I pay my fiancee so she does not work and we chat 8 hours a day while we wait for the K-1. She spends on average $10 a day in Thailand and emails me a daily record. She also lives with her aunt, so no rent, but I pay the electric for thhe house and internet. I gave her a BIG credit card and she charged $0.00 on it and she knows I make a few bucks and we have enough for about anything in life we would ever want. :D

Thanks so much for the feedback guys. Being that I am half crazy anyhow, it exacerbates a fragile situation already-lol. I concur, there is a reasonable threshold of when to call and at this point I would like feedback of when that point is. I only have the one document that says it was received and nothing else. Even with my receipt number and creating an account, I see nothing about it being touched and no other emails subsequent to the initial one. I see a lot of folks on this board that applied for a K-1 a lot later than me approved so I am sitting here in dismay at this wait time as I can clearly see I am past the average time in processing albeit not by much admittedly. Thanks in advance for additional feedback and I think it is reasonable to call shortly as we are now at 5.5 months at the end of this week. I retained legal counsel as I have a special issue that might need to be addressed, as normally I would do this myself and frankly for the expenditure, it was inexpensive. I worked as an assistant campaign manager for a congressman (for free) last year so I do have contacts, but I do not like asking for favors from anyone.

Hi there folks and I did search around and this is my first post. A little background is my fiancée is Thai and I am American and have retained counsel in Thailand that only does Visas. We sent in the K-1 packet and it was received 1-24-11 by USCIS and I have the receipt number and also signed up for email updates. I also heck daily on the USCIS website for progress and still the same exact thing posted "initial review". I also checked timelines for the different USCIS service centers and see I am not officially over the average time. When i asked my counsel about this, he said do not call as if there is a problem, they will come back right to us and say there is a problem. In his written instructions, he explicitly says not to call and still says this is the case. I have traveled there now 4 times from USA to Thailand and been over there now 2+ months since December as I love her and did not want to be away from her. I am VERY disappointed as the illegals walk around with impunity here in MASS and yet I am waiting on this nonsense. My question is would you guys call or wait it out? Any advice other than be patient, and really maybe I need to hear that-lol. But over 5 months is crazy and makes me REALLY angry with the US government to say the least. I might relocate anyhow to Thailand long term, it will happen if there is any problem with the visa as I frankly like Thailand better-it is just my business is here and a cash cow. :star: Anyhow, I will shut up and all ears and thanks very much for the responses.

I had 1 touch which was right after my NOA 1. I didn't get another update until after I received the email that it was approved. I have heard people say that even after they get their NOA 2 the website still doesn't get updated. I wouldn't get too hung up on it. Touches really don't mean anything. It is just such a long process we all want to see some update so we can feel as if we are not forgotten.

As Tim/Mav said, wait until 5 months 31 days and then put in a request for expedite if you still haven't heard an update on your case.

I am wrong, mine was touched 3 days after the recept and I didn't catch it until after my post as I was tired. Per USCIS's website, the VSC 5 month average is less than 5 months and rounded up to reflect 5 months. That said, anything past 5 months would be outside of the normal time frame. So in 2 more weeks I will be at the 6+ month mark so at that stage it would deem prudent to perhaps put in a service request at that time. Thanks again, at the very least VJ helps me share my experience and learn a bit about this crappy process. Off to Florida in a few hours to pick up one of my cars and drive it back to New Jersey and sad I am doing it alone, but it will be a nice distraction from this problem for at least a few days. Top down in the sun driving fast is not a bad thing :devil:

When I put in my receipt number, all I see is this "initial review" part and nothing else. I keep seeing "touched" on this website over and over and anyhow pulling my hair out waiting and looking for any details. I signed up for updates via email from USCIS albeit not texts, but since January, I have nothing past the NOA1 receipt letter. My attorney wants me to wait and do nothing, I want to call my senator for an appointment, but I am deferring to his judgment at this time as he is a full time immigration attorney. Anyhow, I will be quiet so I can learn from others on this touched update and thanks!

Fastviper, you could get the police report before you get your BNK# but I would wait until you get your BNK# for the medical. The police report you can bring a copy of the NOA2. Since it sounds like it is out of the way for her to do I would suggest doing both at once. Good luck.

