Although I think people can be harsh at times. Most these people are right in my opinion. If it was simply a mistake where both your wife and the lawyer missed it, I might say the lawyer should pay as well because it was something that went unnoticed.
BUT due to the fact that your wife saw the error and signed off on it, the lawyer shouldn't have to pay anything.
I am not a fan of lawyers in any way shape or form as my present lawyer just sent me an invoice for 5550.00 for child matters, so right NOW I hate lawyers.
AT the end of the day a lawyer works for you, if your wife saw the mistake she should have questioned the lawyer as They are human as well, they make mistakes.

WOW this got me confused as well... I re-read the entire form and we're supposed to answer:
- ALL questions on PART 1 and sign PART 1.
- ALL questions except #45 on PART 2.
- DO NOT sign PART 2.

Part2 is pretty clear, it says this at the bottom:
"DO NOT WRITE BELOW THE FOLLOWING LINE
The consular officer will assist you in answering item 45.
DO NOT SIGN this form until instructed to do so by the consular officer"

Uhhh let me see We applied for the Cr-1 In My new married last name. However I still had a few documents. Such as My passport to change which I still have to change before the interview. I would change it all as soon as possible to avoid confusion.
It is up to you as which name you plan on using in the future, like said before whatever is on your passport will be the name the visa is issued under.

Lol too late I bugged the irs however they guy was nice. He told me they don't create that from, I thought it was weird that the irs would make it. Ill email uscis and just use the old edition and see if a newer one comes out befiore my interview. Its there fault if its an expired form.

Well that actually depends on the bank and the manager at the bank.I ended up emailing everywhere to ask if I could be added on to an account or if we could open a new account etc, most places said it was possible as long as he was a us citizen. My husband had a account at Wachovia last year and We just walked in and put me on the account, I had to show my passport(and a marriage certificate as my passport was still in my maiden name)within moments we had a joint account. Then April of this year we opened a new account at M&T, again we had no problems and I am still waiting for Case complete. All I can suggest is find the closest banks in the area and give them a call, I was told it is really up to the manager of the bank. I can suggest Wachovia which is now called something else, m&t or Pnc. Good luck and just explain the situation

Yes of course your husband can visit however tell him to make sure to bring lots of ties to Canada, be honest but dont give them more information than they ask for :P Grats on the beginning of your journey.

My advice is go with your heart, YOU are the only one who knows whats too soon or not. If you feel that he is the one and your truly want to be with this person the rest of your life then go for it. If you both understand the limits of his Parole and you two have no problems with it then go for it. You are the only that knows what is right or wrong for you.

If she is from canada she most likely did not get a I-94, We don't usually need vistor visas and can usually go back and forth without much problems. (However secondary can really frigging suck )

I see some issues in your case, not to mention the overstay, she married you within 2 weeks of entering. She had every intention of crossing the border and marrying you to live. This is all true correct?

She may not have intended to be married, however that pose a great question. Did you two already arrange to be married? was this a planned wedding? did you just elope? If you two intended to get married on this visit then this could pose some problems and she really should go back to Canada and start the CR-1 visa. It is not illegal to get married to a US citizen and you dont technically need a visa to do so but she must return home and do the CR-1 visa. However if the wedding was Unplanned, she may do the AOS. I don't exactly see where she overstayed as She entered in August and it is only September however I may have missed something along the way.

1)Make a Infopass appointment to get all the information on your naturalization, I know that naturalization for a "child" is different then an adult there is no test etc. click link http://infopass.uscis.gov/

2)Are you not doing AOS? I mean if she is already there then you can do AOS instead of a Cr-1 and in both cases you need to tell them the truth they could look it up!

3)Yes you are her husband so your "info" would go here

4)Write N/a as you have never lived together

5)If you are doing AOS, complete the information.

I am sorry in advance for asking so many questions, I am not very educated so I do not know much, especially in this area. Please help us out as much as you can. We don't have money to hire a lawyer, so we will have try and do this on our own.


I am a U.S. Citizen, I got my citizenship through naturalization when I was in my early teens. I am now 23 btw. Anyhow, my wife (Canadian citizen) and I just got married a week ago in Seattle, our plan is to live in the States and start a family here. She is not going to go back to Canada to visit until she gets her GC. I am in the process of filling out the I-30 form and I have couple of questions:

For my side on #13 it asks me to "give the give certificate number and date and place of issuance of my naturalization." The problem here is that I was never given a certificate or anything for that matter. All I was given was a U.S. passport once I became a U.S. citizen. All I know is that everything was done in the Seattle office. So...would I need to get this information?, and if I do, how would I go about giving this information. I am sure they have it in the system that she arrives as a visitor.

