Hi everyone-

 

I apologize if this has already been answered a million times, there's a ton of info on this site and it's hard to sort through it all! 

 

Our approved packet was transferred to NVC on 8/16, that's the last notification that I got.  I am going to visit my fiancee next weekend and I was really hoping to get a lot of what we need taken care of while I'm there, like the police letter, the passport photos, and the fees that need to be paid at Banco Popular.  This will be my last visit before the interview so I want to do what we can while we're together but I know some things can't be done too early or without him having received his packet. 

 

I've already put together all the forms and have them in a binder that I'm bringing to him so he's ready to go.  I will update the forms with the financial info and bring the updated copies with me for the interview since pay stubs and savings amounts will change before the interview.

If you have the MNL # from NVC then you can get started NOW with getting your documents together and scheduling your appointment and doing your CFO and Medical. Just follow the steps contained in the link.

Will you and your son have your interview together at USEM?  If so you need only one copy of the I-134 with you listed in item 3 and your son's name listed in the child section of number 3. I just completed a K1/K3 visa for my fiance. I have two K3's and I listed them both as I have described for your son. As Hank stated, your relationship to sponsor should read "fiancee".

I was reading online about what we should do after I get the NOA1 and one of the things it stated was to get a CENOMAR since neither my fiance nor me has ever been married. its a certificate showing youve never been married. Is this really required? If so, does only he need to get one or both of us? And how would he or me or us be able to obtain them? Btw he lives in England.

Hello Guys!

i know i am posting on this thread very late, but if u guys get a chance please reply ....My fiance lives in Dubai had his interview on Feb 5 2014 CO said everything is fine ur approved and given pink slip mean no necessary documentation needed we were totally fine and mentioned pick up passport/visa in 5 days but their was nothing said ur visa is not ready yet. Right after his interview he was placed on AP and on march 4,5,6 status was change and march 6 status was change to ready until march 11. On march 11 they placed us back on AP since then we r facing AP. I wanna know how long we have to wait after even though it was ready :( This is very frustrating situation. I hope we can get our visa soon IA. Any suggestions thanks

 

None of us can't say with any certainly what the hold up is. Each case is different. Cases like yours can be resolved very quickly or it may take some time. I would give it another week (keep checking CEAC).

One caveat to Hank's instructions some have been asked from the bank for their passport when making the payment. I suggest you bring it along in case it is needed. Otherwise, follow Hank's handy dandy guide and you will sail through the process with little or no problems.

Try the K1 guide because it gives good guidance and if you don't understand something, then seek out the K1 forum and many in there will help you out. On the dark blue menu stripe at the top of this page you will see Home, Forums, Portals and Guides etc. Choose "Guides" and look for K1 Guide.

The K-3 will not largely delay your case, but it will certainly not speed it up. It will probably be decided for you when NVC closes the I129F but in case they don't, I'd stick with the superior (and cheaper) Cr-1 visa path

To keep a long explanation short, both petitions that you filed will be tied together and adjudicated at the same time. If both are approved, they will likely be sent to the NVC at the same time and in turn, will arrive at the NVC at the same time. If both petitions are received by the NVC at the same time (or if the I-130 arrives first), the K3 process will be administratively closed by the NVC and the CR-1 process will remain active.

Your wife can continue to use her UK passport to visit the US while this process is pending, and she can also visit during this time. However, there is no guarantee that she will actually be admitted to the US by CBP. She should bring proof of strong ties to the UK in case CBP asks to see such ties.

Hey everyone

I received my I-797 NOA December 17, 2012 stating formally that our I-130 was approved and had been sent off to the NVC. I have been waiting to hear/receive anything from the NVC since then but haven't. On the NOA it says to wait a month before contacting them but I waited a little longer given the Christmas/New Year holiday must have stopped some correspondence from happening.

I mailed NVCinquiry today asking them when we would hear from them and if they needed any additional documents. In the meantime I have tried to get everything ready for them (AOS, etc.) I'm just wondering is this a normal waiting period? Is there anything else I can do in the meantime other than be anxious ;)?



