the US government perceives as fraud, whether real or imagined on their part.

Just my 2 cents...

I hope it's OK to ask more questions in someone else's thread on the same topic. Forum habits and customs seem to vary from web site to web site on this.

So our CR-1 interview is next month. I am the USC.

After going through the pages on irs.gov and Pub 519, I am still uncertain on a few points.

If we choose NOT to include my alien spouse on my return and so I only file my US return alone for 2011, is there any way for me to legally file Single for 2011 or is "Married filing separately" my only option in this case?
There are a few statements on irs.gov that suggest cases where this is possible but unclear whether it applies to me.

If we do decide to file jointly, she should meet at least one of the two tests for Foreign Earned Income Exclusion. If I can't claim it, can she on the same return?

The original plan was to apply for K-3 when we received our NOA1 of the I-130.
But we did not anticipate receiving our NOA2 I-130 approval 5 days later.

Unfortunately, I mailed our I-129F K-3 petition in the morning and received the I-130 NOA2 later in the evening that same day. I hope this I-129F petition does not adversely effect the I-130 petition.

Yes, we received our NOA1 in the mail on Sept 30, 2011. We received the email on Sept 21, 2011. The notice date of the I-797C is Sept 20, 2011.

Then, on Sept 26, uscis.gov and the call center both indicated my petition had been approved and I will be receiving a confirmation in the mail of the approval.

How could this have happened in only one week? If I enter my receipt number on uscis.gov, it already indicates it is in a post-decision activity state.

I posted earlier today after learning this morning that CSC approved my I-130 in ONE WEEK. I must be missing something here but that is what I see when I enter my receipt number at uscis.gov and speak with a rep at their customer service center. We only filed on 15 Sept, NOA1 sent 20 Sep, paper received 30 Sep.

The USCIS and NVC never asked for any proof of residency, specifically. We submitted our non-US lease for our I-130 petition as proof of a bona fide relationship (indicating a joint financial commitment). It was the only such proof that we provided for bona fide relationship proof. This was enough for them. The threshold of proof at US consulates in Canada may be a little lower than other locales so "your mileage may vary."

We did not file DCF as it is not available in Canada, probably due to being so close in proximity to the US.

My wife is from a third country. In this situation, the beneficiary is required to normally be interviewed in the US embassy/consulate local to their home country. They will allow, however an interview in a different country if the beneficiary can provide a copy of a foreign visa/residence permit that indicates right to remain in the foreign country for at least six months. We provided this but still were not required to provide proof of our specific address...only the Canadian visa. If the alien spouse is from Brazil, then this will not be a factor for you.

My wife and I live outside the US together.
I maintain a US residence, US driver license, US voter registration, US vehicle registrations, US auto insurance, and file taxes from US residence.
There is someone at my US residence that can receive my mail for me and forward it to me when I'm not there.

In this situation, my wife and I used only our non-US address for the I-130 and G-325A for both of us.
Then, after it was all passed over to NVC and we started the actual DS-260 visa application process,
I started putting my US address for me and our non-US address for her.
I used my US address for my I-864 financial sponsorship as I needed to have a US domicile in order to sponsor her visa.
I list our US address for our destination and green card address.

We electronically submitted all our documents and chose email for contact. The USCIS and NVC never sent anything by mail except our NOAs for the I-130 to her. Since we got email copies of the NOAs, it didn't matter if the paper copies were sent to one of our address I wasn't at.

This works if you are in Brazil 100% of the time if there is someone who can manage/handle your incoming mail at your US address.

our stats are below this message. Our NOA1 to NOA2 time was unusually short. We had a delay of about a month with our IV application with NVC due to an RFE we had to clear up. If you can and opted for email submission of documents, the time with the NVC can be a lot shorter. Learn the process as you go and use the forums to figure out what document requirements are coming up. If you have them collected, scanned & ready to email in immediately when they request it then things go as fast as they possibly can.

We had the same situation with our CR-1 application.

Wife from Taiwan, we live in Canada. Our Canadian visas are renewed on an annual basis and we only had 4 months remaining on them when our DS-260 arrived at the US Consulate in Montreal. Stating our US green card application as the basis for an early renewal, we found the Canadian immigration to be very helpful with an early renewal so we could present a Canadian visa with at least six months validity to the US consulate.

My wife had the same situation. After several successful visits from the US from Taiwan, two subsequent B-2 tourist visa applications were denied with a 214b letter. On our DS-260 CR-1 application, we specified these details openly. They had no effect whatsoever at any point in our I-130 petition with USCIS, DS-260 CR-1 application with NVC or at any point with the local US consulate handling the final points in the process. Not even mentioned.