Thanks so much, I am making trip #5 to Thailand my Police run and visit and trip #6 my Medical and interview run and then we wait and fly back together I HOPE. Emailing my attorney now to do this and thanks for the information. This forum answers a lot of questions from the senior members here and I am happy to be here and appreciate the help from folks like you so thank you.

Crazy, but it is almost as if USCIS goes fast, you get delayed at NVC. I am not citing this as fact, but it is like they speed the slow guys up and slow the fast guys down. I got my NOA2 last Monday, so nothing yet. My attorney says he will not do medical or police record without the case # "When the NVC has the file they will issue a case number which we need befroe we can take further action like completing the medical exam etc." I know I can do this, well I think I can anyhow without that case #. I'd like to see her in the next few weeks and get the medical and police stuff done while in Bangkok as that is way out of her way to do. When can I get a case #? I suppose they have not even received my file yet, but what do I know? It looks like it will not hit my Embassy for at least a month based on these posts about NVC.

How do "illegals get free stuff" and, more importantly, how do "we treat our own citizens like #######" if we require foreigners to have either a valid visa, or AP, or a Green Card, in order to enter the U.S. from abroad?

THEY GET FREE HEALTHCARE (emergency room is their doctor's office), FREE SCHOOLING (IU watch a feew every day walking to my local school with my own eyes that are confirmed illegals), FREE ENTITLEMENTS-WHERE ON GOD'S EARTH DO YOU LIVE? Do you not pay taxes and see it getting blown away? Are you serious that making us jump through hoops and not even letting us have a honeymoon out of the cuntry is not treating us like ####### relative to the open arms policy of our government to illegals? Do they get a blood test, urine test, criminal background check, a wait, interview, fees, et cetera to come in? No they have laws against it and then do not enforce it, but they stand on the corners with signs saying they want rights. I could go on and on, but if they enforced the laws, this would be reasonable to some extent, but when they can do an NCIC check within 3 minutes from a computer, why does it take nearly a year for a K-1 or K-3? I just came back from the gym and there are PLENTY of illegals here in New Jersey, and how do I know-I ASK THEM (in Spanish) and they tell me. No reason to hide it, the police are told they can do nothing and I work on the local police department's computers and talk to the police all the time relative to the policies that are handed down by DHS. They are frustrated that the government is doing nothing yet we have to deal with copious amount of paperwork. Back on topic, it sucks to not leave the country for a honeymoon and more for me becuase I am a vet and fought for this country and an illegal gets better treatment than a citizen for legal immigration for his wife/fiancee.

Many folks on this site from reading are extremely liberal and this that this process is fine, so you will not get support here. Sad, but my observations and relly makes me wonder what they are thinking as the ilegals are still invading our country. CRAZY we do all this nonsense and why would it not impact our processing time? They will probably grant them free application fees while we are paying out the wazo proving our income, relationship status, police records on both sides, medical checks, paying money in fees from application, medical, interview, adjustment, biometrics, et cetera and they get free stuff from free housing to utilities-CRAZY and makes me sick. What else do you expect from our government-why not reward illegal behavior and put the burdon on us as legal citizens trying to do things the legal way?

Your fiance has a valid entry visa for the USA inserted into his passport. That in and of itself will get him abord the flight from Hong Kong to the USA. I am sure he went through AP when you were at the Embassy interview stage and he should have no entry issues into the USA.

Actually, that will not get him on board the flight as that is a totally different issue. If he is flagged, he has to resolve it there or he will be held up. The visa is only for US entry once he is here and as always subject to revocation. I hope this is just a mix up, for whatever reason the last 3 flights my checked in baggage has been getting searched but nothing is ever missing. Anyhow, our thoughts are with you, but again stay strong to help him.

"Why would they send him back to Dubai?" It sounds by your post that this happened in Dubai, so that is moot. The American TSA is different and it might be a flag or the like. The good news is he will have a layover in Hong Kong where he can perhaps sort things out. If he has any issues, he can call you and you folks can coordinate things and contact the US Embassy in Hong Kong, Dubai or whomever you need to call. As his sponsor, he will need you so try and keep your head on straight as this sounds like a DHS (TSA) issue and might be a glitch, common name that was flagged or the like. Say the Serenity Prayer and do your best to help him.

