United KingdomWhen will I get aproval!!!!

Because you have been waiting for so long you must call and find out what is happening.

Call the USA not the London Embassy.

I'm at work at the moment and the number I used is at home however I think it is 1 800 375 5283.

Give them your case number also I needed my fiances Social Security No. Also the address you have both listed on the application.

Good Luck. I hope you get some positive feedback.

First off let me say that I really feel for you and how long it is taking. My Fiancee and i submitted our petition on 15 March 2006 and have just gotten our interview date in London for the 20th of October. So we know the pain and anguish that you and your fiancee are going thru.

Let me clear up some points here though as regards to what you can and cant do.

First off calling the service center.

When you call the number that is available you are not talking to anyone at the service center. You are talking to a contract employee at an office in New York City. All they can do is tell you what is in the computer. Nothing, and i repeat nothing you can tell them will speed the process up. If you received your NOA1, then they have the right address and all they will tell you is that is in processing. We tried contacting our senators (waste of time as they take over 60 days to even look into it). We also contacted my congressman, there we got some action. You will be required to send them a form giving them permission to look into your case but once that is done, it seems congressman take action and do something. Mine sent a letter to the california service center and magically two days later we got our NOA2. Of course that was after waiting from March 15 to August 8th.

Once you do get your NOA2 the petition is sent to NVC. There you can call and they will tell you when they have received it and sent it on to the embassy. However this process can take from a few days to up to 4 weeks. It can take longer if you are put into administrative review!!! There is no telling if that may happen, it is on case by case basis.

Once you are thru NVC, the embassy will send you what everyone here calls packet 3. Once you receive that you can schedule your medical. You can not schedule it until you have a case number and the proper paperwork from the embassy. As soon as you get packet 3 fill out the required forms and complete the checklist. My fiancee and I had already filled out the proper paper work by downloading it from the web sites and all we did was just send packet 3 right back. (small delay because we were in Rome when it arrived) You already have the police checks, but do you have the financial statement from the US citizen that shows he has the income to support you? That is required prior to the interview. Once you return packet 3, the embassy will schedule you for your interview and send you packet 4 which is your instructions for the interview.

This whole process at the embassy can take from 3 weeks to 2 months. Now if there is no problems, you will receive your visa a few days after your interview, however nothing is for sure. There is literally nothing you can do to speed this process up (with the exception of having all the paperwork done in advance).

I wish I could wave a magic wand and make this all go faster but there is literally nothing you can do to speed it up. Just know you are not the only one suffering thru this and that we are all here to offer advice and support.

Good luck.

Thank you so much! I am going to get my Fiance to get right on to the Congressman, I will try anything!
He has his last years tax return, and he earns more than enough so I am sure that wont be a problem area.

I will let you kow how I get on...

You must call the CSC. You may be on hold for 50 minutes but you might find you have already been approved and if not why. I was approved but they didn't update my notes on the US Website until 7 days after it had been approved. You are still waiting for your NOA2 aren't you?

People on here can be really sniffy and though they are well intentioned sometimes a little more TLC would be appreciated!

I really hope that everything works out for you, but I must agree with the other VJer who said not to use an Attorney. If you do it yourself you will know exactly where you are and that your case is not sitting on an Attorneys desk while they go off to play golf

Yup I am still waiting for my NOA2, am just getting used to all the codes and numbers and forms!

My Fiance spoke to the Senators his local senators office, the said "you should have an answer by 13th october, it could be sooner, but its not a gurantee" What does that mean!

I am praying everyday for the NOA2, and so is everyone I know!

How do I call them myself?

Thanks Guys. I love this site!

I have a big sigh of releif just to know there are people out there who understand are are going through the same process.

I have my police check in hand, i did that as soon as I realised, and I have no chronic illnesses I know of, so thats good.

I am going to speak to my Fiance and come up with a backup plan..........i just want this to be over!

Hey girl hang in there and don't worry. I understand why you did things as you did. Also I had a K1 intrerview at the london embassy and it was easy :-) Like the above people advised get all the paperwork that you require for the interview together now, including vaccination records and police reports for any country you lived in for more than 6 months since the age of 16. If any of your documents are in another language you will have to get them translated and certified by a notary public.
My advise is carry on with the wedding plans.. even if you do not get the K1 in time and are not able to marry legally: 1. as far as USA immigration are concerned it is a family gathering you are entering the country for. 2. The guests will probably not even realize that you are skipping the legal part. Of course then you will have to leave the USA and wait to get you k1. After which you can enter the country on your K1 and get married legally. Your lawyer should be able to advise you on this plan if need be.