I received my I-797 NOA in January, but I was told its best you call them ,so i did & a lady told me that i should call back in 15days because they don't have my case number /file yet

It only makes a difference if your partner is staying in the country illegally and is it really going to take any less time to get the green card? The only thing that was written on my passport at POE was CRI and Admitted. Nothing again was written like expiration or whatever. I guess its Gods doing. I have a friend was issued 10 instead of 2yr and he has been in US for almost 2 yrs plus and hasn't changed anything.

Why not stop or go into PR? It is a US territory just like the USVI and has the same risk IMHO.

OP: Given all the time and expense of getting the visa, I would not risk it. Vegas is nice in March as the "oven" has not been turned on just yet. The Grand Canyon is also nice and not too many people this time of year, but it might be a bit cool for you. As others have said there are plenty of places to go on a honeymoon that are in the US. Hawaii is another nice place, but pricey.

My soon-to-be-wife and I are sitting here on the couch both in tears over this moving thing. We've found so many answers to questions that are just a wee bit different than our situation and neither of us know really where to turn. I was suggested to check out the forum after visiting Metafilter in search of this problem's solution.

Long story short:
I moved up to Toronto working for a company in Canada that I've been working for since 2009; I took a bigger gig up here, more money. I've been offered something back in my home land of Dallas, TX that I really want, and the lovely lady of my life and I are going to drive to Buffalo next week to get married to each other. I quit the job in Toronto, and my love and I have been living together in the same apartment with me as the bread winner for 8 months. In our heads, this would be a nothing process, and it's been one on a list of thousands of things to do in order to move.

I make the money, I take care of us financially. She takes care of me with love and her sweetness. I don't know what to do here to start, it seems like our situation bends just slightly differently than all of the others. I don't know what to do, and I don't even really know where to start. We are going to planning on moving at the end of this month, maybe beginning of next, in Buffalo, NY. Just us and her mom and dad.

Should I file the I-130 directly after? Do you think that they'll tell her she can't move with me and our truck full of stuff? What will she do then, she'll have nothing and nowhere.

Please help, we're both really stressing over this. I thank you immensely for your help.


I would love to know what exactly it is that makes your case "slightly different than all of the others." Pretty sure 99% of us here love our spouses and most of us have had to spend significant time away from them. That's just the way the system works, and it's that way for everyone. It sounds to me like you have done very little to prepare for this process. Immigration is a major step, it's not as simple as crossing the border and being in a new country. You did not make the effort to research in advance what would have to be done and now you are planning to move here with her, even though she does not legally have the right to live here on a permanent basis.

Being away from a spouse sucks, but like it or not, you're not any more "special" than the rest of us. The same rules apply to us all and they are long established and actually pretty easy to understand at a basic level, especially if you have done any research on this site. If you really "can't be without her," then your best bet is probably to keep working in Canada until you properly apply for her visa. Sorry if I come off as being blunt (which I am sure I do), but this is a MAJOR life decision and not one you begin to plan for merely a month in advance. I do sincerely wish you all the best and hope everything works out well for you two.

My husband have submitted application documents to USCIS on 20March2013. USCIS received it on 22March2013, but USCIS haven't cash the check yet. My friends told me it usually takes 2-3 working days for USCIS to cash it. I'm worried if there's a problem with the check. As my husband doesn't have check, he paid for it with their parents' check. I don't think NOA2 has an expiration date. We have been waiting for NOA2 for almost 9months, but still no news. Our case has been transferred to Texas Service Center for 36 days until now. All we have to do is waiting and waiting!  I'm really depressed. I feel hopeless and helpless:(

Part 2 deals with principal immigrant to the mailing address is asking for the mailing address of the immigrant. 

 

This is still part of the principal immigrant.  If they do not have an alien number (which they likely will not) leave it blank

 

JOINT SPONSOR:

 

Yes she needs to put 1 in the spouse box

Her household size would include her father as a dependant.  What was done in 2012 is what the USCIS is looking for.  

Your joint sponsor will have a household size of 4 total.  (The immigrant, herself, her spouse, and her father who she claims on her taxes.)

They are still in process ( I mean she sponsored her family member who lives in back home and that will take a while ).but not a permanent resident. So in the household size number 6 there is a ques. if you have sponsored any other person i-864 who are now lawfully permanent residents enter the number here. So should I put any number or keep it blank, because the person she sponsored before is not lawfully permanent resident yet. Thanks

Your wife is the Petitioner.  She is also your Sponsor. 

