Important Notice - New Application Fees: Nonimmigrant and immigrant visa application fees for certain visa categories will change on September 12, 2014. All visa applicants must pay the fee amounts in effect on the day they pay, with the exception of Immigrant Visa application processing fees paid domestically to the National Visa Center (NVC), which will be effective as of the date of billing.
 
Fees that will decrease are not refundable. If you paid a visa fee before September 12, 2014 and that fee decreased, we cannot give you a refund.

Overview: What Is a K-1 Visa?
The fiancé(e) K-1 nonimmigrant visa is for the foreign-citizen fiancé(e) of a United States (U.S.) citizen. The K-1 visa permits the foreign-citizen fiancé(e) to travel to the United States and marry his or her U.S. citizen sponsor within 90 days of arrival. The foreign-citizen will then apply for adjustment of status to a permanent resident (LPR) with the Department of Homeland Security (DHS), U.S. Citizenship and Immigration Services (USCIS). Because a fiancé(e) visa permits the holder to immigrate to the U.S. and marry a U.S. citizen shortly after arrival in the United States, the fiancé(e) must meet some of the requirements of an immigrant visa. Eligible children of K-1 visa applicants receive K-2 visas.
 
What Is a ?Fiancé(e)??
Under U.S. immigration law, a foreign-citizen fiancé(e) of a U.S. citizen is the recipient of an approved Petition for Alien Fiancé(e), Form I-129F, who has been issued a nonimmigrant K-1 visa for travel to the United States in order to marry his or her U.S. citizen fiancé(e). Both the U.S. citizen and the K-1 visa applicant must have been legally free to marry at the time the petition was filed and must have remained so thereafter. The marriage must be legally possible according to laws of the U.S. state in which the marriage will take place.
 
In general, the foreign-citizen fiancé(e) and U.S. citizen sponsor must have met in person within the past two years. USCIS may grant an exception to this requirement, based on extreme hardship for the U.S. citizen sponsor to personally meet the foreign-citizen fiancé(e), or, for example, if it is contrary in the U.S. citizen sponsor?s or foreign-citizen fiancé(e)?s culture for a man and woman to meet before marriage.
 
The International Marriage Broker Regulation Act of 2005 (IMBRA)

The First Step: Filing the Petition
You, the U.S. citizen sponsor, must file Form I-129F, Petition for Alien Fiancé(e), with the USCIS office that serves the area where you live. See Direct Filing Addresses for Form I-129F, Petition for Alien Fiancé(e) for information on where to file the petition. Further information is available on the USCIS website under Fiancé(e) Visas. Note: Form I-129F cannot be filed at a U.S. Embassy, Consulate, or USCIS office abroad.
After USCIS approves the petition, it is sent to the National Visa Center (NVC). The NVC will give you a case number and send your petition to the U.S. Embassy or Consulate where your fiancé(e) lives.
 
The Second Step: Applying for a Visa
The NVC will mail you a letter when it sends your fiancé(e) case to the U.S. Embassy or Consulate. Once you receive this letter, inform your fiance(e) to take the below-listed actions to apply for a K-1 visa and prepare for the intervew.
 
Eligible children of K-1 visa applicants may apply for K-2 visas. Separate applications must be submitted for each K visa applicant, and each K visa applicant must pay the visa application fee.
 
Required Documentation
You, the foreign-citizen fiancé(e), (and eligible children applying for K-2 visas) will be required to bring the following forms and documents to the visa interview:
 
Completed Form DS-160, Online Nonimmigrant Visa Application. You (and any eligible children applying for K-4 visas) must: (1) complete Form DS-160 and (2) print the DS-160 confirmation page to bring to your intervew. 
A passport valid for travel to the United States and with a validity date at least six months beyond your intended period of stay in the U.S. (unless country-specific agreements provide exemptions).
Divorce or death certificate(s) of any previous spouse(s) for both you and the U.S. citizen sponsor
Police certificates from your present country of residence and all countries where you have lived for six months or more since age 16 (Police certificates are also required for accompanying children age 16 or older)
Medical examination (vaccinations are optional, see below)
Evidence of financial support (Form I-134, Affidavit of Support, may be requested)
Two (2) 2x2 photographs. See the required photo format explained in Photograph Requirements
Evidence of relationship with your U.S. citizen fiancé(e)
Payment of fees, as explained below
Note: The consular officer may ask for additional information, such as photographs and other proof that the relationship with your U.S. citizen fiancé(e) is genuine. Documents in foreign languages, other than the language of the country in which the application takes place, should be translated. Applicants should take to the visa interview clear, legible photocopies of civil documents and translations, such as birth and divorce certificates. Original documents and translations will be returned.