And for all some people like to get on their high horse about not planning a wedding before the paper work is in hand a lot of us do!!!

Good luck!! It will all work out in the end one way or another!!

Maggie

Thanks Maggie, what a lovely message. You really seem to understand where I am comig from!

Family gathering it is unless we get reeeeaaalllly lucky!

Really! oh well, we are feeling desperate now. After living together for 6 months being apart is so hard.
We thought we would try anything!

I need big great heaps of luck!

Yep, you do.

Contact the USCIS and see what is taking your application so long, but I would make alternate plans for a wedding on a later date if I were you.

Good luck.

How do I contact the USCIS?

Thanks everyone, really helpfull!

Just to make things clear, when I planned my wedding we were both living in the uk together. We planned to get married in the US as both our familys live there, we were going to get married there and then go on honeymoon and then come back to the uk. Thats why we planned everything, if you go on holiday to get married you dont need a visa, as you do not intend to stay!

AFTER all the wedding planning, Matt's employer asked him to move back to the US so we made a decision to move out there after the wedding, which is when we sent off for the visa. We would never have planned a wedding if we knew this from the start!

So, we have already spoken to thesenetors office, and we have now hired a lawyer who said (i will believe it when I see it) he can help speed up the interview at the embassy. I am praying he can, i check on line everyday.

Thanks everyone, I will keep you posted........................

I was coming back, now I plan on staying in the states. I guess if it takes 2 months from now we may just make it in time. If not the non-legal ceremony sounds like the only option.

Why is it tacking so long? I have seen people on here aproved and they sent off after us!

No...you still have a medical exam and a face-to-face interview to go. I would formulate a backup plan for the wedding. Don't put down anything you can't get back. You may get the visa before your wedding date; you may not.
[/quote]

Its too late for all that! As I said, we had already starting planning our wedding, we have everything booked. We did all this before we knew we needed a visa. We planned on coming back to the UK to live, so it wasnt a problem. We applied for the Visa as soon as we knew, its been

I am aware that I still have a medical and interview to go through, my question was more how likely it will be that I get this processed in time! Its been over 16 weeks since we started this process, we were told it would take 90. I guess we were wrong.

Sorry, i am not sure how these posts work! I think I did that wroneg......

The wedding is in the US. We had it all planned and then Matt was sent home, so Matt applied for my Fiance Visa so I can stay once we get married.

I not familier with the terms used but our case status is "On August 10, 2006, we received your response to our request for evidence or information. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case. You can use our processing dates to estimate when this case will be done. Follow the the link below for current processing dates. "

As far as I am aware we are just watiing the final aproval form the USCIS? We havnt been touched since August 10th.

Hi

I am new to this site, and its great! Althought I am starting to panic, a lot!

My Fiance was living in the uk for 2 years when we met, and we lived together for 6 months when his employer sent him back to the US. We had already started to plan our wedding before he was sent back in June, and as we always planned on moving back to the UK never n eeded a Visa! Our wedding is december 1st, and our receipt date is 16th May.

We still do not have aproval form the CA USCIS office. Do you think I will make my wedding?

I just want some good news.....please!

United KingdomPacket 3-medical examination!

Hi

I got my packet 3, and it says the medical involves and "External genital examination!"

What on earth is this! Also, int ht ethreads above, it know one has mentied any sort of examination like this.

Is this always, sometimes or never done? Does it depend on the person?

Just want to prepare myself!

Also, my (stupid) doctors dont have me down as having any vaccinations after the age of 4! this is clearly wrong, as I know I have had lots! will they just give me everything anyway?

Thanks

You'll need proof you've had whatever they asked for. If you had them when you were four or under then you'll have proof. Paul's doctor wrote out a list of the vaccinations he'd had. if what they have for you doesn't include a particular vaccination, and you can't prove you've had it another way, you'll be required to get it.

As for the 'genital exam', it's not a big deal. He looked in Paul's pants and left it at that...a general part of any physical.

Oh, well thats strange! I am sure I can manage that....

United Kingdomhow do i get this info on timelines???

Hi all

I have been trying to do a timeline search to get the average timne between sending back the packet 3 and the interview date at London Embassy.