 

Your friend's wife is the only Joint Sponsor.  The rule is that a beneficiary can only have one Joint Sponsor.

 

You are the principal immigrant since your wife filed for you.  So, the answer is yes - she is sponsoring the principal immigrant.

 

To calculate her income, you go by her W-2 and any income you can prove is hers.  Her husband's income will not count.

 

If you want to use your friend's husband's income, he chooses to be a Household Member for his wife.  She would be the Joint Sponsor filing an I-864 , and he would be her Household Member filing an I-864a.

My wife is a US citizen and she applied for me .

She was working full time and initially she filled up i-864 form for me for the affidavite of sponsor. 

But recently she lost her job and I also think to bring a co sponsor is the best option for me .

So My wife friend is willing to sign  the affidavit of support form and we are kind of stuck in few things.

1d- I am the only joint sponsor

or 

1e- I am the first or sencond joint sponsor.

Can she be the only joint sponsor now ( Our interview is very soon and my wife already filled a form before as i-864 form )

i-864 part 3 : I am sponsoring the principal imigrant

yes or no?

 

And the most important thing.My wife's friend in last 3 years tax return one of the year she filled jointly with her husband ( 2010) how to calculate that year ( From w2 form ?)

DUAL CITIZENSHIP

Republic Act 9225 otherwise known as the Citizenship Retention and Reacquisition Act of 2003 (more popularly known as the Dual Citizenship Law) enables former natural-born Filipinos who have become naturalized citizens of another country to reacquire/retain their Philippine citizenship by taking an oath of allegiance to the Republic of the Philippines before a Philippine Consular Officer.  Upon reacquiring their Philippine citizenship, they shall enjoy full civil, economic and political rights as Filipinos.

Under the principle of derivative citizenship, unmarried children below eighteen (18) years of age, whether legitimate, illegitimate, or adopted, of former Filipino parents who reacquired their Philippine citizenship under this law, may also be deemed Filipino citizens, if they are included in the parent?s application for reacquisition of Philippine citizenship.

However, there is another kind of dual citizenship, which is not covered by the law.  This pertains to a dual citizen by birth:  A child born in the United States when either parent was still a Filipino citizen is considered to be a dual citizen from birth (if born on or after January 17, 1973).

Application for reacquisition of Philippine citizenship

REQUIREMENTS:

Submit the original and one duplicate copy of the following required documents to apply for reacquisition of Philippine citizenship:

  4. Copy of Marriage Certificate/Contract, for married women (original to be presented before the oath taking, when applying by mail)
  5. Copy of U.S. Naturalization Certificate (original to be presented before the oath taking, when applying by mail)
  6. Six (6) colored photos, 2? x 2?, taken within six months before the date of application, showing a clear front view of applicant?s face, with a white background.  No sleeveless attire.  Blurred or low quality photos are not accepted.
  7. Processing fee of $50.00 (non-refundable), payable in money order, bank draft, certified check or cashier?s check, and cash when personally applying.  Personal checks and credit cards are not accepted.

Note: The Philippine Embassy/Consulate General assumes no responsibility for any delay or loss in the mail, or while the documents are in the custody of the courier service.  The applicant should note the tracking numbers of all envelopes used and submitted.

ADDITIONAL REQUIREMENTS for Derivative Citizenship

  1. Ensure that the appropriate portions on page 2 of the Dual Citizenship application form are filled up
  2. Duplicate original or certified photocopy of the birth certificate of the children and their non-Philippine passport
  3. Three (3) identical colored photos, 2? x 2?, taken within six months before the date of application, showing a clear front view of applicant?s face, with a white background.  No sleeveless attire.  Blurred or low quality photos are not accepted.
  4. Processing fee of $25.00 (non-refundable), per derivative child, payable in money order, bank draft, certified check or cashier?s check, and cash when personally applying.  Personal checks and credit cards are not accepted.

The applicant will be informed of the date for the oath taking before a Consular Officer at the Embassy/Consulate General.  Prior to taking his/her oath, the applicant will be required to sign the Oath of Allegiance prepared by the Embassy/Consulate General.  The applicant will receive his/her original copy of the notarized oath of allegiance, together with the Order of Approval, Petition for Reacquisition of Philippine Citizenship and Identification Certificate issued by the Embassy/Consulate General, after the oath has been administered.