Medical Examination and Vaccination Requirements
In preparing for the interview, applicants will need to schedule and complete a medical examination. Before the issuance of an immigrant or K visa, every applicant, regardless of age, must undergo a medical examination which must be performed by an authorized panel physician. You will be provided instructions regarding medical examinations from the U.S. Embassy or Consulate where you will apply for your visa, including information on authorized panel physicians. K visa applicants are encouraged to get the vaccinations required under U.S. immigration law for immigrant visa applicants.  Although such vaccinations are not required for K visa issuance, they will be required when adjusting status to that of legal permanent resident following your marriage. Applicants are therefore encouraged to fulfill these vaccination requirements at the time of the medical examination. Proof of Financial Support and Affidavit of Support Forms
During the visa interview, applicants will be required to present evidence to the consular officer that they will not become a public charge in the United States. You may present evidence that you are able to financially support yourself or that your U.S. citizen fiancé(e) is able to provide support. The Consular Officer may request that a Form I-134, Affidavit of Support be submitted by the U.S. citizen fiancé(e).
 
The U.S. citizen fiancé(e) will need to submit Form I-864 to USCIS with the application for adjustment of status to that of legal permanent resident following the marriage.
 
Do the Same Income Requirements Apply to Form I-134 as Apply to Form I-864?
No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.
 
Fees
Fees are charged for the following services: 
 
Filing an Alien Fiancé(e) Petition, Form I-129F
Nonimmigrant visa application processing fee, Form DS-160 (required for each K visa applicant)
Medical examination (required for each K visa applicant; costs vary from post to post)
Other costs may include translation and photocopying charges, fees for getting the documents required for the visa application (such as passport, police certificates, birth certificates, etc.), and travel expenses to the U.S. Embassy or Consulate for an interview. Costs vary from country to country and case to case.

Rights and Protections - Pamphlet
You should read the Rights and Protections pamphlet before your visa interview to learn about your rights in the United States relating to domestic violence, sexual assault, and child abuse and protection available to you. The consular officer will verbally summarize the pamphlet to you during your interview. Additionally, K-1 visa applicants will be provided with any existing criminal background information on their U.S. citizen fiancé(e)s that USCIS received from other government agencies during processing of their Form I-129F petitions.
 
My Petition Expired ? Can It Be Extended?
The I-129F petition is valid for four months from the date of approval by USCIS. A consular officer can extend the validity of the petition if it expires before visa processing is completed.
 
Ineligibilities for Visas
Certain conditions and activities may make you, the applicant, ineligible for a visa. Examples of these ineligibilities include: drug trafficking; overstaying a previous visa; and submitting fraudulent documents.
 
If you are ineligible for a visa, you will be informed by the Consular Officer and advised whether there is a waiver of the ineligibility and what the waiver process is. Learn more and see the complete list of ineligibilities.
 
How Long Will It Take to Get My K Visa?
For Form I-129F, Petition for Alien Fiancé(e), you can visit the USCIS website for the status of your petition.
 
Once your case has been received from NVC by the U.S. Embassy or Consulate that will process it, the length of time varies from case to case according to its circumstances. Some cases are delayed because applicants do not follow instructions carefully or supply incomplete information. (It is important to give us correct postal addresses and telephone numbers.) Some visa applications require further administrative processing, which takes additional time after the visa applicant's interview by a Consular Officer.
 
After You Receive a K-1 Fiancé(e) Visa
If you are issued a K-1 visa, the Consular Officer will give you your passport containing the K-1 visa and a sealed packet containing the civil documents you provided, plus other documents prepared by the U.S. Embassy or Consulate. It is important that you do not open the sealed packet. Only the DHS immigration official should open this packet when you enter the United States. As the K-1 visa holder, you must enter the United States either before or at the same time as any qualifying children holding K-2 visas.
 
