Hi, where did you get the information about Immigration Judge if CIS denies a case? Is it on USCIS website? I don't have joint bank account and file tax separately because we were separated when we filed tax and now we are divorced. All bills are under my name. I am also scared that my documents are not strong. Do affidavits from the immigrants' family work or they have to be from the US Citizen's in laws?

I actually got it from the guidelines from this website, and I am supposing that Ewok based it upon actual statistics from this website.

It's quite the opposite, all the way through this process.



From the step by step guide on removing conditions on this website:

"On the "don't panic" front -- ultimately the burden of proof is on the CIS to show a fraudulent marriage. Even if CIS denies, the application can be renewed in front of an Immigration Judge (IJ) in Removal Proceedings -- and the IJ's tend to APPROVE those cases."

The judge isn't throwing anyone out of the country without hard proof that the marriage is a fraud...In the US, your covered by the constitution...it's up to USCIS to prove fraud.

There's also the added benefit of being from the UK...a country so similar to the US that people don't tend to try to fraudulantly enter the US from there. I'm guessing that's why the interview process at the consulate was such a piece of cake...my husband was asked 3 questions, "Will you live with your wife?" (Duh), "What are you going to do for work?" (Insert any answer you want here), and "How long has your wife been at her job?" (He answered this question wrong, by a long shot) "Congratulations, you're approved."

We didn't have a whole lot of evidence either...hubby works from home and we file taxes as married filing separately because i get such a huge return.We don't have joint bank accounts and I owned the house long before we ever got married. We have both gained weight and detest having our pictures taken, and my daughter requested that I keep the same last name as her until she becomes an adult.
I sent in insurance info, and we each have bills in our names to this address, plus our drivers licenses and affidavits.

I look at it this way; it's their job to prove we are not married. At worst, we'll have to go to an interview or before the judge...just a bit of inconvenience really...they can't prove we're not bonafide because we are.

Well, now that you're going before a judge in Removal Proceedings, USCIS must prove, by a preponderance of the evidence, that your marriage is a fraud...INA Section 216 shows that the burden of proof is on them. As long as you haven't given them any ammo, you should be fine...and hopefully this nightmare will end for you. Just don't get angry before the judge has made a decision!

They could save us all a lot of time and hassle if they just dropped by the house sometime, at their convenience, which they are welcome to do, provided they don't mind dishes in the sink...

I will be happy to keep everyone updated. I am not in the least bit worried that he will be forced to leave, after all, the burden of proof is on USCIS, and we have most definitely been married and slept in the same bed every night since he landed. USCIS would have the burden of proving a negative, which they cannot do, hello, we are married, regardless of what our finances look like...
I'm hoping for an interview, but if it comes to Removal Proceedings, I just hope it happens before his green card expires, otherwise he can't work! I'm really not too worried.

Well, we got an RFE, not completely unexpected considering our marriage doesn't fit into the cute little mold that USCIS wants it to. We don't have joint bank accounts because we deal with our money separately since hubby is self-employed. Mortgage is in my name only because I owned it long before we were married. We file taxes separately because mine are easy and I get a big refund, and his are difficult since he still has income from the UK and we have to factor in the US tax treaty with Great Britain.

We sent in bills, and drivers licenses with the same address, car insurance with him as a covered driver, medical insurance from my job that shows he is covered, and a letter from a mutual friend. We really don't have much else, but just because we haven't co-mingled our finances, it doesn't mean we don't have a real marriage. Perhaps I should send in pictures of the 5000 coffee cups he uses and I have to collect from around the house everyday...

So, hopefully there will be an interview. Worse case scenario, I expect them to start removal proceedings at which point we will go in front of the judge and flip USCIS one great big bird with each hand.
We are older. We had lives before getting married, at 42 years old I have absolutely no intention of having more children...apparently USCIS thinks everyone should be twenty-something's, just getting started, and doing everything together, rather than older adults who had lives previously and didn't feel the need to contact every utility company in a household that had been established for years prior to the marriage, to have everything changed to be in both names.