If the applicant is a Bureau of Immigration registered alien, he shall surrender the original ACR and ICR/CRTV, or in its absence, an affidavit explaining the loss of said documents for transmittal to the BI.

Thank you all for your replies :)

This is very advanced planning on both of our parts, as we still won't have the finances to travel anywhere for at least 6 months. We are both currently unemployed, and I feel the urge to want to pay for everything entirely...but that still leaves me trying to find work in Az. without references...so that's a small issue...or large ^^

 

If she wanted to visit here though, and see the place that she would be coming to live in, is there any other types of visas that will allow her into the usa for even a couple weeks?

 

I apprecitate your concern but I do trust her, she's never given me a reason not to.

She doesn't have a husband or suitor, the guy she had in her life with whom she had a child, wished to have nothing to do with her after finding out that she was pregnant, and stole her dog after he came back angry that she was pregnant to begin with and wouldn't abort the child. Her religion is catholic/roman catholic now, though I'm not sure if it was always.

In this long distance relationship, I will keep a strong trust for her, or we may crumble over suspicious minds.

I've been down the road of LDR 8 times before (only in north america until the one I'm in now) but I really feel different about this one :)

 

On related note and a shot in the dark, would any of you know where it would be easiest to get work within close vicinity to mesa Az?

Just a word of advice. Most Phil-Am relationships are wonderful. I couldn't be happier with my wife. To get to where we are today took about four years. We spoke everyday on the phone for 2-3 hours. My Dad once told me "son.... if you go on a day trip that you are in a car more than 2 hours and all along the way you are communicating back and forth, then you have a very good chance at a happy marriage". I've taken that to heart in finding my bride.

 

To add... Most bad relationships begin when the Pinay begins to ask for money. That's when you run. The majority of good Pinay's will not ask because that is part of their culture. It's their self respect that they wish to keep intact so the good ones do not ask for money. If you want to extend some financial aid at some point, that's ok. Just keep an eye out as there are many scammers from the Phil.

 

I think it is well worth your time to pursue the interest of this young lady. "Nothing ventured nothing gained"  Good luck.

Long story short...I'm in love. :D

My girl is trying to come over to Arizona in the US first to visit, and then after as a permanent citizen of the us once we're married. She's living in Cebu City

For the step of the travel passport/visa, what is required, and how long does it take to get one for her, and I would like to know the cost of getting one?

 

I have heard that Americans stick out like a sore thumb, and are targeted daily for kidnappings and ransom and murdered over there...If I go over for a visit in the philippines myself, should I be worried for me life?

 

Also, She has a little 2 year old girl, that she would be bringing as well ^^

 

I visited my wife two times during our courtship. First time was to Cebu and a side trip to Bohol. Bohol before the storms was beautiful. The 200 plus yo churches were breathtaking for me. Now many are in shambles due to the storms.  Lots to do in Cebu. It's a medium size city which makes it easy to get around. Manila on the other hand reminded me of NYC.  I felt comfortable in Cebu as a white Kano. I would get up at the crack of dawn and go to the street markets near Magellan's Cross.  The locals would take care of me and remind me about the pick pocketers and known trouble makers. I carried an expensive camera with me but made sure that it was wrapped around my wrist and that it could not be jerked out of my hands.

 

The only problem we encountered was when I was getting into a trike and my wife was to follow, she was wearing a gold necklace that some guy tried to rip from her neck. She was so quick that she felt it and grabbed for it and was able to keep it with only the clasp getting broken. 

 

Second trip I went to her home town of Ozamiz City on Mindanao.  Great little city. I felt safe but I always watched around me including my back. It's easy to do, just stop to look at something and use your peripheral vision to look around. Just don't be a loud mouth, flashy or wear jewelry or show your money.  I let my wife carry the money and pay for our purchases as she knows the cost of things and what to stay away from.

 

Being there for the visa interview is a real experience, one that I will never forget. As the consulate is Manila we were able to see many tourist things around the hotel before I soon departed. Museums, shopping malls and Rizal Park was some of the places we visited.

 

Go and visit her, you'll get a better idea what her culture is and how you will merge yours with hers.  I would some day like to call the Philippines my second "home".