With your visa, you can apply for a single admission at a U.S. port-of-entry within the validity of the visa, which will be a maximum of 6 months from the date of issuance. You must marry your U.S. citizen fiancé(e) within 90 days of your entry into the United States.
 
Does My U.S. Citizen Fiancé(e) Need to File Separate Petitions for My Children?
No. Your eligible children may apply for K-2 visas based on the approval of Form I-129F, Petition for Alien Fiancé(e), that your U.S. citizen fiancé(e) filed on your behalf, but your U.S. citizen fiancé(e) must list the children on the petition. Separate visa applications must be submitted for each K-2 visa applicant, and each applicant must pay the K visa application fee.
 
After your marriage, your children will need to file separately from you for adjustment of status. They cannot be included on your application for adjustment of status. More information about adjustment of status is available on USCIS?s website under Green Card (Permanent Residence).
 
Important Notice: Under U.S. immigration law, a child must be unmarried. In order to file for adjustment of status for your child following your marriage to your U.S. citizen spouse, the child?s stepchild relationship with your spouse must be created before the child reaches the age of 18.
 
Are My Children Required to Travel with Me?
Your children may travel with (accompany) you to the United States or travel later (follow-to-join). Like you, your children must travel within the validity of their K-2 visas. Separate petitions are not required if the children accompany or follow to join you within one year from the date of issuance of your K-1 visa. If they want to travel later than one year from the date your K-1 visa was issued, they will not be eligible to receive K-2 visas, and separate immigrant visa petitions will be required. If your child has a valid K-2 visa and you have already adjusted status to that of permanent resident, your child may still travel on the K-2 visa.
 
Entering the United States - Port of Entry
A visa allows a foreign citizen to travel to the U.S. port-of-entry and request permission to enter the United States. You should be aware that a visa does not guarantee entry into the United States. The Department of Homeland Security (DHS), U.S. Customs and Border Protection (CBP) officials have authority to permit or deny admission to the U.S. Upon arrival at the port-of-entry, be prepared to present to the CBP officer your passport with visa and your unopened/sealed packet containing your documents. Travelers should review important information about admissions and entry requirements on the CBP website under Travel.

K-1 Fiance(e) Visa Process & Procedureswe haven't received our NOA1 hardcopy yet.

Hi! I am an worrywart and getting worried about my fiance visa since we never received NOA1 hardcopy yet. :clock:

 

We filed the petition for fiance visa back in July and received an email with WAC#  (receipt number i guess?) on July 29th.

We checekd "my status" on USCIS's   homepage  and found out that the NOA1 hardcopy was returned to USCIS on Aug 14th as undeliverable, So had to called USCIS and tell them the address (Of course the pettitioner never moved after filed).  and they said they will send the duplicate on Aug 18th.

 

Now Its been a month since they said it and we never received the dupulicate. we are going to call the USCIS again as they told us to call them back if we didn't receive it within 30days.

I don't think we will ever get the dupulicate even if we call them again... :cry2:  Maybe we should call the post office to ask why they returned it to sender(uscis)?

 

What i really worried about is NOA2.  what if we don't receive NOA2 like NOA1 even though we have filed the pettition with correct address and even called them to make sure?

 

Is anyone out there in the same situation?

Is it possible that there is something missing from the address you sent to USCIS? If you are receiving other mails then something is really off if the post office returned your mail as undeliverable. Hope USCIS did not address it to your fiance instead of you. I wonder if you can get a copy at your application support center?