Oh well, bring it on USCIS, I'm feeling feisty today...

It baffles me that as his wife I can make end of life pull-the-plug type of decisions yet they cannot give me info regarding the status of his ROC...

Newlife2013, most states have standard sentences for DV cases. In Cali it usually involves a fine, work release, 3 year Summary probation, anger management classes and no negative contact with the complainant. The only way out is if the DA drops the charges (or never files), or there is a Jury Trial and you're found not guilty. I work for the Public Defender in my county and even if the complainant refuses to cooperate, the charges usually still go through based on the evidence collected at the time of the arrest. I have absolutely no idea how that would affect your ROC though.

I know i read it sonewhere...maybe even in the 751 instructions where it states uscis will not send you a notice regarding when you have reached the 90 day window.
You dont need anything like that.


I remember reading that as well, and was surprised when we actually recieved a letter reminding us to remove conditions.

It won't, at the bottom of the letter you'll read that you're supposed to use the case number found on the biometrics letter to track online... I was guilty of this as well.

I read a sad post earlier from a couple petitioning out of Cairo and have read many stories of women married to younger men on VJ. I thought it would be a interesting to start a thread with our experiences.

Because I'm an "equal opportunity" poster, men who are older than their wives are more than welcome to post their experiences as well.

Has anyone had difficulty in their interviews because of age differences? Have you had unpleasant remarks directed to you by family and friends for falling in love with someone younger than you?

I am 19 years older than my husband, and we don't see the difference. We are on the same emotional, intellectual and spiritual level and absolutely adore each other. We're married for love, not a GC....but I've had several interesting comments directed my way since our marriage about our age difference and they came across as pretty judgmental. Do men married to younger women get the same snide remarks and judgment?

Bear in mind when contacting NVC, that they are just a company contracted by the US Government to read to you what USCIS has done or is doing, from a computer screen. The supervisors have slightly more information than the ones reading from the computer screens but not much. I had absolutely no problems whatsoever entering England...but just in case, I brought a folder full of proof of my ties to the US. None of it was needed. I am currently in the UK under a spouse visa but can't find work here and will have to go back to the States to work and unfortunately be away from my hubby. So now we're in the applying for I-130 & CR-1 process once I fly into Cali next month. Besides obvious visa costs, does any of the processes require proof of a specific amount of income on my part; specific amount of assets; and also proof of residency for a specified period of time? I have read over the guides and I'm not seeing a clear picture other than I need to have an income of at least $18,200 proven for the I 864 process in the interview stage. Since I'll be starting anew in the States I wont be rolling in the cash if you know what I mean, but I do have a job to go to that brings me $25 K a year and will have a room to rent, but no means a house. I wouldn't think this a problem as long as the owner agrees to my hubby moving in, but if someone knows different then please let me know :-)

Not sure if it's similar to the UK but for their visa they needed at least 3 months of bank statements, payslips, and proof of joint tenancy. Is this similar for the CR1? Do I also have to have a certain set months of proof of my income in the States to sponsor my husband? And if so at what part of the stage is it necessary? I'm under the impression that it's only necessary at the interview stage??

Totally new at this site guys and CR1 ?'s so please forgive me if any of these questions are redundant. Thanks!


It'll most likely take 3 months just to get through California Service Center, so that part shouldn't be a problem.

We're going CR-1 only because they have made K-3 obsolete, and my husband has stayed with me during his visits, but has never lived here so I really don't see why that would be a problem.

I contacted the Senior Senator from my State on Monday - they're saying that it will take 2 weeks for it to get into their system. I'm hoping we'll be approved before then, but then, I've been hoping for nearly 5 months now...

I have an InfoPass appointment on Wednesday, and I hope that it will bring it to their attention that they've been sitting on our petition since October...

I have this dreadful feeling that they've lost our file - with everything that makes me who I am as a U.S. citizen inside of it - can you imagine if that file got into the wrong hands? Blurg.