Anyone know how to do this for me?

Am sending packet 3 on Tuesday.

Thanks all!

I laid it out here perfectly for you, post #34.

Is something wrong with this answer?

That was NOA2 -> interview, which should indeed answer your questions.

P3- > interview is all right here.

United Kingdomhow do i get this info on timelines???

I spent a long time looking at timelines when I had sent my packet three back so I will tell you what I know... When I was looking the average time seemed to be about 6 weeks, about 2 weeks to get packet 4, which would give you an interview date about a month after that. In my case, my packet 4 took longer to arrive, but the interview date was less than two weeks after I received it! Mine interview was only actually a month after sending back packet three, but I think that's probably nearer the quicker end of the scale.

Good luck and hope you get an interview date soon!

Maria x

Wow, that was quick. I am REALLY hoping for a 4 week turn around after I send packet 3.
I am ready to go, medical on Thursday, and I only live in Hove so I can pop at anytime i need!

I also end work at the end of this month! Yipeeee

United KingdomObtaining Immunization Records

UK immunization records are DESTROYED!! once you reach the age of 25 years old, that was the info i was given from my local health authority. I contacted my GP tellin him my problem about needin immunization records, especially needin documented proof that i'd had MMR and tetanus, to my relief my GP re-did them for free, so i recommend you contact your own GP a.s.a.p to have them re-done before your medical. He/she can only say yes or no, luckily i have a great GP. If he cant re-do them then the doctor at your medical will do them for you, but it will cost you more.

Good Luck

Glad to know we're not alone!!

Any idea of the cost at the medical for the vaccinations?

I needed MMR and Tetnus at my medical. It was £60.00 for the 2 jabs, so £220.00 for the whole medical. If you go to your GP first you should only require MMR and Tetnus to be up to date, everything else like polio etc your too old for now i think?

United KingdomAny London interviews for Nov or Dec yet?

Hi MariaDane.

Yours was the only one I can see for November. Good Luck for Friday!

Clarebumba I posted my Packet 3 back a week before you did, are you getting nervous that you aren't going to make it in time?

I've told all the friends and family not to book anything until I know when the interview is. However I'm wondering if I should make them wait for booking it until I know that I've passed and not just when my interview is.

I asked the Doctor what they test for and he said Syphilis and HIV. I said I'd heard they tested for other things too and he said categorically no, they didn't as they didn't have time to test for anything else. I said so I couldn't be denied due to anything they found in my blood besides those two things and he again reiterated that, that is all they test for.

Hi again,

Just to update you (i have posted this) I got my interview date this Thursday!
Cant wait to book my flight! Wedding and everything has been booked for months, so I am very luck it all seems to be working out for me. Everyone tells you to not book anything till its all gone through, and they are right, but hey I like to take risks! All my family have flights booked and everything! Its just me to go.

Hope you get yours soon fingers crossed

United KingdomAny London interviews for Nov or Dec yet?

Has anyone who sent packet 3 back in October had an interview date yet? I sent my back Oct 12 and looking at Time Line histories it seems to take between 6 -8 weeks from sending it off it the interview date.

My dilemma is that I would like to fly to the USA 2nd Jan. I am going to rent my house out and I need a month I think to sort the house to look it's best for renters, pack my stuff to have it shipped, catch up with people, plan my wedding and also Xmas falls in the middle.

Therefore I need to finish work on 2nd December and I have to give a months notice, which means I need to resign this Friday.

I'm just paranoid that I resign and then my interview doesn't come through until January, which means can't leave 2nd January so I could have worked longer and saved some more money.

What does everyone think. If I take the risk and resign do you all think my interview will be before January?

Opinions greatly appreciated.

Also my Wedding is planned for Vegas 17 Jan 2007. Deposit has been put down but the date can be moved if needed. A lot of my family and friends have surprised me by saying that they would like to attend. I've told everyone not to book anything until I know when my interview date is. Do you think once I know when it is, it would be safe for them to book their flights?

I know it all depends on me passing the interview, but I really can't see any reason why I won't. Had my Medical yesterday which was fine - At the new Medical place on Bentinck Street. First day they opened. Also just to let everyone going through London know. The blood it tested for HIV and Syphilis only. Nothing else at all is tested for.

Drugs, other diseases etc they just rely on you being honest on the questionnaire as they can't ask for your Doctors records either. Very chatty Doctor I had. I'm not sure he should have told me all of that but might make some of you feel better about the Medical.