We were advised that docs will be sent back to US and USCIS will review the denial reason in 120 days. I made a decision not to wait and go ahead and fly to Azerbaijan to marry my fiancee and apply for a Spouse Visa. I got all documents ready, the only thing we were waiting for was marriage certificate. The problem I had was that In order for me to get married here, in Baku, i need a paper from US that i have never been married before and eligible to get married right now. I had gotten that paper and had it notarized and everything but i forgot it at home when I was flying from US to Azerbaijan. My step-dad mailed it to me here, but it got lost on the way here. As a result we missed our registration date, which was Sep. 27th, as they needed that paper. Since we missed that registered date, we had to wait another Month to get a new date. Well I found a way how to do it without waiting a month. My step-dad overnighted new needed document and i got it this morning. We took the document and rushed to the translation center where they would translate and certify needed doc. and then we would be on our way to get married.Right before we walk in to the translation center, Kristina gets a phone call as we walk and suddenly stops and becomes WHITE. It scared everything out of me as I thought somebody passed away or something. and then she states: "Visa got approved!" then I become White too. They said they reviewed our case and decided to approve her fiancee visa. If they called 2 hrs later we would be married and Fiancee visa would be expired.

We already sent a passport to Us Embassy in Georgia and they said it will take them 10 days to provide a k-1 visa. I will be returning to US with my baby. We cannot believe this! Everything happens for a reason. If I didn't forget that document when I was traveling to Azerbaijan, it would have been too late and we would have to wait forever before we meet again.

We think one of the reason they reviewed our case again is that I went to US Embassy in Baku and asked their help to get a new document that I am not married. So US Consular in Baku talked to me personally. Maybe they have centralized system where they saw that I am planning to get married. I have no idea. that is the only explanation.

 

Well, there is my short but super happy story.

When fights get physical, your safety is numero uno. That type of behavior is manipulative and a non-negotiable. Get out of range and get help. Call the police, if you have to. It may be the way he is now, but if he stays that way, he should not be allowed to stay with you. You have to give your permission to be his victim.

sereia, as you say its not good and it should not be done. Both you and confused have Morocco spouses that respond the same way in an argument. They apparently resort to fleeing at the first sign of "rain". As you say, make it clear to him how much it hurts you and your marriage. I feel your frustration and it is validated. Truth is, you should not be looking at the door every time you have an argument. It's a weak way for him to respond because he should be there to support you and not be ready to leave after every argument. I know it hurts and it makes you question his love and I can understand that. Now how do you work this thing out? Only you guys knows what works in your relationship without adding fuel to the fire. Maybe calling his bluff might be one way, then again it might not.

Let them know in a kind manner after you have composed yourselves, that if they are not prepared to walk then they should stop throwing those words around, because it not only hurt but cause you to lose trust and confidence in them that they will be there through thick or thin.. but try not to match anger with anger as it never solves anything. Be firm but not aggressive.

Estadia hits the nail on its head. Your culture and customs are way apart so there is a lot to learn as you grow together. What I do not agree with is when he puts the blame on you by saying you made him say that he is going to go back to Morocco. You both have to take responsibility for what you say and do. He said that because he is hurt.

I find that my husband was not used to some of my expressions for example the word "hush". In Jamaica, depending on the way it is used or the tone in which it is said it could mean "shut up" " I agree with you" or it could mean "don't worry, everything is going to be alright". I would never tell my husband to shut up as that is disrespectful so the first time I used the word hush as a word of comfort he was taken aback and said " but I didn't even say anything." He thought I was saying shut up after he told me he wasn't feeling well smile.gif.

You say that you guys fight verbally over simple things because of misunderstandings. Whenever there is a misunderstanding clear it up immediately or whenever the timing is right and try not to feel like a target. If he is offended by what you said because of a misunderstanding it is your responsibility not to get heated but to say right away in a calm voice that he received what you said in the wrong way. If you retort in the defensive manner then it sparks the argument and frustration will cause the mean spirit to rise and mean spirit beget mean words sad.gif .

As couples each spouse have to place the other before themselves, be respectful, use kind words etc and things will flow easier. I know it sounds like a fairy tail but it works. My husband and I do not have arguments even though we have differences in opinion. One person has to chose to be in control of the situation and see to it that things do not escalate, but both have to come to that agreement. We decided on that when we started to date and it has been working so far (almost 4 years). It is not easy to give up your right sometimes but it brings peace and understanding through love.