Back in 1982, I was charged with a felony of fraud, no jail time, 3 years probation and restitution. For almost 5 months I was holding my breath worried about the consequences this would have on my approval, but thanks to God, I was approved on August 29th. I think it really depends what the arrests were for, the outcome and how long ago they were and your history since those arrests. Also, if you were a minor or not.

With regard to being interviewed, I have seen a very small percentage being interviewed but usually after the approval of the I129F.

Only because I pulled a lot of details out of my profile, to shield my identity, I will say that I have a worse record than this and I was approved personally and I DID time (1 year on two 3 year sentences runing concurrent). A 2nd and 3rd degree felony, but 18+ years ago. I only post this for the benefit of others that are worrying about thier past criminal records. My life has been a beautiful dream following that with owning a business, going to an ivy league university and changing my life around. I'm not perfect, but a day at a time has done me wonders so those of you reading this and worrying about your records, a long time ago even with serious charges I think they are reasonable.

You're right that they're a different breed -- some are downright evil. Read in the Vietnam regional subforum about the Foreign Service Nationals who deliberately sabotage interviews while doing translations. They're just one example.

The OP was spot on and a lot kinder than I would have been considering their circumstances which are sad. The entire process is demeaning for a K-1 and we jump through hoops, write checks, more hoops and then have a person say we do not have enoug money when we meet the guidleines, ask about sexual positions for a Stokes interview, deny poeple at will and sometimes without explanation, and then once you get here you cannot honeymoon outside of the USA until you get payrolled? ARE YOU KIDDING ME? I feel so bad for the OP, my heart is with you here as I read some of your other posts and see you are sincere. GOD speed here to get you both together soon.

You might want to "experience" Thailand a bit more before you decide to leave the U.S. in favor of Thailand. I can assure you that you will not have less problems in Thailand, compared to the U.S. Moving to Thailand may be a viable option for those looking to retire, but for those looking for a better life, look elsewhere. Do some rudimentary research about life in Thailand for foreign business owners as well as foreigner rights in Thailand and you will start to see my point.

I do not need to work anymore going there, so not some of the regular issues associated with making money. I only have been there 2+ months since December, but I am done with the USA regrdless. I am familiar with foreigner's rights, or lack thereof, purchasing land, et cetera so we are on the same page. I am thinking of getting a place in the country, growing a lot of our own food and just chilling out with my love relaxing. I do see your points hands down on some issues, so not like you are blowing smoke at all and I do appreciate all the posts on here. I might however get a small business so I can get a business visa there, but I don't care about making money, just something to show them is all as I do not want to do visa runs. Anyhow, heading there again very soon and will update as things progress on my end and look forward to seeing other Thai/Farangs post on this thread too.

Sawadee Krap! My name is Gary and I am awaiting my K-1, and now 5.5 months at VSC. I am traveling back to BKK soon, 5 trips since December 2010 and LOVE it there. Frankly I do not want to live in the US any longer and my fiancée' is fine staying in Thailand, so we are looking at a way for me to go there. Since I am not 50 years old yet (43 this month-yikes), no retirement visa, so I might have to start some type of business to move there legally. I wanted to live here so she could get my social security in case I die before her, but maybe it is not to be. Personally, I REALLY prefer Thailand over the USA and this wait and they way they treat Americans doing this legally sickens and angers me beyond belief. Anyhow, 5.5 months+ is my worthless $.02 and if anyone wants to practice Thai with me all the better. I am still basic, but can get sentences and such out so long as they are really basic.

LOL How many countries have you been to? I have been in 7 just this year since January and traveled extensively abroad. It sure is not my intention to live here long term, I do not think I will be here over 5 years or more. While I think America is a terrific country in many respects, the decline is here and I do not think it is the best country anymore but 30 years ago I think you could make such a statement and I would be idle reading it. The people that parrot how America is #1 from ym personal experience, frequently have done little traveling outside the US, if at all. In statistics, we have n as the sample for analysis so what is your n making such declarative statements? It should be 189 or higher and my guess is you have not been to 10% of them-am I correct? I'll say one thing for certain, this K-1 process sure has left a sour taste in my mouth as I see illegals get so much without any work on their part. Back to the topic of the OP, no gay marriage for USCIS as yet, but as one poster said, transexual marriages are okay under certain states (NC, NJ, et cetera) if they are post operative. Sorry, to be seperated from a loved on is painful-I think we all agree on that.
