Sigh,
1. Standard service requests don't do anything on the i751... u will get told that they will check it but nothing happens (the exception is a very very late... like 15 month old 751). That is why your lawyer doesn't want to do it... because it just doesn't work.

2. Your file would never take longer than 12 months unless it REALLY got lost so what is with you even thinking for a split second that you would need to get a stamp every year?


Just sit back with the rest of us and live life..... one morning you will go out to check the mail or get a message and the approval or rfe will be there.... and yes you are paying your lawyer to do something, but most are worthless so what do you expect?

It could be the reason you stated... but since you got to this point so quickly while many others are at 8, 9, 10 months I would just wait for two weeks and then call. The difference between three weeks and five after an interview is a lot, and would most likely push them to actually do something about it.

Just to add to the extension letter discussion... you better arrive early because if you are like us, you will end up with a supervisor getting called at check in and another supervisor getting called at immigration (foreign exit side) and it can all add up to you missing your flight if you are unlucky. I wouldn't call traveling with the extension letter ever hassle free, but it rarely is cause for great concern if you have the original and all of your documents in order.

I just entered the date that her card expires since it wouldn't let me leave it blank or N.A. (even though that is not the right thing to do) do it and when I got the change of address letter everything looked fine on it. BUT if what Dave says works for sure do that.

The problem with ROC and proving you need to expedite is that YOU have almost nothing to do after you file and almost nothing to gain directly from being approved. What I mean is that you don't have an interview (most of the time) that would require you to physically be somewhere, nor do you HAVE to have the new ten year green card for anything when the extension letter does the same thing.

No matter what you try to come up with uscis will prove that the letter and type of case (roc) does not result in you needing to be expedited.

Are you in the military? You can serve overseas without having to go back for an interview so this won't work.
You need to travel because mom is about to die or will need 6 months of your helping hand to recover from cancer? The letter will work.
You need the real green card for some government related work? Highly unlikely since almost all government jobs require citz.
You need the green card to get instate tuition? The old one with the letter works just fine.

The list could go on and on, but this isn't n-400 or even aos where there is a list of required places to be and things to do that might get you expedited.... you have to wait like everyone else.

The whole sponsor concept is broken and the result of pure politics. First of all they almost never go after the sponsors should the immigrant become a public charge, and second the sponsors are rarely sued (but it does happen).

If you became a public charge they would go after your spouse and then a little later if they had little or nothing to take they would go after your co-sponsor to get the rest. Having two sponsors is really meaningless, but to answer your question: Yes you are stuck with two of them until you work 40 quarters or become a citz.

If you have a shot at getting your son back I would divorce her and go for it (but we all know the cases with foreign spouses and children outside of the u.s.). You should talk to a lawyer and see if there is a way to get him back in the u.s and if you can, divorce her only once he is back here. As far as growing up without a mother, I can only see problems developing later on once he is older even if you do stay together... at least if you break up now he might be young enough to develop a strong bond with another woman you might meet in the future. Regardless of what you do, I wish you the best.

Your husband should be able to help her out, but if there is no rush I would just wait for your citz paper work to go through. You might check with the student section of this website and others since they would know far more than I do. I know some things about student visas since many of my friends went that route (not adjust to marriage... but to work visa, or j-1 to student, or just apply for the f-1 and ride it out), but I def don't know enough to encourage you to file paper work haha.

To the op, find your congressman's phone number and get ready to call if you are denied... you should also start find a good lawyer and be ready to pay if it is a denial because you will want a lawyer in front of a judge. Just take it slow, be rational, and it will all be ok.

When you think about it.... a lot of people send money to their parents, brothers, etc, etc... BUT how many couples send exactly (or almost) their particular salary every month back home? That would be a HUGE red flag for me... even if the husband made $10,000 a month and that more than paid for the bills. If I make $8,000 a month and my wife makes $2,000 it is pretty stupid to send 2k back home every month since it just screams of having a bf or husband back in the home country. Everyone that isn't in the typical situation has to think, "How is this going to look to a stranger?" Because anything unusual can be interpreted as something that it isn't... such as fraud.

Nah, I don't think so. There are only very few May applications left (based on the approved % of May filers on VJ), so it shouldn't take that long.....maybe just a week's delay, hopefully.


I agree, it shouldn't be too much longer, but the real problem is getting them to work on your case if you aren't approved but August approvals start to roll in (because they will say you are at least 60 days away from getting approved). So the whole thing is just frustrating.... I bet the director was tired of being flooded with SR and calls and superficially pushed the date back to give him some breathing room.