We also made a pledge that anything told in confidence should never be used against the person if a disagreement arises. I remember when my husband's ex-wife called him and told him just four months and two weeks after we were married that she still loved him and he should leave me and return to her. They were never on good speaking terms before and had a horrible marriage but because he helped her kid out (not his) she thought it meant he wanted to be with her (she didn't know he had remarry and that we discussed him helping the kid out) but when he told her he had a new wife who had no problem with him helping her children out she started crying and saying she never stopped loving him and if he returned to her he could get back the house and the car that were given to her in the divorce. Can you believe that my darling even let the idea roll in hid head for a week???!!! Because we are so connected I could feel that something was not right and I told him. He told me what they spoke about and that he called her and told her I am the best thing in his life and nothing in the world could make him leave me. I listened quietly without judgment and when he was through I thanked him for being honest, told him how much I loved him and explained to him that it would have been his biggest mistake in his life if he had chosen to return to her. I told him to cut all ties with her and he called her in my presence and did just that. He then changed his number and she changed hers as well after she found out that he changed his. I have never used it against him as a weapon to cut him down or brought it up. When I speak to him even if it is during a disagreement I use words like sweetie, honey, babe etc and he told me that he likes that about me because even if he is wrong about something I still use words of endearment when addressing him.

I know that everyone is different but the bible says "a soft answer turns away wrath but grievous words stir up anger" and it is so true. We have nothing to prove to each other but our love and commitment. We remain honest to each other and take life a day at a time.

Just try not to get all heated up over the simple stuff. Your husband is going through a culture shock right now and it is still new for him. If he should say that again tell him how it affects you and try not to feed a disagreement because that is how arguments develop.

The institution that he intends to attend can send to his High School for the transcript if he does not have a physical diploma. My GC was received in the mail six days ago and I am now enrolled in school which begins next Monday May 25. The school did everything for me, all I had to do regarding the transcript and application forms was to fill them in online and e-sign them. After filling out the transcript request I faxed it back to them and they sent to my High School back in Jamaica. It was no hassle. They did everything to ensure that I received my grants and loan and my books were mailed to me and I am preparing for classes.

Everything was going fairly smoothly til I filed my AOS package.
I sent the I864EZ with only one year tax returned and attached W2. They sent back saying that they needed W2 + 1040's. Which I sent back.
I recieved another notice saying that they need Federal income tax returns, literal printouts from the IRS (RTFTP) or a Letter 1722 issued by IRS. I dont even know what this is.... ? I am getting so frustrated that all I can do is cry. I am so close but this has now been sent back twice - has this happneed to anyone else?

I literally called IRS to have my transcripts sent to me and they faxed it immediately. They are also going to mail me a copy as well. Call 800-829-3676 now and they will do it for you.

Hey everyone...I am in a bit or a predicament...and need help!..my american husband filed for K3 visa in march and in april he asked the lawyers to withdrawn the file...what should I do and if he could file again?
Oh and we got married last year in august in the states, is there a time limit until we can file for K3 after the marriage?

I understand that K3 visas are replaced by CR-1 if married less than 2 years. Is it possible that he withdrew it based on that fact? Maybe he is going to file CR-1. Only you can tell. All the best.

You do not need to send wedding photos. Those are for the interview where they may ask you questions about persons other than you and your spouse who are in the pictures. Everything else seems fine. You can review the documents on pages 2 and 3 through the link below:

Hello I got the same RFE on Feb 3. I sent a copy of my husband's biographic page of his passport with the I-130 but they requested one for the I-485 as well (which I didn't know because the instructions did not state that I needed to send one with the I-485). Anyway I sent it off with the letter they sent to the address they asked me to mail it to. Its been three weeks since I mailed it out and my case remains on hold with not touches informing me that they received my letter.

Send them what they requested and don't forget to track the mail. As it is going to a PO Box they are going to send it by priority mail. Again, keep a copy of the letter they sent to you just in case.

You should have sent everything that they asked for. You have not mailed what they requested so maybe that is why it appears as if they "lost" your G325A. Not sending what they requested makes it appear as if you cannot prove what you have stated on your application. I hope that you have sent it in by now with a copy of the RFE letter they send to you. Ask for it to be done on a company letter head and stamped. Take pay stubs with you as well just in case. I pray you will not be laid off before then. It will also be good if you have a sponsor if you do not get this letter.

They didn't ask my husband if he was currently employed they just asked for a job letter to verify his income. I claim a successful interview for you also.