Sam

Hi Sam

Well, I sent packet 3 off on 18th October, and I am hoping to have my interview shortly after 12th November, I plan/Hope to travel to the US on the 18th November. I would think you will easily make the wedding! Mine is on the 1st December (wedding that is) and I only have 4 weeks left to make it!

If I were you dont get anyone to book flights until you have your date, but all my family and friends haver theres booked, so who am I to say!

I will post when I get my interview date, you should only be about a week behind me.

Good luck!

Oh, and the Doctor tol me that they test for HIV and Syphillis and ANYTHING else the see as appropriate. I guess if you look dodgy they could test for anything!

United KingdomChanging Address at London Embassy

Where did you hear/read that? As far as I am aware the Royal Mail has an obligation to forward all mail for that address.

*shrugs*

You got me there! I don't know about embassy letters. Would have thought they would have been forwarded like any other item of mail.

I think the Embassy stuff will be forwarded ok, but I dont think the postoffice can forward government mail? My Fiances stuff from the USCIC with a government stamped enelope did not get forwarded, even though we set up a re-direct. Although something from the NVC did!

Best to check with the Embassy too just to be sure...

United KingdomChanging Address at London Embassy

Hi everyone. I know this has probably been asked before, but I did a search and nothing that matched turned up.

Basically, I'd like to change my husband's address. He moved yesterday and we want him to get packt 3, naturally. I know we have some time before that stage, but better to be prepared.

I tried changing it with USCIS, but they were incredibly unhelpful. NVC has not gotten our case yet, so I will keep trying them there.

However, USCIS has told me on two separate occassions now that our case could be sent to the consulate before being sent to NVC (which seems so backwards to me and I keep thinking both operators must be wrong!)

I want to cover ourselves and make sure things go smoothly. When I emailed the Consulate(Londonconsular@state.gov), I got an automated response stating that if I was not told to use the email address, I would receive no further information from them...

Has anyone experienced anything similar? Should I send a formal letter to NVC and London Embassy just to be safe or is that crazy??

Thanks, in advance and again, for helping me maintain sanity in this process.

Be very carefull! Thats all I can say from my experience....

Ok, call the london Embassy. You will get a call centre in Glasgow. They are very helpful. If they have received your case they will give you a reference number, you can then email the Embassy with the reference in your subject box. this will then be ready withing 3-5 days. Without thius reference you will be ignored and deleted!

I changed my address at the USCIS twice, in writing AND by recorded mail, they were both ignored! My packet 3 sat at my old address for 2 weeks, gutted!

You could also put it in writing, but again if the havent receiverd your case yet you will get a standard letter, which will do nothing.

Good luck!

I didnt hassle them, but if you look at my time line I sent my forms off way back in April, so I am thinking they would prioritise my application as I have had a long delay.

I had a wedding date of December 1st and a travel date or 18th #November, so that may have also helped the situation.

United KingdomShipping Advice
I too used excessbaggage.com and it all went well. Cheaper to book on the phone than at the airport, the guy at Gatwick told us that!

Make sure you have someone to help when they collect, as its CURB to CURB, we lived in a flat, he would help bring the stuff down, he was nice enough, something about insurance.

We spenmt £800 but i fully insured everything, we had 8 very big boxs/t chest size. (insurance was £300 of that)

took about 10 weeks, brighton to Ohio.

As some (but not much!) of the stuff was my Fiances he filled out all the forms in his name, so I dont know about the visa thing. He was living here any way, work sent him back so it wasnt that dodgy!

Everything arrived safe and nothing was damaged. At the other end the delivery driver was more helpful in taking the box's into the house.

I shipped my stuff over way before my visa. Trouble is I shipped all my winter clothes thinking I would be over in September, so I have gradualy extended my wardrobe again! A good excuse for a girl to shop!

Make sure you can live witout anything you ship.
Dont send things that are cheap to buy in US, get a new one!
Mainly send sentimental items, and things you can not replace.
Dont send furniture unless its antique, everything is so much cheaper in the US if it costs £800 to ship a table and chairs you would be able to by a really good one in the US for that, as I say unless its sentimental.
Send lots if little things that make you feel at home right away!

I am so pleased that it all worked out for you time wise. You can now smile smugly at all those cynics on here who told you that you had no chance of getting your visa in time for your wedding!