VSC just posted their updated 04/23/2012 Processing times. They are no longer processing June 20, 2011- they have gone back down to May 13, 2011. What a surprise!

Anyways, for all of us VSC filers- I guess we have another 2 months to wait. sigh!



Dang.... I thought we were almost there and a Service Request just might work if for some reason we were an outlier... but I guess all hope for that route just got crushed :(

But it is going to be a pain dragging around an expired green card and extension letter (which will also expire pretty soon) to job interviews etc etc. Sigh, why can't you just approve us already.... it will be April soon!

There is always a first time for everything, give it another two weeks and it will show up. I mean at this point the worst that happens is you fight them to save the fee for a replacement green card. Sure it is a pain, but a lot better than fighting to get approved haha.

Whidbey I havent even heared anything yet.......Called the Senator's office again to get an update but they havent called back yet.My nerves are wrecked..........I would be happy as heck if I would at least get the approval letter....NO update what so ever on my online status....it STILL says 08/03/2011 Inital Review,no touch,nothing.
Had to get Hubby to the VA Clinic yesterday cause his anxiety has gotten so much worse with this that he had to have his meds increased..........We are REALLY worried.


Relax a little, this entire process can be really hard. Back in the visa stage we had a limited amount of money, fighting the Irish embassy to grant an Irish study visa, fighting the poe people in Dublin to let me in (said 2000 euros wasn't enough for me and would be denying me entry), paper work for her visa went to The Netherlands instead of Dublin (embassy was pretty hateful and told me it could take 2 months to transfer it) and had to get my Congressman on it (who did it in 7 days), and throughout it all I was doing tons of paper work for my classes (about 20 hours). In the end I just put it in God's hands and worked hard, every step I ended up overcoming their objections or meeting the right person who could. No matter what you will end up winning your case and being together, when I was going through all that I had no idea if we would be forced to be apart for a year or more.

We will be moving next month so I am a little afraid that in this long wait things will get mixed up and the GC gets sent to an old address... I fail to understand why there is a buildup of cases since 07 saw the massive buildup and 08 (when we all filed for k1, k3, etc, etc) saw an decrease in processing time. What did they do.... fire the extra people??? Sometimes it really bothers me that this is mostly a check up on people that have already weathered the worst of the uscis/embassy ####### (I am hoping....) and such a long wait makes no sense.

I am not expert on stats, but polls often use 1000 ppl to gauge the entire u.s. population so why wouldn't 50-100 ppl per month be a good sample size of all petitions? Of course nothing is truly random, people that go on this site might have a tendency to do this or that better so RFE's might be less common, or early bios, all of which might speed things up.... but I think it is a good in deciding when they begin to work on your petition, not necessarily approve it.

looks like you've gotten some good advice in the RFE thread. i think what you are adding (joint lease, driver's licenses, etc) will probably sort out the RFE. and i don't think the envelope is as important as the contents of the envelope.

we will keep our fingers crossed for a quick road to an approval for you!

it does remind me that i should not be so confident about our ROC packet. we also have no kids, no property (house, car, anything really), no 401K, no life insurance, not even the same last name..... we sort of just get by on bicycles and small paychecks. while i guess we have a few things going for us (joint lease, joint utility bills, joint bank account, and quite a bit love), my positive thinking is slowly eroding as the weeks pass. the idea of a relatively simple approval is giving way to the stressful possibility of an RFE. in part because i am a bit dense when it comes to finances and while i thought we had been filing jointly for our taxes, we weren't. USCIS will probably find that suspect. i wrote a little note that said 'taxes are not my strong suit, thought we filed jointly, mea culpa, next year, etc'.

but, i suppose that an RFE is not the end of the world. but it sounds upsetting/frustrating/scary. <sigh>

I feel the same way, we don't have a house or insurance or anything that... the only thing that is different is the car.... but she is just on a learner's permit so no car insurance in both of our names :( I started off thinking everything is going to be quick and painless, but as the weeks go by an RFE seems to grow more and more likely. You are right getting an RFE isn't the end of the world, but I don't know what else I could show them and that concerns me a little. I guess this is one part of the process where older couples have it made... they have everything from stocks to a house but young people have next to nothing :(

I agree that rfes are often just a way of "checking up" on people when they ask for the same stuff you already included. Knowing the government they have a specific quota to fill in that regard (I mean on cases that are over a certain time period). But including only one bank statement could have made them lean toward the rfe, I still think people should include as much financial proof as they can.... the post office isn't going to charge you an arm and a leg for those extra 15 or 20 papers so why not stuff them in there to make sure?