As it was said recently and for some reason I have said this lately to a few people. Going to the united states to marry your love is NOT ILLEGAL! However you must return home (as you said you wanted to). Yes you will most likely be asked at the border as to what your trip is for, Be honest but never give more information than asked for. I am not sure what will happen when you tell them you plan on getting married and then returning home. You may need to bring a TON of evidence in this case. Make sure to have a return ticket as well. In the case of a marriage license I used my passport/drivers license for "id" purposes but check with the court house you intend to marry at. I would suggest if this does not go well to marry in the uk :)

To other poster, The k-1 visa is so that a person can go to the states and marry then ADJUST STATUS and stay in the states. The visa it self is so that one does not have to leave the states.

Cheap well that would be sticking with us, We dont charge for advice or help! However you will still need to pay all the cr-1 fees. Unfortunately the above posters are right, montreal is backed up but its not that bad if you think of the end result. One year to be with your loved one for good :) well 12-14 months. I suggust you read up on the guides and then get started as soon as possible and when you get to the second stage you can do electronic procssing to try to cut off some time. Anyways good luck :)

Funnily enough I was reading a thread a few days ago. Canadian citizen, now in the U.S. adjusting status, had been arrested in her youth at least 3 times, for being drunk.

She answered on the form that she had never been arrested and seemed quite flip about it - but to each their own.

Do they know? Hard to say, probably not - but they do know about things you wouldn't expect them to.

I'm no expert on this subject at all, there are people here who have criminal records who have successfully done a K1 or CR1 visa etc - there is a waivers forum here on VJ, if you want their opinions you need to give details of what she was charged with.


Telling the truth is always the best way. I am currently waiting for court records for a juv offense. Worse part was when I called to try to get my records first it was a hassel because I have no record and my papers are sealed and purged, but the funniest part was the clerk of the court asked me how they would know about my record, I said I told them, she said why would you do that, I said well it said have you ever been charged and I answered truthfully, she said well noone can access your juv record so you should have said no.whether they. Can see her record or not, truth is always better that way there are no surprises later on. Never realized it would be so complicated to get juvy records. Get your wife to call the courthouse she wass charGed at as it takes awhile to get them.

Heres a question are you the petitioner or the ben? where were you two married? You can easily walk into the court office or marriage restraition office and get a certified copy within minutes. Solving all your doubts and preparing you for the next stage as well.

It says license AND certificate, and has the information of where and when the marriage took place, also the judge that officiated and the location of the marriage and bride and groom signatures.


My original one is like this as well. It was our license and the certificate as my husband brought it home then we brought it with us on the day we picked, the minister took the paperwork , signed it dated it stamped it and handed it back to us the same day. I did get certified copies a few weeks later but I sent a photocopy of the original in.

If it looks like mine then you should be fine... let me go look

wow Ive totally been off my rocker this whole time then. For some absurd reason Ive been thinking that it was 2 months between NOA1 to NOA2, then 7 months from NVC receiving the paperwork to interview. So I was thinking ok, 9 months isnt fantastic, but its do-able. So I guess my question now is, 5 months to NOA2 (luckily we are 2 months into that process), but then still another 7 through the Montreal center? Also, Im going to visit my Husband in a week and a half for 2 weeks. I have a friend who just got their fiance visa and she said her and her fiance would do 3 month long visits and then hed come back to Canada. Is 3 months the maximum for a visitor visa before you are considered there illegally and jeopardize your immigration paperwork?


All I can say is look at the timelines of people currently in front of you, My noa-2 was quick but recently the noa-2s have been up to 5 months and then 30-60 days for NVC then 5 months wait for interview. It is worth it in the end though, believe me, I just got here 5 days ago and the long wait has been forgotten :).

As for visiting, I use to visit 6-12 weeks at a time, I even stayed once last year for 4 months. Now I am not advising you to stay more then 6 months in one year. I visited my husband from feb to april in the states. Then came back to the states july 12th till sept 19th, My hubby came to get me for poe on october 31st. Always bring a load of ties to canada, and be truthful. I was lucky to never have any complications crossing the border via car. Some crossings seem to be more strict then others or at least from what i have read.

dont think it matters what country, as said above the quicker the marriage certificate is issued the better. You can marry in the states but you MUST return to Canada as you have intent when crossing the border. you might have some problems at the border though, as you are getting married and they will want to know that you are not trying to "immigrate" without the proper visa. It is not illegal to marry in the states nor do you need a visa for it but you will have to do the cr-1 visa.
