She has a cr1 2 year green card.

It is not likely the protective order covers entry to the US - am not even certain one can get that strong a protective order. Usually it covers a certain distance (50 feet, 100 feet etc., from the person being 'protected.' good.gif

Hi all

I am getting ready to get the conditions removed. I am the usc. me and my wife had a fight when she first came to the US. The police were called and a report was made but no arrest. Then my X wife found out and put a protective order on her and my children. There is no questions on the i-751 that have a place to put this.

My question is

1. will a police report with no arrest cause problems?
2. Will the protect order cause problems? This has been lifted.

I am so worried. I have search and not found anything related to this. Should I bring it up in the i-751 Package...

wife was arrested for assault. It looks like it will be a misdemeanor. I know we will have to be honest on the i751. But will this ruin her chances for getting 10 year card ?

Sorry, I did not really answer your questions.

1.) If the charges were dropped will this still cause problems in getting conditions removed(i know we have to still list it on the i-751).

No problems. Just put the information into paperwork.


2.) the DA has said he would sign an expungement request.

Do not do this. It looks like you want to hide something.

3.) I have talk to a lawyer and he wants 900.00 to do the services. is it worth it now (i will do it later when money is better). or since the charges were dropped does it matter as far as the conditions being removed.

Lawyer just wants a lot of money to write a 1 page explanation for you. If you are not that good at writing, get a friend to write it for you.

Personal opinion: I would draft a letter and get the DA to sign it rather than going for an expungement of the arrest record itself.

You can always go ahead and get an expungement letter later if you really need it... but your concern is explaining the situation for the IO reviewing your I-175, and you need to file that soon, much sooner than a year.

I would check the "yes arrested" box, and then prepare and explanation of what happened in exhaustive detail as part of your submission for the I-175.

I would also draft a simple one page letter for the DA to sign, simply stating your wife was arrested for whatever offense, but that charges were dropped and she was not indicted or tried.

Good Luck, I'm sure you will be fine with no ill effects from her arrest.

Thanks for your input. I just found out it takes almost a year to do an expungment. So i guess it will have to wait. I appreciate your help. Hopefully since the charges were dropped it will not be a problem.

My wife and i are getting ready to file to have conditions removed. May 2 is the 90 days before.
She had an incident with someone where she was arrested for a felony assault with a deadly weapon. She was protecting herself and the charges where dropped. the case didn't even make it to court. first off i have search the site. so i am not just looking for help with out doing the leg work first.

1.) If the charges were dropped will this still cause problems in getting conditions removed(i know we have to still list it on the i-751).

1. I don't remember what I sent in for joint bank accounts, but I think the first page should suffice
2. I beleive we sent in the policy which shows the address, the duration of coverage and we copied also the insurance cards (with the same information on them showing both names) and we have AAA so we also included a photocopy of our road service membership cards... for the policy, I would send in a copy of each one to show that there was a continuation of the policy and not only 6 months or 1 year....
3. Absolutely - anything to show living together will only help.
4. not sure what this means..... did she sign a POA to you or someone else? If you, then it will be good to include that
5. DL are not important - we didn't send ours in because we moved and the DMV then wouldn't accept my application for a new DL because I couldn't provide proof of legal presence in the US for 180 days or more... so I had a different state's DL and we decided not to include them.. However, if she has a state ID that will show the address and will certainly be helpful but not important.
6. I think a couple will be enough. If you have your insurance showing that the coverage is for your and your spouse, include that as well. This is good evidence.

hi everyone

filing may May 2 for ROC. got most of it clear but a couple of questions to try and keep it simple.

1. Joint bank account: the 1st page show the meat of the account. the other 10 pages are just transactions. i am thinking just send the 1st page. names and direct deposits are on there.

2.car insurance just the policy when activate and copy of the cards or every statement. this seems excessive.

3. live in corporate apt for 6 months. Would letter from boss stating we lived there be sufficient and should it be motorized.

4. My wife the non-usc signed power of attorney to help her with US formalities she didn't understand be good to send.

5. God bless her but she has not been able to get her driver license. will this be a problem.

6. she had 2 surgery's. all the medical showing my insurance or just 3-5 showing i was taking care of her.

I am try and to do just bob's theory. i have looked for these on the site. because it is a wealth of information but can not get a warm fuzzy about the above questions.

I live in Louisiana and working in Houston... Sorry but so how do i get an an appt with out a real choice. and can i go to any office...

Hi Everyone...

Here is my story and i hope that someone can give advice... i have found some information the site about this subject but it is a little unclear in what my next move should be. i have been married to this for 2 years. it has been a rough road but i the usc have hung in there thinking it would get better. we filed the i751 on MAY 4 and apparently she thought is was a done deal. So being rough turned into just plain mean. Long story short. She has stated she is glad that she will finally have her 10 year green card so she could be rid of me and my kids. Although surprised, not surprised if you know what i mean. i tried to explain to her that it was far over... finger prints, may RFI's and maybe an interview. Well her response was that she would kill the whole family if she did not get her green card. i have moved and got my stuff. well with the threats i do not want her to ever have access to me of my kids. we are now separated in my mind (no legal separation in Louisiana). I am filing for a divorce and i want to take away my joint petition. she drinks and i am scared on one of her drinking binges she will follow through with her threats. Is there any way i can do this. i have a feeling she will not make the biometrics appt tomorrow.

1.) but can i call someone and just tell them that apparently this has all been a rouse to get her green card?
2.) Can i revoke my joint petition?
3.) if she stays here illegally am i still responsible for her?

At the least i want immigration to know that we are separated and i am seeking a divorce. The sad part is there has been so many signs that i need to see and deal with and i just wanted to not hurt her.

My wife entered the country on a CR1 visa. During her medical exam she was not given all the Vaccination shots because they were not offered. I noticed that during the removal of the conditions there is no mention of the shots. ????? My Guess is we move forward with the Vaccination shots. or have I missed something.