I'm just looking at flights at the moment. Did you see any good deals? If you are taking lots of clothes, are you over your luggage allowance and if so, how much are you being quoted for the excess if you don't mind me asking?

Just trying to work out whether to ship everything or take some stuff with me and pay the excess.

Bon Voyage

Sam

Thanks Everyone! I am so excited, and I tried to edit the title and it wouldn't let me lol!

I am flying out with my sister, so I am sharing her luggage allowance, I have 3 BIG cases, 1 full hand luggage, my wedding dress is my sisters hand luggage, and I have given a small case to my friend Emma. I am taking everything! clothes wise anyway.....

I already shipped 8 T chest size box's. It was with excessbaggage.com they pick it up and drop it off, they also supply box's and tape. It was £500 to ship and £300 to insure. Thats from Brighton to Cincinnati Ohio.

Good luck to those behind me! See you state side for AOS! (after a nice wedding and honeymoon!)

I really cant believe I received my visa in the nick of time, by the skin of my teeth! Things always seem to work out for me, I have a lot of family and friends praying all the time!

Love Claire xx

United KingdomStill no word from the embassy

Our package 3 was signed for at the London Embasssy on October 23rd, over three weeks ago. We still haven't received our package 4 with an interview date. Should we be worried?

We've seen some other K3 applicant couples on here who say they sent the package 3 in around the same time as us or even later and they've already had their interview!

Is it worth ringing the Visa Helpline (09042-450-100), or is that a waste of time and money? We've tried calling the NVC, but they told us that we needed to speak to the embassy itself.

Any help/advice/encouragement gratefully received....

PS - The one thing that may be delaying us is that we previously lived in the Netherlands, which for some reason is one of the countries that the Embassy has to apply directly for my police record. Has anyone any experience of this and would it delay our application this much?

I woudnt start t worry just yet. As long as you sent packet 3 special/recorded delivery and you know they got it. It took 2 weeks for me to get my interview letter, but that is concidered super quick! I would wait for 4 weeks to be up and then chase it up. If you didnt state a travel date then they wont priorotise you.

I am sure it will come very soon! Dont worry.
All the waiting gets to you doesnt it!

Good luck x

United KingdomUK Tax help please.......

Hi ALl.

I moved to the USA in November 2006, and got married on a K1 fiance visa December 1st 2006.

I was self emplyed from Jan 06 - Nov 06 when I left. I didnt file a tax return before I left, or notifly them I moved abroad. I have been ignoring it hoping it will go away.......I think I needed to file this JAn 07 for the end of that tax year, and then what do i do with this tax year?

I have 2 questions (morals aside)

1; Will the USA find out when I do AOS and could it effect me?
2; Will the uk tax people find me, or just ignore it if i am not at that address.

I feel so bad about this and keep putting off doing anything cos I know I dont have the money for a tax bill, and I figure with a new name in a new country it wont matter? I know thats bad....Any ideas anyone?
I did pay tax as a PAYE before I went self employed.

1 - No, this will not affect your AOS in any way.
2 - Who knows - they may at some point??

I was self-employed in the UK too. I was a tax and NI payer but that is not the point. This is just my experience with the tax office and being self-employed.

The only thing I think it would affect is if you returned to the UK and started work again. Never say never and all that. I assume, because there was no tax paid, and they did not even know you were working, there is still the issue of NI contributions unless you were registered as unemployed. That means your NI contributions have not been paid for those months. Most would argue that there probably won't be a pension available for you when you retire, but NI contributions also count towards sick pay and other things I can't be arsed to look up. Again, this isn't relevant to you if you plan on never returning, but that is the question no one can answer from the future, near or far.

I don't know. That's the only thing I can see happening. But like Mark says, going back at some point would make it difficult, and there would be a huge bill waiting for you once you kick into the system again.

Personally, I'm too much of a worrier too. Call your local tax office back home. I have ALWAYS had very good luck with their staff. They are friendly and helpful, and surprisingly know what they're doing most of the time! But that is your choice. For now, you don't have to worry yourself -- people have done a lot worse! PM me if you need help. :)

Thanks!
My Husband doesnt know, and I keep putting it off. I think I will take a couple of days to think about it, its only a few months worth of tax, and I plan on not going back to the U"K as all my family is in the US anyway. But you never know how things turn out, so maybe I will call them????? hmmmmmnwhat to do!
Thanks for the adice, I may come back to this again....
