Hello,

I just wanted to clarify what documents I send to the US Consulate and which I bring with me for the interview.

It is my understanding that I complete form DS-160 electronically online which I have done and then I mail to the US Consulate a completed DS-230 form along with the checklist they provided. Is this accurate?

Am I to understand then that the I-134 (Affidavit of Support) and all other supporting documents such as the police certificate, letter of continued support, birth certificate, proof of ongoing relationship, paycheck stubs, tax returns, bank records, employment letter, the medical results, the NOA2 and the copy of the I-129F package are to be brought to the actual interview?

I never thought of that, that's amazing. It gives us another 1.5 months or so for her to find a job. Wedding is on June 6th so its coming fast.

Hello everyone,

I am wondering if anybody has any accurate information about if a co-sponsor can be removed from their liability of sponsorship at their request later down the road if they are to be replaced by someone else, in this case my fiancee.

The reason I ask is that my fiancee lost her job due to the economy and corporate layoffs and hasn't found a new job yet. I have my interview with the US Consulate General at the end of April and the old I-134 notarized form that we had from her previous job is no longer applicable. Her mother is hesitant to co-sponsor me at the moment because she doesn't understand all that is required and I'm trying to collect all the information needed so she can make an informed decision.

Basically, I just want to know if its possible for someone to temporarily co-sponsor someone so that once my fiancee finds a job, we could just remove the mother's name from the sponsorship list and absolve her liability.

Any ideas?

I greatly appreciate any feedback.

With regards to patience being a virtue, I definitely agree. We're both firm believers that if you can make a long distance relationship work and get through it, then anything else life throws at you will be cake in most cases. Having to wait another year is something we're both fully committed to doing. We just wanted to make sure that we were going about this the right way as surprises in the future would hurt a lot more than tackling any issues beforehand.

Boy am I glad I asked the question!

Thank you everyone for your input so far, it's VERY MUCH appreciated.

I'm thinking that the K1 visa would be the best potential course of action then. We're not yet married and I don't want to have to wait too too long after I get there to start working. From what I've read, after marrying on an K1, it's just a question of getting a social security number to start working right? Or does it have to wait until the AOS is done?

The flipside to having to wait a little longer before we marry is that we'll be able to save up for the roman catholic wedding we both want to have instead of doing the civil route because of financial reasons and having to save up for the big wedding later.

The CR-1 route also looks interesting just because of your ability to begin working immediately...

Hello everyone,

I am new to the community and I have been unable to find an answer to a particular question sadly so I am turning to you all for some feedback!

I am a Canadian citizen. My girlfriend is an American citizen. We are trying to find the best way to go about being with each other. We already know that we want to marry each other. At first, the plan was for me to find a job in the USA and for us to live together and enjoy each other's company as a normal couple would before marriage. However, given that my career choice is sales, the profession doesn't fit within NAFTA's TN categories or H1 visa categories. So, after much discussion, we decided that we are ready for the next step: marriage.

About 2 weeks ago, while vacationing together in Vermont, I spoke with a US Immigration lawyer based in San Diego (found his info on the internet) about the different work visa options. I also asked him about the marriage option and here's what he said:

1- If I am legally allowed to enter the USA to visit, I can get married and then apply for an adjustment of status in order to obtain the green card and later work permit.

I asked him if I needed a K1 or K3 visa and he said that since I am legally allowed to enter the USA as a visitor I wouldn't need to go that route... You can imagine the joy my girlfriend and I had after hearing that... We started to make plans to have me move down there in 1 month and get married (civil for now) so that we could begin our lives together.

However, after giving this some thought and really thinking about it, I think it was a GROSS oversimplification of the process.

Can anybody confirm if this lawyer's advice is either accurate/sound or terribly misguided/bad? wacko.gif

If you think it will be processed in December, you should be fine. You get 6 months to move to the US and then an additional 90 days from the moment you get your passport stamped in the US (if I am not mistaken).

If you move to the US in mid March or later, you should be good to have your wedding on June 6th.

We were planning on having me move there 2 weeks before the wedding to help finalize everything. I am going to work until the last week of May to be in a better financial position when I do make the move. Given that it will take a few weeks/months for the AOS and work permit to kick in, we're trying to keep that window as small as possible! Otherwise I'd jump at the chance of going there sooner to be with my gal!

I may move that up a little bit depending on how things are going with the preparations but she has an army of relatives there that are looking forward to her getting married that they're all giving us a hand which is absolutely phenomenal.

Hi everyone,

I received the package from the US Consulate here in Montreal this week so we're nearing closer which is great!

I've been seeing that it moves VERY quickly from here and that has me concerned because Jen and I were planning on a June 6th wedding and since these visas are good for 6 months only that means if it get processed before mid-December, then it is really cutting it close. On the other hand, the visa application is good until mid-February before it expires.

While we're definitely wanting this to move forward, I'm thinking of waiting a couple of weeks because having a visa that would expire BEFORE June 2009 would be a problem since we've started making preparations for the wedding.

Anybody else going through something similar?

I was debating using a lawyer or not for our filing. After looking over the documentation and considering the quality of the step-by-step guides found here, we elected to go it alone and so far have not regretted the decision. We just just received the NOA2 without any RFEs whatsoever. The key, in my opinion, is not rushing anything. It is very important to take the time to read and understand the process, steps and all the forms. Triple-check everything. Perhaps even have someone you know help you out. Sometimes we're so tuned into what we're doing that we don't see what's missing. It's just like when we wrote essays in school and had to correct them; it is always hard to spot our own mistakes, yet you look at someone else's essay and you spot the errors very quickly!

A good lawyer is instrumental, however, if someone does not have a good grasp of the English language, and/or if pressed for time.

Hi,

My fiancee is American and I'm Canadian. We're also planning for a June 2009 wedding (in the USA though). Our path started in June 2008 and we elected to go the K1 Fiance Visa route. If you marry outside of the USA, I believe you would indeed have to go with a K3 Marriage Visa.
