Just as long as he doesn't lie to the border inspectors, he will most likely have no problems. If asked if he has (or will) apply for the K-1 Visa, he should tell them yes and that he is just now coming to the U.S. for a visit with his fiance, while awaiting approval of the I-129F petition.

Proof of ties to his home country is always a good thing to bring along, such as mortgage/lease papers, most recent pay stub, letter from employer or school that he will be returning to work/school on a certain day, etc.

To answer your questions:

1. It is perfectly fine for you to start the paperwork while your boyfriend is in the U.S. As long as he can show ties to his home country and is admitted into the U.S. without any problems, you'll be fine.

2. After your fiance enters the U.S. with a K-1 visa, you have 90 days to get married. You can apply for AOS, EAD and AP right after your marriage, as soon as you have a copy of your marriage certificate. Your fiance will need either a Green Card or Advance Parole documents to return to the U.S. after travel abroad.

3. I doubt 7 years age difference will cause you any problems.

With a K-1 Visa, after you get married the K-1 Visa is void because you are no longer a fiance. You are then required to apply for Adjustment of Status as soon as you possibly can.

If you want to leave the U.S. and re-enter, you will need either AP (Advance Parole, I-131) or the Green Card. You can apply for AOS, EAD (Employment Authorization) and AP together at the same time for one price.

The fact that you have applied for AOS does not affect your daughter getting the K-2 visa.

What is important is that you must obtain the K-2 visa within one year of the date you received your K-1 visa. If you came to the U.S. in June, then your K-1 visa must have been obtained prior to that, which means you have around 3 months to get the K-2 visa.

You need to contact the office where the K-2 interview would take place to ask them what you need to do to start the K-2 visa process. We had to fax the Vancouver Consulate Form DS-230 to start the process, and then began gathering the necessary documents, such as the Police Certificate and we had her medical exam done.

Before you leave the U.S. to go get your daughter when the time comes, make sure you either have Advance Parole or your Green Card to make sure you will be able to get back into the U.S.

Welcome to VJ!!! You will find a lot of very helpful people here as well as a lot of information in the "Guides" and "Visa FAQ's" sections.

Most of us (myself included) did NOT use a lawyer. The process is completely doable by yourself and you will save a lot of money as well as a lot of headache because some people have claimed that the lawyer just messed up their paperwork and then it took them longer to get back on track again.

If you two both think that there is a future for you, you could always get married before the 90 days ends, and then apply for AOS/AP and then your husband could return to Sweden (after getting AP) or try to find another part of the U.S. to live in. That way, you will not be pressured into solving this situation in the next week and then having to reapply for a new K-1 visa down the line.

I realize this means that if you two couldn't work things out, you would have to divorce before you could move on with your lives.

If you can get all or most of both your fiance and step-daughter's AOS paperwork completed in advance, you will cut off a lot of time waiting for their GC's.

If you make enough to sponsor your fiance, using a co-sponsor is totally unnecessary. Why would you want to put yourself through all that paperwork, etc. if it's not necessary? The immigration process is already complicated enough.

Just my 2 cents worth, but if it were me, I certainly wouldn't bother with unnecessary paperwork. As long as you make more than the poverty guidelines state, there is no need for anything further. You won't increase your chances of approval just by having a co-sponsor. The financial aspect of the visa process is only one consideration towards your approval.

Okay I'm a little confused reading the posts so I thought I might post how it makes sense to me :)

The CR-1 is DEFINITELY the best option for you. This is how it'll work:

- in either the US or Canada you get married
- you then return to Canada and file the CR-1. Your (now) husband can file the CR-1 for you from either the US or Canada
- While the CR-1 is processing, you can still visit your husband, and he you, but you can't MOVE to the US until you get the CR-1. You can also keep you job :)
- Once you have the CR-1 you can enter the US to activate it, and immediately leave the US. Your GC will be sent to the address you put on the paperwork
- you can then travel backwards and forwards.

The only problem I see is travelling backwards and fowards if you want to apply for citizenship. You will need to list every trip outside the US. Read the N-400 paperwork and see what you think.

For "Time outside the U.S." on the N-400 (Naturalization application), you only have to list the trips of 24 hours or more outside the U.S. So, going to and from work every day, as long as you return to the U.S. don't have to be listed.

The document we got for my daughter's biological father to sign was called a "Statutory Declaration", and we filled the form in ourselves and then had it notarized at a lawyer's office. This is what it said:

"I, (Father's Name), of (address), solemnly declare that: I give my permission for my daughter (daughter's name), date of birth (xx/xx/xxxx), to move to the United States of America to live with her mother, (mother's name), mother's date of birth (xx/xx/xxxx), of (address), effective immediately."

Her biological father went into the lawyer's office and signed the document.