You should also bear in mind that uscis uses notions of marriage that are considered common among reasonable married couples in America. Most Americans are included on car titles, houses, bank accounts, power bills, water bills, etc etc and the system is setup so that two people can be included on all of those things.... Why do you think divorce is so complicated in this country? We intermingle EVERYTHING.

With that said, many people that marry foreigners do things the way their partner does... In China you can't have two ppl on a bank account, house, car, etc etc so only one person gets on the document. You also go out with friends and one person often pays for everything and you return the favor later on. The problem for a uscis officer is that he doesn't know what people in China do, what people in peru do, he only knows what normal Americans do... so anything that goes against that norm makes him pause and the result is an rfe... The best thing people can do is just follow the typical American idea of what married couples do and you won't really have many problems.

Ah K1, I waited a good two months or so before I headed out to just do the waiting with her... I think if you already lived with them for a long time and had to move back that is much harder than those who have limited contact with their fiance (u know... u are too used to everything and is suddenly changes) and the wait isn't good at all since you already know each other very very well and have everything ready to go. I think being married to the right person is much easier than waiting on k1 (we are going on 2 and a half years now), sure you have problems etc, but you overcome them together not on the phone or msn thousands of miles apart. Rest assured though, the hardest part of this entire journey is the K1 wait... We are nearing 3 months wait on ROC and I am not even really counting the days.... we will be approved when we are approved and as long as it doesn't take one year I could care less. Good luck!

You are wrong. The joint sponsor need only be a US citizen or LPR over the age of 18. There is no need to show any special connection. A friend can be a joint sponsor.


There have been tons of people that are specifically asked who their sponsor is and why they would do it.... I know I was one of them. If the vo doesn't like the answer you don't get approved, it is that simple. Does that mean you have to prove some long close relationship? No, but you have to at least give something.....

PR can sponsor others, but you should have some form of connection to them and be able to show it (they always ask why this person would risk their money for you....). As long as he makes enough to support himself and you I don't know why it would be a problem with uscis and his case... But things would be a lot simpler if you found a usc or even a pr that has already removed conditions to help you out. Anyway if I am wrong and somehow missed something one of the other users will chime in. Good luck

What I mean is wouldn't they know how the support papers play into everything? Lets assume that the paper becomes null, wouldn't it would mean he is off the hook for the medical bills? I don't see why he would be responsible for the birth at that point.... but none of us know what papers he filled out etc.

eh - hang on.

You can call yer local USCIS office, and get appointment for the Fraud Prevention Unit. You'll need to file a letter, as well, to remove your I-864 affadavit of support, listing the reasons that you have.

The Officer you talk to in the Fraud Prevention Unit (face to face, btw) will tell you whether or not IF you have a valid case.

If you have a valid case, then they can start deportation proceedings, AFTER they conclude their investigation.

The annulment of the marriage is a seperate thing - suggest you view it 'that way', and proceed asap. The Laws of Yer State will apply, for that.

You'll need to document as much as possible, writing up timelines and events, for the Fraud Case.



Yeah, the best thing to do is talk to the only people that can get anything done. If uscis believes it is visa fraud and is willing to go the distance to get her out.... that is going to be what happens. As far as the hospital bill goes... there is a good chance your going to be responsible for it... but again only uscis is going to know that kind of info. As much as vjers go.... marriage fraud is one of those things that you only learn from real world experience.... and thankfully most of us have solid, true marriages. But I wish you the best of luck with deporting the piece of trash (what??? she is a piece of trash as far as I am concerned).

Any thoughts on anything they might be able to do going forward to make it so that they will have a chance? I think they really are in love and really do want to be together. Is the only way that is going to happen if she goes to his country?


Here is the BIG problem though.. ssd is only 800-1200 a month... most likely she would get 700 or so and 400 for her kid... that means her yearly income is $13200 and I believe that isn't enough for three people (I haven't checked the numbers since I had to back in 2008 or so). If she really loves him she needs to find a job (but at 4 years she is getting close to the magical number of 5 years wait which is when they approve you), so now she is looking at another year waiting... So why not just tell the truth in court and wait the year to be approved???? Now she still has another problem even after she gets approved... if she finds a job to make up the $2000 or $3000 gap ssi will take that "extra" money out of her check so that begs the question, "why wait the year?" What I am saying is this: If she really loves him she has to find a job.. there is no way around it, the government made it 125% for a reason (to exclude ppl that rely on benefits). Also wanted to add.. are they really going to have a happy life being forced to rely on her ssd? That seems to rule out a co-sponsor even though it is a way that could work.