3. I am the petitioner of my spouse, my spouse is the only one coming to the US and my salary is the only supporting evidence for I-864. This means I can file I-864EZ. Correct?

4. I started working in 2009. I have my tax returns for 2009 and 2010. In 2008 I was a dependent under my parents and my income was zero. Does that return need to be submitted? (I have checked the box in the I-864 application where it says I am sending last 3 years' worth of returns).

5. I filed an incorrect tax return in 2010 and then later filed an amended return. Do I need to just send the amended return or both original and amended returns?


I had a similar situation due to unemployment. My income for 2008 was below the 125% poverty level but I was at about the 125% level for 2009 and well above for 2010. The instructions for the I-864 instruct to send the previous year's return which we did. We were never asked to submit any returns for 2008 or 2009 so, in the end for us, it didn't matter.

I am left to wonder whether anyone else has been asked for any prior year returns?

You need to send the entire tax return packet. The original 1040, the amendment to the return and the W2s and 1099s associated with it.

Situation: I am a citizen of the U.S., plan to marry my fiancee in her country A, and I plan to work and live in a country B for the next 2-3 years, after which we will move to the U.S.

My idea:
1. We marry in her country A.
2. I move to B, where I start work.


We are in the same situation.

For us,
A=Taiwan
B=Canada

I, the USC, successfully sponsored my wife with the I-864 because I was living in B but being paid through a US company. This proved convenient for I-864 purposes as well as maintaining a US address for the paperwork tho living in B. For the I-130 petition for CR-1, I reside in US but can be with my wife in country B. The sweet part about this is that you can be together in country B while the paperwork is in progress. I honestly really admire those who have not had this luxury. You all have more character and patience than I do.

You can usually apply in country B & arrange your visa interview near the end of the application process in country B as long as you can show the US visa center that you have a right to remain in country B for at least six months from the time you complete your visa application and ready to schedule the interview. Otherwise, you'll have to return to country A to complete the interview.

Since you are married but still living in the Philippines you can,
1) if you have a SSN# or ITIN you can file Married Filing Jointly which you will get more of a refund or,
2) if you do not have either a SSN# or ITIN you can file Married Filing Seperately and once you are in the US and receive your SSN# file an amendment as Married Filing Jointly.


I can confirm all of the above. We don't have the SSN yet so we just filed Married Filing Seperate status and then amend with a 1040X when the SSN arrives, changing status to Married Filing Jointly with her new SSN. We will then add her income to "Wages & Tips", File a Form 2555 as it is all qualified as Foreign Earned Income exclusion, enjoy the extra deduction and get a bigger refund.

The USCIS will not accept a UK money order drawn on US funds (in US$).

We made the same mistake and submitted a Canadian money order drawn on US funds. It was returned with RFE and we had to resubmit the I-130 package.

Usually, the US citizen sponsor is the US. If they aren't, they need someone in the US to fetch either a US$ money order purchased in the US or write a personal check.
In my case, I was in Canada at the time but I still had my US checkbook to resubmit the check (yeah, I figure out only after the RFE that they would accept personal checks).

The welcome letter is a good indication that they are aware that the Green Card holder has physically arrived in the US.
You may use that as an indication that they have ordered the actual card and it will be along shortly.

We received our welcome letter on March 6th and the actual card arrived on Thursday, March 12th.
Your experience will vary but the card should be on it's way.

We are still waiting for the Social Security Card. We finally received a letter last week stating they need proof of her Green Card before they can issue a Social Security Card (!).
Some people have reported here that they have waited some time for their Social Security Card. Read up on advice and other experiences in this forum to guage what to do next, if you need to.
So we just sits and waits :)

It will all come together.

Near the bottom of this page there is a table that states ONLY if you "lived in a different country for more than 12 months" AND "you were 16 years or older at that time" are you required to obtain a police certificate for a country in which you have lived.

Based on this information, it would appear you do not need one for Syria. Please review this information to be sure but you should be OK without a Syria police certificate.

Not knowing your particular circumstances and how 192 days came to pass, it could have been for one or more of a hundred reasons. If you submitted everything in a expedited manner, unfortunately, it could have been that the clerk handling your case had a family crisis and everything on his or her's desk was placed on hold pending their return. Or perhaps there was a RFE and they waited a while for docs to be submitted.

In my very brief experience with this whole process, my impressions are that using an attorney will only slow things down. They have absolutely no incentive to expedite their handling of document submission on your behalf. Further, since due to their case load, I can't imagine they would have any attention to detail at all. They know the general process so will have a general template in their minds and pursue it. There is no guarantee that they have the experience to handle every possible complication and you may be paying them in the end to reseach any resolutions to complications that arise in your particular process.