That's not a dumb question but a good question. It is when an adjudicator physically touches your file and it is being processed. We get emails when we register on the USCIS site and that's when we know our case is being "touched". Look in the FAQ and you will see more descriptions okay?

Thanks, as you say (call a lawyer). I don't think that marriage is recognized. None of the documents you asked about has his mother's name. My thoughts on it is that his ex got married to and divorced from someone who doesn't exist.

I dont think they check like that. They do background checks. Can u imagine if they did all that kind of check for every applicant? It would take years to get approved. You can go to the USCIS site and read up on the type of investigation they conduct. When I did my biometrics I called FBI three weeks later and was told that they sent off my results the very day it was taken.

Remember that the G-325a comes in a set of 4. When you fill it out on the computer all four sheets are filled out automatically for each person. Print it twice to get the second copy. Fiancee set should also consist of 4 sheets. It is numbered 1 to 4. Maybe I am getting what you wrote wrong but I got the impression that you divided the set of 4 into 2 sets of 2. If I am incorrect ignore this but if not make sure that you have the complete set and make a copy of the full set. Go to the guides and get more information

Ok, so I met this nice sweet girl, and she is living in Kenya. I don't suspect anything bad, but I have read so much out here about marriage fraud that I get kinda scared. Based on the fact that you are doubtful that is an indicator that deep down you strongly believe that you do not know enough about her to commit to marriage so soon. You met her once and only for a week and the rest is based on what you both decide to disclose about yourselves via yahoo or phone calls.

Just recently I heard someone say "the person you date/court is only a representative and the real person is who you see when you get married." The person you date doesn't really want to disclose any negative things about themselves. As a matter of fact that person is so perfect and if you think hard enough it might never even cross your mind that they even have bad breathe when they wake up in the morning. They are your sunshine and joy as it normally is at the beginning of every relationship. Take time to know her. Learn what she dislikes, what she likes will be told to you without you even asking; find out what you both have in common; find out what her family and friends are like. A good pointer is to see how quickly she starts downloading her needs and her sad stories to you. Try not to make her feel as if you are her genie; many men do that to impress and the poor woman doesn't even know that the opportunity cost of the $500 he sent to her is his unpaid rent (I'm just keeping it real).

If she asks for financial help too quickly as someone pointed out, that is a great big SIGN. Again, if you are doubtful you are obviously taking it too fast and you need to know more about her before making a serious commitment.

Co-sponsor should show most recent taxes filed. 2011 tax deadline is April 17; she can show 2010 and paystubs showing she's over the poverty guideline. Regarding her 18 year old, that can be tricky. I think it is based on the age of majority in her state; if the daughter is under the age of majority she should add her. The burden of proof is on her to prove that after the interview she will not file for her as a dependent and that may be hard. I don't believe they will take her word for it. Again, it's about age of majority. Look at the I-864 instructions again to get clarity.

My hubby's kids are 20 and 19 and are working and one is in college.. They do not live with us and his ex-wife declares them as her dependents. however, we had to add them as household members because they are under the age of majority in NY based on the I-864 instructions. All the best.

Yes the requirement is that he has to file taxes for the past three years if he is the only support financially. However, if he hasn't, he will need a sponsor. He will have to write a letter giving reasons for his infield years. .

Iff he's not getting a salary. He needs a sponsor before the interview. If you are employed and your earnings is more than the poverty guidelines, you can use that as household income or show assets that will indicate you will not become a ward of the state. Bottom line is, you guys have to prove financial independence or support from a friend or family member.

Why do you need the individual's credit score? If you believe or have new information that it affects the process, just state what score does. Anyway, as far as we know it does not affect the process.

Get excited that your case is moving regardless of how slowly others may predict it to be; at least something is happening. It is always good to see the progression of a case however minute. I know it was less then an oz, but could have been reduced to a spliff due to the police taking their cut of the ganja I.e. Corruption. What sorts of questions does a panel doctor ask? Like I said- just beginning to explore this process and have little knowledge of what it all entails and what kind of road blocks may be encountered.

Anotherlostsoul- no offense taken. My future husband is a Rastafarian and it is part of his religious practice. I am also from a US state that has legalized marijuana, and hold the personal conviction that it is less dangerous then alcohol.
